Yannick attack case
Circumstantial proof nailed accused

Jalandhar, October 25
Even as the three prime witnesses in the high-profile case pertaining to the April 21, 2012, murderous attack on African LPU student Yannick Nihangaza had turned hostile, there was sufficient circumstantial evidence which led the prosecution to nail the seven young assailants. The decision regarding the 10-year sentence for all seven accused was pronounced by the Additional District and Sessions Judge yesterday.

The evidences included the recovery of pieces of blood-stained glass and stones (used in the attack) from outside the rented accommodation of Yannick, fresh injury marks on the nose of one of the accused Sahildeep, three cars recovered, certain mobile phone tower locations and proving of the fact that Rommy Uppal had changed the number of his Innova car used in the attack.

The prosecution proved that accused Uppal had changed the number plate of his car used in the attack to conceal his identity. Using record from the office of the DTO, it established that the Innova with its actual registration number PB-08-M-0020 was being plied with fake number plate PB-32-L-0012. The car was found parked at the rear side of the house of his father Dharam Singh Uppal, SP Nawanshahr, from underneath the trees covered with tarpaulin.

The police got a whiff of it as inspector Naresh Kumar Joshi, then in charge, police post bus-stand, said he received a wireless message from Police Control Room that a foreign national had been admitted in Chhabra Care Neuro and Trauma Centre in an injured condition.

Two main statements

At hospital, main complainant Charanjit Singh Sidhu, resident of Dashmesh Nagar, Jalandhar, met the police and got his statement recorded. His statement was considered to be of utmost importance, as he, along with his nephew Naveen, was present at both places, first at liquor vend near Sultej Cinema where first fight took place and then at Dashmesh Nagar where nine boys got together reportedly to take revenge.

He said, "It was birthday of Arsto, an African boy on April 21, 2012. In this celebration, the other friends of Arsto were also present at Dashmesh Nagar. I and my nephew Naveen also joined in. I, Naveen, Nbuyaamba Girejase and one Junior went to liquor shop to purchase beer bottles. Three clean-shaven persons (according to prosecution version - Sahildeep Singh, Amandeep Singh and Jaswant Singh) were also standing with a white car. At about 11:30 pm suddenly, Nbuyaamba Girejase and Junior started quarreling with the three persons."

"On coming out of the house past midnight, I saw that all the three persons (who had quarreled with Junior at the beer shop) were giving hard blows on Yannick's head. All three persons were hitting him with stones and glass bottles, thinking it was Nbuyamba Girejase. On seeing me, all the accused fled from the spot."

Another witness Madan Lal, a taxi driver owning a Xylo Mahindra, said, "On April 21, 2012, at about 4:40 pm, he received a phone call on his mobile from Grace, African student of the LPU, to take them for some party of their friend's birthday. The witness testified that he knew Grace, Polin and other African students as he used to take them from Amritsar and Chandigarh. At about 6 pm, he picked up Grace and Polin from the LPU and then picked up some other students from Garha Road PG and reached the place of party at Dashmesh Nagar at about 10 pm."

"African students went inside the house where the party was being held. He parked his car facing towards the bus-stand. At about 11:45 pm, one African student whose name he later on came to know as Yannick, was knocking the door where the party was being held for entering therein when three cars with nine to 12 persons came from the bus-stand side. They hit Yannick on his head with glass bottles or some other things and fled. He made a phone call to Grace that one of their colleagues had been attacked and they should come out and take care of him. The injured was profusely bleeding, so he refused but he took others with him to hospital in the auto."

Witnesses turning hostile

Like Sidhu and Naveen, he also refused to identify the accused present in the court as those assailants. He was also declared hostile. The public prosecutor said they had all turned hostile under fear and pressure from the accused persons who belonged to very influential families of Jalandhar. One of the accused, particularly, is son of a Superintendent of Police, two are sons and one is a near relative of MD of Sugar Mill. The parents of other accused are business and influential families of the city.

Mistaken identity

The accused had reportedly come to take revenge from Nbuyaamba Girejase, but hit Yannick in the process as a case of mistaken identity. Yannick had just entered and was about to join the party then.

Car registration and mobile tower details

Besides the car of Uppal, two other cars were recovered in the case were PB 08 AZ temporary 9260 Liva white reportedly with accused Sumeet Bunny. The third car was Lancer bearing RC number PB-67-C-2000 belonging to Amandeep Singh. He had hid it in Mithapur village near the house of his relatives.

A voluminous call record detail was produced with some of the mobile phones showing location as Nirmal Complex, GT Road, Jalandhar, or Alfa Estate Building, opposite bus-stand, Jalandhar at the given time was also produced. However, there was a lot of confusion with some irrelevant details produced. At this, the public prosecutor argued, "Some call details pertain to the mobiles recovered from the accused by the police on their surrender or disclosure statements much after the occurrence from a few days to two and a half months. It will be naïve to presume that the accused must have given the real mobiles or SIM number to police to their own detriment. The accused must have prepared or consulted appropriate persons before surrendering evidence against them. The police is also found to be so inept that it fell into their trap. It never got done forensic examination of the mobiles to test the claims of accused."

Modi a potential political option: Bedi
Tribune News Service

Jalandhar, October 25
Social activist Kiran Bedi today said BJP's Prime Ministerial candidate Narendra Modi has emerged as a potential political alternative for the country.

On her visit to Dr BR Ambedkar National Institute of Technology here, Bedi said, "The country had a ruling party in Congress which gave us a decade of corruption. On the other hand, there is BJP’s Prime Ministerial candidate who is known for development he has brought in Gujarat."

Speaking on the issue of what she thinks of Arvind Kejriwal's way to counter the "political rot" in the country and why she herself abstained from joining the Aam Aadmi Party, she said, "Kejriwal has chosen electoral politics but I have never considered joining politics as a solution for countering the present-day problems the country faces."

About the controversy surrounding self-proclaimed godman Asaram Bapu, Bedi said, "Such incidents are making women come forth and speak up about the atrocities faced by them." She, however, refrained from directly making any comment on the issue.

Later, during an informal interaction with the students of the institute, Bedi asked them about the problems which the country was facing. She also prepared a list of issues pointed out by them and also what were the positive things about the country in the present scenario.

"A few months ago, I went to California. As I drove down the country roads, there was beautiful countryside spread over miles covered in orchards, vineyards and farmland. Today, as I drove down from Amritsar, the only farmland visible was divided in fragments. We once had agricultural resources but not anymore," Bedi said.

Speaking to students, she said they needed research-based study. She said there should sessions for students wherein they play teachers.
