The Supreme Court today virtually allowed Punjab to go ahead with the Shahpur Kandi dam project on Ravi river for the purpose of irrigation and electricity generation despite Haryana’s plea for handing over the work to the Centre or a Central agency such as the Bhakra Beas Management Board (BBMB).

A Bench comprising Justices CK Prasad and Gopala Gowda, however, incorporated in its order Haryana’s offer to pay Rs 480 crore representing 21 per cent of the total project cost of Rs 2,285 crore.

However, Punjab was free to accept or reject this payment, it clarified. At the same time, Punjab’s refusal to accept Haryana’s offer would have no bearing on Haryana’s claim of 21 per cent share in the power generated from the project, the Bench said.

Arguing for Haryana, senior counsel Gopal Subramanium said his client was offering the contribution to reinforce its claim to its share in electricity.

Haryana contended that the Centre, represented by Additional Solicitor General Mohan Jain, had informed the Supreme Court that it was not giving any funds to Punjab for executing the project but in fact had extended financial assistance.

Punjab’s senior counsel Harish Salve, however, said the Central assistance was for the irrigation component of the project and not for power generation.

Subramanaium said Punjab was going ahead with executing the project on its own, ignoring the claims of Haryana, Rajasthan and Jammu and Kashmir.

Today’s Supreme Court order came on Haryana’s plea for interim relief in the form of restraining Punjab from executing the project. It was unfortunate that of late the Centre was holding meetings on the project only with Punjab without inviting Haryana and Rajasthan.

This was against the decisions taken earlier by the Centre. The least that was expected from the Centre was transparency and impartiality, Subramanium said.

Rajasthan’s Additional Advocate General Manish Singhvi said Rajasthan had also decided to file a suit against Punjab, staking its claim to water and electricity from the Ravi river projects.

Punjab was making “short releases” of water from the Ranjit Sagar/Thein dam which was not helping Rajasthan much. The Shahpur Kandi dam project should be executed by a Central agency, not Punjab, he said. Rajasthan is claiming 49 per cent share in electricity, besides a major share in water.

In its interlocutory application in the 2009 original suit, Haryana had also sought a direction to the Centre not to release any “further funds” to Punjab for executing the Shahpur Kandi project. Salve, assisted by Punjab’s standing counsel Jagjit Singh Chhabra, however, maintained that taking away the project from Punjab could not be sought in the form of interim relief.

Today, the BBMB pleaded with the SC to remove it as a party to Haryana’s suit against Punjab. The Bench said the suit would be listed for hearing again after four weeks.

For the second time in two months, Comptroller and Auditor General of India Vinod Rai underscored that the mandate of the watchdog body was to ensure that the government is held accountable for the money it spends to the legislature, especially as the social sector spending has increased over the years.

“Our mandate is not merely to prepare reports and place them in the legislature. The constitutional mandate places a larger responsibility on us: that of holding the government financially accountable to the legislature,” Rai said at a conclave organised here by a media organisation.

The remarks sounded similar to the observations made by the CAG during a lecture at the Harvard Kennedy School last month where he sought to know that as the government auditor, should the body limit its role to placing reports in Parliament or raise awareness about the spending through outreach.

Today, he reiterated the mandate enjoins upon the auditor to keep the ultimate stakeholder - aam aadmi - appraised of the outcomes of the government spending and not merely conduct expenditure audits.

“Thus to sensitise public opinion, we have taken steps to disseminate audit findings to citizen groups, non-governmental bodies, educational institutions and the media. We believe such an initiative has served as a force multiplier for us and helps to promote accountability and good governance,” Rai said. The remarks by Rai comes at a time when the reports by the watchdog body has raised hackles of those in the government.

Rai reminded that the focus of the audit itself has undergone a major change due to massive outlays on socio-economic development activities. The attention has shifted into areas of performance audit that is an assessment of the operational performance of the government as against its pre-established goals.

“Performance audit provides an early warning system to the administrator and is a tool for improving government's accountability to public...and helps them to ensure that their operations are effective and efficient,” he said.

Controversial UPSC notification put on hold

The government today put on hold the UPSC notification on Civil Services Exams-2013 after MPs slammed its pro-English/Hindi slant at the cost of regional languages.

Minister for Personnel V Narayanasamy assured the Lok Sabha that the March 5, 2013, notification would be kept in abeyance until the matter was resolved. “We will summon UPSC officials and work out a solution. Till then, the notification will be in abeyance,” he said after 20 MPs questioned UPSC’s move to introduce a compulsory English composition paper of 100 marks in the Mains exam.

Terming the change as detrimental to the interest of rural aspirants, MPs demanded the removal of UPSC officers who drafted the “discriminatory” notification.

RJD’s Lalu Yadav termed the UPSC move as a conspiracy to prevent disadvantaged sections from entering country’s governance structure. JDU’s Sharad Yadav joined him in seeking removal of the UPSC chairman.

MPs, including TKS Elangovan of the DMK, Jayant Choudhary of the RLD, Dharmendra Yadav of the SP, Sanjeev Naik of the NCP, SD Shariq of the NC and Sis Ram Ola of the Congress slammed the move and sought the old system retained where students could write the Mains paper in any of the languages included in the 8th Schedule of the Constitution.

The UPSC has added another caveat-it will allow students to write Mains papers in a certain regional language only if a minimum of 25 aspirants seek such permission. Otherwise, they must write the Mains in Hindi or English only.

AIADMK chief J Jayalilathaa had written to the PM terming the notification a retrograde step. She said the changes reflected “bias against civil services aspirants from non-Hindi speaking regions”.

Indian agencies have warned the government that it could face a ‘hot summer’ in Kashmir following increased militant activity in Pakistan Occupied Kashmir (PoK) over the past four weeks, including the use of three high-frequency radio transmitters to direct militants while infiltrating into India and re-activation of three militant training camps.

“Hot summer” is a phrase used to describe increased militant activity. Separately, the passing of a resolution by the Pakistan National Assembly condemning the death of Afzal Guru has been interpreted by Indian observers as a ‘political signal’ to the terror groups in Pakistan. Afzal Guru, a convict in the December 2001 Parliament attack case, was hanged to death on February 9 at Tihar Jail here leading to protests in Kashmir.

In the past, radio transmitters sporadically functioned during peak summer months. But this year, the transmitters started functioning in February after Afzal Guru was hanged in India, sources said. Radio intercepts have been picked up which show the three transmitters are being used to talk to militants in India and also directing their safe entry through infiltration routes in the still snow-clad mountains.

The PoK-based handlers use these transmitters in such a fashion that they get good coverage till about 20 km within Indian territory. Three locations in the PoK are in Dudhnihal, Aathmukam and Hazika, all along the Line of Control (LoC) that divides Jammu and Kashmir between India and Pakistan.

The Multi-Agency Centre (MAC) functioning under the Ministry of Home Affairs estimates some 350 militants are hiding in Kashmir - some 200 odd are north of the Pir Panjal range and the remaining are south of mountain range. The Indian side estimates that three terror organizations - the Lashkar-e-Toiba, the Jaish-e-Mohammad and the Hizbul Mujahideen - are operating in Kashmir.

New Delhi assesses there are 42 terror training camps in PoK and three of them have been re-activated in the past few weeks. These are at Shawai Nallah, Garhi Habibullah and Sensa.

“Local Pakistan Army units in PoK have been told not to pose any hurdles for infiltrators,” says an input from one of the Indian agencies monitoring the situation. Continuous assessment is made by the Intelligence Bureau, the Research and Analysis Wing, the Military Intelligence and the Signal intelligence units. Some of these units routinely trace talk over hand-held radio sets and long distance calls.

Another signal indicating at increased activity is the fact that the first two months of 2013 have witnessed five infiltration attempts by PoK-based terror outfits in January and February, a period of extreme cold in Kashmir. In the past, attempts used to start in mid-March.

In a tough message today, Army Chief Gen Bikram Singh said India cannot shake hands with Pakistan which exports terror to India while he advised the Indian politicians that time was not right to remove the Armed Forces Special Powers Act (AFSPA) from Jammu and Kashmir.

Speaking at a function organised by a news organsiation, the Army Chief responded to a question by a visiting Pakistani journalist saying you can’t expect us to shake hands when you send terror across the border.” India and Pakistan must first address trust deficit. “You can’t export terrorism to India and expect to talk Siachen.” Gen Bikram Singh said.

On the issue of removing the AFSPA, he said: “We (Indian Army) only make recommendations. If I was to be asked, I would say that the time is not right at the moment to tamper with this enabling act. We should not take away AFSPA at this juncture.”

He was responding to queries on the matter especially since Union Minister Farooq Abdullah’s demand for repeal of the AFSPA. There have been similar demands voiced by his son and Chief Minister Omar Abdullah, other political leaders and separatists in the Valley.

Further elaborating his argument, the General said: “It was important to observe the situation and it is important to understand the security contours before we take a decision. It should be a pragmatic one, it should be in national interest and it should not be politicised.”

In a major relief to married couples who patch up and want to withdraw dowry harassment and other criminal complaints, a three-member Bench of the Supreme Court today ruled that the high courts have powers to quash such cases.

Exercising their inherent powers under Section 482 of the Code of Criminal Procedure (CrPC), the high courts “can quash the criminal proceedings or FIR or complaint in appropriate cases,” the Bench comprising Justices P Sathasivam, Jagdish Singh Khehar and Kurian Joseph held.

“In our view, it is the duty of the courts to encourage genuine settlements of matrimonial disputes, particularly when the same are on considerable increase. Even if the offences are non-compoundable, if they relate to matrimonial disputes and the court is satisfied that the parties have settled the same amicably and without any pressure, we hold that for the purpose of securing ends of justice, Section 380 of the CrPC would not be a bar to the exercise of power of quashing of an FIR, a complaint or the subsequent criminal proceedings,” the Supreme Court said.

Pointing out that there has been an “outburst of matrimonial disputes in recent times”, the apex court said the institution of marriage occupied an important place and role in society. “Therefore, every effort should be made in the interest of the individuals in order to enable them to settle down in life peacefully. If the parties ponder over their defaults and terminate their disputes amicably by mutual agreement instead of fighting it out in a court of law, in order to do complete justice in the matrimonial matters, the courts should be less hesitant in exercising their extraordinary jurisdiction,” it said.

The case

The SC made the clarifications while allowing a woman from MP to withdraw her complaints of dowry harassment against her husband and his family. She had made the plea following an out-of-court compromise reached with the help and intervention of family members and friends

New Chinese PM dials Manmohan
Says Beijing wants strong ties with India

Within hours of his election as the new Premier of China, Li Keqiang today telephoned Prime Minister Manmohan Singh, emphasising the significance of the country’s ties with India.

Li said he looked forward to working with Singh to further strengthen bilateral ties. He also pointed out that Singh would get an opportunity to interact with the new leadership of China on the margins of the upcoming BRICS Summit in South Africa later this month.

China's new President Xi Jinping is scheduled to attend the BRICS Summit. Singh, while congratulating Li on his election, expressed his desire to work together with China's new leadership. The Prime Minister expressed satisfaction with the progress in bilateral relations in recent years. He also expressed confidence that the ties would expand further in the years ahead, official sources here said.

The two leaders also emphasised the need for maintaining high-level exchanges. They extended invitation to each other to pay bilateral visits at their earliest convenience. Both leaders gratefully accepted the invitation and looked forward to an early opportunity to interact.

Rail minister justifies fare hike, rules out another soon

Railway Minister Pawan Kumar Bansal today justified the recent hike in fares but clarified that there would be no further hike in the near future in reservation or cancellation charges.

As the Rajya Sabha passed the Railway Budget for 2013-14, Bansal, while responding to the debate on the budget in the Rajya Sabha, said, "It is our duty that people get a safe journey at affordable prices. I agree we should not consider it a business organisation but the mandate of the Railways should be on a strong financial principle. We also have a national responsibility.”

Bansal pointed out that cross subsidy from freight to passenger segment had touched Rs 25,000 crore and stressed on the need to bring down the operating ratio from the current level of 88.8 per cent to 80 per cent by bringing efficiency in resource utilisation and for expansion of railway services including infrastructure.

“It used to be so. But in recent years, operating ratio went as high as 94.7 per cent. We need to bring it back to 80 per cent,” he said.

In a reply similar to that in the Lok Sabha, Bansal justified the hike in the fares effected on January 21. He said it was "inevitable" as it had come after 12 years.

"People have largely accepted the hike,” he said urging members to accept it as the need of the hour.

The railway passenger fares were hiked in January, a month before the Rail Budget was presented.

Bansal said the government's decision to raise passenger fares was accepted by most people and the Railways needed to make at least 20 per cent profit to continue running.

"I was accused of raising the fares through the back door and was criticised for it. But I want to say that it was the minimum fare hike.

“They accuse me of raising the fare by 25 per cent. This is, however, a marginal hike as in real terms, it is only a hike of Rs 2 for a person travelling up to 100 km. The bus fare has, in the meantime, gone up several times," he said.

Jaitley also raised questions on the country’s foreign policy. “In the backdrop of a serious situation that our country is facing, whether it is Male or it is Rome or it is Islamabad, I think we need to discuss our foreign policy and where it is leading us, ” he said.

Instead of investigating the case, the Delhi Police tried to close it saying "it had neither seen any dead body nor any burnt house. The police team neither visited the area nor met witnesses", Cheema said.

In the daily diary (roznamcha) of the Raj Nagar police post under the Delhi Cantonment police station, no incidence of violence had been mentioned from November 1 to 5, 1984.

The CBI counsel argued against the statement of a beat constable of the area (in 1984), who appeared as a defence witness, that he did not see any incidence of violence in his area from November 1 to 3 in 1984. He neither saw any dead body nor any burnt house, the policeman had said.

Cheema informed the court that the present FIR (No. 416/84) mentioned 30 killings and burning of numerous houses and vehicles. The evidence showed that the atmosphere at that time was volatile and the Delhi Police had conspired to shield the accused.

Arguing against another defence witness, also a police official, Cheema said during his investigation spanning over many years, the police official never visited the affected area nor did he record the statement of any local resident.

"What sort of investigation is this? It appears the Delhi Police is interested in collecting evidence against complainant Jagdish Kaur only; and not against the accused responsible for the murder of her husband and son," Cheema said.

The arguments will continue on March 18.

Cong core group discusses Lankan Tamil, marine issues

The issue of Sri Lankan Tamils and the controversy surrounding the absconding two Italian marines today figured at the meeting of Congress top brass, including Prime Minister Manmohan Singh and party President Sonia Gandhi here.

The meeting, in which External Affairs Minister Salman Khurshid was specially called, took place at a time when the government is working on its stand on a proposed UNHRC Resolution on Sri Lanka.

Making a statement in the Rajya Sabha in the wake of demands made by the DMK and the AIADMK that India should support the US-sponsored resolution on killing of Tamils in Sri Lanka and holding of an independent inquiry, Khurshid said there should be accountability besides an “impartial, independent and transparent” probe into allegations of atrocities on Tamils.

He said the process for a decision on the resolution is underway and India has already started engaging with other countries to finalise its view on it.

The party’s core group meeting, attended by Defence Minister AK Antony, Finance Minister P Chidambaram and Sonia’s political secretary Ahmed Patel, also took place amid India deciding to downgrade its diplomatic ties with Italy.

“The government is firm on the marines’ issue,” a leader said after the Core Group meeting when asked what would be the next step of the government on the matter. 
The two marines — Massimiliano Lattore and Salvatore Girone — facing trial for allegedly killing two Indian fishermen last year, were permitted by the apex court on February 22 to go to Italy for four weeks for voting in election and directed to return within four weeks.

Strong defence capability vital, says President

As our country moves ahead on the path of economic progress, it is essential to preserve peace for which we need to maintain an effective deterrence and a strong defence capability.

Asserting this while addressing the personnel after presenting colours to the Air Force Central Medical Establishment (AFCME) and No. 3 Base Repair Depot (3BRD), President Pranab Mukherjee said that, as a nation, we are fully committed to maintaining peace.

We are steadfast in our belief that the resolution of disputes should be through discussion, he said. “But at the same time, we need to be prepared to face any aggression and safeguard our territorial integrity with all our might. The Indian Air Force has a critical role to play in this effort,” the Supreme Commander of the armed forces said.

The colours were received from the President by the Air Officer Commanding, AFCME, Air Cmde CK Ranjan and Air Officer Commanding 3BRD, Air Cmde Suresh Singh.

Stating that IAF personnel have, in the past, risen admirably in defence of the nation with valour, courage, devotion and fearlessness, the President said that the bestowal of colours is an expression of gratitude and appreciation for the exceptional services IAF personnel have rendered to the nation.

Felicitating the two IAF units on receiving the colours, the President said that AFCME, the primary role of which is to provide comprehensive medical assessment of the aircrew of the armed forces, paramilitary organisations and the civil aviation industry, achieved the rare distinction of becoming the first unit in the Armed Forces Medical Services to acquire an ISO 9001:2000 certification.

Complimenting the achievements of 3BRD, the largest maintenance depot of the IAF, the President said that nations might have the most sophisticated platforms, but their effective deployment would hinge on the quality of repairs and maintenance of aircraft and equipment, the President said.

Also present on the occasion were Punjab and Haryana Governors Shivraj V Patil and Jagannath Pahadia, respectively, Haryana CM Bhupinder Singh Hooda, Air Chief Marshal NAK Browne, Air Officer Commanding-in-Chief, Maintenance Command, Air Marshal Jagdish Chandra, Air Officer-in-Charge Administration, Air Marshal HB Rajaram, Director General, Armed Forces Medical Services, Air Marshal DP Joshi, Director General Medical Services (Air), Air Marshal AK Behl and a host of local civilian and military dignitaries.

Akhilesh completes 1 year, law & order his big worry

Describing people being able to exhale and breathe in the fresh air of democracy as the biggest contribution of his year-old government, Chief Minister Akhilesh Yadav admitted that the law and order situation remained the government’s Achilles’ heel.

Yadav said the state’s worsening law and order situation was a major worry of his government and was undermining his government’s enormous achievements on various fronts. “We are constantly working on improving the law and order situation. In the days, to come we will use technology to further improve police efficiency. For instance, we are going to install GPS on police vehicles to track them and reduce their reaction time,” said the CM.

He said law and order was non-negotiable for his government and that it we would proactively work to improve the quality of policing as well as personnel behavior, language and perspective through additional training. He promised to remove officers who did not shape up despite all the nudging.

Addressing a press conference at his official residence on the occasion of the Samajwadi Party government completing a year in office, Yadav said, “During the last one year, people’s confidence in democracy has increased as they experienced a kind of openness and freedom they had not sensed during the last five years.”

Virtually presenting a report card of his government, Yadav said 108 schemes based on promises in the SP election manifesto had been implemented either partly or fully.

Calling inclusive growth with a focus on farmers, minorities, women and youth as the main agenda of his government, he said 74 per cent of his government’s budget was reserved for farmers and the rural sector.

Defending his government on the communal violence front, Yadav said there were a number of communal riots during the last year, but timely action was taken in all cases.

Year on, Somalian pirates free crew of two tankers

The crew members of two oil tankers - MT Smyrni and MT Royal Grace - who were taken hostage by pirates from Somalia have been released after a year-long ordeal, according to information available here.

The two ships have 28 crew members from India including the captain of Royal Grace — Shankar Dutta, 61 — who belongs to Bangalore.

All the crew members of the two vessels reached Oman earlier this week and are expected to reach home shortly, according to the National Seafarers Union here.

While MT Royal Grace with 17 Indians on board was hijacked on March 2 last year, MT Smyrni, which included a crew of 11 Indians, was captured on May 10.

The crew members of both vessels are reported to be in good physical condition.

According to information available here, MT Smyrni with a cargo of 1,35,000 tons of crude oil was hijacked near Oman. Its owners, in a statement, announced the release of the vessel but did not say if any ransom was paid to the pirates.

"We would like to take this opportunity to thank the crew, their families, our employees and those agencies that have provided support through this long ordeal," Dynacom Tanker Management which owns the vessel said in its statement.

Relatives of the Indian crew who hail from different parts of India have been lobbying with politicians for more information about their loved ones ever since the two vessels were hijacked.

Relatives of crew members of MT Smyrni based in Mumbai told local newspapers that all those on board the vessels were treated well and were provided with adequate food and rations.

ISRO to celebrate silver jubilee of satellite launch

This Sunday is an important day for the Indian spacefaring community. It will mark the silver jubilee of the launching of the first made-in-India fully operational remote sensing satellite into the space.

On March 17, 1988, IRS-1A, the first of the series of indigenous state-of-art remote sensing satellites, was successfully launched into a polar sun-synchronous orbit by a Soviet rocket from the cosmodrome at Baikonur.

IRS-1A carried two cameras with resolutions of 73m and 36.25m, respectively, with a swath width of about 140 km. The mission came to end in July 1996.

Bhaskara 1, the first indigenously built remote sensing satellite, which was also launched by a Soviet rocket, preceded the IRS-1A by over nine years. But Bhaskara was an experimental satellite with a mission life of one year only.

Bhaskara 1 was followed by three experimental remote sensing satellites before IRS-1A was launched into the orbit. The Indian Space Research Organisation (ISRO), the state-run space agency spearheading the Indian space programme, has launched 21 remote sensing satellites since the launch of IRS-1A.

ISRO now has 12 remote sensing satellites in the orbit, which is the largest number of satellites any space agency has in the space at this moment.

While the geostationary satellites of the Indian National Satellite System (INSAT) series are meant for communication, television broadcasting and meteorological services, the satellites of Indian Remote Sensing (IRS) system are for resources monitoring and management (agriculture, water resources, forestry and ecology, geology, watersheds, marine fisheries and coastal management).

While the launch of the first INSAT series of satellites preceded the IRS-1A, it was only in 1992 that an INSAT satellite (INSAT-2A) could be successfully operationalised.

ISRO is planning to celebrate the silver jubilee of the IRS programme in a big way. There will be a two-day symposium here on March 16 and 17 on the IRS programme so that everyone associated with the programme can assemble under one roof and 
celebrate the success of the IRS programme.

“To make this milestone an important event, and to recollect the past and set goals for the future, the Indian Society of Remote Sensing (ISRS), in partnership with other professional societies namely, the Astronautical Society of India (ASI), the Indian Society of Geomatics (ISG), the Indian Meteorological Society (IMS), the Indian National Cartographers Association (INCA) and the Space Society of Mechanical Engineers (SSME) is organising the symposium,” an ISRO spokesperson said.

“Data from the IRS satellites are received and disseminated by several countries all over the world,” the spokesman said.

Cong faces no-trust motion in AP

Hyderabad, March 15
A weak and tenuous Congress government in Andhra Pradesh is faced with a test of strength on the floor of the Assembly with Opposition parties, led by the Telangana Rashtra Samithi (TRS), moving a no-confidence motion in the House today.

However, there is no threat to the survival of the government because the main Opposition Telugu Desam Party (TDP), with 85 MLAs in the 294-member Assembly, has decided to remain neutral.

This means that the 30-month-old Kiran Kumar Reddy government will be let off the hook despite its inherent instability and the threat of desertions from its ranks. This is the second no-trust motion being faced by the Congress since its return to power in 2009.

On paper, the strength of the Congress is 155 in the 294-member Assembly, just seven more than the magic figure of 148.

However, the ruling party has been facing steady desertions from its camp. Five legislators have already submitted their resignations to Speaker N Manohar.

Karuna threatens to pull the plug

Mounting pressure on the Centre on its demand to punish 'war criminals' in Sri Lanka, UPA key ally DMK today threatened to pull out its ministers from the Union Cabinet if its demand to bring in amendments to the US-backed resolution at UNHRC in Geneva was not conceded.

"The DMK will find it meaningless to continue in the Prime Minister Manmohan Singh-led Cabinet if our demand is not obliged to," party chief M Karunanidhi said in a statement late tonight.

"While so many opinions on the resolution by the US are doing the rounds, the DMK insists on New Delhi bringing amendments to that motion, wherein those responsible for genocide are identified and an independent international probe is launched against the war-criminals within a specified time frame," he said, reiterating the party's demand.
