BCCI disciplinary panel a sham: Modi
Former IPL commissioner says probe of irregularities against him was biased

New Delhi, April 30
Former IPL Commissioner Lalit Modi today came down heavily on the three-member Disciplinary Committee, probing alleged irregularities against him, saying the panel has made a “mockery of the proceedings”.

The committee, after recording versions of lawyers representing Modi and the BCCI, said it is likely to give its recommendations to the BCCI by the end of May. “In hurry to conclude, committee has made mockery of the proceedings. My lawyers wanted one session each to deal with 12 issues,” Modi tweeted. “They have made this enquiry a sham exercise of new ways to do Judicial inquiry,” he wrote on his twitter handle. A legal team representing Modi has objected to “undue haste” by the Committee, and he sought to bring it to light. “Looks like everything is predetermined. What is the undue haste for. Why this hurry. What are they afraid of.

Possibly the truth,” Modi said. Directing his ire at the Cricket Board, Modi said, “Even if BCCI were to read headings of documents it would have taken 2 full days to only read heading of those documents. “Three show cause notices running in 150 pages, my reply running in 15000 pages, live evidence record running into 2000 pages. “Amazing how BCCI lawyers yesterday took only 40 minutes to argue its full case against me.”

Commenting further against the board, Modi said, “BCCI dictates that no member or administrator gives evidence to bring out the truth. “The persons who wish to appear on my behalf are stopped by BCCI acting under instruction of its President - Srinivasan.

“My application to examine witnesses in defence is not allowed by the committee.” Modi also took potshots at Arun Jaitley Arun Jaitley, one of the three members in the Disciplinary Committee.

“While suit against bias of Arun Jaitley is pending in court, he shows undue haste 2 close proceedings so that I cannot have legal remedy,” he wrote. “Let me tell the truth of these proceedings. The fact that Arun Jaitley was the original complainant in the BCCI was suppressed from me,” Modi said. He said the committee was scared to face him. “I am not afraid to face the committee, but looks like committee is afraid to face me. And from my legal team.

“The inquiry was instituted against me but looks like the committee does not wish to hear my version,” Modi said.

Modi’s legal team had earlier accused the Disciplinary Committee of ignoring its request to present its defence in the case.

“I am constrained to note the working of the committee. It declined to give Modi a chance to present his case via video link. The committee has already refused to take Modi’s response to show-cause notices issued to him saying it was 32 hours late,” said Mehmood M Abdi, General Counsel and Constituted Attorney of Modi.

Verdict likely by the end of May

The three-member Disciplinary Committee, probing alleged irregularities against former IPL Commissioner Lalit Modi, is likely to give its recommendations to the BCCI by the end of May.

The three-member Committee in its meeting held here yesterday has recorded versions of lawyers representing Modi and the BCCI. “The panel has heard all the parties. It has given 15 days time to Modi to give his final reply,” a source said.

The Committee is likely to finalise its decision by next month end after getting final response from Modi, the source said.

The Committee will submit its recommendations to the BCCI which will than take a final decision on Modi’s fate.

A legal team representing Modi has objected to “undue haste” by the Committee.

“Disciplinary Committee’s undue haste to wrap up the proceedings was aptly complimented by BCCI which completed its arguments on all charges just in 40 minutes. How can the analysis of bulky evidence and material collected in three years is possible in three hours?” said Mehmood M Abdi, General Counsel and Constituted Attorney of Modi.

Modi’s legal team also accused the Disciplinary Committee of ignoring their request to present its defence in the case.

“I am constrained to note the working of the committee. It declined to give Modi a chance to present his case via video link. The committee has already refused to take Modi’s response to show-cause notices issued to him saying it was 32 hours late,” Abdi said.

Modi, who is living in London due to security threats, could not submit his 229-page reply by April 20 as he was undergoing dental treatment, he said.

The disciplinary panel, comprising Arun Jaitley, Jyotiraditya Scindia and Chirayu Amin, started hearing the matter in July, 2010, two months after Modi was suspended as IPL Commissioner due to alleged irregularities.

The panel had earlier also met on April 22, 23. Modi is facing about 15 charges of having proxy stakes in IPL franchises among others. — PTI

Lionel Messi’s fitness key to Barcelona’s comeback hopes

Madrid, April30
Barcelona admit any chance the Catalans have of overturning a 4-0 first-leg defeat to Bayern Munich in their Champions League semi-final return on Wednesday depends very much on the fitness of Lionel Messi.

The World Player of the Year looked out of sorts in Munich last week as an energetic display from the hosts tore Barca to pieces, but Messi did come off the bench to score a wonderful individual goal and set-up a second for Alexis Sanchez in Barca’s 2-2 draw with Athletic Bilbao on Saturday.

And Barcelona assistant manager Jordi Roura believes Messi has started to find his feet again after being troubled by a hamstring injury for the past month.

“Messi is the best player in the world and obviously when you don’t have him you notice it. He makes the difference,” he told a press conference after the Athletic game.

“He will continue with his recuperation after the injury. He was very good today and we hope that little by little he arrives at his best level. He will continue improving and the better Leo is the more chances we will have against Bayern.”

Despite Messi not being at 100 per cent, Barca’s principal problem in the first-leg was their defending and manager Tito Vilanova has even more problems at the back with Jordi Alba suspended for Wednesday’s clash.

Adriano does return from suspension and is expected to replace Alba, however the biggest doubt remains who will partner Gerard Pique in central defence.

Javier Mascherano returned to light training on Monday well ahead of the schedule planned for him after suffering a lateral knee ligament injury against Paris Saint-Germain on April 2 and he could be thrown straight back into the side, although Vilanova also has the option of using either Eric Abidal or Alex Song.

Bayern by contrast will be able to welcome back striker Mario Mandzukic after he too missed the first-leg through suspension.

And despite their comfortable lead, manager Jupp Heynckes has said he won’t rest any of his six first-team regulars that could miss the final should they be booked at the Camp Nou.

Captain Philip Lahm, Dante, Javi Martinez, Luis Gustavo, Bastian Schweinsteiger and Mario Gomez are all just one booking away from missing the showcase at Wembley should Bayern seal their passage into the final next month.— Reuters

However, the other Indians in the fray — Oscar Bansal and Abhimanyu Singh —failed to cross the first-round hurdle.

Bansal fought hard before going down to Beryno Jiann Tze Wong of Malaysia 21-7 16-21 15-21 in 36 minutes, while Abhimanyu handed Hong Kong’s Yan Kit Chan a walkover in the first round.

Raina, Dhoni strengthen CSK at the top of table

Pune, April 30
Suresh Raina worked his way to a superb 63 and Mahendra Singh Dhoni played an explosive 16-ball 45-run knock as Chennai Super Kings strengthened their position at the top of the table with a 37-run win over Pune Warriors in the domestic T20 championship on Tuesday.

Raina anchored the innings with his 50-ball knock and skipper Dhoni provided the late fireworks as Chennai overcame a slow start to post a challenging 164/3. Paceman Mohit Sharma then rocked the Pune top-order in a fiery spell in which he dismissed Aaron Finch (15), T Suman (0) and Yuvraj Singh (5) from which the hosts never recovered and managed just 127 for nine. Finch was caught behind and Suman was trapped in successive balls in Mohit's first over. He returned to scalp Yuvraj. Raina's electric fielding resulted in run out of Robin Uthappa (10) which left the hosts reeling at 43 for four inside fifth over.

As if that was not enough, Luke Wright was run out in an unfortunate manner when Steve Smith played a solid straight drive but the ball touched Albie Morkel's foot before hitting the stumps and Wright was caught out of crease.

Pune fielders were sharp in the field but Luke Wright failed to latch on to a mistimed pull by Raina at short-midwicket in the ninth over. — PTI
