HC wants remedial measures on Cable TV Act violation

Faridabad, April 13
The Punjab and Haryana High Court has delivered its judgement in connection with two public interest litigation (PILs) filed by a social activist based here regarding the alleged violation of the Cable TV Act by the cable operators here and the encroachment on public land by the shopkeepers in the NIT area here. The court has directed the local authorities to take appropriate action in the matter.

According to the judgement in the cable operators case, the court has directed that the authorised officers shall periodically carry out a reassessment of the working of cable operators under the relevant statutes which govern the matter and take such remedial measures as may be considered appropriate.

It may be recalled that the Petitioner, Mr K.L Gera, in his PIL filed in 2002, had alleged that the cable operators in the city had been violating various rules and regulations as they had been not only displaying advertisements in an illegal manner but had also been running news and views programmes in an unauthorised manner.

He had also alleged that a majority of the operators here were not showing the actual number of connections and thus were evading tax .The petitioner had made the Deputy Commissioner, the Secretary, Home, Government of Haryana, the Sub-Divisional Magistrate and the SP party to the petition.

In the other PIL regarding the alleged encroachment by the shopkeepers in the Tikona Park area of NIT here, the court in its order has stated, “In view of the fact that the connected matter i e CWP no 11558 of 2003 has been dismissed no separate orders need to be made in the present petition and the respondents may proceed against the encroachers in accordance with the law. While the district authorities, including the Deputy Commissioner and the Municipal Corporation, Faridabad, had been made party to it, the petitioner had alleged that an auto market and a subzi mandi had come up unauthorisedly on the government land and had been a cause of traffic congestion, pollution and inconvenience to the residents.”

Lawyers protest against shifting of courts

The lawyers today demonstrated in front of the Delhi High Court to protest against the proposed transfer of shifting of certain courts from Tis Hazari to other newly built court complexes. They also protested against the shifting of the courts dealing with the cases of cheque dishonour to Karkardooma courts.

A delegation of lawyers met the Administrative Committee of the high court headed by Chief Justice B. C. Patel and submitted a memorandum to him.

The talks in this regard remained inconclusive as Delhi Bar Association (DBA) members objected to the presence of some lawyers from the Shahdara Bar Association.

The demonstration organised by the DBA was also supported by the New Delhi Bar Association and the Delhi High Court Bar Association. Former Delhi Bar Council Member Jagdev said the Chief Justice should discuss the issue with lawyers thoroughly before taking any decision on issues concerning lawyers.

The courts are to be transferred from Tis Hazari to the newly constructed Rohini Court Complex and transfer of civil cases from Tis Hazari to Karkardooma courts.

Delhi High Court Registrar-General V. B. Gupta had yesterday clarified that no decision had been taken so far on these issues and questioned the rationale behind the decision to organise a protest demonstration.
