Yog Raj’s cousin moves HC
Chandigarh, October 6 Section 354-B, introduced following the infamous Nirbhaya gang-rape incident in New Delhi, deals with assault or use of criminal force with the intent to disrobe. The brawl between Kuljit Kaur’s family and the retired DSP Ashanand and his two sons had allegedly taken place on August 24. Appearing on her behalf, senior advocate Puneet Bali told the Bench that attempt to rape case under Section 354-B was not registered despite the chest and neck injuries. Bali added that Section 166A in the Code of Criminal Procedure, 1973, also made it clear that the police officers refusing to register case under the relevant Section of the IPC were to be proceeded against. Taking up the matter, Justice K Kannan of the High Court fixed October 13 as the next date of hearing in the matter. Kuljit Kaur has already submitted a handwritten statement to a DSP, narrating the incidence of brawl between her family, and the retired DSP Ashanand and his two sons on August 24. In her complaint to the officer, Kuljit Kaur had alleged that the police officials were unwilling to lodge her complaint, even though she showed him the bruises she and her children suffered. She also alleged that she - along with Yograj Singh, Bhupender Pal Singh, Aaron, and Tanya - were made to sit in illegal detention the whole night on August 24 at the Sector 5 police station. But the police allegedly did not detain the retired DSP Ashanand and his two sons the same night, but arrested them only the next morning. |
