Striking staff "to face" serious action

CHANDIGARH, Dec 12 — Although the exact number of employees who went on strike in Haryana yesterday in response to the call given by various trade unions, including the Haryana Sarvkaramchari Sangh, will be known only by Monday, those belonging to the departments offering essential services are certainly in for serious action.

Provisions of the Essential Services Maintenance Act had been invoked in respect of certain departments/organisations, including the Haryana Vidyut Prasaran Nigam and Public Health, to ensure normal essential services to the people of the state, says Mr R.S. Varma, Chief Secretary.

In the case of striking employees of other departments who had been marked absent by heads, the normal principle of "no work, no pay" will be made applicable, Mr Varma adds. However, he says, the number of absentee employees was very small as the attendance at most of the places in the State was more than normal. The Punjab and Haryana High Court, he recalls, has already upheld the principle of "no work, no pay".

HC fines judge for violating orders

CHANDIGARH, Dec 12 — The Punjab and Haryana High Court has slapped a fine of Rs 1,000 on Mr M.M. Sharma, Additional District and Sessions Judge, Rewari, for violating the orders of the District and Sessions Judge of Narnaul, staying proceedings in the court of Mr Sharma in a case filed by Mr Dilawar Singh, Assistant Food and Supplies Officer, Rewari.

Allowing a contempt petition filed by Mr Dilawar Singh, Mr Justice N.K. Sodhi, who delivered this order, observed: "The question that now arises is what should be the punishment that should be awarded to the Additional District Judge. Considering the fact that he is a senior judicial officer with long standing, I punish him with fine of Rs 1,000."

On a request made by counsel for the Additional District Judge, Mr Justice Sodhi stayed the operation of his order for a period of two weeks to enable Mr Sharma to file an appeal.

The Assistant Food and Supplies Officer, Rewari, was placed under suspension on December 31, 1997, by the departmental authorities. He had challenged the order of his suspension in a civil suit filed on January 6, 1998, which came up for hearing before the Civil Judge (Senior Division), Rewari, on January 8, 1998. An application for the grant of ad-interim injunction seeking to restrain the defendants in the suit from implementing the order of suspension was also filed. While issuing notice to the defendants, the court had restrained them from implementing the impugned order.

Feeling aggrieved by the ex-parte order of injunction, the department preferred an appeal in the court of the Additional District Judge, Rewari, which came up for hearing before the respondent in this contempt proceedings. By his order dated February 9, 1998, the respondent allowed the appeal and set aside the ex-parte order of injunction. The petitioner then filed civil revision No 603 which was disposed of on March 16, 1998, with a direction to the trial court to dispose of the application for ad-interim injunction within two weeks from the date of receipt of the order without being influenced by any observation made by the respondent in his order dated February 9, 1998.

The trial court disposed of the application granting ad-interim injunction in favour of the plaintiff. The State of Haryana filed civil appeal in the court of the Additional District Judge, Rewari, which again came up for hearing before Mr Sharma on May 27, 1998. The petitioner had filed a caveat, apart from filing an application for the transfer of his case from the court of Mr Sharma on the ground that the Additional District Judge had already expressed his views while appealing the appeal of the State on February 9, 1998. The District Judge issued notice for June 4, 1998, to the State of Haryana on the transfer application and, meanwhile, stayed further proceedings before the Additional District Judge. The stay orders were conveyed by the Assistant Food and Supplies Officer to the Additional District Judge. However, he went ahead with conducting the proceedings.

As for the affidavit filed by the public prosecutor in support of the Additional District Judge, Mr Justice Sodhi observed; "The district attorney seems to be more loyal to the king than the king himself. I do not want to comment on this affidavit because it is clear from the record that the petitioner had filed a caveat and notice of the appeal had been served on counsel."

CM inaugurates lift irrigation scheme

GURGAON, Dec 12 — The fifth lift irrigation scheme, inaugurated by the Haryana Chief Minister, Mr Bansi Lal, today promises to bring relief to the dry areas of south and south-east Haryana.

These areas in the south and south-east Haryana were drought-prone and had been shifting to sand dunes. The areas used to witness mass migration of humans and cattle. The fifth lift irrigation scheme, known as the Rewari Lift Irrigation Scheme will not only check the spread of the desert in the Ahirwal area of south Haryana, but will also provide additional drinking water in the region. The foodgrain production is also expected to receive a boost following the completion of this project.

It will irrigate 78,790 acres of land across 99 villages lying in Pataudi, Gurgaon, Rewari and Jhajjar tehsils. The Rs 46.50 crore scheme will be funded by NABARD and is slated for completion in March 2000. It will be 128 km in length and have a discharge capacity of 218.15 cusecs and receive water through the Western Yamuna Canal and the Jawaharlal Nehru feeder from Hathnikund barrage.

The parts of Jhajjar tehsil in Rewari district and parts of Gurgaon district receive scanty rain and have undulated topography. The groundwater in these areas is fast depleting and has gone down by 5 to 12 metres. The scheme will provide adequate irrigation water in the project area that has so far no canal system to irrigate the parched tracts.

Laying the foundation stone of the scheme near Brijpura village, Mr Bansi Lal said his government had started work in the Hathnikund barrage. He said he was himself monitoring the progress of the project and was hopeful it would be ready by June.

Mr Bansi Lal said the scheme was an important project and Rs 668 crore had been spent on improving the irrigation and drainage system in the state.

Referring to the steps taken to improve the availability of power, he said the promise of providing power round-the-clock might be fulfilled in a month or two earlier than in July. Mr Bansi Lal said tenders to set up two units of 250 MW each at Yamunanagar had already been received and that these would be evaluated soon. Four units of 110 MW each at Panipat thermal plant were being renovated, he added. After the renovation these four units were expected to generate an additional 250-270 MW of power.

Mr Bansi Lal disclosed that an agreement had been signed with Indian Oil Corporation for getting 301 MW of power from its power plant coming up at its oil refinery at Panipat. A 432 MW gas-based power plant was under construction at Faridabad, and its first unit of 143 MW capacity would be commissioned by March. The second and third units were expected to be ready by May and December, respectively, he added.

Mr Jindal, who is busy mobilising support for tomorrow's rally told TNS that he wanted to articulate the grievances of the general public.

Mr Jindal also said that his front was not against any particular caste as was being projected.

The industrial tycoon turned politician said he felt that the common man had no voice. While in the government he was not able to express this.

He felt that the government, of which he was a part until recently, did not come up to the expectations of the people.

Mr Jindal regretted that the opposition had not been effective either, with opposition stalwarts like Mr Bhajan Lal, Mr Om Prakash Chautala and Mr Bhupinder Singh Hooda failing to expose corruption and lawlessness in the state.

He claimed that his proposed rally would be a "grand success" as there was great public resentment against the present government. "They want their grievances aired and I will provide them the platform", Mr Jindal remarked adding that he had no lust for power. He claimed that he had always opposed ruling parties barring the last two-and-a half years. He said he fought Mr Devi Lal and Mr Bhajan Lal when they were Chief Ministers. "Now I do not have any regrets fighting Bansi Lal, when he is the Chief Minister".

Among those scheduled to address tomorrow's public rally here besides Mr Jindal are Mr Ashwani Chopra, Mr Arvind Sharma, Mr Raghu Yadav, Mr Mange Ram Sharma, Dr Prem Kumar Chaudhary and Mr Rajinder Tanwar.

Although there are speculations about four dissident MLAs of the HVP-BJP alliance attending the rally, there was no confirmation from Mr Jindal about this.

Meanwhile, Chief Minister Bansi Lal has cancelled his public rally scheduled for December 13 in Hansi. Official sources claimed that the government did not want to give an impression that it was putting obstacles in the way of Mr Jindal's rally.

Hundreds of vehicles have been pressed into service by the supporters of Mr Jindal to ferry people from different places to Hisar and Mr Jindal, himself, is touring Hisar constituency to garner support for the rally, in which he claims "more than one lakh people will participate".

RLD ‘to continue’ support to BJP

CHANDIGARH, Dec 12 — In spite of the fact that he blamed the BJP leaders for the defeat of his candidates in the recent Assembly elections in Delhi and Rajasthan, the Rashtriya Lok Dal (RLD) President, Mr Om Prakash Chautala, told newsmen here this morning that his MPs would continue to support the Vajpayee Government at the Centre.

Although he said his party had been "cheated" at the polls, "we remain the BJP's friends in adversity". He said Mr Sahib Singh, former Delhi Chief Minister, had put up candidates against his party's candidates in spite of the fact that those seats had been allotted to his party "for contesting officially".

Enumerating the causes for the BJP's defeat, he said the steep hike in the prices of essential commodities, infighting in the BJP itself and non-performance of the Vajpayee Government at the Centre were among the major reasons.

Mr Chautala also alleged that Mr Sahib Singh had openly not only opposed his candidates but had supported the Congress candidates in certain areas to ensure defeat of his candidates.

Talking about the Haryana scene, Mr Chautala said his party would submit a memorandum to the President of India next month on the "misdeeds" of the Bansi Lal Government. While there was rampant corruption in the state, the law and order situation had deteriorated significantly. A murder was committed almost daily, he said. In spite of the fact that money had started flowing into the treasury after withdrawal of prohibition, developmental, activities were at a standstill in the state. While 13,000 tubewells had been disconnected, no new tubewell connection had been given by the present government, he added.

The government, he said, should issue a white paper on development works. As many as 76,000 applications for connections were pending even when test reports had been received.

Haryana was the only state to invoke ESMA, he claimed.

To back up his claim about the deteriorating situation in the state, he also released a copy of the resolution of the Haryana Excise and Taxation Gazetted Officers' Association highlighting the role of politicians and others behind murder of an ETO and also how the officers were feeling demoralised.

He said due to waterlogging alone, 27 per cent of cultivable land could not be utilised.

He also alleged that the Congress President, Mr Bhupinder Singh Hooda, and the Chief Minister, Mr Bansi Lal, were supplementing each other's role. He went to the extent of charging that Mr Hooda's statements released to the press were being prepared by Haryana's PR men.

33 lakh children given polio vaccine

CHANDIGARH, Dec. 12 -- The Haryana Health Department today said it had achieved 112 per cent success in administering oral polio vaccine in the first round of the pulse polio immunisation campaign on December 6 last.

Mr Om Parkash Mahajan, Health Minister, Haryana, said 33,29,378 children were given oral polio vaccine as against 27,06,019 children up to the age of five years during the first phase. He said the coverage in the rural areas was 110.65 per cent while in the urban areas it was 116.15 per cent. In the first phase in the Mewat area, the response of the parents was very encouraging as 1,18,097 children were given pulse polio drops.

Mr Mahajan said that total 9,289 static pulse polio immunisation (PP) posts were set up, besides 524 mobile posts were set up in the state. The Minister said special emphasis was laid on high-risk areas, under-served areas with low routine coverage, urban slums, areas having confirmed polio cases and the area having large influx of migrant population during the first phase of the pulse polio immunisation programme.

Mr Mahajan said Gurgaon district topped in the first phase by administering pulse polio drops to 125.86 per cent children, followed by Panchkula 124.72 per cent while Rewari district remained third by achieving 116.11 per cent coverage.

HUDA directed to refund money

PANCHKULA, Dec 12 — The Consumer Disputes Redressal Forum has directed HUDA to refund Rs 57,525 to a local consumer for failing to give possession of a plot at Sonepat within a stipulated period. HUDA has also been directed to pay Rs 500 as cost.

The forum handed down the order on a complaint filed by Mr Rakesh Kumar Chopra through his GPA, Mr Sham Lal Jain, a resident of Sector 10, here.

The complainant alleged that he had applied for a 14-marla residential plot at Sonepat, and deposited Rs 23,020 as the earnest money. In a draw of lots, he was allotted a plot in August, 1991. A sum of Rs 34,505 more was deposited by him.

He said despite several representations the possession of the plot was not handed over to him. In November, 1995, he received a letter from HUDA, informing him that his plot had been resumed and the amount deposited by him forfeited.

HUDA claimed that the complainant had failed to pay the remaining instalments after which he was issued notices under various sections of the HUDA Act, 1977. A penalty of Rs 3,120 was imposed on the complainant which he failed to pay, it claimed.

Rapist awarded 10-yr RI

KURUKSHETRA, Dec 12 (UNI) — District and Sessions Judge R.P. Bhasin has awarded 10 years’ rigorous imprisonment to Ram Kishan of Gujran village under Pehowa police station on a charge of raping a widow of the same village about three years ago.

According to the prosecution, the accused forcibly entered the house of the widow and after committing the crime fled. He continued to threaten the victim while absconding from the village. The police arrested him after seven months and produced him before the court.

After about two years of trial, the Sessions Court found the accused guilty and sentenced him to 10 years’ imprisonment under Section 376, IPC.

The Judge also awarded three years' imprisonment under Section 452, IPC, and one-year imprisonment under Section 506, IPC, and imposed a fine of Rs 500 under two different sections of the law.

In case of default to pay fine, the accused would have to undergo one month imprisonment. The sentences are to run concurrently.

Computer courses in Sonepat

SONEPAT, Dec 12 — The State Board of Technical Education, Haryana, has decided to start new one-year and two-year job-oriented certificate courses in computer science in this city for the academic session of 1998-99.

The Deputy Commissioner, Mr P.K. Mahapatra told mediapersons here today that the structure of these courses had been designed and developed by the Haryana State Electronics Development Corporation Limited (HARTRON), which is the nodal agency for IT and Electronics Industry in Haryana.

Admission to these courses will be made on merit by the Principal, Government Institute of Engineering, Sonepat. The eligibility is 10 plus 2 pass or equivalent in any discipline. The last date for the receipt of applications is December 15 and the reservation of seats will be as per rules of the Haryana Government, he added.

The Deputy Commissioner also disclosed that the Indira Gandhi National Open University (IGNOU) New Delhi has also recognised this institute as 'Internet Access Point' for MCA, BCA and other courses. These courses, he said, would be started from next month.

He further disclosed that the successful students of this institute will be absorbed in government jobs on priority basis and efforts will be made for their eligibility to admission to MCA.

Cops booked for giving fake certificates

SONEPAT, Dec 12 — The city police has registered a case of fraud and cheating against two newly recruited police constables namely Balbir of Matan village and Rajpal of Rohna village for submitting fake certificates in connection with their educational qualifications.

The Superintendent of Police, Mr K. Selvraj, told mediapersons here today that both the candidates had qualified in the written as well as physical tests and their names were included in the selection list. But when their certificates of academic qualifications were sent to the Education Board authorities for verification, these were found fake.

The two were selected against the vacancies reserved for ex-servicemen.

This was decided at a meeting of the Council of Haryana Institute of Alternative Medicine and Research chaired by the Governor, Mr Mahabir Prasad, at Haryana Raj Bhavan today. The name of the Council had recently been changed as the Council of Indian System of Medicine and Research.

The Haryana Chief Minister, Mr Bansi Lal, the Finance Minister, Mr Charan Dass Shorewala, Minister of State for Ayurveda, Mrs Kanta Devi, and some senior officers of the State Government were also present.

Brother held for killing sister

SONEPAT, Dec 12 — The Rai police has arrested Dinesh of Liwan village in connection with the alleged murder of his unmarried sister Sonu on December 2 in the village.

The Superintendent of Police, Mr K. Selvraj told mediapersons here today that the culprit had confessed that he had committed the murder after suspecting about her character. He told the police that he had taken his sister on scooter for a medical check-up and murdered her on the way. He also confessed that he had burnt the body of his sister.

According to official sources, the Superintendent of the home, Mr Balwant Singh Kataria, has lodged an FIR with the city police in this regard. The police has launched a massive hunt to apprehend the boys.

The district authorities are holding an inquiry.

Re-evaluation to end in PGIMS

ROHTAK, Dec 12 — Maharishi Dayanand University has decided to abolish the re-evaluation facility for the MBBS and BDS students of Post Graduate Institute of Medical Sciences and the decision is likely to be approved at the 144th meeting of the executive council to be held here on December 14.

The Vice-Chancellor of the university, Lt Gen (retd) O.P. Kaushik, had reportedly issued orders in this regard on May 15 last.

Widespread resentment prevails among the medical students of the institute over the decision.

According to university sources, the facility would be withdrawn from the MBBS and BDS examinations commencing from December, 1998.

It is learnt that the university administration has directed the legal branch to visit various universities in the country and study their rules and regulations regarding re-evaluation.

Meanwhile, the university has proposed to set up a separate faculty of dental science. Dental college has been functioning as wing of the faculty of medical science so far.

Sanitation drive by HUDA

GURGAON, Dec 12 — The Haryana Urban Development Authority (HUDA) has launched a special drive for the repair of roads and improving sanitation in various sectors.

The Administrator of the HUDA , Mr Ankur Gupta, said the garbage was being removed from vacant plots, repair of streetlights was in progress and roads were being recarpeted. Mr Gupta added Sectors 4, 7, 15, 31, 17, 23 and 14 had been covered under the drive.

The Administrator said the maintenance of parks in each sector was getting special attention. He added that at present 70 lakh gallons of water was supplied to various sectors through the Basai Water Treatment Plant and its capacity would be increased to 200 lakh gallons when required.

He also said a 30 mld capacity sewerage treatment plant would be started soon at Dhanuawapur.

He urged the people not to litter the vacant plots with garbage and added that the details of the proposed golf course were being finalised.

Sugar mill workers threaten stir

ROHTAK, Dec 12 — Leaders of various sugar mill workers’ unions in the state have warned that work in the mills would come to a standstill if their demands were not accepted by December 15.

A decision to this effect was taken at a meeting held at Cooperative Sugar Mills here today. Meanwhile, three teams of workers’ unions, which undertook a tour of mills in the state reported widespread resentment among the workers.

As many as 21 workers of the sugar mills here held a relay fast for the sixth day today. They have been demanding implementation of revised pay scales, time-scale promotion, 60 per cent retaining allowance, regularisation of the daily-wage workers and recruitment of dependants of deceased employees.

FATEHABAD, Dec 12 — The Haryana Panchayat and Development Minister, Mr Kanwal Singh, has asked the elected women representatives of the panchayats to come forward and take independent decisions for the development of their respective villages.

Speaking at public meetings at Jandwala Sotar, Rattangarh, Bahmanwala and Bhunderwas villages here today. He said decision making by the spouses of these women members defeated the whole purpose of the Panchayati Raj system.

The Minister said the state would become self-dependent in power generation by the end of 1999, and would even sell power to other states.
