No baby to be delivered in jail, rules SC
New Delhi, April 13 Delivering a judgment on a bunch of public interest litigations (PILs) raising the issue of jail reforms in general and the issue of children born in prison in particular, a Bench of Chief Justice Y.K. Sabharwal, Mr Justice C.K. Thakker and Mr Justice P.K. Balasurbamanyan directed the Centre and states to amend the rules to facilitate the implementation of the order within three months. Also laying down various guidelines regarding welfare of women jail inmates and their children, the court said the purpose of ensuring the delivery of child outside the prison hospital was to avoid mention of jail's name in the birth certificate of the child so as to save him of the "stigma". A child born to a woman facing criminal cases should not be condemned for the act of the mother, the court said, adding that it was a duty of the state governments to ensure that such children were given the required nutritious food and provided with minimum facilities like playschools and better healthcare. Incidentally, under the law, a child below six years of age has to be kept with his or her mother in the jail if there no reasonable arrangement can be made within family or there are no relatives to look after the child. Protection of the fundamental rights of such children, their proper education and healthcare were the responsibilities of the State and the same could not be allowed to be violated, the court said. While delivering a verdict on a bunch of PILs, filed by various social organisations, the court had taken into consideration the report of a committee headed by a former apex court Judge, Mr Justice Krishna Iyer, on the jail reforms. The Centre and state governments were directed to submit compliance reports by the court on the implementation of its guidelines within four months. |
Rajkumar cremated amid chaos
Bangalore, April 13 In the process, the city was virtually turned into a ghost town and the confidence of its citizens shaken to the core. One police personnel and one person from the crowd succumbed to their injuries in the disturbance at Kanteerva stadium. Three other persons were killed at Kanteerva Studios on the outskirts of the city where Rajkumar was buried. Around 36 persons were injured, including 12 police personnel. Even Deputy Chief Minister B.S. Yediyurappa was not spared, who was hit on the back by a stone while entering the Kanteerva stadium today morning. Similarly, police Joint Commissioner Gopal Hosur, who was deputed at the Stadium, also received minor injuries. The burial of the Kannada superstar came about after he was taken in a procession to Peenya after traversing various parts of the city in a funeral van. Frenzied fans even blocked the funeral van and also tried to get atop it. In an attempt to prevent further escalation of violence at the burial site, the administration removed VIPs, including actor Rajnikant and Anil Kumble from the area. The Army was also alerted to be on standby. The state administration failed to come to grip with the situation despite rioting incidents already haven taken place yesterday. There was complete chaos around the Kanteerva stadium in the centre of the city today where Rajkumar’s mortal remains were brought late last night. Thousands of people gathered in and around the stadium and became unruly. When the police resorted to lathi- charge and lobbed tear gas shells to control the situation, the mob first started pelting stones at the police personnel and then went on a rampage. Two state undertaking buses were torched and a bus full of police personnel was gheraoed and stoned. The police personnel rushing out of the bus were singled out and beaten up severely. One police personnel succumbed to injuries. There was an undeclared bandh in the city today. All educational institutions, business houses, courts, theatres and even banks pulled down their shutters. Reports of bandh were also received from Bellary, Mysore, Raichur and Mandya. People from these districts also descended on Bangalore today, but were prevented from entering the city at the border itself. Karnataka Chief Minister H.D. Kumaraswamy said lack of adequate security personnel had been felt due to contingents being sent on election duty to Kerala and Tamil Nadu. |
Javed dead; friends ransack ICU, detained
New Delhi, April 13 The 18-year-old, who was shifted from Jaiswal Rai Hospital at Meerut with 70 per cent burns last night, died around 5.30 am, according to Aneeda Begum, mother of Javed. Javed’s family claim that he died due to negligence of the doctors at Safdarjung, as he struggled throughout last night. Furious at the “indifferent” attitude of the hospital authorities, friends of Javed ransacked the ICU breaking the glasses of some gates. The family also claimed that the police has detained four boys, Arif, Mahfuz, Deepak and Ikram, inside the burns ward. No official from the hospital was available for comment. Meanwhile, the Meerut administration has recommended a posthumous bravery award for Javed. “We have already forwarded our recommendation to the Central and the state governments,” newly-appointed District Magistrate Mukesh Meshram said. Mr Meshram said the authorities were compiling a list of all those individuals who helped save people during the tragic incident. “We are setting up a fund, at the local level, to assist the victims and reward all those brave people,” he said. Javed, who hails from Bareilly in UP, was working as a helper in one of the stalls at the electronic fair where the devastating fire on Monday claimed as many as 60 lives. Javed, who appeared for his 12th board examination from Sarvodaya Boy’s Senior Secondary School at west Vinod Nagar in East Delhi, was giving a helping hand to his father Mizaz, who does embroidery work in Mandawali area. Javed’s friend Arif Chowdhary, said, “when the fire erupted, five of us came out safely. However, seeing several children engulfed by the fire, Javed went into one of the pandals to save them.” He managed to pull out six to seven children, but got trapped while continuing his rescue efforts. He was later found unconscious, he added. Congress President Sonia Gandhi along with Minister of State for Home Sri Prakash Jaiswal had visited Javed at the Jaiswal Rai Hospital ICU and praised his heroic deed.

Lucknow, April 13 Promising complete transparency in the probe Mr Meshram assured the grieving family members of focusing on the problems of missing persons as soon as possible. The Home Secretary S.K. Aggarwal, admitted to have received a letter from the NHRC regarding the human rights violation in Meerut, Mr Aggarwal said that the state government would soon be responding to it. Officially the toll has now gone up to 42. Another 133 are under treatment, 89 of them in Meerut and the remaining in neighbouring towns like Ghaziabad, Noida and Delhi. |
War-room leak case: 14-day custody for 3
New Delhi, April 13 A CBI court today sent Mukesh Bajaj and Rajrani Jaiswal, who were arrested from Pune and brought to the Capital on transit remand and Vinod Kumar Jha brought from Muzaffarpur, to 14 days judicial custody till April 27. Bajaj and Jha also moved bail applications that would be heard on April 18. On April 6, several months after the sensational 'pilfering' of classified documents from the Naval war- room, the CBI had arrested five persons, including three former Naval officers, and raided 17 places across six cities. Arrested include Lt Cdr (Retd) Kulbhushan Parashar, who was picked from the IGI Airport soon after he landed here from London on April 5. The other four arrested were ex-Naval Commanders Virender Rana (Delhi) and Jha (Muzaffarpur) who were arrested along with two civilians, Bajaj and Jaiswal (both arrested from Pune).

New Delhi, April 13 In a letter to the SHO of the Parliament Street police station, she described the case of attempted suicide against her as illegal. The NBA leader said she was on fast demanding rehabilitation of the people affected by the Sardar Sarovar Dam. Her demands also included the immediate suspension of construction of the dam “in accordance with law, the Constitution and the directions of the Supreme Court”. “I aspire to live and continue the same till the affected people get their rights,” she said. Meanwhile, Bollywood superstar Amir Khan will visit the dharna site of the NBA activists and the Bhopal tragedy victims at Jantar Mantar tomorrow to express solidarity with them. |
Oppn mum on office-of-profit Bill inputs
New Delhi, April 13 Today, the same political parties appear to have put this matter on the backburner as none of them have shown any inclination to respond to Lok Sabha leader Pranab Mukherjee’s letter seeking their inputs on the proposed Bill redefining an office of profit. At its April 30 meeting, the Cabinet Committee on Political Affairs had decided to present such a Bill in the reconvened Budget session of Parliament beginning May 8. It also entrusted Mr Mukherjee to write to all political parties seeking their inputs on the contents of the Bill. It was decided that the government would frame a fresh Bill or amend the existing legislation based on the suggestions it received from all political parties. As it happens, no party has, so far, responded to Mr Mukherjee’s letter in which the Defence Minister also informed them that the government wanted to pass the Bill in the coming session without referring it to the Parliamentary standing committee, as is the normal practice with all legislations. He asked the parties to send in their suggestions and wanted to know whether they would prefer that it is implemented with retrospective effect. The government had deliberately decided to seek the Opposition’s views in writing to make it difficult for its leaders to back out. Subsequently the office-of-profit issue had rocked Parliament last month as a belligerent Opposition charged that as NAC chairperson, Mrs Gandhi was holding an office of profit. Having gone on the offensive, the Opposition parties have now slowed down as all of them are preoccupied with other matters. |
Boeing bids to sell Navy P-8A maritime aircraft
New Delhi, April 13 In what is the first ever direct military sales offer from the USA, Rick Buck programme manager told newsmen here that a high-level company team had made a presentation on this effect and had also submitted its proposal to develop and deliver the aircraft which is currently under development for the US Navy. He said that the proposed aircraft which is expected to undergo first tests in 2009 for the US Navy would provide India with futuristic technology and significantly improved maritime patrol and reconissance capability. On offer of technical partnership to Indian Navy, Mr Buck said “US Navy, the prime contractor for the P-8A programme, were looking for development partners for the project. Incidentally, Boeing’s proposal includes the development of Indian Navy’s need-centric P-8A configuration and significant participation for Indian industry, test and certification activities the company is looking at delivering the eight aircrafts over a four year period. |
