New Delhi, March 11 Lalu had contested from Chhapra and Madhepura but the election in the former seat was countermanded by the Election Commission due to allegations of “rigging” and widespread violence. However, he was declared elected from Madhepura and took oath as a union minister on May 22, 2004, and as an MP on May 26. Election in Chhapra took place on May 31 and he was declared elected from there also on June 2. But he had resigned from Madhepura on June 16 and retained the Chhapra seat in the Lok Sabha and the petition filed by P.C Sharama, raised a question that his election from Chhapra was “illegal and unconstitutional” for reasons that he had contested it in the countermanded election even after taking oath as Lok Sabha MP from Madhepura on May 26, 2004. The Constitution does not contemplate contesting of an election to the same House by an MP, who continues to be its member unless he had resigned his seat. Since Lalu Prasad had not resigned from Madepura before contesting from Chhapra in the countermanded election, his election from Chappra was challenged in the petition filed through advocate Ahsok Pandey said. Pandey said he had earlier moved the Allahbad High Court, which though said a valid question of constitutional law had been raised in the petition, but it had no jurisdiction to hear the matter as it either had to be filed in the Patna High Court or in the Supreme Court, hence he moved the apex court. The Supreme Court though earlier had ruled that there was no bar in contesting elections from two seats for a particular House, but here a situation became different because the countermanding of election and holding of it after Lalu had taken oath of his Lok Sabha membership, the petition has said. |
Launch of Bangalore airport runs into rough weather
Bangalore, March 11 According to sources, civil aviation authorities have decided to direct the international airport authorities to put off its launch date for another three to four weeks due to insufficient manning of its air traffic control (ATC) tower and other issues. Bengaluru International Airport Limited (BIAL) CEO Albert Brunner today maintained that he had not got any information from the civil aviation authorities indicating there would be a delay in start of commercial operations. He also maintained that the inauguration of the airport, which is scheduled for March 28 by Prime Minister Manmohan Singh, would also be held as scheduled. According to sources, a team of Airport Authority of India (AAI) has submitted a report that the airport had still to recruit the required number of controllers till an inspection held last week. Though BIAL insists that it will have the required number of controllers soon, the AAI as well as the Directorate General of Civil Aviation (DGCA) is not buying this. AAI sources said the controllers had to familiarise themselves with at least a few hundred traffic movements before the launch of commercial operations. There is also the issue of some equipment, which is still to be installed at the ATC. The sources said based on these reports the ministry was likely to postpone the launch of commercial flights at the airport by another fortnight at least to allow for sufficient time for installation of equipment as well as training of the ATC personnel. The BIAL on its part has claimed that all its systems are in place. A few days back it had also hosted the landing of two commercial airlines to check the calibrations of its instruments besides a live check of its baggage check in and other facilities. The BIAL authorities have also been adversely hit by the admission of four petitions by the High Court, which has also voiced the opinion that it is technically feasible to run two airports simultaneously. The High Court while referring to the concession given to the BIAL agreeing not to have any other airport within a 150 km radius could be amended. The court also maintained that the main issue was whether the HAL airport should be allowed to function till the connectivity problems to the new airport were solved. Various petitioners who have filed PILs in the court have maintained that it would be very difficult for short haul passengers to negotiate their way to the new airport at a time when broadening and other Public Works on the road were on. They maintained these works could not be completed before the proposed launch of the new airport. |
CPM centre attacked
Hyderabad, March 11 A group of seven unidentified persons barged into “Sundarayya Vignana Kendram”, an auditorium-cum-library run by the CPM, poured kerosene on the portrait of veteran communist leader late P Sundaraiah, ransacked the furniture and damaged glass panes. The intruders also attacked a security guard on duty with iron rods. While left parties blamed the BJP and RSS supporters for the attack, the saffron party denied the allegation and said it was staged by the CPM to defame the BJP. The two parties took out parallel rallies in the city today and tried to march towards the Assembly, which is currently in session. The police had a tough time in controlling the protesters. Over 100 persons including the state secretaries of the CPM and the CPI B V, Raghavulu and Narayana respectively, and the BJP president B Dattatreya were arrested for defying the prohibitory orders. The CPI and CPM members raised the issue as soon as the Assembly met for the day and stalled the proceedings demanding stringent action against the culprits. However, the BJP floor leader G Kishan Reddy countered saying the CPM was pursuing politics of revenge in Kerala and West Bengal. |
Scarlet’s death points to free drug flow in Goa
Panaji, March 11 The senior police officials have confirmed that Scarlet was high on drugs on the fateful night and interrogations have revealed that she had a mixed dose of drugs and liquor that day. “She had sniffed cocaine and later had ecstasy tablets. In between, she had liquor too,” the police officials said. According to investigations, Scarlet also used to smoke hashish, the police informed. The police contend that all those rounded up in the case are ‘drug consumers’ and investigations are likely to expose the drug trade in the coastal belt. The 15-year-old was partying in a shack at Anjuna beach little before her death, which has also posed question mark on the conduct of the police attached to the Anjuna police station. The state police have already withdrawn all powers from police sub-inspector Nerlon Albuquerque, who conducted the initial probe in the death of British girl, even as state tourism minister Fransisco Pacheco has put his foot down demanding thorough enquiry in the entire drug cartel. “I had informed home minister Ravi Naik about the drug trade flourishing in Baga, Calangute, Anjuna and Palolem coast,” tourism minister Pacheco had said earlier. — PTI |

New Delhi, March 11 Nanda, his son Sanjeev, who is an accused in the BMW hit-and-run case, chartered accountant Bipin Shah and deputy director of income tax Ashutosh Verma were produced before designated CBI judge I.K. Kochar who remanded them to CBI custody till March 14. The four were arrested in Mumbai on Saturday night and were produced before Additional Sessions Judge in Mumbai who had sent them on a transit
remand here. Earlier, the CBI counsel sought a 10-day custody of the accused to unearth details in the case. The counsel said the accused had to be confronted with various documents seized during the raids at different places after their arrest. They also had to be questioned on the recovery of Rs 55 lakh from Shah’s residence.

MoU with ICICI Lombard to be reconsidered

Dehra Dun, March 11 The development followed the news conference in which mediapersons picked holes in the process of signing the MoU without fulfilling the required bidding process, besides other discrepancies. The MoU was formally signed here today in the conference in the presence of the minister, principal secretary rural development Vibha Puri Das and the regional manager, ICICI Lombard, Jaideep Goyal. In fact the MoU was meant for the renewal of the scheme called Narain Krishak Kavach Yojana started in 2004 under the ND Tiwari government with the same insurance company. The scheme covers 9.5 lakh small and marginal farmers of the state. Apparently, the minister was unaware about the different aspects of the renewed agreement, as he could not answer media queries as to why other companies were not invited for bidding. Even the principal secretary looked around when asked for the same and repeatedly maintained that the rate of premium offered by ICICI Lombard was the lowest. “I realise that I was kept in the dark about the whole process,” admitted the minister. He said the whole process would be examined within a week and new bids invited after that to maintain transparency in the process. Sources told The Tribune that the process adopted for signing the agreement was fishy. Some officials of the department were allegedly hand in glove with the insurance company, as no one tried to look into the performance of the scheme. In 2004-05, the company received 799 claims, of which 144 were paid. As many as 142 claims were pending and 86 were rejected. In 2005-06, the number of claims came down to 189, of which 73 were paid. More than 80 claims were pending, 32 rejected and 28 were under process. The number dipped further as only 56 claims were made in 2006-07. Of these, 18 were paid, six rejected, while 27 remained pending. The officials of both sides attributed the reduction in number of claims to lack of awareness among farmers about the scheme. But sources said all this directly benefited the company as any increase in the number of claims would mean increase in the outflow of the money from the company’s coffers. Under the MoU, the state government was to pay Rs 47.50 lakh annually as the premium to the company. |
Chinese naval buildup in Indian Ocean worries Japan
New Delhi, March 11 Prof Marie Yoshioka Izuyama and Eiichi Katahara of the National Institute for Defence Studies, Tokyo, said Japan was also planning to strengthen its missile defence capabilities to counter possible missile threats from North Korea. Prof Katahara, giving a presentation on “Japan towards a normal state: Implications for Asia Pacific” at the Observer Research Foundation here, warned, “If North Korea launches missile attack against Japan then it would be the end of the Kim Jong II regime.” He also said Japan had a very good intelligence gathering capability from North Korea and that would give enough warning time to his country and the US to retaliate appropriately. Prof Katahara said there was also a big debate going on in his country whether to go for the nuclear umbrella being offered by its ally US to counter the North Korean nuclear threat. Replying to a question, Katahara said there was no strategic change in the US position towards denuclearisation of North Korea. “US’s direct talks with North Korea only indicate a tactical shift in its policy of denuclearisation of North Korea. There is no strategic shift in the US position,” he said. The Japanese professors noted that as part of becoming a “normal state”, the Japan Defence Authority (JSA) had now been (since January last year) transformed into a full fledged ministry of defence with powers to bring in its own legislations to Diet (Parliament). It had been turned into a “political agency” from a “management agency”, Katahara said. In forging a new security order led by the US, Japan has to see that the US do not commit mistakes like it did in Iraq. “It is very important for Japan being its ally,” he noted. He said the other international security order that Japan would prefer was East Asia Security Community in which Japan would play a major role. The Japanese defence scholars said they did not expect Japan to become a “normal state” at least not under Prime Minister Yasuo Fukuda. “Maybe later in this millennium”, they said. |
Lieut-Col’s trial time-barred: GCM
Chandigarh, March 11 The GCM, presided by a Brigadier from Army Headquarters, had assembled at New Delhi on March 4, when the defence had raised its plea in bar. The court’s decision has been forwarded to the General Officer Commanding Delhi Area for confirmation. Sources in Army Headquarters said the officer, Lieut-Col R.
Rajain, had faced charges under Section 354 of the Indian Penal Code read with Section 69 (civilian offences) of the Army Act. The officer was posted in the MI Directorate at Army Headquarters when the alleged offence took place in December, 2004. Sources said the woman clerk had approached the officer over an issue pertaining to her annual confidential report. Thereafter, he allegedly made several telephone calls to her and also asked her to meet him outside the office. Though the alleged incident had taken place in December, 2004, the matter, according to sources was reported to the authorities after a few months. During investigations, the officer had denied the allegations and had maintained that he had called up the clerk for some official purpose only, sources added. Though the prosecution had opposed the plea in bar, defence counsel Col Virender Singh (retd) contended that the victim was aware of the alleged offence and identity of the alleged perpetrator and hence the time for the limitation period commenced from the date of the alleged offence and not the date of the matter being reported. |

New Delhi, March 11 In an obvious attempt to improve the report card of his ministry following the illegal kidney racket in Gurgaon recently, health minister Anbumani Ramadoss is keen on introducing ‘presumed consent’ principle in organ donation by starting with the cornea. He, however, said the cornea would not be removed in case where a brain dead person has specifically willed against organ donation. Ramadoss is optimistic that the principle of presumed consent will contribute to an increase in the availability of organs. The minister said while most of the countries have adopted the presumed consent, India and the United States have the expression consent. In the first concept, it is presumed that any person who is brain dead has agreed to donate his or her organs while in the second concept, the family of a brain dead person has to give permission for donation of his/her organs. The minister said the concept of presumed consent would be introduced after a public awareness campaign. He said the decision was taken after a team of health ministry officers visited Belgium, France, Spain and Singapore to study the organ transplant law there and recommended adherence to the Spanish model. The team led by director-general of health services R.K. Srivastava reported that in Spain presumed consent had led to increased donor rates. Dr Mahipal Sachdev, corneal specialist and medical director of the Centre for Sight says that the move to adopt the concept of presumed consent is likely to raise a storm among the Indian population. “Instead of touching cases of natural death- say, a brain dead patient in a case of a stroke, it makes more sense to harvest the corneas from a person who has had an unnatural death and where a postmortem is mandatory under the law. This can be the first step as is applicable in some states in the United States. This in itself would take care of shortage of corneas in the country to a large extent. A noted ophthalmologist who has worked in cornea services and eye bank at RP Centre in AIIMS, Dr Sachdev said, “We have to first understand that nowhere in the world are corneas removed before a person is actually dead. Why should the government decide to deny the next of kin of a terminally ill patient on life support the right to give consent to donate the patient’s corneas? In any case, the consent of the next of kin of such a patient is mandatory to withdraw life support.” Dr Samiran Nundy, a noted liver transplant surgeon and member of the Singhvi committee that drafted the Human Organ Transplantation Act, 1994 says: “We examined and considered this aspect of presumed consent for organ donation and decided against it because we felt that the semi-literate poor would not understand the concept of opting out. Besides, only a handful of countries with a very high level of literacy have enforced presumed consent. Many countries including the UK have rejected presumed consent. It is completely wrong on part of the government to say that in case a brain dead person has willed against organ donation, his corneas will not be removed.” Dr Nundy who has been a member of the editorial board of the British Medical Journal and editor of the Indian Journal of Medical Ethics, said, “I do not think it is ethical in our country where only the educated and rich will opt out and the poor will not understand the concept. I have a genuine apprehension that it may retard rather than encourage brain dead cadaver organ donation. It is better to educate public and doctors on the merits of removing organs from brain dead.” |
Uproar in House over remarks against Mahatma Gandhi
Lucknow, March 11 Joining hands to lash out at the BJP for being “soft” on the Gorkahpur MP’s remarks Congress and SP MLAs not only resorted to slogan raising but also stormed into the well of the House forcing Speaker Sukhdev Rajbhar to adjourn the House for half an hour. Taking exception to Yogi Adityanath’s remarks questioning Mahatma Gandhi’s status as ‘Father of the Nation’, Congress Legislature Party leader Pramod Tiwari raised the issue through a point of propriety. Addressing a gathering of youth, including city Mayor and well-known BJP leader Dinesh Sharma at the Rashtriya Swayam Sewak Sangh (RSS)-run Saraswati Shishu Mandir in the state capital on Monday the young MP Adiyanath had remarked, “Gandhi was not the appropriate person to be called Father of the Nation; instead, the mantle should have gone to someone like Ram or Krishna”. Hitting out at the BJP-Hindu Mahsabha’s political face, Tiwari branded those supporting the BJP ideology as cohorts of Gandhi’s killer Nathuram
Godse. Reacting to the remark, senior BJP leader Hukum Singh claimed that his party had “deep regard” for Mahatma Gandhi and referred to him as Bapu. “Still it does not mean that those who do not completely agree with his philosophy could be bracketed as his murderers,” he pointed out. Virtually holding a brief for the Mahant, Singh underlined that the title of ‘Father of the Nation’ was not a Constitutional position, but a sobriquet adopted by people out of regard for Mahatma Gandhi. As such no one was bound by it and was free to express his opinion and that was perhaps what the Gorakhpur MP had done,” Singh said. Not stopping at that, Hukum Singh went on to add that, “some fake Gandhis have been using the name only to draw political mileage.” An angry Tiwari unleashed a diatribe against the BJP and led his group of Congressmen into the well of the House where they settled chanting Bapu’s favorite hymn ‘Raghupati Raghav Raja Ram...’ Not to be left behind in hitting out at the BJP the SP members also trooped into the well raising anti-BJP slogans. Seconding the Congress demand in an emotional speech Leader of the Opposition Mulayam Singh Yadav also demanded action against the Hindu hardliner MP for making anti-Gandhi remarks. Another senior SP leader Mohammad Azam Khan also lashed out at the BJP and its allies for “always vitiating the atmosphere.” Remaining a mute spectator to the unfolding drama parliamentary affairs minister Lalji Verma opposed Tiwari’s insistence of allowing the issue to be raised through a point of propriety. |

Fresh cases of bird flu in backyard farms
New Delhi, March 11 “It is difficult to understand how some birds were left out, when the government claimed that they had completed the culling operations,” the National Egg Coordination Committee (NECC) today said, pointing out “huge losses” suffered by the organised sector due to continued negligence of backyard poultry farms. Incidents of bird flu in backyard poultry farms amounts to huge monetary set backs to the industry, says the organisation with more that 25,000 poultry farmers as members while appealing to the government to understand “the gravity of the crisis being faced by poultry farmers” and extend to them a relief and revival package like agri-farmers. It says, while bird flu occurs in backyard farms, which account for just 2-3 per cent of the industry, it is the organised sector that suffers. “The organised sector, which is 98 per cent of the industry, is technologically one of the most advanced in the world. Our disease surveillance, disease prevention and bio-security systems are among the best in the world. Hence, the organised sector is free from bird flu.” However, due to recurring cases of bird flu in backyard farms, the entire industry, supporting livelihood of 3.2 million persons and contributing over Rs 40,000 crore to the GNP, is forced to suffer huge losses, NECC claims. The NECC says prior to the ban, over 4 crore-table eggs per day and 2 crore hatching eggs per week were being sent to West Bengal and northeastern states from Andhra Pradesh, Tamil Nadu and Karnataka. However, because of the ban on their movement, these eggs/hatching eggs had to be diverted to other markets in the country at distress prices, resulting in a loss of at least Rs 3,000 crore. The industry says the government should treat the matter seriously and ensure that the culling is done properly, as such incidences in the backyard poultry affect livelihood of millions of people dependant on the organised poultry sector. |

India committing another historic blunder: LTTE
Chennai, March 11 The statement titled: “Is the Indian state attempting yet another historic blunder?” issued from LTTE headquarters in Jaffna in Sri Lanka was sent today to journalists throughout Tamil Nadu. In it, the LTTE urged the “Tamils of Tamil Nadu to understand the anti-Tamil move by the Indian state and express their condemnation” and thereby make the central intelligence agencies sit up as militant activities in the state have been on the rise over the past several months. It pointed out that by aiding the Sri Lankan military and welcoming its chief, Major General Sarath Fonseka, “India is committing yet another historic blunder”, the first one being sending of the IPKF in 1987 following the accord between the then Indian Prime Minister Rajiv Gandhi and Sri Lankan President J.R. Jayawardene. Subsequently, an LTTE suicide bomber assassinated Rajiv Gandhi on May 21, 1991 at Sriperumbudur, 70 kms from here. The LTTE’s statement came following Fonseka’s visit to New Delhi early this month seeking military aid. The Tigers stated: “We wish to point out to India that another historic blunder by it will continue to subject the Eelam Tamils to face genocide on a massive scale. “Sri Lanka, in its canard, is blaming the LTTE and is seeking assistance from the world for its war of ethnic genocide,” it alleged and pointed out that many European countries, understanding “this hidden motive of the Sinhala state, had halted all assistance to it”. However, it lamented: “India also knows this truth. Yet, while pronouncing that a solution to the Tamil problem must be found through peaceful means, it is encouraging the military approach of the Sinhala state. This can only lead to the intensification of the genocide of the Tamils.” The LTTE said New Delhi’s reception to Fonseka, “who is heading the Sri Lankan state’s war of ethnic genocide against the Eelam Tamils, has deeply hurt us” and it strongly condemned welcoming the military chief of “the Sinhala state which has unilaterally abrogated the ceasefire agreement and launched widespread military offensives in the Tamil homeland”. The militant organisation fighting a 28-year-old war for an independent homeland for ethnic Tamils in northern Sri Lanka said the view expressed by the Indian military chief — “India wants to ensure that the Sri Lankan Army maintains its upper hand over the LTTE” -- illustrates the efforts of India to prop up the “Sinhala war machine”. |

Give more powers to CBI: Panel
New Delhi, March 11 The committee was of the view that the CBI should be given power to recruit officers at various levels to meet manpower shortage rather than depending on the UPSC and felt that there should be less dependence on deputation from other forces. The panel in its report, placed in the Rajya Sabha today, suggested that a separate anti-terrorism wing be created in the CBI with powers to act on intelligence inputs collected by the central government to ensure prevention of crimes. Briefing reporters about the recommendations of the committee, its chairman
E.M. Sudarsana Natchiappan identified terror acts, human trafficking, smuggling and blackmarketing as crimes, which could be classified as federal crimes that could be taken by the CBI directly. As for incidents like terror attacks, the committee felt that by the time the CBI was handed over the case, precious time elapsed which not only resulted in loss of local evidence

India reconciles to price hike
New Delhi, March 11 “There will be some price hike. We need to pay extra amount and whatever amount is due, as per contracts, we will pay,” Mehta, who had in the past opposed any renegotiations with Russia on a price hike demand, said. His remarks assume significance in the wake of defence minister A.K. Antony’s statement in Parliament that the expert team had discussed aspects of all additional works projected by the Russian side on the carrier. “The process of examination of the scope and necessity for additional work has been initiated,” the minister said in Lok Sabha. On Barak anti-missile system, the Naval Chief said though the Navy needed more of them, it had built up enough stockpiles for the present. — PTI |
RS to have Zero Hour everyday
New Delhi, March 11 The leaders shared Ansari’s anguish over derailment of the Question Hour and Zero Hour and favoured a way out so that normalcy was maintained in the House, Parliament sources said. As a solution, it was broadly agreed that Zero Hour would be taken up everyday to enable members ventilate their views on important issues concerning their states, the sources said. There was a near consensus to permit 10 issues every day and three minutes could be allotted for each issue, they said. The Upper House does not have Zero Hour every day at present and when members are not allowed to raise various issues during the pre-lunch sitting, the House witnesses’ uproar and frequent adjournments. The suggestion came even as a proposal was before the Chairman that the Question Hour be shifted to some other time during the day. However, the suggestion did not find favour among MPs.

Ahmedabad, March 11 “Our main concern this year was the subprime crisis. We are relieved that this has not affected the placement at all and the average salary offered has been about 30 per cent more in comparison to last year,” IIM-A director Sameer Barua told reporters here today. The highest international annual salary of Rs 1.44 crore was offered by a company in finance marketing sector, informed IIM-A officials. However, they refused to reveal the identity of either the company or the student, saying both have requested anonymity.

Mumbai, March 11 According to reports from the interiors of the state, three farmers in Akola district had committed suicide since Monday night. The police have given the names of the three as Ramesh Ambhore, Shrikrishna Gangaram and Gowardhan Manik Solanki. Local media persons say all three were indebted to money lenders though the local police are not attributing the deaths due to indebtedness. On Monday Devendra Khedkar (28), of Jitapur village in Akola drank insecticide at the district headquarters. According to activists, farmers had long exhausted all opportunities for loans from banks and were now relying on money lenders who charged high interest rates. |
