HIGH COURT Chandigarh, May 26 He added that following the withdrawal of the notification dated April 20 “nothing survives to be adjudicated” and it would be “just, fair and in the interest of justice to permit him to place on record the new notification dated May 17 to dispose of the writ petition as having become infructuous”. After going through the affidavit, the Bench, comprising Mr Justice Amar Bir Singh Gill and Mr Justice V.S. Aggarwal, held the petition to be infructuous. The Judges, on the last date of hearing, had stayed the operation of the notification issued by the Punjabi University Registrar. Seeking the quashing of the notification issued on April 20, the petitioners had stated that the Registrar, vide the notification, had also conferred recognition on Dr Jamshed Ali Khan and four other respondents. The action, counsel for the petitioners had added, was in violation of the constitution of PUTA. On a petition challenging the move to retrench workmen of Barnala Cooperative Cotton Marketing and Spinning Mills Limited, a Division Bench of the Punjab and Haryana High Court on Saturday observed that “if the petitioners were to be retrenched on account of closure or winding up of the institution, the same would be done after following due process of law”. In their petition before Mr Justice R.S. Mongia and Mr Justice K.C. Gupta of the High Court, senior clerk Dwarika Parshad Joshi and nine other petitioners had earlier alleged that the cooperative societies in Punjab were running into losses due to “corrupt practices”. Seeking the quashing of the retrenchment notices, the petitioners had also sought directions to the respondents against making appointments in the cooperative societies and other government undertakings till the petitioners were absorbed. Issuing notice to the standing counsel for the Central Bureau of Investigation for July 17, Mr Justice K.S. Kumaran of the High Court has ordered that three Rohtak residents will be released on bail if they were sought to be arrested in an alleged bank fraud case. The three — R.K. Jain, S.C. Jain and Ajay Kumar Jain — were apprehending arrest in a cheating and forgery case registered on April 29, 1998. The case, according to the prosecution, pertained to the alleged misuse of official position by a bank branch manager while releasing the payment of fixed deposit receipts. Seeking the grant of bail, the three had contended that they were being implicated in the case. Claiming to be innocent, their counsel had stated that the petitioners had been roped in the case. |
