CBI to probe Ishrat Jehan encounter
Ahmedabad, December 1 The court also directed the special investigation team (SIT) to file a fresh FIR in the case. A Division Bench of Justices Jayant Patel and Abhilasha Kumari asked SIT chief RR Verma to file an FIR within two weeks and transfer the case to the central investigation agency observing that the case should be considered as an "exceptional one which has national ramifications". The HC also ordered the CBI to probe the claims made by the Gujarat police after the 2004 killings that Ishrat and three others were LeT terrorists on a mission to kill Chief Minister Narendra Modi. Ruling out handing over the sensitive case to the Gujarat police, the National Investigating Agency (NIA) and the SIT, the Bench listed a set of reasons for its mandate in favour of the CBI. The court enumerated 12 reasons why the case should not be given to state police. In a clear reference indicating trust deficit in the Gujarat police, the court said, “The agency to probe the case must instill confidence and should have credibility among the victims, therefore we find it fit not to assign the case to the state police.” The court also ruled out assigning the investigations to the SIT citing differences of opinion among its members and a majority of them being not willing to continue with the probe as the reasons for not handing over the responsibility to it. The HC also did not give its mandate to NIA, citing the issues concerning its jurisdiction and competence, besides limited scope for cases that it can take up. Based on the SIT report, the Gujarat High Court had recently ruled that the encounter of Ishrat and three others was staged by the police. Ishrat, who hailed from Mumbra in Thane district of Maharashtra, along with Javed Sheikh alias Pranesh Pillai, Amjad Ali Rana and Zeeshan Johar, was killed on June 15, 2004, in Ahmedabad.

New Delhi, December 1 Police are also searching for five more members of the same module, which was operated by Shahrukh. A senior police official said that the remaining terrorists of the module have many aliases, which is a hindrance to their apprehension. The police suspect them to be involved in three separate terror incidents - at German Bakery in Pune, Chinnaswamy stadium in Bangalore and Jama Masjid in Delhi, where the operatives had fired at Taiwanese tourists. The police recovered barrels of weapons such as rocket launchers, grenade launchers and carbines, besides four kilograms of white and brown powders. The police are trying to ascertain whether these powders were used to make explosives. The police is also searching for similar factories situated in Delhi. The factory belonged to Irshad Khan, who is among the six IM members arrested. The police had nabbed him with Abdur Rehman in Chennai on November 27. According to the official, Bhatkal brothers, Riyaz and Iqbal, founders of the IM have been financing the operations from Karachi. They had sent Adil, a Pakistani national, to India on August 10. The official said that Adil was staying in a rented accommodation in Madhubani, Bihar on a mission to recruit impressionable students. He had arrived in India via Nepal. The IM is targeting mainly students because “they are not the usual suspects”.

Group C officials under Lokpal
New Delhi, December 1 Sources said the meeting was hastily convened after senior Congress leaders specifically asked committee chairman Abhishek Singhvi to make the party’s stand clear on the matter. Law Minister Salman Khurshid is understood to have said that including lower bureaucracy under the Lokpal ambit would be “unimaginable”. At the today’s meeting, Congress members remained unambiguous about the exclusion of Group C officials from the ambit of the Lokpal, while BJP, CPM, BSP, SP members demanded their inclusion. The Congress’ argument was that the lower bureaucracy could come under the CVC, which should submit a report to the Lokpal every two months. Angry BJP leaders demanded inclusion of Group C bureaucrats within the ambit of the Lokpal. BJD MP Pinaki Mishra agreed with the Congress’ point of view that bringing Group C bureaucrats under the Lokpal would make the body unmanageable. The report will now be tabled in Parliament with dissent notes from all those who have divergent views. Committee’s chairman Abhishek Singhvi said: “There are differences. This report is not about the Prime Minister, or class A or class B. There are 25 important issues for which there has been convergence in the meeting.” |

New Delhi, December 1 Kerala CM Oomen Chandy, who is expected to meet the Prime Minister tomorrow, wrote a letter to Tamil Nadu CM J Jayalalithaa asking for reducing the water level in the reservoir to 120 feet. In her response, Jayalaithaa referred to "unwarranted provocations from across the border" and said Kerala should abide by the SC order. Replying to letters written by Jayalalithaa on the issue, Singh said he had asked the Water Resources Ministry to convene an early meeting between officials of Tamil Nadu and Kerala to "sort out outstanding issues and allay genuine concerns". He also sought Jayalalithaa's cooperation on the issue.

Basti. According to Basti Superintendent of Police VK Singh, the body of the boy, son of a vegetable seller Ram Samer of Raghopur village, was found from the fields. On investigation, it was found that local strongman Niraj Chaudhury and his brother Dhiraj Chaudhury had ordered the murder as they were angry at the boy called Niraj and his younger brother named
Dhiraj. While both the main accused are absconding, a local youth Pramod
Chadhury, who killed Niraj, and a Dalit boy, who dumped the body in the fields, have been arrested. On interrogation, they termed annoyance at the name of the boy as the motive for the crime. On November 22, they reportedly picked up Niraj when he was returning after watching television at a neighbour’s house. The next day, his body was found in a nearby field.

2G: Raja’s pvt secy Chandolia gets bail
New Delhi, December 1 "The bail application is allowed," Special CBI Judge O P Saini said, accepting Chandolia's bail plea. With the grant of bail to Chandolia, only Raja and former Telecom Secretary Siddharth Behura have been left in jail. All 12 other accused, arrested in the case, have now secured bail. Chandolia, who has been in jail since his arrest on February 2, was granted the relief on furnishing a personal bond of Rs 3 lakh with two sureties of the like amount. The court had yesterday reserved its order on Chandolia's bail plea after hearing counsel for the accused and the CBI. The CBI had opposed Chandolia's bail plea saying he, Raja and Behura were public servants and formed the "core sector" of conspiracy and stood on a "different footing" from those granted bail in the case. "The core sector of conspiracy comprises these three gentlemen (Raja, Behura and Chandolia) and they fall in the same category which is different from others who are granted bail," Special Public Prosecutor U U Lalit had said. "These three gentlemen are on a different footing....It will be unrealistic to draw a parity with those released on bail," he had said. Vijay Aggarwal, counsel appearing for Chandolia, however, had contended that even the apex court has "not dissected the case and granted bail not to the individual accused but in the 2G case".

New Delhi, December 1 A Bench, however, made it clear that Tiwari need not file his response in writing as it would delay the proceedings. The Bench made the clarification when Tiwari’s counsel sought time for filing a reply to the appeal by Rohit, who claims he was born out of a relationship his mother Ujjawala had with Tiwari. The Bench advised Tiwari’s counsel to come prepared for a final hearing on January 19, 2012 and explain why his client should not be forced to give the DNA sample. The Bench asked the counsel whether his client was willing to give a sample now. The counsel replied in the negative, contending it was against his client’s dignity and right to privacy.

New Delhi, December 1 A Bench sought the call records after senior counsel Gopal Subramanium pointed out that the state police was yet to hand over the details to the CBI, which had taken over the probe. “You must have the CDs containing details on Wednesday when the case would come up for hearing again,” the Bench told Gujarat’s Additional Advocate General Tushar Mehta. Mehta, however, said he would have to find out whether the police had any such CDs.

Kolkata, December 1 Governor MK Narayanan attended the function as the state government’s representative. He also criticised China for unnecessarily interfering into the Dalai Lama’s activities. Chief Minister Mamata Banerjee was to attend the function, but she could not because of the critical condition of her mother. The Governor also said that China had no right to dictate the movements and activities of the Tibetan religious leader. When asked about the Chinese consulate’s letter to the state government to ensure that the CM and Governor did not attend the programme, Narayanan retorted, “What do you expect me to do about it? If they have written to the Chief Secretary. They have written.” When a newsman pointed out that the Chinese consulate had objected to his visit here, the Dalai Lama said, "This is quite routine. From their point of view, it is also logical. Some Chinese officials consider me a demon. They raise every objection.” Asked if he expected this kind of reaction from the Chinese Government, he quipped, "I have faced this before. I don't want to comment on the letter from the Chinese consulate." "In March, I formally and officially handed over the political leadership. I am no longer a leader of political administration. So, I don't like to politicise my visit here," the Tibetan leader remarked. The state BJP also strongly criticised China for poking its nose into the personal matters of the Dalai Lama. State BJP chief Rahul Sinha said the Dalai Lama was always welcome to the state. Earlier, India had refused to accede to China's insistence that the Tibetan spiritual leader should not be allowed to attend a Buddhist congregation in Delhi, leading to last-minute postponement of the border talks which were to be held last Monday.
