Truce not weakness, Advani tells Pakistan Govt Ghaziabad, March 2 “Pakistan is indulging in proxy war as it is frustrated over India’s steady progress and the country’s growing image at international arena,” Mr Advani said while speaking at the 32nd Raising Day celebrations of the Central Industrial Security Force (CISF) here. Pakistan was trying to create instability in India as it had realised that the two-nation theory on the basis of which it came into existence had failed, the Home Minister said. “The evidence of failure of the two-nation theory based on religion could be seen from the fact that a bigger Muslim population is peacefully living in India than the whole population of Pakistan,” he said adding “the separation of Bangladesh from Pakistan has also affirmed that nations built on basis of religion could not last long.” Asserting that India wanted to have a peaceful and friendly relationship with the neighbouring country, Mr Advani stressed that the extension of ceasefire should not be considered as Centre’s weakness and any attack on security forces would be given a befitting reply. “Ceasefire doesn’t mean the militants have been given a free hand in the Valley...During the so called ceasefire as many as 184 militants were killed in the Valley by security forces in a period of about three and a half months,” Mr Advani said. The Home Minister said the announcement of Ramzan ceasefire and its subsequent extensions was yet another instance of India’s peaceful overture after the Lahore peace process, initiated by Prime Minister Atal Behari Vajpayee, was sabotaged by the hostile neighbour. Hailing the performance of the CISF in providing fool-proof security in vital government installations, especially in atomic, space, power and coal sectors, he asked the organisation to prepare itself to play a major role in giving training to paramilitary personnel in disaster management and assured Centre’s help in this regard. In his welcome address, the CISF Director-General, Mr B.B. Nanda, impressed upon the expertise the force had in its possession to begin a disaster management training centre and sought the government’s nod and help. Earlier, Mr Advani inspected a parade by the CISF jawans and gave away President’s Police Medal for Distinguished Service. The Minister of State for Home, Mr Vidyasagar Rao, the Union Home Secretary, Mr Kamal Pande, were among several top officials dignitaries present at the function. |
SC: co-accused with same intention can be convicted New Delhi, March 2 The offence under Section 34 (common intention) of Indian Penal Code was intended to meet a situation wherein all the co-accused had also done something to constitute the commission of a criminal act, a three-Judge Bench headed by Mr Justice K.T.Thomas said. Other judges of the Bench, Mr Justice R.P.Sethi and Mr Justice B.N.Agrawal, agreed with the findings of Mr Justice Thomas through a separate judgement. Mr Justice Thomas said to attract Section 34 two postulates were indispensable — criminal act (consisting of a series of acts, should have been done by more than one person. Secondly, doing of every such individual act cumulatively resulting in the commission of the criminal offence should have been in furtherance of the common intention of all such persons, he said. On the first postulate, the Bench said, “The accused who is to be fastened with the liability on the strength of Section 34 should have done some act which has nexus with the offence. Such act need not be very substantial, it is enough that the act is only for guarding the scene for facilitating the crime.” Suresh and another person killed his brother, sister-in-law and their children over the issue of a small land and were convicted and sentenced to death penalty on the basis of an eye-witness account given by a child who escaped the hands of the assailants. This evidence of the child was corroborated by two other witnesses. The child also said that his aunt Pavitiri Devi was involved in the crime though it was not corroborated. The Apex Court upheld the death sentence awarded to Suresh and his brother-in-law Ramji for their involvement in the crime but acquitted Pavitiri Devi of Section 34 saying just because she was seen at the scene of the crime it could not be held that she shared common intention with the accused.

North India in Parliament New Delhi, March 2 Replying to a question by Mr Pawan Kumar Bansal, the minister said the sale price of petrol was slightly higher in Chandigarh compared to its satellite towns in Punjab and Haryana as there was Central sales tax liability for Chandigarh but not for Punjab and Haryana. The Minister of State for Youth Affairs and Sports, Mr Radhakrishnan, informed the Rajya Sabha that no fact came forth during the CBI inquiry to link Kapil Dev with any aspect of match fixing and related malpractices. Replying to a question by Mr Lajpat Rai, the minister said the findings in the CBI report were based on fact unravelled during an inquiry and there was no pressure from any source either to exonerate or implicate anyone. In reply to another question, the minister said at present there was no proposal to open a national sports institute in the Rohru area in Shimla district. The Railway Minister, Ms Mamata Banerjee, informed the Rajya Sabha that the field survey for the gauge conversion of the Pathankot-Joginder Nagar section had been completed and the report was being complied with. The Minister of State for Chemicals and Fertilisers, Mr S.B. Mookherjee, said out of the 12 fertiliser plants located in the northern region, three plants of NFL and one plant of Duncan Industries Ltd suffered a production loss of about 26,000 tonnes of urea during the period April 2000 to January 2001 on account of power failures in Northern Power Grid. Installation of diesel generators at fertiliser plants was not considered economically viable. The Minister of State for Commerce and Industry, Dr Raman Singh, informed the Lok Sabha that one growth centre had been sanctioned at Saha in Ambala district of Haryana under the growth centre scheme. Replying to a question by Mr Rattan Lal Kataria, the minister said the Haryana Government had acquired a land measuring 301 acre 5 kanal for this growth centre. The Centre had released Rs 200 lakh and a total expenditure of Rs 1091.60 lakh had been incurred by the state government on the implementation of this project. |
Abolition of exams till class X on cards New Delhi, March 2 Replying to supplementaries during question hour, Human Resource Development Minister Murli Manohar Joshi said to reduce strain on students, the government had suggested to the National Council for Education Research and Training (NCERT) and the Central Board of Secondary Education (CBSE) to abolish tests
up to class X and hold examinations only in class 12. He said the government was aware of problems faced by schoolchildren. These will be examined by the Child Commission and the process for constituting it had been completed, Mr Joshi said. The commission would go into complaints of corporal punishment and beating of a child would be declared an offence. The minister said the system of carrying heavy schoolbags by schoolchildren should be done away with. The government has launched a new scheme, Sarva Shiksha Abhiyan, to implement the programme for free, compulsory and quality education for all children below 14 years of age, Mr Joshi informed. The scheme would be implemented by the state government through the state-level implementation society and the decision regarding programme implementation would be taken by the national and state missions, he said in a written reply. To another question, he said the programme provides eight years of schooling for all children in the 6-14 age group. Provision for back-to-school camps for children out of school and other dropouts has been included under the new scheme of education guarantee scheme and alternative and innovative education, he said, The Constitution (83rd Amendment) Bill, 1997, to make right to free and compulsory education for children in the age group of 6-14 years a fundamental right was introduced in the Rajya Sabha on July 28, 1997, while the Supreme Court in a ruling in 1993 had declared that education was a fundamental right for children up to the age of 14. He said the Tapas Committee made an assessment of additional requirement of Rs 1,37,000 crore for universalisation of elementary education over a period of 10 years. The government has launched the new Sarva Shiksha Abhiyan scheme for this purpose.

Srimanta Sankaradeva awards presented New Delhi, March 2 The awards, instituted by the Assam Government in 1986, are given in recognition of their dedication towards making a new society free from class differences and religious intolerance and to establish universal human values. Giving away the awards, Mr Vajpayee said Shankaradeva played a major role in resurrection of society and showed the path of light, respect for women and equality among human beings. In a lighter vein, he said Odissi exponent Kelucharan Mahapatra was blessed with eternal youth and vigour. Referring to sarod maestro Amjad Ali Khan, who is from Gwalior, he said “I was born in Gwalior. They say that even a child cries in a raaga there.” President K.R.Narayanan, who was earlier to give away the awards, could not attend the function due to some unavoidable reason. However, in a message, read out by Assam Chief Minister Prafulla Kumar Mahanta, he congratulated the awardees and said culture was the basis of unity. The awards carry Rs 3 lakh, a citation and a gold medal. The annual award is given annually to Indian nationals of 50 years or above in the fields of journalism, arts, culture and literature. Meanwhile, a jovial Prime Minister today described himself as a “stepney” for President K.R. Narayanan at the award-giving function and said “it cannot be as good as the original tyre but gets you to the destination”. Putting behind onerous worries, the Prime Minister spent two hours at the Srimanta Sankaradeva Awards function, where he made a light-hearted speech sending the entire gathering into splits of laughter. Lalit Mansingh is envoy to Bahamas New Delhi, March 2 Mr Mansingh is due to retire from the Foreign Service this month. His successor Chokila Iyer has joined the Ministry of External Affairs as Officer on Special Duty (OSD) with an objective of ensuring a smooth transition. Mr Mansingh is expected to take over as India’s Ambassador to the USA in Washington sometime next month but he is likely to hand over the charge of the ministry to Mrs Iyer around middle of this month. Mr Mansingh would function as High Commissioner to Bahamas with residence in Washington, the release said. |
Two killed in gang war New Delhi, March 2 The desperadoes, Rakesh of the Bhoori gang and Devinder of the Jaggi gang fought with each other at Pooth village at about 10.30 p.m. The incident occurred when Rakesh was having a meeting with his accomplices in the village, the Deputy Commissioner of Police, Mr Sandeep Goel said. While Rakesh was talking to his accomplices, Devinder came along with his associates and allegedly fired at him. In return Rakesh and his men also fired, injuring Devinder seriously, the DCP said. While Rakesh died on the spot, Devinder was admitted to Jaipur Golden Hospital by his associates where he succumbed to his injuries, he said. |
TU activists march to Parliament New Delhi, March 2 The slogan-shouting and placard waving workers, under the banner of the National Platform of Mass Organisations, were stopped by a large posse of police personnel near the Parliament Street police station, about 500 yards from Parliament House. Addressing the workers, leaders of trade unions affiliated to different Left parties alleged the Union Budget presented by Finance Minister Yashwant Sinha on February 28 “exposed the gameplan to hand over the national economy to the MNCs and enslave the working class by scuttling all labour laws.” The leaders, including MPs J. Chittaranjan (CPI) and Abani Ray (RSP) exhorted the working class to “oppose and resist the nefarious designs of the government to sell out the country”. |
Charge against Balayogi rocks AP Assembly Hyderabad, March 2 The ruckus was caused when Mr Reddy alleged irregularities and favouritism in allocation of natural gas to a private power project in coastal Andhra Pradesh, promoted by relatives a TDP MP from the state. The “unusual speed” in sanctioning gas allocation to the promoter even before financial closure smacked of “favouritism”, the Opposition leader alleged evoking instant protests from TDP members.

Legal awareness camp held Hanumangarh, March 2 The secretary of the board and Chief Judicial Magistrate, Mr Chandra Narayan Mathur, gave information about the functions of the board. He urged the villagers to file their cases in the local courts. He also told the villagers about the free legal assistance provided in the legal services clinic. He urged the gathering not to file forged cases. The president of the Rawatsar Legal Services Committee and Civil Judge, Mr Ravinder Kumar spoke on the Acts of law. The villagers were told about the child marriage prohibition and the dowry prohibition Acts. Information regarding consumer protection, laws concerning women, the Motor Vehicle Act, cirminal laws and the Distillery Act was also given.

to get arrears Hanumangarh, March 2 He gave the assurance at a meeting with the regional president of the Rajasthan Ayurvedic Employees Federation. The Ayurvedic Officer added that all bills would be prepared and drafts would be issued from the bank upto Friday. He said 123 accounts had been got transferred here from Sriganganagar and some accounts were still lying there. He said the duplicate copies of the service books of 63 employees were ready.
