Sirhind faces power, water shortage

In Sirhind frequent power failures at odd hours are causing inconvenience to the citizens as well as business establishment alike. He said the college lecturers, DPROs, medical officers and ETOs were given Class I status while they were drawing a lower pay scale than the school principals.

SAD proposals ‘to strengthen’ federal setup

NEW DELHI, Aug 28 — Federal character of the Indian Constitution, as envisaged by the founding fathers and which got lost in the mist of time, would be strengthened only by giving more powers to the states, the Advocate-General of Punjab, Mr H.S. Mattewal, said today.

‘‘The unitary system negated the very concept of decentralisation of powers and devolution of resources, with the result that the empowerment of the people at the grass-roots level has remained only a distant dream,’’ Mr Mattewal said.

In an interview to The Tribune, soon after the submission of the proposals of the Shiromani Akali Dal (Badal) to the Constitution Review Committee, Mr Mattewal said these proposals would strengthen the polity of the nation. 

The proposals, if accepted by the government, would strengthen the unity and integrity of the country. They are more ‘‘nationalistic’’ in nature, than the autonomy resolution passed by the Jammu and Kashmir Assembly.

Stating the proposals calling for ‘‘true’’ federalism were different from the US Constitution, Mr Mattewal said ‘‘they reflect the experience of 50 years of working of Constitution in the country.’’

The provisions in the proposals call for strengthening the role of the state in a federal polity and does not seek for the establishment of dual citizenship, state judicial system or cessation as envisaged by the US Constitution.

He said the Centre should retain Defence, Foreign Affairs, Currency and General Communication. On other subjects, the states should have powers to formulate own laws.

On Article 356, which gives powers to the Centre to impose President’s rule in a state, Mr Mattewal said ‘‘this provision should not find place in a federal framework.’’

He said ‘‘fresh elections should be held and a new government should be installed even if there is a constitutional breakdown.’’

The Advocate General said ‘‘if there is no provision for the President to take over the Central Government in the event of failure of constitutional process, there is no justification for the President’s rule in states.’’

Mr Mattewal said the apprehension expressed by the founding fathers during the discussion in the Constituent Assembly had come out to be true.

‘‘It is constitutional crime to empower the President to interfere not merely on the report of the Governor or ruler of the state, but otherwise,’’ Mr H.V. Kamath had observed, the Advocate General said, adding that the experience of 50 years have shown how farsighted they were in their vision.

On the anti-defection law, he said ‘‘the concept of ‘split’ and ‘merger’ should be done away with and a MP elected on a party ticket should continue with till the dissolution of the House. However, if this proviso continues to exist then there should be a ban on the defecting legislator from holding government or quasi-government office until such a member is re-elected.’’

He said this concept has drawn inspirations from the Swiss model where there is a provision to recall an MP if the electorate of the constituency are not satisfied with the performance of their leader.

The country should adopt German model when it comes to the no-confidence motion against the Central Government, he said.

Explaining the model, he said ‘‘before a no-confidence motion is brought against the existing government, there must exist an alternative government ready to take over.’’

SAD for changes in Indian polity

CHANDIGARH, Aug 28 — The Shiromani Akali Dal (SAD) in its proposals submitted to the National Commission to Review the Working of the Constitution in New Delhi today has reiterated its demand for a “true” federal system for “effective” governance and socio-economic development of modern India.

The proposals in the 28-page memorandum are primarily based on the SAD’s Anandpur Sahib Resolution, which the party had formally adopted at the Ludhiana conference on October 29, 1978.

Following the SAD’s differences with its coalition partner, the Bharatiya Janata Party, on certain proposals, the decision to submit a memorandum to the commission on behalf of the Punjab Government was dropped even though a formal committee was constituted with senior BJP ministers as members. Therefore, only one memorandum, on behalf of the SAD, had to be submitted.

Much of what is stated in the memorandum is well known. The issues are a pet theme of the Akalis. These relate to the Sikh identity and religion, politics, Centre-state relations, the strengthening of the Constitution, the judiciary and the legislature, education, no-confidence motions, the anti-defection law, the protection of minorities and the interests of the Scheduled Castes, the Scheduled Tribes and the backward classes, the empowerment of women, etc.

It also recaptures the role of the Sikhs in the freedom struggle and their contribution to India’s development in the post-Independence period. It also mentions the role of the SAD, which claims to be the sole repository of the Sikh aspirations (religious, political and socio-economic), and seizes the opportunity for the appraisal of the Constitution in the light of the past 50 years’ experience. It lashes out at the Congress, calling it a “monolithic” party, which hoisted on the people a “totalitarian, authoritarian system, resulting in the distortion of the Indian Constitution, which needs to be rectified now”.

In consultation with various legal, political and constitutional experts, the Punjab Advocate-General, Mr H.S. Mattewal, has prepared the main draft.

Besides demanding the setting up of a judicial commission on appointments to the higher judiciary, the SAD has suggested that a national minorities schedule should be appended to the Constitution.

The main focus is on Article 25 of the Constitution and its Explanation II that clubs Sikhs with Hindus, Jains and Buddhists, giving a “wrong” impression about the independent Sikh identity and institutions.

Therefore, the SAD wants the word “Sikh” to be deleted from Explanation II of Article 25 to remove the confusion about the true identity of the Sikhs. “The Sikh religion should be described as one among the many religions of India, not as one part among the many parts of Hinduism”.

It has suggested that the Constitution should be suitably amended to give more powers to women through the reservation of seats in the state legislatures and Parliament. The SAD favours a second look at the anti-defection law. Horse-trading has been witnessed in the case of a “hung” Parliament or a state legislature. The provision relating to a “split” and “merger” is done away with. A member once elected to a House on the ticket of a party must stay with it till the dissolution of the House.

On the no-confidence motion, the memorandum prefers to adopt the German model. It envisages the presence of an “alternative” government. In the event of a government being  defeated, instead of dissolving the House and ordering fresh elections let the “alternative” government step in. Such a provision  in the Constitution will bring about stability in the political system, it argues.

One of the proposals is that the Rajya Sabha should be made a true representative of the states. Its members are elected on the principle of equality of the states as autonomous units. Some changes in the Union List and the Concurrent List are also suggested. So is a change in the Preamble to the Constitution where the suggestion is that the word “federal” should be added.

The SAD’s stand on Article 356 of the Constitution, which enables the Centre to dismiss a state government, is well known. Such a provision had no place in a federal constitution.

In the event of the dismissal of a government there should be immediate elections and no scope for President’s Rule. (Article 356 has been invoked 94 times and it was first used in Punjab, where eventually it has been invoked nine times. Kerala, too, has had President’s Rule as many times.)

The proposals seek more executive and financial powers for the states and the deletion of certain Articles, namely 256, 257 and 356. It suggests that internationally acceptable riparian laws should be made applicable to the states in conflict over the sharing of water with the non-riparian states having no stakes. The SAD also suggests that no international trade or commerce treaty directly affecting a state should be entered into without the consent or agreement of the state concerned.

There is also mention of the dwindling share of the Sikhs in the armed forces of the country due to the “wrong” policies pursued by the Centre.

The Akalis have reiterated that the Centre should retain four departments, named defence, currency, communication and foreign affairs.

A major point made in the  proposals, while referring to the “sacrifices” and “contribution” of the Sikhs to nation-building, is, inter alia:  “Truly, every inch of India belongs to the Sikhs and the Sikhs belong to India”.

Jail warden held for aiding ultras

CHANDIGARH, Aug 28     A warden of Model Jail in Burail here was arrested today evening while trying to fax certain documents on behalf of Balwant Singh, an alleged assassin of former Punjab Chief Minister Beant Singh, to a place in the Britain. Significantly, this comes just three days prior to the fifth death anniversary of the former Chief  Minister.

The Ropar police picked up warden Om Vir from a public call office in Morinda while he was sending the fax message late this evening. Highly placed sources said the fax message lauded the role of alleged human bomb Dilawar Singh in the former Chief Minister’s killing. According to the Ropar Senior Superintendent of Police, Mr. G.S. Bhullar, the message also contained information  meant for UK-based underground millitant outfits. The message was from Balwant Singh and had mentioned about the last dialogue between him and his friend Dilawar.  Om Vir, the SSP added, was being used a conduit to fax the documents. Interrogation was on, he disclosed over the phone from Ropar when contacted late in the evening.

Om Vir has been booked on the charges of sedition under Section 124-A and 153-A of the Indian Penal Code. The Ropar police informed the authorities in Chandigarh at about 9 p.m. regarding the arrest of Om Vir on serious charges.

Confirming the arrest, senior Chandigarh Administration officials avoided further comment on the issue saying that the Ropar police was yet to give exact details

This is the second time that an  official of the Burail jail  have been found to be involved in a controversy with the same set of militants. Earlier, an Assistant Jail Superintendent was booked by the Chandigarh police in the alleged jailbreak case,  the conspiracy of which was reportedly hatched to free Jagtar Singh Hawara and certain other accused in the assassination case.

The former Chief Minister, it may be recalled, was killed in a blast outside the Punjab Civil Secretariat on August 31, 1995. Believed-to-be human bomb Dilawar Singh was killed in the explosion, while other accused in the case are facing trial.Top

 

Chahal, Bhullar may be promoted as DGPs

CHANDIGARH, Aug 28 — The Punjab Government may  abolish the  post of Director-General of Police (Rules) while  ordering much awaited promotions in the top echelons of  the State Police soon.

A number of senior police functionaries of the State, including three officers of the rank of the Director-General  retired on attaining superannuation during the past few months.

The proposal of the Police Department to promote all officers belonging to the 1970 batch of the Indian Police Service to the rank of Additional Director-General, has been pending with the State Government for a long time. In fact,  Departmental Promotion Committee proceedings have already cleared these officers for elevation.

The Police Department has been maintaining that promotions in the top echelons of the State police have already been delayed by about two years. Normally, an officer with 28 years of service is promoted Additional Director-General while those with 30 years of service get the rank of the Director-General of Police.

In case of five officers of the 1970 batch — Mr Lalit Bhatia, Mr S.C. Jain, Mr D.R. Bhatti, Dr G.S. Aujla and Mr MPS Aulakh, — promotions, the department maintained, have already been delayed by two years.

Once these promotions come through, two seniormost Additional Directors-General of Police — Mr Jarnail Singh Chahal and Mr Mahal Singh Bhullar — are all set to be promoted as Directors-General. The State has only two cadre posts of Director-General. The third, which was held by Mr R.K. Sharma, who retired on July 31 as Director-General (Rules), is being abolished.

Mr Sube Singh, who was Director-General of Police before being replaced by Mr Puran Chand Dogra, retired on May 31 this year as Director-General (Vigilance).

The third officer to retire on July 31 was Mr K.K. Sharma, Director-General, Home Guards.

The only officer of the 1964 batch left, is Mr Daljit Singh Bhullar, and he is facing trial in a murder case and is under suspension.

After clearing the 1970 batch, Punjab has only one officer in the 1971 batch, Mr K.K. Attri.

Once these seven officers are promoted, there will be cascading effect leading to promotions at the Inspector-General and Deputy Inspector-General level also. But in these cases, the DPCs are yet to be convened.

In that case officers belonging to the 1978 batch are expected to be cleared for elevation as Inspectors-General. There are five officers of the 1978 batch of which one, Mr Hans Raj Chadha, is on deputation.

PCMSA up in arms against Kanjhla

SANGRUR, Aug 28 — The PCMS Association, Punjab, at a special meeting of its state executive committee here yesterday urged MLAs and ministers to raise the issue regarding “misbehaviour” with four women doctors allegedly by Mr Gobind Singh Kanjhla, a Punjab minister, in the ensuing Assembly session.

Besides the association’s leaders from Ludhiana, Patiala, Amritsar, Bathinda and Hoshiarpur, Dr Baldev Sahota, Dr D.C. Sharma and Dr Surinder Singla, president, general secretary and regional secretary respectively, of the association, attended the meeting.

The meeting also urged the Jathedar of Sri Akal Takht to initiate action against Mr Kanjhla as he had “violated” the Sikh principles by allegedly “misbehaving” with the women.

The meeting also appealed to democratic organisations and women organisations to join the campaign launched by the association against Mr Kanjhla. The meeting alleged that Mr Kanjhla was threatening association leaders and the women doctors through his supporters for launching the agitation against him.

Dr Singla said the meeting also described the silence of the Punjab Health Minister and the Minister of State for Health, Punjab, on the issue as “unfortunate” and appealed to them to talk to the Chief Minister to sack Mr Kanjhla from the Council of Ministers.

He said the meeting also took a serious note of the statement of three leaders of another group of the association that the agitation of the doctors had become meaningless as Mr Badal had himself expressed regrets on the issue of alleged “misbehaviour” with the doctors by Mr Kanjhla. Dr Singla said the meeting felt that such leaders had no moral right to issue any statement on the issue as they had not played any role in the agitation.

He reiterated that their agitation would continue till Mr Kanjhla apologised. He said the association would hold a massive rally on August 31 in the local Civil Hospital. On the same day, a protest march would also be taken out in the town and an effigy of the minister concerned would be burnt.

He said the association would intensify the agitation by holding a state-level demonstration in Chandigarh and protest demonstrations at the district headquarters throughout the state in September and October.

Meanwhile, a section of the local lawyers has condemned the campaign against Mr Kanjhla. Mr Daljeet Singh Sekhon, advocate, who issued a note signed by lawyers, said the agitation by the doctors was a part of the “conspiracy” to malign the image of Mr Kanjhla.

At the time of power cuts, the receiver of the telephone at complaint centre is also reportedly off the hook.

Due to power failure in early morning as well as late at night the water supply is the worst affected. The majority of the residents depend upon the water supplied by the Municipal Council for their daily need. Though the Municipal Council have three water tubewells to cater to the needs of the town, but has only one water tank and one or two of them mostly remain out of order. The council has installed a powerful generator set only at water tubewell Sirhind Mandi, but this generator has never functioned properly. The staff posted at tubewell says this generator is out of order since it has been installed. They say the council has fixed a limited quota of the diesel for the genset, accordingly it could be operated only for few hours.

But the sources say that the bogus bills of thousands of rupees for repair, maintenance and diesel are made every year. Where as the generator has never functioned.

When contacted the Executive Officer, Municipal Council Sirhind said the reason was the council had only three tubewells for the entire town. Due to the new water supply lines laid in new areas, the pressure of the water has gone low. He said two more new tubewells were needed if proper supply had to be maintained. He said there was also staff shortage at tubewells.

When asked about the nonfunctioning generator at tubewell and the amount spent on its maintenance, he directed the accountant to give the figures, but the accountant refused to give any detail. He said that no separate account was maintained for the generator set installed at tubewell.

Meanwhile, the residents of Sirhind and Mr R.N. Sharma, president, local Citizens Welfare Council, has demanded that as water was the basic necessity of life, so it was the duty of Municipal Council to provide clean drinking water to the citizens.

But the police chief has not taken any step to implement the Chief Minister’s order, said the BJP MLA, Mrs Lakshmi Kanta Chawla, talking to The Tribune here today. 

She said the Chief Minister had issued the instructions in her presence on August 22.She had also presented the kith and kin of crime victims before the Director-General of Police, Mr Sarabjit Singh, when he visited the city on August 14. But was shocked at the apathetic attitude of the DGP, she emphasised.

Giving details of the murders Mrs Chawla said a young salesman Rishi Kapoor was shot dead last year on the busy Lawrence Road in broad daylight. The police has yet to trace the assailants.Recently a young couple was murdered in their house at Judge Nagar in the Gopal Nagar area. Besides this a young daughter of a sweeper Vijay Kumar has been missing from the Shivala Bhaiyan Temple for the past three months. Top

 

Four administrative  complexes planned

BARNALA, Aug 28 — The Punjab Urban Development Authority (PUDA) will construct four district  administrative complexes at the Patiala, Sangrur, Hoshiarpur and Kapurthala district headquarters within  one year utilising surplus government land.

This was disclosed by Mr Ranjit Singh Balian, Minister of State for Housing  and Urban Development, Punjab, while addressing a press conference after delivering his key-note address at the first inter-city meeting of Rotary  District-3090, here yesterday.

Mr Balian said PUDA would spend Rs 20 crore  on the construction of the administrative  complex  in Patiala in 13 acres adjacent the jail complex.

He said Rs 12 crore  would be spent on the construction of the administrative  complex  Blocks II and III  and Government  Girls School at Sangrur and Rs 5 crore in Hoshiarpur.

Earlier, lauding the role of the Rotary Club, Barnala, for its remarkable contribution in the field of social service and community development projects, Mr Balian announced a grant of Rs 50,000 to it.

This was     stated by  Mr Bikramjit Singh, Principal Secretary for Home Affairs and Justice, Punjab, in an exclusive interview with The Tribune at the Punjab Police Academy here immediate after the passing-out parade function yesterday.

He ruled out any possibility of revival of terrorism in Punjab though Pakistan was conspiring against India through the ISI.

Replying to a question he claimed full coordination with neighbouring states and regular meetings of state police chiefs. He denied the reports of increasing crime in Punjab and described these as rumours only. He said there was no proposal to abolish police districts.

When asked to comment on the introduction of police commissionerate system in Punjab, the Home Secretary said this proposal was only under discussion and moreover, the present system was doing well. He denied the reports of serious differences between IAS and IPS lobbies in Punjab.

However, he stressed the need of amendments in police law according to requirements and the changing social situation. He said the Punjab Government had also set up a law commission. Academy Director A.A. Sidiqui, IG G.S. Aujla, Mr D.R. Bhatti, Mr Chander Shekar were also present.

Proceedings against firm quashed

CHANDIGARH, Aug 28 — Allowing a petition, Mr Justice S.S. Nijjar of the Punjab and Haryana High Court today quashed the proceedings against a Faridkot-based firm pending before the Chief Judicial Magistrate on the basis of a complaint under the Insecticides Act.

In his petition, Kissan Brothers had earlier stated that a sample of weedicide, manufactured by Rallies India Limited, taken by an inspector on November 23, 1998, was declared misbranded even though the seal of the container had not been opened.

Pronouncing the orders, Mr Justice Nijjar held that in similar circumstances, this court had quashed the proceedings on the ground that once it was found that the insecticide was properly stored and was acquired from a licensed manufacturer in a sealed container, respondents would not be allowed to file a complaint on the same set of facts.

“It was held that the filing of a complaint would be an abuse of process of the court. The matter is, therefore, squarely covered by the judgement. In view of this, the petition is allowed. The proceedings pending in the court of the Chief Judicial Magistrate at Faridkot on the basis of the complaint are hereby quashed”.

Dalee, secretary and joint secretary of the association, respectively, said it was a matter of concern for the lawyers that the district administrative complex, the construction of which began after the district judicial complex, had already been completed a few months ago while the latter was still lying incomplete due to the non-allocation of requisite funds.

They further alleged that the state government had not fulfilled its promise to complete the judicial complex by June 30 this year despite making a commitment with the Chief Justice of Punjab and Haryana High Court in this regard during his visit to this town a few months ago.

Both leaders said the state government had also failed in starting the construction of chambers for the lawyers so far though several representations in this regard had been sent to the state government and the judicial authorities.

Jalandhar GM (T) promoted

JALANDHAR, Aug 28 — Mr C.R. Kataria, General Manager, Telecom,  Jalandhar district has been promoted as Principal General Manager, Telecom. He was initially posted as Principal General Manager (Operations) in the circle office at Chandigarh. His orders have now been modified and he has been posted as Principal General Manager, Jalandhar, by  diverting the post of the Principal General Manager (Operations) from the circle office to Jalandhar. He has assumed charge of the new post from August 22.

Five killed in road mishap

CHANDIGARH, Aug 28 (UNI) — Five persons, including four children and a woman, were killed and eight others seriously injured today in a road accident on the Chandigarh-Ludhiana highway, about 18 km from Khanna town, official sources here said.

The mishap occurred when a speeding car skidded off the road and crushed the victims to death on the spot after the driver lost control over the vehicle while overtaking a bus, the sources said.

The ill-fated children were playing about 15-feet from the highway, while the deceased woman was sitting under a tree along with other women near their jhuggis when the car hit them.

The seriously injured, including seven women and a child, have been admitted to the Civil Hospital at Samrala.

Stepfather held for raping minor

JALANDHAR, Aug 28 (UNI, PTI) — A man, who enticed away his minor stepdaughter from home here a month ago, was caught by the Delhi police on August 26 and was booked yesterday by the city police on a charge of raping her after abducting, the police said.

Ram Milan Yadav of a village in Sultanpur district of Uttar Pradesh, who had been living with Kashmir Kaur since 1994 after the death of her husband Mangal Singh in 1991, enticed Kashmir Kaur’s daughter from her first marriage and took her away in a car on July 28. After going to Mumbai, Goa and other places, he started living with his stepdaughter in Delhi’s Kalyanpuri area from where he was caught and the girl rescued on August 26, the police added.

The two were brought here next day at police station division No 4 and registered a case under Sections 363/366 and 376 of IPC against Ram Milan Yadav.

The girl has been restored to her mother, who has another daughter from Yadav, the police added.

Meanwhile, Punjab Police has arrested two persons for raping a minor girl in Mallian Khurd village in Nakodar yesterday.

It was reported by the father of a minor girl, aged 15-16 year, that his daughter, who had been living with her maternal uncle in Mallia Khurd village, had been raped by three youths.

It was alleged in the FIR that on August 27 at about 5.30 am when the girl went to the nearby fields three persons over-powered her and took her to fields.

Mangat Ram Alias Mangu, allegedly raped the girl and his brothers helped him in the crime by pinning her down. The girl raised an alarm and upon hearing her cry some persons came to her rescue. However, after seeing them the perpetrators ran away. A police party arrested Mangat Ram and Roshan Lal, today. The third culprit is still at large.

Trust officials, residents clash; cases registered

BARNALA, Aug 28 — In a clash between Improvement Trust officials and Dalit residents of local Aabe Basti yesterday the police had to register cases against the two parties involved.

The police has registered a case against Mr Rupinder Singh Sandhu, Chairman, Improvement Trust, Barnala under Sections 307, 148, 149, 452, IPC, following a statement by Pritam Singh, a Dalit resident of the basti, who sustained injuries in the clash. His statement was recorded in the Civil Hospital, Barnala in presence of Mr S.S. Mann, Judicial Magistrate first class-cum-Duty Magistrate, Barnala under Section 32 of the Indian Evidence Act.

Pritam Singh alleged in his statement that Mr Sandhu sprinkled kerosene over him and then lit a fire.

On a complaint lodged by trust officials the police registered a case against residents under Sections 307, 353, 186, 309, 148, 149, IPC, alleging that Pritam Singh himself poured kerosene and put himself on fire.

Mr Ajaib Singh Kaleka, senior Superintendent Police, Barnala police district, when contacted today, said he had ordered a probe into this incident. He said the probe team would be headed by Lakhwinder Singh S.P. (Detective), Barnala.

Meanwhile, the Bar Association, Barnala, is reported to have staged a  demonstration in front of the office of the SSP, Barnala demanded withdrawal of case against Mr Sandhu who is a lawyer at the local court.Top

 

School principals seek Class I status

MALERKOTLA, Aug 28 — The Gazetted Educational School Services Association has demanded Class I status for school principals.  In a press note issued here today Mr Joginder Singh Aulakh, state president of the association, alleged that the Punjab Government was giving a stepmotherly treatment to the school principals. He said the college lecturers, DPROs, medical officers and ETOs were given Class I status while they were drawing a lower pay scale than the school principals.

He said the principals were deprived of their rights as the Fourth Pay Commission had recommended a Class I status for them. He appealed to the Education Minister, Punjab, to intervene.

PHILLAUR, Aug 28 — Lt-Gen Kamal Dawar has appealed to all industrialists to come forward for the manufacture of Army equipment and work for the nation. Talking to the  reporter at Hotel Lilly Resorts after attending  the installation function of the Rotary Club Phagwara (South-East) yesterday.

Mr Dawar said the Army was  organising a seminar on “Army Industry Partnership in New-Millennium and an exposition in collaboration with the CII on September 13 and 14 at Chandimandir, near Chandigarh.
