Chandigarh, February 21 The treasury benches, on the other hand, are unlikely to shy away from "exploiting” the JBT scam indictment in which three leaders of the INLD, including Leader of Opposition Om Prakash Chautala, are in jail to silence any criticism. “We have rallied the state over to expose the 'conspiracy' of the arrests of our leaders and our 'pol khol' campaign has made the government jittery. Now we will use the floor of the House to expose the CBI-Congress 'connection' and raise the issues of poor health, an ineffective police set-up, a lackadaisical administration, the power crisis and the burning issue of 'land grab' by the Congress mafia. They have no answers," Abhay Singh Chautala, MLA Ellenabad and member of the INLD political affairs committee, said. Maintaining that the INLD legislature party has no intention of choosing a new Leader of theOpposition even though Om Prakash Chautala, holding this position, is in jail , Abhey said each of the MLAs would play that role. The BJP legislature party chief, Anil Vij, said while the government will be made answerable for "discrimination in development" besides other issues. "The government must explain why its own party leaders are alleging discrimination. We say no development is happening and so do Congress leaders. Then, where is all the development taking place," he asks. Meanwhile, the belligerent Congress, keeping in tune with the aggressive mantle it recently donned, will hit out at the INLD over its involvement in the JBT scam and for misleading the public with its 'conspiracy theory'. Also, the Congress is bound to take pot-shots at the division with the BJP over the 'alliance partner' of their choice. “We would want the Opposition to participate in a healthy debate on issues of the state and contribute to the development though our experience,” Parliamentary Affairs Minister Randeep Singh Surjewala, said. Buses off road, banking paralysed for 2nd day
Hisar, February 21 Hundreds of workers assembled at the Krantiman Chowk in Hisar in the morning and paid tributes to trade union leader Narender Singh, who died after he was hit by a bus he was trying to stop from plying at Ambala yesterday. Surender Mann, district president of the Sarva Karamchari Sangh and Raj Pal Nain, district president of the Karamchari Mahasangh claimed that the strike was complete in the district. Sirsa: Triggered by the death of a roadways worker during strike in Ambala yesterday, the workers of the Haryana Roadways observed a complete strike here today. The Sirsa bus stand wore a deserted look as no bus came out of the roadways workshop today. The striking workers as well as the activists of the Left Parties staged a dharna outside the mini secretariat under the banner of the Centre of Indian Trade Unions (CITU). Fatehabad: Hundreds of striking workers drawn from various government departments, nationalised banks and insurance companies of the public sector today started their “maha padav” (big dharna) outside the bus stand to stop plying of the Haryana Roadways buses in the morning. Amidst heavy police deployment, the striking workers delivered lectures condemning the state and the central governments for their “anti-workers” policies. The striking workers held the authorities responsible for the death of a roadway worker at Ambala and demanded registration of criminal cases against those responsible for his death. FARIDABAD: In Faridabad today, about 1,500 employees of various government departments and industrial workers took out a procession. Traffic movement was affected on the highway and inner roads of the city on the occasion. The roads in Faridabad wore a deserted look. Private transport operators made good business as buses of Haryana Roadways were off the road for the second day. Karnal: Normal life was hit and banking services were paralysed on the second day of nation-wide strike on the call of trade unions here. The entire bus fleet of Haryana roadways was grounded. The employees leaders' threatened to go on an indefinite strike if their demands were not met. The public sector banks wore a deserted look as there were no

Rs 10 lakh for kin of dead employee; probe ordered
Ambala, February 21 The state government decided to give a financial assistance of Rs 10 lakh to the victim's family and a government job to his daughter-in-law as per her academic qualification. It was also decided that a magisterial inquiry of the incident would be conducted and no action would be taken against the employees against whom an FIR was registered for ransacking government vehicles and blocking the highway till the conclusion of
the probe. The administration also agreed to bear the medical expenses of all the injured employees admitted in the civil hospital. |
No more speedy promotions for Dalit staff
Chandigarh, February 21 Against the backdrop of a recent judgement of the Punjab and Haryana High Court, the office of the Chief Secretary today directed all departments in the state, including the universities, to comply with the directions of the high court. In its judgement, the HC held the “decision of the Haryana Government dated March 16,2003, granting ‘accelerated seniority’ to the SC employees as a consequence of promotion under the reservation policy” as ultra vires since it ran counter to the dictum in Supreme Court’s judgement in the M. Nagaraj vs Union of India case in 2006. Prem Kumar Verma, a state government employee, had challenged the March 16, 2008 order under which the Haryana government had been granting ‘accelerated seniority' to the SC category employees in violation of Article 16 of the Constitution and law laid down by the apex court in the M. Nagaraj vs Union of India case. Rejecting Verma’s application for hiking his pay equivalent to that of Amar Singh (an SC promotee) in 2010, the Haryana government had contended that the SC employees were entitled to ‘accelerated seniority’ as a consequence of promotion under the reservation policy according to an amendment to the Constitution (85th) Amendement Act, 2001, which amended Article 16 (4-A) of the Constitution. However, the high court held that in its judgement the apex court, while upholding the 85th Amendment in the M. Nagaraj vs Union of India case, had clarified that the states "were not bound to make reservation for SCs in the matter of promotions." “However, if they wish to exercise their discretion and make such provisions, the states have been mandated to collect quantifiable data showing backwardness of the class and inadequacy of representation of that class in the public employment in addition to compliance with Article 335 of the Constitution,” it said. “This exercise, as mandated by the Supreme Court, has not been undertaken by the Haryana govenrment. No survey has been conducted, no data has been collected which would determine as to whether adequate reservation of the SC category employees in public employment is there or not,” the high court said, quashing the order of the Haryana government.

Compensation scheme approved
Chandigarh February 21 The crime on account of which the compensation is to be paid under this scheme should have happened within the jurisdiction of Haryana. The employees of central or state governments, boards, corporations and public sector undertakings and income tax payees would not be eligible under this scheme. There would be a victim compensation fund. The Home Department would be the nodal department for regulating, administrating and monitoring the scheme. The State Legal Service Authority would be accountable for its functions and furnishing periodical returns of the sums distributed to them by the government through the nodal department. The fund would be operated by the member-secretary, State Legal Services Authority. A victim would be eligible for the grant of compensation where, a recommendation is made by the court under Sub Sections (2) and (3) of Section 357A of the Act or the offender is not traced or identified, but the victim is identified, and where no trial takes place, such victim may also apply grant of compensation under Sub Section (4) of Section 357A of the Act In case of loss of life up to 40 years of age , a compensation of Rs 3 lakh would be paid. It would be Rs 2 lakh for those above 40 years and up to 60 years and Rs 1 lakh for those above 60 years. Similarly, in case of loss or limb or part of body (80 per cent) including loss due to acid attack, a compensation of Rs 2 lakh would be paid for those of 40 years or below in age. It would be Rs 1 lakh for persons between 40 and 60 years. The compensation would reduce to Rs 50,000 for those above 60 years. In case of loss of any limb or part of body (50 per cent), including loss due to acid attack, a compensation of Rs 1 lakh would be paid for those of 40 years or below in age. It would be Rs 50,000 for above 40 years and up to 60 years. A compensation of Rs 25,000 would be paid for those above 60 years. In case of rape, a compensation of Rs 3 lakh would be paid. As a result of loss or injury causing severe mental agony to women and child victims in cases like human trafficking, kidnapping and molestation, a compensation of Rs 50,000 would be paid. In addition to the compensation mentioned above, Rs 2000 would be paid as funeral expenses. Also, in case of medical expenses, actual expenses incurred before death or on account of injury supported by bills or vouchers, but not exceeding Rs 15,000 would be paid in addition to the compensation mentioned above. |
Nirmal Yadav seeks prosecution sanction documents
Chandigarh, February 21 Seeking photocopies of the documents pertaining to her prosecution sanction, her counsel SK Garg Narwana is insisting that the Code of Criminal Procedure came into force in 1973 when technology was not so advanced. In the case of voluminous record, inspection, rather than supply of copies, was a solution. But over the years technology has progressed and providing copies of documents was now a matter of minutes due to efficient photocopiers. Narwana claimed the very fact that inspection of the documents has been allowed indicated that the papers do not fall in the category of privileged or classified. As such, the copies could be supplied at the petitioner’s cost. It was added that non-supply of documents was against the principles of natural justice as these would be relied upon by the prosecution during the trial. Supplying the documents would only assist Justice Yadav to properly assist the court in the matter, he added. Her petition seeking the supply of documents, a day before the case is to come up before the court for arguments on framing of charges, was placed before Justice Sabina this morning, but the matter has been referred to another Bench. A special CBI court in Chandigarh on February 2 had dismissed her earlier application while fixing February 22 as the date for arguments on framing of charges. The court made it clear that the documents could be inspected by Justice Nirmal Yadav or any accused anytime in person or through their counsel. |
Gurgaon-Manesar plan violates NCR Act, Centre tells SC
New Delhi, February 21 In an affidavit filed in the SC, NCRPB’s Chief Regional Planner Rajeev Malhotra has pointed out more than 20 violations, including the absence of efforts to “conserve agricultural land” and a proper rehabilitation plan for farmers. Under the Regional Plan 2012 prepared by the board, GMUC was to be developed for a projected population of 4.5 lakhs by 2011 and 16.5 lakh by 2021, not 37 lakhs as planned by the state, the Centre said. Further, the state’s plan was lacking in several aspects such as public transport, water, roads, sewerage and drainage, adequate open spaces and recreation, disaster management, particularly in the event of tremors in the highly earthquake-prone zone, protection of monuments, land use pattern covering farmland and urban areas, power and solid waste management, it said. Today, a Bench comprising Justices GS Singhvi and Ranjana Desai made UP, Rajasthan and the NCT of Delhi as parties to the case as they were also part of the NCR and involved in NCRPB’s regional plan 2012. Additional Solicitor General Mohan Jain appeared for the Centre, which has been urged by the petitioner to intervene and check the haphazard development of GMUC. The petition would be taken up for hearing again after four weeks. |

Grandmother who strangled newborn girl arrested
Sirsa, February 21 The court has remanded the accused to judicial custody for 14 days. The accused told the police that she did not want a girl child in her family and hence she became upset when she came to know that her daughter-in-law Ramandeep Kaur had delivered a girl. The police had booked her under Section 302 of the IPC after her daughter-in-law Ramandeep Kaur alleged that Jasbir Kaur had suffocated her newborn daughter. The complainant said she was lying on her hospital bed and her five-hour-old daughter was lying besides her when Jasbir Kaur picked the girl, throttled her to death and left after placing the little one’s body on the bed. The girl’s mother raised the alarm, brought the matter to the notice of the hospital staff, and then lodged a complaint with the police. |

Missing ammo: 21 army personnel face inquiry
Ambala, February 21 The train had had set off from Pulgaon in Maharashtra for Jalandhar
cantonment. The matter had came to light during the routine check of the train at the Ambala railway station. However, the boxes were later traced by the Delhi police near Indrapuri railway station. The sources said it appeared to be a handiwork of miscreants who broke the locks of wagon No 71041 and removed the boxes carrying ammunition. However, on realising that the boxes contained ammunition, they abandoned these near Indrapuri railway station. |

Mystery shrouds boy’s death
Rohtak, February 21 His kin who rushed him to the hospital had told doctors that the boy had got injured after he fell down on the street. But the victim’s post-mortem found a bullet stuck in the boy’s neck. He had died of bullet injuries and not of simple head injury, the doctors concluded. The police has registered a case of murder. |

Sonepat, February 21 His body was handed over to his family members after a postmortem examination today. The police has taken possession of the footage of CCTV cameras installed at the station. The two gangsters, with faces covered, reached the pump station around 8 pm and entered the room where Ramesh Gaba was sitting and fired at him from close range. After collecting the cash, they escaped on the motor cycle. In protest against the killing, petrol station owners of Gohana today went on a strike and demanded the arrest of the guilty. |
Sirsa jail inmates clash, 11 booked
Sirsa, February 21 The seven injured prisoners — Rahul, Gursmeet, Rakesh, Awtar, Nishan, Avneet and Kuldeep — were shifted to General Hospital late last night. While two were sent back to the jail after first aid, five have been admitted in the hospital. The FIR lodged with the police by Amit Bhadu, Deputy Superintendent of the jail, said 11 prisoners created a ruckus in the prison and beat up their fellow jail inmates late last evening. The complaint said Satish, Daljit, Rakesh, Gurjant, Sunny and Krishan, all from Ellenabad, Rohit from Mandi Dabwali, Sonu from Hisar, Somjit from Rania, Vinod from Panihari and Balwinder from Nanakpura beat up their fellow inmates and prevented jail officials from performing their duty. An FIR has been registered against the accused. Sources said rivalry between two groups of prisoners had been brewing for some days, leading to the attack last evening. |
5 held in honour killing case
Rohtak, February 21 Those arrested are Pappu (41), girl's father, Balle Ram, alias Balle, 45 (uncle), and Parminder, alias Binder,(son of Pappu), Gohnu and Kala, all residents of Garhi Sampla village of the district. It is claimed that the accused who came in a vehicle had shot dead Rohit Kumar, who was standing near a bank at Sampla. The victim used to work at a spare parts shop there and had been arrested two years earlier in connection with the abduction and rape of a girl of his village. He had allegedly eloped with the minor daughter of Pappu in 2010 and was an undertrial since then. |

Rohtak, February 21 As many as 2,191 unmarked answersheets were found lying abandoned on the building rooftop on February 2. The number of accused could rise after investigation gathers steam as a nexus between officials and staff operating in the varsity had allegedly been active for the past several years, claimed sources in the university. The police has already taken possession of several documents, including unmarked answersheets. It may be recalled that the MDU authorities had earlier suspended 18 employees and officials in this connection after a seven-member probe committee submitted its report and pointed towards the role of employees of the security and secrecy departments. |
