Haryana for implementing Sarkaria report CHANDIGARH, Aug 31 — The Haryana Government today sent its comments on certain basic issues concerning the Constitution to the National Commission to Review the Working of the Constitution set up by the Centre. The Chief Minister, Mr Om Prakash Chautala, said the written communication sent by Haryana related to those basic issues that had already been discussed at the national level in different fora. He said the state government had examined all relevant issues relating to the subjects being considered by the commission for the proposed review of the Constitution. He said the state government had agreed with all recommendations of the Sarkaria Commission and favoured their implementation wherever required. Mr Chautala said that on the issue of reservation of Bills, which related to giving or withholding of assent to Bills passed by the Legislative Assembly of a state, the Haryana Government suggested amendment or modification of the Constitution so that the Governor reserved a Bill for consideration of the President in rare and exceptional cases only. While reserving a Bill for consideration of the President, the reasons for such course of action should be communicated to the state government. In case the Governor does not accord assent to a Bill or reserves it for consideration of the President for three months, it could be deemed that the Governor had accorded his assent to the Bill. On the issue of the appointment and role of Governors, Mr Chautala said the government was of the view that although the Sarkaria Commission had recommended the appointment of the Governor of a state by the President of India in consultation with the state government concerned, the Haryana Government felt that mere consultation would not be enough. The government had detailed discussions on this issue and recommended that this process of consultation suggested by the Sarkaria panel should be “effective and meaningful prior consultation” and that a person to be appointed Governor should be an eminent person from outside the state. He should be a detached figure and not connected with the local politics of the state. The government also felt that persons belonging to minority groups should continue to be given adequate representation. The Chief Minister said on the issue of administrative relations the state government had agreed with the recommendations made by the Sarkaria Commission that before the issue of directions to a state or application of the relations sanction under Article 365, the utmost caution should be exercised. Mr Chautala said the government also stated that there were certain inter-state issues relating to water disputes which needed to be resolved. He said it should be mandatory on the Union Government to constitute a tribunal within a period not exceeding one year from the date of receipt of the application of any disputant state. The tribunal should give its award within a period of three years from the date of its constitution. However, if due to unavoidable reasons the award could not be given within three years, the Union Government should extend the period suitably not exceeding two years. He said on the question of imposition of President’s rule, the state government was of the view that although the existence of Article 356 of the Constitution was essential, adequate precautions needed to be taken to prevent its misuse. He said the state government had urged that a harmonious national consensus should be evolved on such an important issue as Article 356. Finally, after detailed deliberations the Haryana Government suggested that ordinarily prior approval of both Houses of Parliament should be obtained before issuing a proclamation under Article 356 except when the situation was so grave and emergent as in the opinion of the President was likely to affect the sovereignty and integrity of India. Mr Chautala said the government had also drawn the attention of the Central Government to the fiscal imbalance that made states heavily dependent on the Centre. He said there was need for reviewing the Seventh Schedule under Article 246 classifying subject matters in the Union List, the State List and the Concurrent List. The subjects in the Concurrent List needed to be clearly identified on which states should be allowed to make laws. He said the government had also suggested that Article 281 of the Constitution, empowering the Centre to accept or reject the recommendations of the Finance Commission, needed to be reviewed to the effect that such recommendations be placed before the National Development Council or the Inter-State Council for discussion before these were finally implemented. Mr Chautala said that the recommendations of the Sarkaria panel were not statutory or mandatory. These were suggestive in nature, the implementation of which would provide the requisite impetus to the strengthening of Centre-state fiscal relations. All 44 recommendations made under Chapter X relating to Centre-state financial relations, had been intensively deliberated upon by the Inter-State Council. Many of these had already been implemented or were in the process of being implemented. |
Paddy arrivals may be 31 lakh tonnes CHANDIGARH, Aug 31 — A total of 31 lakh tonnes of paddy was expected to arrive in Haryana mandis this year for procurement, official sources said here today. The corresponding figure last year was 26 lakh
tonnes. Sources said that 59 lakh tonnes of wheat remained in godowns in Haryana and problems might crop up regarding the storage of rice which would start arriving in the markets from October onwards. The state had approached the Centre for expediting the movement of wheat and creating storage space for rice, the sources said and added that the Centre was also requested to begin the procurement of paddy from September 16 instead of October 1 as announced by the
FCI. |
Haryana to purchase
paddy from Sept 15 KAITHAL, Aug 31 — The Haryana Chief Minister, Mr Om Parkash Chautala, has said that he was surprised to see a statement by the Congress observer for Haryana, Mr Moti Lal Vora that the Congress party did not want to dislodge the Chautala government. Mr Chautala, who was on a hectic tour of the district, was addressing a press conference at Pundri Rest house, 20 km from here today. Mr Chautala said that the Opposition had always tried to remove him from power but it was not in their control. He said that the Congress, which itself was a divided house, could not dislodge him from power when he had absolute majority in the Assembly and support of the people of the state. He said that keeping in view the interest of the farmers the state government had decided to purchase the paddy from the mandis from September 15, whereas the Central Government agencies would start procurement of paddy from October 1. Speaking about improvement in the power supply, Mr Chautala said that there had been considerable improvement in the generation of power. At the same time the government had also succeeded in checking theft and line losses and misuse of power. He said the government was aiming to ensure sufficient power for industrial, agricultural, trade and common consumers. He said that besides promoting setting up of new industries, the government had given attention to the new education policy so that the students and other unemployed youth could get employment opportunities after getting expertise in information technology. He clarified that there was no ban on recruitment for government jobs and a large number of posts of teachers, constables and other posts were being filled after following proper procedure, Replying to another question he said that for police recruitment, the preference would be given to the candidates of the same district, however, according to the Constitution of the country, any body could apply, appear and be appointed to any post from anywhere in India. He also hinted that soon the improvement trusts would be revived and headed by representatives of the people. When it was pointed to him that condition of vehicles provided to the Kaithal police was bad, he said that a high power committee had been constituted to scrutinised the needs of different departments and provide them vehicles as per their needs. Mr Chautala ruled out the possibility of making Bahadurgarh a separate district. During his visit to the district Mr Chautala inaugurated a bridge constructed at a cost of Rs 56.50 lakhs at Keorak village which will link number of villages with Keorak. This bridge was damaged in 1993 floods. Later Mr Chautala also dedicated a community centre built by HUDA in Sector 20. Mr Chautala also laid foundation stone of a milk chilling centre at Patti Afgan here. At Pundri Mr Chautala inaugurated a gaushala constructed by the Chalti Devi Mani Ram Garg Charitable Trust, Delhi. Mr Chautala also unveiled the statue of a former Haryana Assembly Speaker, Mr Ishwar Singh, in the premises of Kanya Maha Vidyalaya, Pundri. Mr Chautala inaugurated two PHCs at Pai village and Jakholi village. He also laid the foundation stone 33 KV sub station at Jakholi. In the last leg of his tour, the Chief Minister laid foundation stone of a water supply scheme at Deoban village.

Distillery of Bhajan’s
son-in-law closed down CHANDIGARH, Aug 31 — The Haryana State Pollution Control Board (HSPCB) has closed down M/s Haryana Organic, a wine distillery belonging to Mr Anup Bishnoi, son-in-law of a former Chief Minister, Mr Bhajan Lal, for failing to observe the pollution control norms. Earlier, the HSPCB had shut down M/s ADL Hisar, also belonging to Mr Bishnoi, on the same ground. The step had triggered off a political controversy as Mr Bhajan Lal alleged that it was a vindictive move by the Chief Minister, Mr Om Prakash Chautala. Sources in the HSPCB, however, said that Haryana Organics, located at Samalkha, Panipat, was closed down on August 29 as the unit was emitting effluents under the Water Act and covered under 17 categories. The pollution discharged by the unit was 500 Kg per day, which was equivalent to the total effluent discharged by the industrial units of Panipat, the source claimed. |
Non-bailable warrants
against Dangi AMBALA, Aug 31 — The Additional District and Sessions Judge, Ambala, Mr Lakshman Sharma, issued fresh non-bailable warrants against the former minister of Haryana, Mr Anand Singh Dangi, for November 30 here today. A case was registered against Mr Dangi by the Haryana Vigilance Bureau about four months back here on the charge of allotting lands to some persons illegally. Earlier, the district court had issued non-bailable warrants against him for August 31. However, Mr Dangi could neither secure bail nor he surrendered himself before the court within this period. Counsel for Mr Dangi urged the court today to grant some more time to implement the court order. Issuing the fresh non-bailable warrants, the judge has fixed November 30 for the next hearing. |
Retired Sube-Major
killed, wife and son hurt AMBALA, Aug 31 — A retired sube-Major was done to death and his wife was seriously injured in Ambala city last night. The incident took place at about 3 a.m. when Subedar-Major Jagannath Sharma was sleeping along with his son, Rajiv, at his Uttam Nagar residence in Ambala city. His wife, Saroj, was sleeping in an adjacent room. Rajiv, who is in a state of shock, informed the police that there were four masked men, two of whom woke up his father, who committed the crime. He fell unconscious and did not know what happened next. When he regained consciousness, he found his father lying lifeless and his mother too was unconscious. Rajiv raised the alarm and a next-door neighbour rushed there. The neighbour on learning about the incident, informed the police. Subedar-Major Sharma is reported to have been strangled, while his wife has sustained serious injuries. Saroj has been shifted to the PGI, Chandigarh, and Rajiv is recuperating at Civil Hospital, Ambala city. A police official said that three teams had been formed to solve the murder case. While one team has been sent to Punjab, the other two teams were working on some clues. Forensic experts and the dog squad had visited the crime scene. He said that the telephone line of the residence had been cut and the assailants had ransacked the house. The assailants were armed with iron rods and one of them was carrying a firearm. The assessment of the goods taken away by the assailants is yet to be made but the police is hopeful of solving the crime on the basis of certain clues. The incident has come as a shock to the local residents who have expressed concern over the vulnerability of falling prey to assailants, specially during night.

Selja leads protest march SIRSA, Aug 31 — The District Congress led by former Union Minister and All-India Congress Committee secretary, Ms Selja, led a procession and staged a dharna outside the camp office of the Deputy Commissioner in protest against “politically motivated” cases against party workers and the “anti-people” policies of the Chautala government. Addressing workers before submitting a memorandum to the Deputy Commissioner addressed to the Governor, Ms Selja said the government had gone back on its promises. The farmers of the state were the worst hit as instead of free electricity, power was being given to them at a higher tariff. The traders too were annoyed as instead of abolishing “inspectory raj”, the government had introduced CT-38. Even law and order had deteriorated. Senior Congress leader Ranjeet Singh admitted problems within the Congress and said these needed to be resolved. |
Town planning cell
to be set up CHANDIGARH, Aug 31 — With a view to curbing unauthorised mushroom growth of colonies and regularising the existing ones, the Haryana Chief Minister, Mr Om Prakash Chautala, today announced a two-pronged strategy. Presiding over a meeting here to review the situation arising our of unauthorised colonies in the state, Mr Chautala said these colonies had sprung up all over the state the during the past several years because people with low income had not been able to get plots at low rates in urban areas to construct their houses. Also, the migration from rural to urban areas continued unabated with the rapid growth of population. He announced the creation of a Town Planning Cell in the Local Bodies Department to check future mushrooming of unauthorised colonies. The cell would be headed by a senior town planner and it would undertake survey of the areas susceptible to unauthorised colonisation. The cell would prepare urban plans, besides mapping the area. He also directed municipal bodies to complete the survey of their areas within six months under the supervision of the Town Planning Cell. The land thus vacated would be developed by the municipal bodies to benefit the low-income strata of society in tandem with land owners by way of town planning schemes. The Chief Minister announced that henceforth no unaurthorised colony would be allowed to spring up and those indulging in such practices would be proceeded against. He observed that most of the residents of unauthorised colonies had not deposited development charges after their colonies were regularised. Keeping this in view, the authorities concerned would consider ways and means to get the development charges in advance from the residents of unauthorised colonies before regularising them. |
Haryana DTA offices
may be computerised CHANDIGARH, Aug 31 — Opening of fully computerised District Transport Authority offices in the 19 districts of Haryana is on the cards with the proposal for the same having been forwarded by the State Transport Authority to the government for approval. With an estimated 1.3 lakh vehicles rolling on to the roads each year after requisite approval of the Transport Authority and over 5000 being given sanction in Panchkula alone, the need for such offices was felt in each of the districts which prompted the move. Besides, with traffic regulation becoming a specialised area of activity, the department felt the need for bringing the registration offices of the commercial and non-commercial vehicles under one roof. In addition, computerising the offices is aimed at streamlining the ever-increasing work activity of the department and increasing efficiency. While at present the workload of the authority in these districts is divided between the Sub-Divisional Magistrates managing non-commercial vehicles, the Regional Transport Authority at seven places is the only licencing authority in cases of commercial vehicles. The RTAs are functional at Ambala, Faridabad, Hisar, Karnal, Rohtak, Rewari, Gurgaon, Jind, Yamunanagar and Sirsa. After the proposal gets the nod of the government, all RTA offices will be merged with the new DTAs in the districts. An official explains: “There is tremendous rush at our office for registration of commercial vehicles and records of previous years are stacked haphazardly. Catering to densely populated pocket of Ambala and Panchkula in addition to that of surrounding areas in the absence of easy availability of records is a major bottleneck in quick disposal of cases.’’ A cause of concern at the district headquarters where the SDMs are entrusted with the task of handling matters related to licensing and registration of non-commercial vehicles is their frequent transfers which leads to unnecessary delays in routine matters. Also, the SDMs are over-worked, managing field jobs and office ones. While functioning as Land Acquisition Controllers, in settlement of police cases under Sections 107 and 151 of the IPC, they carry out inspections in their respective sub-division besides functioning as the Licencing and Registering Authority. It is learnt that the technicalities related to staff, their training and offices will be worked out at a later stage once the department gets the green signal from the government though new recruitment is expected as also shifting of surplus staff from other offices is under the active consideration of the department. |
Fire in train, mishap averted SONEPAT, Aug 31 — The alertness of a train driver averted a major mishap and saved the lives of the passengers in a train between Sonepat and Harsana Kalan railway stations, about 4 km from here, today. According to preliminary reports, the engine of a DPM passenger shuttle bound for Delhi caught fire. The driver immediately swung into action and tried to control it. He, however, failed in his efforts and applied the brakes as a result of which the train came to a halt. As soon as news about the fire spread, the passengers
became panicky and they rushed out of their coaches. On seeing the fire, they also helped the driver in controlling the fire. After sometime, the train began its journey and reached Rathdhanna railway station where the fire was brought under control finally. The train was, however, delayed for an hour or so and it reached Subzimandi around 9.45 a.m. |
Robbers decamp with gold, cash AMBALA According to Mr Puneet
Batra, a resident of Sector 7, Urban Estate, when they woke up this morning, they found that the almirah in an adjacent room had been broken open. "The robbers have taken away gold jewellery and Rs 5,000 cash which was kept in the
almirah," he said. The robbers had entered from the backdoor of the house and none of the family members heard anything. A case has been registered. Mr Batra said that he had announced a reward of Rs 20,000 for whoever solved the crime |
Police recruitments
on merit: Ajay HISAR, Aug 31 — Mr Ajay Chautala, MP and a son of Mr Om Prakash Chautala, has said the ongoing recruitment of police constables will be purely on merit. Addressing a public meeting at Singhwa village near here yesterday, he said the state government had directed the superintendents of police that the recruitment process should be transparent. He denied corruption charges in police recruitments levelled by opposition parties and alleged that during their rule in the state all norms were violated. He added that the state government would construct senior citizens’ homes in every village on the state. All basic facilities would be provided at these homes, Mr Ajay Chautala added. He said the Chautala government was giving equal importance to every district of the state regarding development projects. Lauding the “sarkar apke dwar program, he claimed it had given positive results and the program’s second phase would begin from October 2. He inaugurated a Rs 80-lakh drinking water project at Garhi village near Hansi and laid the foundation stone of a water supply augmentation project at Sorkhi village. The Local Bodies Minister, Mr Subhash Goyal, was also present on the occasion. |

killed in mishaps KARNAL, Aug 31 — Matta, a youth of about 20 years of age, was run over by a Haryana Roadways bus of the Karnal depot at Nilokheri this evening. Matta, a student of third semester of Government Polytechnic, Nilokheri, was trying to board a speeding bus bound from Saharanpur to Karnal. He slipped out from the rear window and was run over. He was rushed to a hospital in Nilokheri in a precarious condition. Students of the polytechnic tried to block traffic on the GT Road for some time to protest against the accident. Commuters from Nilokheri to Karnal face great inconvenience everyday in boarding buses from there. Hundreds of them have to wait for hours to get local buses between the two towns. The roadways drivers are indifferent to their lot. Ordinarily, they do not stop buses there. If at all a bus is stopped, the driver speeds it up the moment five to ten students board it. The running students often slip down. The roadways could easily run a local bus service in the evening between Karnal and Nilokheri but the authorities are a mute witness to such mishaps. In another accident this morning Father Shanti Nandan, a Christian missionary, who was on his way from Delhi to Karnal was crushed under the rear wheels of a Himachal Roadways bus of the Hamirpur depot at the ITI Chowk here. The missionary was trying to disembark from the bus when the driver started it. He fell down and was crushed. He died on the spot. The bus driver fled the scene. The police has registered a case against the driver. |
Marked rise in cases of
water-borne diseases FARIDABAD, Aug 31 — There has been a sudden spurt in the cases of water-borne diseases like cholera, diarrhoea, dysentery and typhoid in several parts of the town in the past one month. According to information received from some of the microbiology laboratories and the cases reported at government hospital here, the cases of these diseases had increased almost four times in the past four months. According to Dr Vinod Kaul of ‘Vibles Specialise Microbiology Laboratory (VSML) here at least 14 cholera and 33 typhoid cases were confirmed after the examination of samples. Dr Kaul, who is a former Head of the Microbiology Department at Sir Ganga Ram Hospital at New Delhi, said majority of the patients had been referred to his laboratory by private practitioners. It is learnt that at least 16 patients with symptoms of cholera had been admitted to Bhadshah Khan Government Hospital here within the past one week. However, health officials denied these reports. But doctors and other hospital staff have admitted that there has been an increase in the cases of diarrhoea and other water-borne diseases. Most of the patients admitted for treatment belong to colonies, including Jawahar Colony, Rajiv Colony, Sanjay Colony, Dabua Colony, Adarsh Colony, Kalyanpuri, Ballabgarh town and jhuggi clusters here. The areas allegedly have poor sanitation facilities. The patients admitted in the hospital here have been identified as Vikram, Vijaylaxmi, Jitender, Chanchal Neha, Munni, Kanika, Jyoti, Sahil, Nathan Devi, Balvinder, Deepak, Heera Lal, Shiv and Suraj. Meanwhile, according to some experts indiscriminate use of antibiotics by medical practitioners and patients themselves had led to the problems. They have appealed to the doctors to prescribe the medicines only after
establishing the sensitivity pattern of the infecting organisms. The district administration had reportedly launched a campaign against diarrhoea and other similar diseases several months ago as hundreds of persons had been affected within a short span of time. Residents, however, are not
satisfied with the measures taken by the authorities concerned to prevent the breakout of these diseases on a large scale. Complaints of the supply of contaminated water, heaps of garbage and waste near the residential areas and
inadequate drainage of the rain water have been pouring in from almost all parts of the town. |

IT training
for ministers CHANDIGARH, Aug 31 — An information technology (IT) course for Haryana ministers will begin from October 2. Mr P.K.
Chandlery, IT Commissioner of Haryana, said that the course had been designed to familiarise the ministers with IT within a short- time frame. He said that researchers employed with the state government had developed a user-friendly digital keyboard. “There would be various icons on the board such as appointments, task, general information, calendar, etc, and the ministers would only be clicking them to have access to the information”, Mr Chaudhery said. Mr Chaudhery said that IT familiarisation courses for senior officers, including DCs and SPs, would also begin at about the same time. According to Mr Chaudhery so far there was no concrete plan for offering IT training to MLAs. Even if some MLAs were given training they would not be provided with the specially designed keyboards. Though it would not be mandatory for the ministers to attend the training course, there would not be any bunking of classes by them, Mr Chaudhery felt . He added that recently when during a Public Accounts Committee meeting, the proposal was floated to train the ministers in IT, they were all excited. Later, talking to TNS, Finance Minister Sampat Singh said he would like to learn IT provided he could find the time. “My children are familiar with the computer and the Internet and when I see them I feel that I should also have known Net surfing,” he said. |

Pro-VC clarifies on air travel CHANDIGARH, Aug 31 — The Pro-Vice-Chancellor of Kurukshetra University, Dr Hoshiar Singh Sihag, has clarified that he travelled to Berlin from Delhi by economy class and not by excursion class by Air-India vide boarding pass no. 95 dated August 21, 1994. Dr Sihag was referring to a news item, “Dr Sihag in TA controversy”, published in these columns on August 21. He said there was a basic difference between the fares for economy class and excursion class. He said that in excursion class the return journey was not possible before 14 days whereas he returned within seven days. Dr Sihag said one of the conditions of the organisers was that he should travel by economy class and a photo copy of the original ticket was to be handed over to them for their accounting purposes. He said this was done and the organisers had made the payment only after verification. “Had there been any discrepancy, they would have promptly pointed it out.” He said the university auditors as well as the Haryana Government auditors posted at the university duly checked and recorded “original seen” on the TA bill submitted by him. He said if the auditors had not seen the original, they would have recorded their objection on the TA bill itself. “Absence of any such objection indicates that the claim was in order and duly processed and passed by the officers concerned.” Dr Sihag said he did not say that the TA bills go to the UGC. “I only said that after the audit of accounts, a utilisation certificate is sent to the UGC. The situation cannot change unless the record is tampered with at a subsequent stage by vested interests against me.” |

Revenue clerks
want patwari’s pay scales FATEHABAD, Aug 31 — The Deputy Commissioner Office Employees Union has demanded that the clerks working with the Revenue Department should be given pay scales equivalent to the revenue patwaris. In a letter to the Chief Minister, a copy of which was released to the Press, the union said earlier the revenue clerks had got pay scales equivalent to that of patwaris from January 1, 1968 to December 31, 1995, but in the new pay scales issued on January 1, 1996, the patwaris and clerks were placed in different pay scales of 3050-4590 and 4000-6000, respectively. The union said these scales were not justified as the nature of work of the two categories were different. The union said the revenue clerks were made to work till late hours, particularly during tours of ministers and during natural calamities. They also had to do certain technical works like typing and operating computers besides their own work. The union also submitted a memorandum to the Deputy Commissioner in this regard. |

Three arrested for
carrying beef FARIDABAD, Aug 31 — Three persons were beaten up by a mob at Sector16-A this morning for carrying beef on their motor cycles. The police has seized the beef and arrested the youths. The youths were intercepted by some persons of Daultabad village in Sector 16-A at about 6.30 a.m. The accused were carrying the beef to the Babanagar market here. Three youths on motor cycles were overpowered by the local residents. One youth fled on his motor cycle. He was also carrying beef. He claimed that he took out a country-made revolver when he was stopped. This enraged the residents and they beat up the youths. A delegation of the residents met senior police officials and sought strict action against the accused. The local unit of the People For Animals (PFA) has expressed concern over the increase in the incidents of cow slaughter in the district. The president of the Haryana wing of the PFA, Mr Naresh Kadian, said his organisation would take up the issue with the higher authorities. PM urged to improve
working of drug factory CHANDIGARH, Aug 31 — The Chief Minister of Haryana, Mr Om Prakash Chautala, today sought the intervention of the Prime Minister, Mr Atal Behari Vajpayee, to improve the functioning of the Union Government’s drug manufacturing plant at Gurgaon in the interest of the people working in it. The Chief Minister sent the representation made by the workers’ union of the plant to the Prime Minister drawing his attention to the fact that the plant had not been functioning up to it full capacity despite the fact that its is equipped with sophisticated machinery. He urged the Prime Minister to direct the ministry concerned to take up the matter on a priority
basis. |

Gang of robbers busted KAITHAL, Aug 31 — The district police has busted a gang which had robbed Rs 3.27 lakh from the Haryana Vidyut Parsaran Nigam (HVPN) office at gunpoint here on May 15. The Superintendent of Police, Mr Parbhat Ranjan Deo, told mediapersons here yesterday that the gang leader, Randhir, alias Dheera, of Karora was overpowered by a police party near Deoban village when he tried to flee after firing at the police party which had been chasing him from the police naka near Saran village. A .315 bore pistol and some cartridges were seized from him. Dheera’s accomplice Surinder was able to escape. |
