Clinton hints at visiting India

NEW DELHI, Dec 2 (PTI) — Prime Minister Atal Behari Vajpayee has been in regular touch with the President of the United States of America Bill Clinton reiterating India’s desire for a broadbased relationship between the two countries, the Lok Sabha was informed today.

In a written reply to a question by Mr Mohan Singh, Bala Saheb Vikhe Patil and K.S. Rao, Minister of State for Agriculture Sompal said the US President had indicated his desire to visit India in the near future.

United Nations: To another question Mr Sompal said the government of India had been making efforts to obtain full reimbursement from the United Nations for the services rendered by it in the UN Peace-Keeping operations.

The UN Secretariat was reminded from time to time for expeditious settlement of claims and payment of arrears. He told the Lok Sabha to a question by Prem Singh Chandumajra, Mr Chandrashekhar Sahu and Mr Sriram Chauhan.

CTBT: To another question on the Comprehensive Test Ban Treaty, Mr Sompal said bilateral discussions were held with France, Russia, United Kingdom and the United States of America on a range of issues including disarmament, non-proliferation, India’s security concerns.

The discussions on the CTBT are continuing and India has declared that "it is prepared to bring these discussions to a successful conclusion so that a coming into force of the CTBT is not denied.

Ruckus over Ports Bill

Rajya Sabha adjourned for 15 minutes

NEW DELHI, Dec 2 (PTI) — The Rajya Sabha was adjourned for 15 minutes today following clashes between the Congress and the treasury benches, over the introduction of a Bill on major ports for modifying guidelines to permit joint ventures between board of trustees and owners of foreign ports.

The House witnessed noisy scenes in the post-lunch session over a ruling by Vice-Chairman Adhik Shirodkar that the Major Port Trusts (Amendment) Bill, 1998, had been introduced in the House after voice vote. This was disputed by Opposition members.

It began when Surface Transport Minister M. Thambi Durai sought permission of the Chair to introduce the Bill when the House was in the midst of a discussion on the calling attention motion relating to schemes of the Unit Trust of India (UTI).

Mr Jibon Roy (CPM) and Mr Vyalar Ravi (Cong) were the first to oppose Mr Thambi Durai’s proposal for introduction of the Bill, saying it was an important Bill concerning jobs of lakhs of workers engaged in ports.

They argued that the Bill would have serious ramifications if it was passed without adequate discussion and suggested referring it to a House committee.

The Chair allowed introduction of the Bill after the minister assured that the interest of the workers would be taken care of. The members were also free to discuss it.

The Chair refused permission for division as demanded by the Opposition which claimed that "nos" had the majority in the voice vote.

Giving his ruling, the Vice-Chairman said he had allowed the minister to introduce the Bill only after having sought permission of the members and he was sticking to the ruling.

Members from both sides referred to rule books and procedures of the House in support of their arguments on whether they could challenge the ruling of the Chair.

However, Opposition members, including Md Salim, Mr Nilotpal Basu, Mr Jibon Roy, all CPM, said they had the right to challenge the Chair's ruling.

In the beginning, Mr Jibon Roy staged a protest walkout when the Vice-Chairman said he had expunged the member's "remarks".

The agitated Opposition members did not agree with the views of the Finance Minister Yashwant Sinha who said that there was no need for a discussion once the Chair gave its ruling.

He said there was no need for division as no member had objected to it at the introductory stage. He appealed to the members to take a decision when the Bill came up for discussion.

The Opposition continued to protest, saying the ruling was unprecedented and a threat to democratic functioning in the House despite repeated appeals by the Chair.

The Vice-Chairman did not agree with the suggestion by CPI member Gurudas Dasgupta that the matter be "reopened" as the members' rights were "somehow overlooked".

He later called Mr Raghavji (BJP) to participate in the discussion on the calling attention motion.

The Vice-Chairman adjourned the House for 15 minutes as Opposition members continued to disrupt the proceedings.

When the House met after adjournment at 1525 hours, he asked the members to treat the matter as closed and restore normalcy in the House.

Later, the House took up discussion on the calling attention motion.

Taj no architecture: Jethmalani

BANGALORE, Dec 2 (PTI) — The Taj Mahal is no architecture at all, according to Union Urban Affairs Minister Ram Jethmalani, who says the ancient monument does not fit in his definition of architecture.

Architecture, to be qualified so, should serve the twin purpose of fulfilling practical needs of civilised men and giving expression to the architect’s inner soul, he told an international symposium on ‘Innovative Architecture in Asia.’

Going by this definition, he said, Taj Mahal was by no means architecture, as the architect had not put his ‘inner soul’ into the monument and had only satisfied the ego of a king, who merely wanted to perpetuate the memory of his wife.

“The architect was only depicting the pathos of a king, not of the architect himself,” he said.

This great monument (Taj Mahal) also symbolised ‘ruthless exploitation by the king of his helpless subjects, thousands of whom must have died,’ he said, adding money spent on it was from the poor man’s resources commanded by the king.

The Taj might be bringing in revenue from tourists ‘but that was not something Shahjahan thought of’ and he only wanted to create a structure by which he and his wife would be remembered by posterity, Mr Jethmalani said.

Mr Jethmalani said he held a similar view about pyramids in Egypt as they did not fulfil the utility criterion and into which the architect did not put his soul.

“I don’t think these things are architecture, though they are considered masterpieces of architecture”, he said.

Referring to “India’s practical needs,” he said there was a colossal deficit in housing with 3.3 crore units to be built to meet the requirements of the poor.

Mr Jethmalani said it was a great challenge for the architects to ‘produce something of utility to the poor and something that brings joy of possession and joy of civilised existence.’

No change in Agni missile programme

NEW DELHI, Dec 2 (UNI) — India’s talks with the USA and other interlocutors have not led to any change in the plan of the Agni missile programme, Defence Minister George Fernandes informed the Rajya Sabha in a written reply today.

Based on the threat perception, the government had already approved the development of a longer range Agni using state-of-the-art technology developed indigenously, the minister told Mrs Veena Verma.

India had explained her security concerns during talks with the USA and other interlocutors, the minister said.

Mrs Verma wanted to know whether after the successful fourth round of talks with US Deputy Secretary of State Strobe Talbott, the government had decided to test the modified longer range version of Agni

Border firing: In a statement in response to another question the minister said the exchange of fire along the IB portion of J and K, Line of Control and Saltoro range area is a regular phenomenon.

Pakistan resorts to unprovoked firing all along the border in J&K with the aim of abetting infiltration and to portray that J and K is a flash point. A befitting reply is given by Indian troops in all incidents of firing.

In so far as the border in Punjab, Rajasthan and Gujarat is concerned there were two incidents of unprovoked firing from Pak Rangers, in which one BSF personnel was killed and two injured.

During the Foreign Secretary-level talks between India and Pakistan, held from 15th to 18th October, 1998, in Islamabad, India strongly took up the subject of cross-border firing with Pakistan.

India pointed out that the repeated firing by Pakistani forces constituted a violation of the commitments of Pakistan under the Simla Agreement. Pakistan was urged to instruct its forces to exercise utmost restraint and to use the established diplomatic and military channels to prevent untoward incidents.

On the induction of Prithvi missiles he told another questioner that the Prithvi surface-to-surface missile with 150 km range and one tonne warhead had been inducted into the Army.

Surjeet asks allies to rethink

NEW DELHI, Dec 2 (PTI) The CPM today said the allies of the BJP would have to “seriously rethink” on continuing their support to the government for their own survival, as various policies being pursued by the Centre went against their interests.

“Allies will see whether the BJP is a liability or an asset. If they are losing by joining (with) the BJP then they will have to seriously rethink for the sake of their own interests,” party general secretary Harkishen Singh Surjeet told reporters here.

To a question about supporting a Congress-led government in the event of this government “falling under its own weight”, Surjeet said “Let this government go. There will be no dearth of solutions (for an alternative).”

Asked what could be the solution to problems like price rise and attacks on minorities, Mr Surjeet said, “The immediate solution is that the BJP government goes. It has been seriously damaged by this (Assembly poll) verdict. It has lost the moral and political legitimacy to continue.”

“In the present situation, I would like the BJP to go. Only then can the national situation be saved from further deteriorating,” he said while elaborating on the “threats” posed by the BJP to secularism and federalism.

“But there is no question of replacing the BJP with a Congress government. We will not do anything like the BJP did in Uttar Pradesh by organising defections through moneybags,” he said.

On the Left’s support to a Congress government, the CPM leader said, “It is not going to be a permanent arrangement, nor will it be an alliance or a front. We will give issue-based support to such a government for a particular time

Preserve sanctity of shrine: HC

BANGALORE, Dec 2 (PTI) — The Karnataka High Court today passed orders directing the Karnataka Government to take steps to preserve the sanctity of the shrine, "Baba Budangiri Dattatreya Peetha", by maintaining peace in Baba Budangiri hills on the eve of Datta Jayanthi and rath yatra proposed to be taken out by the VHP and the Bajrang Dal.

A Division Bench comprising Chief Justice R.P. Sethi and Justice Mohammed Anwar passed the orders on a public interest petition filed by Mohammed Obaidulla Shariff, Chief Editor, The Daily Pasban, Bangalore and another person.

The petitioners had submitted that a call for rath yatra from December 1 to December 3 had been given by the Bajrang Dal and the VHP. The petitioners apprehended breach of peace in the shrine situated in Baba Badangiri hills, Chikmaglur, due to the yatra.

The judges had earlier ordered issue of notice to the respondents. When the matter came up for hearing today the state government filed an affidavit and objections.

The judges after placing on record the same directed the state to take necessary steps to preserve the sanctity of the shrine and adjourned hearing on the writ petition to next week.

Meanwhile, hundreds of VHP and Bajrang Dal activists arrived here on Wednesday to a tumultuous welcome even as security was put on top gear following their threat to "liberate" the shrine.

The VHP-Bajrang Dal activists, chanting Vande Mataram, swarmed the city as five rath yatras from different corners of Karnataka and one from Maharashtra wound their way through the busy thoroughfares before culminating in a rally.

IRA Bill next week: Khurana

NEW DELHI, Dec 2 (PTI) — Opposition within the BJP appears to be mounting to the Bill to open up the insurance sector to foreign equity with party MPs coming out in the open against it even as the government wrote to the Lok Sabha Speaker that it plans to table the legislation early next week.

A day after confusion and contradiction on the introduction of the Bill yesterday, the controversy over the government’s move deepened with party general secretary and the Lok Sabha member Sumitra Mahajan coming out strongly against the proposal saying "we are totally against (Bill) and it is not in our manifesto".

She said the Bill would not be beneficial to the country and appealed to the government to "reconsider’ it.

However, the Rajya Sabha member K.R. Malkani was hard hitting in his criticism when he said the government’s move was not right and had been done under "pressure".

"There is enormous pressure by the USA and I regret the government is buckling down, a bit, it seems," he added.

A minister in the Vajpayee government, Uma Bharati, who reportedly criticised the Bill at the parliamentary party meeting yesterday, appeared to tread a cautious path today.

Refusing to give her comments on the issue, she said "I am part of the government and whatever I have to say I will do so in the proper forum."

Party spokesman Krishan Lal Sharma sought to play down the controversy saying the BJP would support the Bill for its passage in Parliament.

In a discussion on any subject, various views were expressed but when the Bill would come up for passage the party would secure the vote of its MPs even if by issuing a whip.

After yesterday’s flip flop, Parliamentary Affairs Minister Madan Lal Khurana told reporters that he had written a letter to Speaker G.M.C. Balayogi for permission to introduce the Bill on Monday or Tuesday.

Tribune News Service

NEW DELHI, Dec 2 — Prime Minister Atal Behari Vajpayee may soon call another meeting of all political parties to discuss the constitutional amendment Bill providing for one-third reservation for women in Parliament and State Assemblies while the Lok Sabha will start discussion on rise in prices tomorrow.

The Union Parliamentary Affairs Minister Madan Lal Khurana said the decision was arrived at the business advisory committee of the Lok Sabha, which met here to finalise the agenda.

Referring to the motion for discussion on the issue of sharp rise in prices of essential commodities, Mr Khurana said it was agreed to start it tomorrow under rule 193. The Leader of the Opposition, Mr Sharad Pawar, had sent a notice to the Speaker which is supported by other party members like Mr P.C. Chacko and Mr Ajit Jogi.

IRA Bill: BJP puts up show of unity

NEW DELHI, Dec 2 (UNI) — The BJP today put up a brave show of unity by saying that criticism in certain quarters of the party was part of the "ongoing debate" within the party on the controversial Insurance Regulatory Authority (IRA) Bill.

As long as the Bill is not introduced, members are free to air their views. But once the Bill is introduced the party will stand behind the government like a rock, BJP Vice-President Krishan Lal Sharma told newspapers here.

Mr Sharma said consultations were on at various levels to find out the reasons for the party's drubbing in the just concluded assembly elections in three states. HC refuses to intervene in Jha murder case

NEW DELHI, Dec 2 (PTI) — The Delhi High Court today refused to intervene in Shashi Nath Jha murder trial at this stage and turned down a plea for sending blood samples for ‘DNA’ test abroad, saying the CBI had already submitted the charge sheet in the trial court.

A Division Bench, comprising Mr Justice Devinder Gupta and Mr Justice Mukul Mudgal, disposing of 1996 habeas corpus petition filed by Jha's mother Priyambada Devi and his friend Mukesh Babu, said the petitioner could request the trial court in this regard.

The court said "if the petitioners are not satisfied with any order passed by the trial court, they may approach the High Court."

The court disposed of the habeas corpus petition after CBI counsel A.K. Dutt submitted that on the basis of probe done by the agency, charge sheet had been filed against Soren and six other persons for the alleged murder of Jha, who was abducted in May 1994 from the capital and taken to Ranchi.

According to the charge sheet, Jha was allegedly murdered at Ranchi because he had "knowledge" of payment of bribe in the JMM MPs' bribery case.

The CBI in August this year recovered a skeleton from there, which it claimed, was Jha’s.

Petitioner’s counsel Satyanarain said his clients were apprehensive of "fair trial" as the CBI had made those persons as witnesses who were "hand-in-glove" with the accused persons.

He cited names of former JMM MP Simon Marandi, Sushil Kumar and Mukti Tirak, two close confidants of JMM leaders, in this regard.
