Jammu, December 3
Smoking has been banned at public places under Section 4 of the Cigarette and Tobacco Products Act-2003. This was revealed during a meeting, chaired by Additional District Commissioner (ADC) Kalyan Singh. The survey has claimed that in 93 per cent of public places that include private work places as well active smoking was not observed and 87 per cent of the public places have displayed "No smoking" signboards. Kalyan Singh asked the officials to centralise tobacco control efforts and have better coordination between health, education and police departments. He said the Section 6 (B) of the Act, which says "Sale of tobacco products within 100 yards of educational institutions is banned", should be implemented effectively. "The heads of all educational institutions should send the reports to the CEO and police station concerned so that action can be taken on anyone selling tobacco outside educational institutions," Kalyan Singh said. "All officials have been directed to ensure strict implementation of the Act. The enforcement of the law is very important for which all officials concerned will have to issue challans for any such violation under the Act," Kalyan Singh said. In his presence, challan books were given to the SSP, Jammu, by the Drug & Food Control Organisation for effective enforcement of the Act. District coordinator of the Voluntary Health Association of India Muhammad Altaf Dar, who has been working for tobacco control programmes from the last three years in the state, presented the main findings of the survey conducted by the Drug & Food Control Organisation. On March 6, J&K had also banned sale and transportation of "gutka" in the state. The notification was issued by the Commissioner, Food Safety, under clause (a) of sub-section 30 of the Food Safety and Standards Act, which bans manufacture, storage, sale, transportation, display or distribution of "gutka" in the state. Debate on Art 370 intensifies in state
Jammu, December 3 Reacting to Modi’s statement on having a discussion on the Article 370, Minister for Agriculture and president of Democratic Party Nationalist Ghulam Hassan Mir today said to make Article 370 a point of debate would create mistrust among people of Jammu and Kashmir and the rest of the country. The minister said with the efforts of all mainstream political parties and cooperation of the people of the state, J&K was coming out of two decades of turmoil. “All of us, including the
BJP, should work to strengthen the process instead of driving a wedge between J&K and the
Centre. “Our vision should be to bring people of J&K closer to the Centre and strengthen their confidence in the fact that future of J&K is safe under the flourishing democracy of India,” Mir said, adding that Modi’s statement can “increase the trust-deficit between the state and the rest of the
country”. Govt to scrap admission of students who bought papers
Jammu, December 3 “After thorough investigations by the competent authorities, the registrations of the students who gained admissions to the MBBS course through illegal means will be cancelled,” Minister for Medical Education Taj Mohiuddin told The Tribune over phone. Taj said that there would be no leniency with those found guilty. The Minister for Medical Education further said while the matter was being investigated by the Crime Branch, the court would also come out with some directions. He asked the Crime Branch to speed up the probe into the scam and come out with a list of students who got admission after purchasing CET question papers. “As soon as the Crime Branch comes out with the list of students, who secured admissions by paying bribe, their registration would be cancelled then and there,” the Minister for Medical Education said. Ever since the scam was unearthed by the Crime Branch, students of government medical colleges in Jammu and Srinagar have been on a strike. Minister for Medical Education has appealed to the striking students to maintain calm and wait till the probe agency comes out with the facts. The Crime Branch began a probe last month into the case after a complaint alleged that 12 candidates had qualified the CET-2012 by purchasing question papers from a syndicate that included officials close to the then BOPEE chairman, Mushtaq Ahmed Peer. Peer was arrested by the Crime Branch in Srinagar last month after raids allegedly found incriminating evidence from his residences in Srinagar and Jammu. The Crime Branch has also arrested one Sajjad Ahmad Sofi, who had allegedly acted as an agent in the racket. During investigation, the Crime Branch has found that a “special” examination centre was set up at a hotel near the Dal Lake in Srinagar for the candidates who had paid as much as Rs 20 lakh to come out with “flying colours”. CET-2013 PAPER LEAK After the news of the paper leak appeared in a section of the media on June 23, 2013, Common Entrance Test (CET) aspirants lodged protests against the board. The CET is held for various professional courses in engineering and medical colleges of the state and is conducted by Board of Professional Entrance Examinations (BOPEE), an autonomous body. The biology paper was leaked on June 22. The board authorities cancelled the entire examination. On July 3, the High Court issued notices to the Chief Secretary and Secretary, BOPEE, asking them to explain the reasons behind the paper leak. On September 11, the court also summoned entire record related to a previous complaint regarding the misconduct of the CET held in 2012. . |

Srinagar, December 3 The High Court has also directed the Crime Branch to file the latest status report of the investigation into the matter by the next hearing. The orders were passed today by a division bench comprising Justice Mohammad Yaqoob Mir and Justice Muzaffar Hussain Attar. “File the latest status report of the investigation by December 30. Investigate and give details about the movable and immovable properties of the persons, including of their family members,” the HC observed in its orders while directing the Crime Branch authorities to file the status report about the investigation being carried out in the alleged scam in a “sealed” cover. It has also directed the persons named in the scam “not to create any third party interest” in the properties in their names. The persons whose property details, including bank account details, are to be furnished by the Crime Branch include ex-chairman of the Board of Professional Entrance Examinations (BOPEE) Mushtaq Peer, his close aide and kingpin, Farooq Ahmad Itoo, Sajjad Ahmad and Haroon. The court today directed the Crime Branch to forward the list of candidates to the BOPEE authorities, against whom there was strong prima facie evidence so that the Board could take appropriate action in this regard. Refuses to gag media The High Court on Tuesday observed that it could not stop the media from reporting the scam. It observed that the Press had “played a pioneering role” in unearthing the scam. These observations were made today by the HC in the wake of an application by former BOPEE chairman who had pleaded that media should be disallowed from reporting the scam. |

Demanding rehabilitation, the protesters rallied across the City Centre, press colony and Lal Chowk with posters reading: "Construct schools for deaf", "Understand our sufferings". Many non-government organisations (NGOs) launched campaigns and took out rallies to spread awareness among masses. A few NGOs staged protests, urging the government to provide better living conditions to the disabled. Officials of Humanity Welfare Organisation Helpline (HWOH), an NGO fighting for the rights of disabled, said there were nearly 8 lakh people suffering from various disabilities in the state. "The government has adopted charity-based approach towards handicapped. It is providing a stipend of only Rs 400 a month to them," the HWOH spokesperson said. The All Jammu and Kashmir Association of the Deaf urged the government to build schools that could impart technical training to the disabled so that they could support themselves. "There is only one private school for deaf and dumb and that, too, is in bad shape. We want the government to open schools for these people so that they don't feel alienated," said one of the activists. Voluntary Medical Society (VMS), another NGO, launched a signature campaign across all public hospitals in the city to spread awareness about the condition of disabled. "The government has to play an important role in mitigating the sufferings of physically challenged who are being neglected by society," said the organiser of the campaign. Dr Mushtaq Margoob, a psychiatrist, said it was essential to inculcate confidence in the disabled so that they start appreciating their abilities to lead self-dependent lives. |

Vijay Kumar Gupta, president of the association, while addressing the rally, said as per the J&K Persons with Disabilities, Equal Opportunities and Full Participation Act of 1998, 3 per cent quota for the handicapped in government jobs and opening of schools for them in each district had been provided, but the state government was yet to implement it properly. He added that the state government had faltered miserably in providing employment opportunities to the physically challenged persons candidates claiming that they had to meet certain minimum criteria in the form of qualification/expertise. "Though for the last few decades, slow and uneven progress has been made to address these issues by the government, but continuous action at all levels is needed to ensure that physically challenged persons enjoy full and equal participation. The state government needs to set up a vocational training centre to train the deaf and mute children in various trades like electronics, automobile, mechanics, textile, designing etc," Vijay Gupta maintained. Meanwhile, the J&K Handicapped Welfare Association submitted a memorandum of demands to the Chief Minister on the eve of World Disability Day. The association in its memorandum appealed to the government to implement 3 per cent promotion and transfer policy for physically challenged employees, appointment of a full-time Disability Commissioner, reservation in professional colleges and declaration of World Disability Day as a holiday for all physically challenged persons working in government departments. The association also demanded to set up an advisory board on physically challenged persons and health cover with special package for them. World Disability Day was also observed at the Government College for Women (GCW), Gandhi Nagar. The event was jointly organised by the Nirvana Academy and Disabled Care Foundation in collaboration with the NSS unit of the college. Chief Secy stresses need to promote public transport
Srinagar, December 3 He said this while reviewing the proposed "Comprehensive Mobility Plan for Srinagar" at a high-level meeting chaired by him in Jammu today. "In view of heavy traffic in cities resulting in congestion, especially during peak hours, the state government has appointed an expert agency, RITES Ltd, to prepare a mobility plan for Srinagar and Jammu cities," the Chief Secretary said. He said a study had revealed that on a daily basis, 75 per cent people travelled by buses in and out of Srinagar city and 6.2 per cent travelled by privately owned cars. He said unless steps were taken to encourage people to travel by buses, the city would remain congested. "While we take other necessary steps to redress the issue, we also have to ensure that our standard and mini-bus fleet is up to the mark and comfortable to travel by," he said. The proposed short and long-term mobility plan has been prepared by RITES Ltd after studying the existing traffic and travel patterns, existing infrastructure and road space available and transport and infrastructural demand forecast. The study area of the mobility plan involves the master plan area of 757 sq km, including Srinagar, Ganderbal, Budgam, Pampore, Khrew and 346 village settlements. The recommendations would address the passenger and freight mobility requirements for the next 20-25 years, keeping in view the future population and growth in 2021, 2032, besides integrating the Srinagar Master Plan. RITES Ltd General Manager YP Sachdev gave a power-point presentation about the study, analysis and the strategy for implementation of the transport development plan.

Srinagar, December 3 "The Income Tax Department has started an e-filing portal which tax payers should use to their advantage. The portal and other computerised facilities will make the process of filling taxes a less cumbersome and more user-friendly process," Singh said while addressing reporters in Srinagar. The officer said the department had already formulated assessment information system under broader AST and appealed Valley taxpayers to get their grievances redressed through the new facility. He appreciated the role of taxpayers of J&K, especially from Kashmir Valley, in their contribution towards payment of direct taxes. Emphasising voluntary, non-obstructive and smooth tax administration, Singh said taxpayers should pay their taxes willingly. He said tax officers need to be more polite and cordial towards taxpayers. "The department proposes to hold awareness programmes in the Valley to make people aware of the latest facilities available to pay taxes. It is a matter of concern that tax assesses are not aware of their rights and the issue needs to be dealt with responsibly," he said. Earlier, Singh had a meeting with taxpayers and members of Income Tax Bar Association.

"This is a technical issue and our Chandigarh server is down. I hope it will be restored till evening. LeT module behind SHO’s killing: Police
Srinagar, December 3 The LeT Qasim module was also behind the Hyderpora attack on the Srinagar bypass on an Army convoy in which eight jawans were killed on June 24. On November 7, this module was also blamed for the killing of two CRPF men in the Jawbara area of Awantipora town on the Jammu-Srinagar highway. Police sources said Chadoora area, where SHO Shabir Ahmad was shot dead, had remained by and large peaceful for a long time, but Qasim module of the LeT had its presence in the area. The module, they said, was operating in various areas of central and south Kashmir. The module was headed by Mohammad Qasim- a Pakistani militant- who had been in the Valley for the past nearly three years, they said, adding that Qasim had taken over the charge of the LeT in south Kashmir after the killing of senior commander Rehman Bhai in 2011. When Rehman was heading the LeT in south Kashmir, Qasim was operating from Dachigam area on the outskirts of Srinagar. The police said Qasim module had been a headache for the security agencies. While the police blamed the LeT for the attack on the SHO, sources said it was possibly a target killing as the slain Sub-Inspector (SI) had remained in the forefront against the militancy in the past. “I am sure that it was a target killing,” said a police officer. “The slain officer had joined as a constable in early nineties and rose to the rank of a Sub-Inspector as he had remained active in counter-insurgency operations,” he said. On Chadroo attack, Director General of Police Ashok Prasad said the militants had changed their strategy and the security forces would continue with their policy of avoiding collateral damage. “We have been saying it for a long time that militants have changed their strategy and it is not the J&K police which have suffered casualties but other security agencies have too suffered. While we have to ensure that the causality is reduced, we will continue with our policy of avoiding collateral damage,” Prasad said while talking to reporters in north Kashmir’s Handwara town. |

Jammu, December 3 A dinner was hosted at the BSF Officers’ Institute, in which the Chief Minister was the chief guest. Deputy Chief Minister Tara Chand was the guest of honour. Senior officers of the civil administrations, Army, Police and Central armed police forces were present. All retired BSF officers of the Jammu region were among the guests. “The Chief Minister’s presence bolstered the spirits of officers and men,” the BSF officer said. Anantnag, December 3 “Usually, the coaches are occupied by the Railway Police Force (RPF) personnel, especially those heading home for vacation. They travel till Banihal,” said Burhan Ahmad, a passenger. “As this is a routine, people like me find it difficult to board the regular coaches of train,” said a physically challenged person who did not wish to be named. “The coaches can also be used by those feeling unwell or are injured. But for that, they need to produce a certificate to prove their condition,” said Sajjad Majid, a commuter. He said: “A month ago, I had met with an accident and my leg was plastered. Technically, I was a handicap then, but security guards did not allow me to enter the special bogey even though it was vacant.” Officials at the railway control room acknowledged the allegations as not entirely baseless. “I have received many complaints in this regard and I make sure that their issues are resolved,” said a senior official at the control room. Admitting that security guards could act bossy at times, he said: “A train guard, who is also in charge of the bogey, might have sometimes allowed security guards in the special bogey to return favours as they all are friends,” the official said. He said to make the system foolproof people should approach the railway authorities every time they face such problem. “This will help us identify specific problems and make sure they are rectified,” he said. |

Wildfire rages in Pahalgam forest for fifth day
Anantnag, December 3 The fire has engulfed dozens of trees in the area and is posing a grave threat to the wildlife in the area. Reports said the wildfire started on Friday night and after engulfing trees in the forest area, it spread to the nearby Awoora wildlife sanctuary. People in the area said they could only see thick clouds of smoke emanate from the forest area during the day. “However, as darkness descends, the blaze can be seen even from a distance,” said Mushtaq Ahmad, who lives near to the forest area. While the quantum of damage caused by the wildfire is yet to be ascertained, sources in the Forest Department said the preliminary reports had put the number of damaged trees in hundreds. “The smaller trees particularly are the most damaged, given that it was more of a ground fire,” said a highly placed source in the Forest Department. The District Forest Officer was not available for comment despite repeated calls. The wildlife authorities have, meanwhile, said the wildfire that had entered a part of the Awoora wildlife sanctuary had been brought under control. “Last night, the fire dousing operations were called off after darkness. This morning I personally assessed the situation,” said Imtiyaz Ahmad, wildlife warden, south Kashmir range. He said the fire was brought under complete control by noon today. “No animal has been affected by the wildfire,” Imtiyaz said, “Animals have a natural instinct of running away from fire. Moreover, in the winter, they tend to live in the peripheries of the forest area.” Battling flames Reports said the wildfire in the Pahalgam forests started on Friday night. The GOC-in-C of the Western Command was accompanied by GOC of 9 Corps Lt Gen Parveen Bakshi, GOC of 26 Infantry Division Maj Gen Ashwani Kumar and GOC of 29 Infantry Division Maj Gen Balbir Singh this morning when he called on the Chief Minister here, said a government spokesperson. “During the meeting, various issues relating to prevailing security situation and concerning law and order were discussed. The Army commanders presented a resume on the issues in detail,” the spokesperson said. After the September 26 terror attacks in Hiranagar and Samba which left 10 persons, including four Armymen dead, General Campose, on November 15, had visited forward areas along the 198-km-long international border in the Jammu region
and reviewed the security scenario. The GOC-in-C had visited the Jammu Garrison on September 3 to review the military situation in the backdrop of frequent skirmishes between Pakistan and Indian armies on the Line of Control (LoC). On September 26, three heavily armed Pakistani terrorists had carried out suicide attacks at the Hiranagar police station and at an Army camp of 16 Cavalry. The unit of 16 Cavalry under Samba Brigade belongs to 9 Corps which is headquartered in Himachal Pradesh. It falls under the Western Command. On October 29, General Campose had again visited Jammu to hold a meeting with his brigade commanders and senior officers of Rising Star Corps in the Jammu Garrison. The Pakistan shelling had left BSF guard ML Meena dead and 31 others injured.

Domestic help found dead in Srinagar
Srinagar, December 3 Hailing from Alipor area of West Bengal, Kharijan worked as a domestic help at local resident Gulzar Qureshi's house, police said today. Kharijan's body was found in the servant quarter of Qureshi's house.
