Cabinet clears ordinance to amend
POTA New Delhi, October 21 Parliamentary Affairs Minister Sushma Swaraj said an ordinance to give teeth to the committee would be promulgated by the President during the Winter Session of Parliament. The move apparently comes in the wake of criticism of misuse of POTA by some state governments and is aimed at helping people detained under law. Until now, the committee can only make recommendations, and the Central and state governments need not act on the recommendations. The Central Review Committee set up in March this year could now review cases filed by aggrieved persons and its findings would be binding on Central and state governments and interrogating police officers, said Parliamentary Affairs Minister Sushma Swaraj. The committee is headed by Mr Justice Arun Saharya, former Chief Justice of Punjab and Haryana High Court, and has two other members. The committee was set up in March following criticism that some state governments were misusing certain clauses of POTA. The committee was asked to take a comprehensive view of the use of the legislation in various states and give its findings and suggestions for removing shortcomings in the implementation of POTA. Today’s decision is also in line with the recent statement of BJP President M. Venkaiah Naidu that the recommendations of the review committee should be made ‘binding’ on state governments. While announcing the formation of the committee earlier this year, Deputy Prime Minister L. K. Advani had told the Lok Sabha that the provisions of POTA should be used for combating terrorism and not against ordinary criminals or those whose acts cannot be considered as terrorist acts. The use of POTA against MDMK leader Vaiko, TNLA leader P. Nedumaran, Independent Uttar Pradesh MLA Raja Bhaiyya and his father resulted in an outcry by various political parties. |
SC flays HC for reopening case after final
decree New Delhi, October 21 Imposing a cost of Rs 25,000 on the tenant for abusing the judicial process, a Bench comprising Mr Justice N. Santhosh Hegde and Mr Justice B. P. Singh said, “Such errors on the part of judicial forums only encourage frivolous litigation, causing delay, and bring bad name to the judicial system.” The Bench said the high court’s order was “wholly erroneous” considering the fact that the tenant had raised an issue which had already been settled. The courts below should be careful enough to see through such diabolical plans by those against whom the decree had been passed by the court, the judges observed. Directing the tenant to vacate the shop belonging to Ravinder Kaur of Chowk Panjeer in Jalandhar district, the apex court said she had got an order in her favour from the Rent Controller, the high court and the apex court after she had initiated legal proceeding for evicting the tenants in 1997. When the shop was not vacated after the appeal was decided in favour of the landlady in March, 2002, she had moved the local court for execution of the decree. But the tenant raised an objection that the eviction order was not about that particular shop. On dismissal of the objection by the local court and handing over the possession to the landlady by ordering breaking of the lock of the shop, the tenant had again moved the high court, which directed the local court to decide his objections before handing over the possession. Since the local court had repeatedly rejected the plea of the tenant, there was no reason for the high court to restore it, the Supreme Court said. |

Indo-Lanka defence pact soon New Delhi, October 21 The growing Indo-Lankan ties were reflected by the proposal of the visiting Sri Lankan Prime Minister, Mr Ranil Wickremesinghe, for commencing a ferry service linking Colombo with Kochi (Kerala). New Delhi and Colombo called for an early conclusion of Additional Protocol to the SAARC Convention on Suppression of Terrorism, reflecting their commitment to fight the scourge. In a joint statement issued at the end of the official visit of Mr Wickremesinghe to India, India assured Sri Lanka that it was committed to the sovereignty and territorial integrity of the island nation. Demonstrating its willingness to carry forward relations with Sri Lanka, the Vajpayee government today allowed private airlines to extend their operations to Sri Lanka and decided to eliminate the existing requirement of commercial agreements between designated airlines of both countries. Sri Lankan carriers were also allowed unlimited access for air services to and from 18 tourist destinations in India. Mr Wickremesinghe held extensive talks with Prime Minister Atal Bihari Vajpayee, Deputy Prime Minister L. K. Advani, External Affairs Minister Yashwant Sinha and other leaders on bilateral and international issues during his stay here. Besides, India also offered to Sri Lanka the facility of daily air services by its designated airlines between Colombo and the metropolitan cities of Delhi, Mumbai, Chennai, Bangalore, Hyderabad and Kolkata.

Meetings at Kolkata ‘maidan’ banned Kolkata, October 21 The state government which has challenged the judgement before a division Bench, will now face another challenge in the Kolkata High Court against the Fort Williams on the use of ‘maidan’. A petition was formally filed today in the High Court on behalf of the Defence Department at Fort Williams, seeking the court’s protection against pollution and other environmental hazards in the ‘maidan’, which the honorable Chief Justice admitted. The case will come up for hearing on November 13, when the Bench hear the state government’s plea against Mr Justice Lala’s judgement. The ‘maidan’ traditionally belongs to Fort Williams. But the Kolkata police looks after law and order matters there and it has given permission for holding of meetings, rallies and exhibitions there. The state PWD takes toll from the organisers for using the ‘maidan’ for commercial purposes. The government and all political parties, irrespective of their differences, have opposed the ban. They feel the ban is neither possible nor desirable as ‘maidan’ had been the venue of all political meetings even during the British regime and it had now become their inherent right to hold meetings and rallies there. The state Home Secretary, Mr A.K. Deb, said the government would challenge the Fort William’s decision in the court. |
Congress targeting Shekhawat, says
BJP New Delhi, October 21 “When an elder statesman tours his state, leaders from various walks of life were bound to meet him. Painting such meetings as dabbling in party politics was not fair,” BJP spokesperson Prakash Javadekar told newspersons here. Mr Javadekar said the Vice President had clarified that he had not indulged in party politics and there was no need for the Congress to give a political colour to his recent meetings with BJP leaders in Rajasthan. |

Jogi paid me 5 lakh to join Cong, says ex NCP leader
Raipur, October 21 “In the presence of a senior police official, NCP Youth general secretary Ravi Sahi and Kathghora block president Hasan Khan, Jogi handed me Rs 5 lakh for joining the ruling Congress here yesterday evening,” Korba NCP President Naushad Khan claimed at a press conference at the NCP headquarters here, displaying the currency bundles of Rs 500, Rs 100 and Rs 50 denominations allegedly given to him. All three leaders had joined the Congress yesterday in the presence of Mr Jogi, saying they were feeling frustrated because of which they left the NCP and were joining it. Mr Nausad claimed today, in reply to questions, that his intention was not to register any case against Mr Jogi but to tell the world that NCP workers were not purchaseable. —

to alliance New Delhi, October 21 The BSP leader alleged that the media was witch-hunting her. She said a section of the media was projecting her legal right to seek relief in bad light by twisting facts and highlighting unsubstantiated claims of the CBI as authentic facts. Ms Mayawati declined to comment on the allegations levelled by the CBI including the finding of huge sums of money in her bank account. Lucknow, October 21 The two-member Bench comprising Mr Justice G.K. Gupta and Mr Justice Khemkaran heard the
counsel of the Mayawati and said they would deliver judgement in the case tomorrow. Her counsel pleaded that the case against the petitioner was mala fide and politically motivated. There was no evidence to prove that the former Chief Minister was involved in any scam, it said. The Bench also reserved its order on two petitions filed by Ms Mayawati’s former Principal Secretary P.L. Punia and former Secretary (Environment) V.K. Gupta till tomorrow. Punia and Gupta too had sought stay on their arrests and demanded quashing of the FIR in the case. |
Shammi Kapoor turns 73 Mumbai, October 21 The actor, recuperating from lung infection, was inundated with flowers and greeting cards and fans and well-wishers lined up outside his suburban residence to wish him. “I have turned 73. I feel I have been reborn,” an elated Shammi said, alluding to his recent sickness which forced him to spend nearly a month in hospital. “God has been kind and merciful. I thank my friends, family and fans who have prayed for me. I thank God for this new life,” he said. —
