CHB told to pay 18 per cent interest on deposit

CHANDIGARH, Jan 27 — In a landmark order, the UT Consumer Disputes Redressal Commission has ordered the Chandigarh Housing Board to pay 18 per cent interest on earnest money deposited by a cooperative housing society in Sector 48-A. The money was deposited before January, 1992.

The cooperative society in a complaint had said that the housing board failed to provide minimum facilities to facilitate construction.

The interest will be paid from the date of deposit till the time the Chief Engineer or an officer below him issues a certificate that the site was now fit for construction.

The order also says that the CHB will not be entitled to recover the ground rent so long as the certificate was not issued.The commission also noticed that " there is a provision of 5 per cent rebate on the land cost where the payments have been made in time, the complainant is obviously entitled to this concession.''

The commission asked the board to take this into consideration and calculate the amount payable to the society within three months.

Mr J.B. Garg, president and Mr Sada Nand and Mrs P Ojha, both members of the commission, respectively, gave the order on a written complaint filed by Jeewan Adhaar Cooperative House Building Society through its secretary Mr B.M. Maini and the Blossom Cooperative House Building Society.

In the complaint it was alleged that the UT Administration notified a scheme of allotment of land to cooperative societies. The land for construction of residential houses was to be developed by the Administration through the Engineering department.

The land was to be allotted to be societies before May, 1992. However the formal possession was delivered in Sector 48 in September, 1995.

The major allegations of the society were that the zoning plan was not finalised till September, 1995, revised in October, 1996, though the allotment was made in December 1994; arrangements for water drainage scheme were not made; there was no electrification in Sector 48-A ; the UT Administration was unable to provide water connection which disabled the complainant from starting construction at the site; and that the roads were not laid at the site till the complaint was instituted.

The cooperative societies demanded compensation on account of deficiency in service and for want of essential services despite receiving 25 per cent of the price.

The Jeewan Adhaar Cooperative will receive Rs 5,000 as costs of the proceedings while the Blossoms Society will receive Rs 4,000.Top


 

Centre clears Sinha's appointment

CHANDIGARH, Jan 27 — While the Union Government has cleared the appointment of Kumar Anugreh Prasad Sinha as new Joint Secretary Finance, Chandigarh Administration, it has reportedly returned the file pertaining to appointment of a new Commissioner, Chandigarh Municipal Corporation.

The Administration had proposed the name of Mr Kirpa Shankar Saroj for the post of Commissioner, CMC. Mr Saroj belongs to Punjab and is from the 1989 batch of the IAS. The Administration may solicit another panel from Punjab before recommending another name to the Union Government. The present incumbent, Mr Satish Gathwal, who belongs to the UT cadre, has already completed his tenure here.

The orders of appointment of Mr KAP Sinha, an IAS officer of the Punjab cadre belonging to the 1992 batch, have reportedly been received by the Administration. Once the Chandigarh Administration issues his formal appointment order, he will be relieved by the Punjab Government.

The post of the Joint Secretary Finance had been lying vacant ever since Mr Sanjay Kumar, was recalled by the Punjab Government. Since then the Administration had been making ad hoc arrangements from within the available manpower. Mr Prithi Chand, a PCS officer, who is also Director Social Welfare, had been holding the additional charge of Joint Secretary Finance.

The Ministry is also understood to have cleared the appointment of Mr Ashok Khemka, an IAS officer of Haryana, for appointment as Chief Executive Officer, Chandigarh Housing Board. The post had been lying vacant ever since Mrs Asha Nayyar was repatriated to her parent UT cadre some months ago. For some months, the charge was given to Mrs Rinku Dugga, who has already gone back to her parent UT cadre. At present, Mr M.L. Sharma has been holding the charge of CEO in addition to being Secretary, Chandigarh Housing Board.

Meanwhile, the Chandigarh Administration, in pursuance of the order of the Central Vigilance Commission (CVC), has appointed Mr R. Ashok, Additional Secretary, CVC, as Enquiring Authority in the Sector 32 Government Medical College Hospital case. An enquiry conducted by the UT Administration had pointed out several irregularities in allotment of works at this prestigious project.

The enquiry had held that an electrical contractor was given civil contracts while civil contractors were elbowed out of the competition. On the basis of the enquiry, the CVC had recommended major penalty proceedings against the then Chief Engineer, Mr K.K. Jerath, and others.

The Enquiring Authority will look into various charges against Mr K.K. Jerath and others in the matter pertaining to various irregularities in the allotment of civil works. Top


 

Sagar: help in planned growth of city

CHANDIGARH, Jan 27 — The Adviser to the Administrator of Chandigarh, Mr Jagdish Sagar, has called upon people to help the Administration maintain law and order and contribute in the planned development of the city.

The Administration has tried to give clean governance to the people by taking stringent action in public interest wherever required, he said while addressing the Republic Day gathering at the Sector 17 Parade Ground here yesterday.

Mr Sagar said that the Administration had decided to provide basic amenities to old houses constructed near the "abadi" outside Lal doras" of villages where the beneficiaries will bear the cost of the facilities provided. The Administration would take stringent measures against any new illegal construction to ensure planned development of the city instead of haphazard illegal constructions. The Administration would also develop 1850 acres of land between the city and SAS Nagar. Nearly 500 acres of land was being acquired in Jhumru, Palsora, Burail, Kumbra and Kajheri villages while another 300 acres of land was being developed in Sector 38 by the Chandigarh Housing Board to provide shelter for 1.5 lakh people.

Mr Sagar also talked about metalling of roads, construction of new bridges and commissioning of new tubewells in villages of the UT. He said new school buildings were being constructed in Darua, Mauli Jagran, Dadu Majra, Dhanas and Burail villages. Five schools had been provided multi media computers while Principals of a number of rural schools were sent out for refresher courses to introduce new teaching techniques to make education interesting.

For four villages within the municipal limits, new building bylaws are being drafted.

The fourth phase of the water supply augmentation scheme had been approved. Giving details about water supply, he said 18 places had been identified to improve water pressure by installing booster pumps at 10 places. New pumping machines were proposed for the sectors 12 and 26 waterworks. Mr Sagar also talked about construction of a new grain market and the second Inter-state bus terminus in Sector 43. The Ministry of Surface Transport had cleared the construction of a flyover at Transport roundabout. A new community centre had been constructed at Mani Majra.

Mr Sagar said work was in progress to complete 2,666 units at Mauli Jagran to rehabilitate jhuggi dwellers. Allotment work for rehabilitation of people living in Shaheed Bhagat Singh colony, Karsan and Sector 31 has been completed. As many as 4900 units were being developed to rehabilitate people living in Kumhar and Janata colonies.

He said that roadside auto mobile mechanics and workers were also being given sites for their permanent rehabilitation. Similarly, those engaged in informal avocations had also been identified and they would be issued permanent identity cards.

Mr Sagar also talked about holding of an international conference to celebrate Chandigarh 50 years of the idea.

CBSE Class X exams from March 5

CHANDIGARH, Jan 27 — The annual secondary school (Class X) examination of the Central Board of Secondary Education will commence with English ( courses A and B) paper on March 5.

The first examination of senior school certificate (Class XII) will also be English (both core and elective). It is scheduled for March 4. This will be followed by the elective and core papers in Hindi, French and Spanish on March 6.

The first paper of Class X will be followed by the social science paper on March 9. Science examination (with and without practical) will be conducted on March 16; mathematics on March 20; Arabic and Sanskrit on March 22; and Hindi on March 26.

The minor papers of commerce, including elements of business, elements of book-keeping and typewriting will be conducted on March 12; Urdu, Punjabi, Bengali, Tamil and other languages including music on March 24; and Sindhi, Spanish, Portuguese, Limboo and home science on March 31.

Practical examination for regular candidates in science, music and home science will be conducted internally at the school concerned. Practical examination of private candidates will be held at the theory examination centres. The candidates will have to meet the principals of schools concerned for dates and time before the theory examination are over.

In commerce, the candidates have the option to offer either elements of business or elements of book-keeping and accountancy or typing. The results of both examinations will be declared in June.

The last theory examination of Class XII is scheduled for April 7. Examinations for both classes will be conducted in the morning session.

The practical examination in certain subjects are to be conducted according to a handbook supplied by the board. These papers include physics, chemistry, biology, geography, home science, agriculture, painting, graphics, commercial art, psychology, physical education, music, dance, computer science, sculpture and other vocational subjects.

Practical examination for regular candidates in all the subjects will be conducted by schools for their own candidates in the first and second week of February.

Centres for subjects of practical examination offered by private candidates will be the same as the centres of their theory examination. The candidates are required to be informed well in time about the date of their practical examination. The examination for private students has to be completed by April 12.Top


 

Miscreants damage hospital property

PANCHKULA, Jan 27 — At least 12 persons armed with lathis, hockey sticks and knives roughed up an employee of the local General Hospital today and damaged hospital property before escaping on their vehicles.

The police suspects the involvement of these miscreants in an alleged gang rape of a 44-year-old woman at Bhainsa Tibba village here. However, in both the cases the police has registered separate FIRs.

The miscreants, who came on scooters and a Maruti van to the hospital, had brought along an injured accomplice for treatment.

According to hospital sources, the injured accomplice was bleeding from his head. While the doctor on duty was attending to the injured person, the other persons, who were in an inebriated state abused the hospital staff and even misbehaved with a staff nurse, Ms Kusum Sharma.

The problem started when the doctor tried to inform the police about the case. This reportedly enraged the miscreants who broke window panes of the hospital and damaged a vehicle of the hospital before escaping.

The SMO of the hospital, Ms Kamla Singh, said the administration had been requested to provide a permanent police post at the hospital to prevent any such incident in the future. Meanwhile, sources said it took the police party more than 30 minutes to reach the hospital.

A case under Sections 148, 149, 332, 353 and 427 of the IPC, has been registered.

Mr Alok Mittal, SP, said three police personnel had been posted at the hospital. According to information available, the accused had earlier visited the house of the woman at Bhainsa Tibba and threatened her over a property dispute. They gang raped her and while the victim was trying to resist one of the miscreants was reportedly injured.

The victim in her statement to the police said she and her son-in-law, Kulwinder, had been living at the house of his maternal grandfather at the village. His grandfather owned about 7 marlas at the village which he sold to a property dealer, who further sold it to Santosh Kumari. The sale of land was challenged by relatives of the victim at the court.

On the basis of the statement given by the victim, a case has been registered under Sections 148, 149, 324, 326 and 376, IPC.Top

New office-bearers for PUSU

CHANDIGARH, Jan 27 — It was introspection time at a meeting of stalwarts and members of Panjab University Students' Union (PUSU) which was held at Student Centre, Panjab University, to appoint office-bearers and give a younger image to an old union, here today.

The veterans of the union discussed at length the future course of action with most speeches liberally peppered with references to PUSU's days of glory.

Kuljit Singh Nagra said the students' mandate this year was a clear indicator that the office-bearers had failed to perform their duties when they were elected to the Student's Council, and infighting among members was the primary cause for the deterioration. Certain members of PUSU had sacrificed the party at the alter of their own selfish ends, he alleged.

He felt that the union could be revived only if each member established a rapport with the students, mixed around with them and worked to solve their problems.

Jatinder Virk said that the secular nature of PUSU had helped it survive during trying times. He said keeping in mind the changing times, it had become mandatory to involve women in the working of the union.

Another "senior", Rajinder Deepa, said they watched the working of PUSU from the sidelines and were there to render any help it needed. He stressed that the need was for sincere and dedicated workers to come forward.

Mr Jaskaran Singh Brar, who was chosen the chief patron of the union announced the names of the office-bearers of the union. The office-bearers are: chairman — Mr Vipan Kamboj, president — Mr Lakhjeet Singh, convener — Amandeep Bawa, general secretary — Mohan Singh ‘Mohini’, chief patron — Jaskaran S. Brar, patron — Jatinder Virk and Kuljit Singh Nagra, chief advisor — Rajinder Deepa, advisor — Ajit Singh Virk and Binder Singh.

The interviews will now be held on March 4 and 11.

Free eye camps from Feb 1

CHANDIGARH, Jan 27 — As part of the national programme for control of blindness, the UT Health department is organising free eye care camps at 21 rural and slum areas in the city beginning from February 1.

Dr Jaspal Singh Gill , State Programme Officer of the local unit of the blindness control programme, said a meeting of NGO's comprising Lions Club International, Rotary clubs, Citizen Awareness Group, Vishva Kalyan Sabha and other social organisations was chaired by the Director Health Services UT today.

The camps will be held on February 1 at Dadu Majra colony and Mauli Jagran; February 2 at Maloya colony, Indira colony and Colony no 4; February 3 at Khudda Lahora and Bapu Dham colony; February 4 at Kumhar Colony, Kishengarh and Dhanas; February 5 at Burail and Kaimbwalla; February 8 at Kajheri and Ram Darbar; February 9 at Colony no 5, Hallo Majra and Khuda Ali Sher; February 10 at Badheri and Makhan Majra; February 11 at Palsora and February 13 at Attawa. Pre-arrest bail for DETC

CHANDIGARH, Jan 27 — The Punjab and Haryana High Court today directed the Investigating Officer to release Mr Mukesh Gambhir, Deputy Excise and Taxation Commissioner (DETC), Faridabad, on bail in the event of his arrest.

Mr Justice R.L. Anand, who handed down this order, also directed that Mr Gambhir would join the investigation as and when required. He would not tamper with evidence and leave the country without the permission of the Chief Judicial Magistrate. The Judge also ordered that Mr Gambhir surrender his passport, if he held one, to the I.O.

The Haryana Department Vigilance had booked Mr Gambhir under the Prevention of Corruption Act on November 26, 1998. A case was registered against him at the Central Police Station in Faridabad.

Explaining his assets, Mr Gambhir had stated that he had acquired them through the income of his wife, Dr Renu Gambhir, who was a class-I officer and had a good income. He also said he had inherited assets, including gold, cash and immovable property from his mother.

During the course of arguments Mr Gambhir's counsel told court that his client apprehended that the police would subject him to third-degree methods if he was handed over to it.

Earlier, his wife, Dr Renu Gambhir, had sent a letter to Mr Justice R.L. Anand who had converted it into a petition and ordered an inquiry into the conduct of Vigilance Department officials.

Notice to DRME on appointment

Our Legal Correspondent adds: Dr Rachhpal Singh Deol, Member of the Punjab State Homoeopathic Council, challenged the appointment and nomination of Dr Baljeet Singh, former Director of Research and Medical Education, Punjab, as chairman of the Punjab Homoeopathic Council.

A Division Bench comprising Mr Justice J.L. Gupta and Mr Justice N.C. Khichi issued notice of motion for March 3, to the state of Punjab, the Director of Research and Medical Education (DRME) and Dr Baljeet Singh.

It was submitted on behalf of the petitioner that the respondent, Dr Baljeet Singh, had been nominated as chairman by the state of Punjab in utter disregard of the various provisions of the Punjab Homoeopathic Practitioners Act, 1965, and that the chairman by virtue of his acts and conduct has brought a bad name to the institution.

The petitioner pointed out that the respondent-chairman issued a show cause notice to the Principal of the Homoeopathic Medical College, Chandigarh, without consulting any member of the council, disaffiliated it for admission for 1998-99 academic session.

He allegedly constituted a board of studies without consulting members. He also appointed three allopathic doctors as inspectors, including his own wife who is Principal of Rajindra Medical College, Patiala, for inspecting homoeopathic institutions.

He allegedly appointed his wife as inspector to put undue pressure on homoeopathic institutions.

Even papers for the 1998-99 academic session were checked at Rajindra Hospital. The Registrar of the council was appointed without any meeting of the council, the petitioner alleged.

The petitioner sought the issuance of a writ of quo warranto for direction to the respondent to vacate the public office which he was illegally occupying.

Validity of KU course upheld

Mr Justice H.S. Bedi today tried the B.A. (one-sitting programme) introduced by Kurukshetra University as valid for 1996 and allowed the writ petition of Ms Devinder Kaur, who had passed the B.A. examination in one year instead of usual three years, admission to the B. Ed course.

She appeared in April, 1996 in all 12 papers which constituted the course and cleared the examination. She applied for admission to B.Ed course from a college affiliated to Punjab University, which was however, rejected on the ground that she had passed B.A. degree in one sitting. Aggrieved by this, the petitioner approached the High Court.

Mr Justice Bedi observed that to my mind the petitioner was fully entitled to seek admission on the basis of her B.A. (one setting) degree.

The Judge highlighted the fact that the one sitting B.A. programme was introduced by the university to meet a particular situation and its validity had been limited up to 1996 by the Supreme Court as also by the university themselves. It was meant for those persons who could not continue their higher education after 10+2 due to various reasons.

The judge directed the respondents to consider the candidature of the petitioner on the basis of her ranking in the joint entrance test, 1998, provided she fulfilled other conditions of eligibility.Top

Six killed, 23 hurt in road mishaps

CHANDIGARH, Jan 27 — Six persons, including three tourists from Mumbai, have died and 23 persons have been injured in three different road accidents in the city and its periphery since last night.

The Mumbai-based tourists were travelling in a jeep ( MH-02-K-8246) that collided with a truck on the Chandigarh-Ambala road near Lalru town, 35 km from here. Three of tourist — Mr Abdul Wahid, Mr Abdul Razzak Ibrahim and Mr Ismail Ibrahim — died on their way to the PGI here. The condition of the other three, who were also travelling in the jeep, is said to be stable. The injured — Mr Mussa, Mr Asthan and Mr I.L. Sahid — were admitted to the PGI.

The incident took place around 1.30 this morning. The Mumbai-based tourists were returning from Manali after a holiday. The jeep was headed towards Ambala when a truck coming from the opposite direction hit their vehicle.

The truck was overtaking another vehicle, according to police sources. The truck belongs to a Dera Bassi-based person. Police parties have been despatched to nab the truck driver.

In an accident involving a Punjab Roadways bus and a truck near Ropar, two persons were killed on the spot while 20 others were injured. The deceased have been identified as Mr Karam Singh of Jhallian village, near Khamanon, and Mr Mandeep Singh of Sihara village in Ludhiana district.

One of the injured, Ms Kulwinder Kaur, was rushed to local General Hospital. The others were discharged after first-aid.

According to sources, the accident took place at 7.30 a.m. when the ill-fated bus coming towards Chandigarh collided with truck coming in the opposite direction. The truck driver, against whom the Kharar police has registered a case, managed to escape. The truck has been impounded.

Meanwhile in Chandigarh a scooterist was crushed to death after being hit by truck on the busy Chandigarh-Panchkula road on Wednesday morning. The scooterist, Mohit of Sector 12 Panchkula, was hit by a truck. He died on the spot.

Two cops dead: Two persons, including a Head Constable of the Central Reserve Police Force (CRPF), have died in separate incidents. The CRPF jawan, Arvinder Singh, was found dead inside the Inter-State Bus Terminus (ISBT) in Sector 17.

Meanwhile, an unidentified person was electrocuted in Ram Darbar in the evening.

Stolen: A VCR, jewellery and other household articles have been stolen from a Sector 11 house while the owner, Mr Sukhwinder Singh, was away. The theft took place on the night intervening January 25 and 26.

Assaulted: Two persons have allegedly been assaulted in separate incidents in the city. Mr Hari Singh of Burail village alleged that he was assaulted by Rajinder and Devinder Singh of Sector 35. Mr Babu Ram of Madrasi colony, near Bapu Dham colony, Sector 26, alleged that he was assaulted by Anil Kumar of the same locality.

Case registered: A case of trespass has been registered against Kaka Singh and his son, Narinder Singh, for allegedly trespassing into a house in Badheri village.Top


 


MC meeting adjourned amid bedlam

CHANDIGARH, Jan 27 — Amid protests by the councillors belonging to the BJP-SAD alliance over seeking of confidence vote by the Mayor, Mr Kewal Krishan Addiwal, the meeting of the Municipal Corporation of Chandigarh had to be adjourned again today.

As soon as the meeting, the first to be chaired by Mr Addiwal, started, a former Mayor, Mr Gian Chand Gupta, who along with Mr Mohinder Singh(SAD) had sent the supplementary agenda urging the Mayor to seek the confidence vote, pleaded that the Mayor should seek a vote of confidence. As Mr Addiwal was elected on the minority support securing 12 votes of the 29 votes, rest of the agenda should be taken up only after the confidence vote, he added.

The Mayor and the members of rebel BJP ruling group argued that since the item was on the supplementary agenda, it should be taken after the rest of the items were considered.

They were supported by Mr Harish Bhanot, who was in the Chair when the election for the post of Mayor was held on December 23, and another nominated councillor, Mrs Saudamini Bambah, who said the Mayor had duly been elected as per the law and the main agenda should be discussed first.

This, however, did not convince the BJP-SAD members, who were on their feet and reiterated their demand that the Mayor should seek the confidence vote as he was in the minority. Certain nominated members, who tried to reason with the alliance members, were shouted down.

When Mr Mohinder Singh wanted to second the "resolution" of Mr Gupta, Mr Addiwal ruled that since the resolution had not been moved, it could not be seconded. He then adjourned the House for tea amid protests by the BJP-SAD members.

When the House met again the story was no different. Allegations and counter-allegations between the BJP-SAD alliance and the ruling group followed with the former Senior Deputy Mayor, Mr Prem Sagar Jain, alleging it was due to the presence of workers like Mr Gupta that the image of the BJP had taken a beating. BJP councillors charged the ruling group with deceiving the electorate and running the House in an "autocratic" manner.

At this moment, Congress councillors — Mr Raj Kumar Goel, Mr Gurcharan Dass Kala and Mrs Kamlesh-- were also on their feet and alleged that the two groups, while indulging in the petty politics, had brought the working of the civic body to a "standstill".

As the allegations and counter-allegations continued, the Mayor expelled the leader of the alliance, Mr Des Raj Tandon, for disrupting the proceedings of the House and summoned the marshal. However, strong protests by the alliance members kept the marshal at bay, and Mr Tandon continued to defy the Chair.

Seeing that there was hardly any chance for the smooth running of the House, the Mayor adjourned the meeting after two and a half hours of fruitless discussion.

Later, Mr Addiwal said today's developments had shown that the alliance was least interested in the development of the city. Mr R.L. Arora, leader of the ruling group, dared the alliance to move the no-confidence vote.

The president of the SAD, Mr Gurpartap Riar, announced that the alliance would not let the "minority Mayor" to work. The no-confidence motion would be brought against the Mayor if need be, he added. Mr Tandon resented personal remarks of Mr Jain against certain members of the alliance.Top
