Construction of double storey in
single-storey zone
Chandigarh, August 27 As the issue came up for hearing before the High Court, its Division Bench dismissed a petition
filed by Sudeep Mahajan against the Chandigarh Administration and other respondents. He had challenged the amendment in the zoning plan of Sector 36-D vide notification dated November 9, 2005. Owner of a 2-kanal house in the Sector 36, his grievance was that the Administration had permitted construction of double storey servant quarters in Phase-II sectors of Chandigarh by amending the earlier zoning plan of September1968. He had added that the construction of double storey servant quarters would invade the privacy of residents in the vicinity, as the accommodation could be let out to paying guests, resulting in the rise of noise level and hooliganism in the area. Taking up the matter, the Bench of Justice Hemant Gupta and Justice Kuldip Singh observed: “A perusal of the directions shows that the zoning plan for servant quarters in 2-kanal houses in Phase-II sectors of Chandigarh was allowed as in zoning in respect of houses in Phase-I sectors…. “The zoning has been changed to permit double storey construction on the single-storey zone to facilitate the ever increasing demands of the inhabitants of the city and at the same time maintain a uniform pattern. What kind of construction should be permitted in the Chandigarh urban area is for the experts to decide. “If the experts have decided to permit construction of double storey building on a single storey zone, the same cannot be said to be invalid or arbitrary…. Thus, we do not find any illegality in the amendment in the zoning to prescribe height of the servant quarters as 24’-9”…. “The other arguments that the amendment in the zoning plan invades the right of privacy or that the occupants of the house will use the servant quarters for letting out the same to the paying guests; the noise level will increase and that there will be hooliganism, are the matters which are in the realm of conjectures. “If the noise level increases and there is hooliganism, the petitioner has an efficacious remedy under Section 133 of the Code of Criminal Procedure and under the Civil Law as well. The right of privacy is not an absolute right. The perception of privacy differs from person to person. “Once uniform Rules have been framed for all owners, the same cannot be said to be invalid for the reason that one of the occupants feels threat to his privacy. Consequently, we do not find any merit in the present writ petition and the same accordingly dismissed”. |

Stray dog menace Chandigarh, August 27 Taking note of inability to put a leash on the population of stray dogs in the city, Justice Rajan Gupta also asked the MC Joint Commissioner to appear in person on Thursday. As the case came up for hearing, Justice Gupta observed: “What was the need of such a tour since all such information was available on the internet. Can’t the councillors operate the internet? What kind of information they have collected from Nashik to control the stray dog menace?” The HC has already directed the Chandigarh Administration to launch a special drive to control the stray dog menace in the city. Directing the administration to start it as a pilot project from Sector 16, the HC asked it to launch a cleanliness drive in the area too so that the vulnerable spots where stray dogs were found assembled most of the time could be identified and cleaned up. The HC also asked the administration to first carry out a survey in the sector before launching the drive. Taking up the stray dogs menace case, the HC had earlier asked the authorities concerned in Chandigarh to give its response on the feasibility of setting up anti-rabies vaccination centres at veterinary hospitals in Sector 38 and Mani Majra. |

Developer penalised for delaying possession of flat Chandigarh, August 27 The commission has also directed the Delhi-based developer to obtain
completion and occupation certificates from the competent authority within six months apart from paying Rs15,000 as cost of litigation. Naveen Parkash Kashyap (58), a resident of Zirakpur, had, in October 2006, applied for a flat in the Jaipuria Sunrise Greens, VIP Road, Zirakpur, a project by SMV Agencies Private Limited. He claimed that he was misled by the developer that the apartment had the statutory approvals from various government departments/authorities. He stated that in the allotment letter, the developer had promised that the possession of the said flat will be given by October 2008 but it failed to deliver it as the apartments were not ready. However, SMV Agencies Private Limited denied any deficiency in service. The company admitted that the possession was not given on the appointed date, adding that the complainant had admittedly received compensation for the delayed period at an inflated rate of 9 per cent on the condition that he shall raise no further claim. Regarding the completion certificate, the developer stated that the application for grant of completion certificate was filed with the authorities concerned and its issuance was awaited. “It clearly shows that the completion certificate has still not been issued to the developer by the competent authority, which is a clear cut deficiency in rendering service and unfair trade practice on the developer’s part,” the commission ruled. |

Lok Adalat quashes power bills of over
Rs 5 lakh
Mohali, August 27 The Lok Adalat, headed by Jagroop Singh Mahal, allowed an application moved by Jagjit Singh of Sector 68 and set aside the bills of August, October and December, 2013, for Rs 97,290, Rs 2,04,140 and Rs 2,20,310, respectively. The respondent was also directed to overhaul the account by taking into consideration the actual consumption in the corresponding period of the previous year and to pay Rs 10,000 as litigation cost to Jagjit Singh. Jagjit had an electric meter at his residence which was defective and, on his request, it was removed. However, for four months the respondent did not send the meter to ME Lab for testing. In the meantime, electricity bills of Rs 97,290, Rs 2,04,140 and Rs 2,20,310 were issued to the applicant and he was directed to pay the amount. According to the PSPCL, the meter on testing was found to be “OK” and, therefore, the bills issued on the basis of the actual consumption were liable to be paid by the applicant. The Lok Adalat found that the PSPCL did not observe the rules and regulations while removing the meter or getting it tested from ME Lab. It was neither sealed nor signatures of the applicant were obtained on the packing when it was removed. No advance notice was given to the applicant about its testing, though seven days’ advance notice was necessary. The meter was tested in the absence of the applicant. The affidavits of the persons, in whose custody the meter remained for a period of four months, were not produced. It was, therefore, held that since the meter was not removed and tested in accordance with the regulations, the report of the lab could not be accepted as correct and the bills issued on the basis of the readings given by the defective meter were set aside. The respondent was directed to overhaul the account by taking into account the consumption of electricity for the relevant period of the previous year and pay Rs 10,000 towards costs of litigation to the applicant. The respondent was directed to recover Rs 10,000 from those officials who did not comply with the rules and regulations. |

Mohali, August 27 After being rounded up, Gulati was taken to the Phase 1 Police Station from where a Punjab Police IG-level officer took him along forcibly in his car at around 12 am. Sources said the person, who had come with Gulati to meet Krispy at the hospital, was the same officer. Gulati was declared a proclaimed offender by Mohali courts since May this year. The police chased the officer’s car and brought back Gulati to the police station after around one hour. “After being chased, the car was found parked at Max Hospital. We again nabbed Gulati from there,” said a police official, claiming that the IG was also there in the room from where Gulati was nabbed again. Today, the Mohali police confirmed that they had arrested Gulati against whom and three other accused, including Gulati, the fraud case was registered at the Phase 1 Police Station. Notably, Gulati and Gill are partners in a real estate company - Sky Heights. Meanwhile, Gulati was produced before the court this evening. “The court has sent him to two-day remand under the police custody,” said the police.
IG (Patiala Range) told to probe Krispy Khaira case
Punjab Police ADGP (Law and Order) Dinkar Gupta has directed Inspector-General (Patiala Range) PS Gill to inquire into the entire episode of suicide attempt by Krispy Khaira. Notably, Krispy, who had made allegations of molestation against Punjab Police IG Gautam Cheema and another person (Ajay Chowdhary), had attempted suicide by consuming sleeping pills on Monday night. “She was under stress as the police were not taking action against the senior police officer and she (Krispy) was receiving threats by some persons,” alleged Surinder Kaur, mother of Krispy. The ADGP has asked the IG to submit the report at the earliest. |

4 youths abuse cops at naka, arrested Mohali, August 27 The accused, identified as Amarjot Singh, Jagtar Singh, Harveer Singh, all residents of village Bhago Majra and Gagandeep Singh, a resident of village Manakour Majra, were produced in a court here today and have been sent to judicial custody. Inspector Satwant Singh, SHO, Sohana police station, said the rowdy youngsters, who were in a Tata Safari (SUV) bearing stickers of PUSU, started hurling abuses on the police party at the naka on being signalled to stop. All of them were associated with the PUSU, he claimed. “They managed to flee first time but were nabbed when they returned and did the same thing again. They even hit a barricade with the SUV when we tried to catch them,” said one of the cops manning the naka. Inspector Satwant Singh said a case under Sections 353, 186, 294, 427 and 34 of the IPC has been registered against the youths at the Sohana police station. Unidentified youths assault HAREDA officer in
Panchkula Panchkula, August 27 In his complaint to the police, Ved Parkash Dhull, a section officer in HAREDA and a resident of Sector 19 here, stated that three unidentified youths attacked him with sharp-edged weapons, including a ‘iron knuckle’, while he was on his way home. The trio attacked him on his head, neck and upper parts of the body causing serious injuries. The assailants fled from the spot when he raised an alarm and called his office peon, Ram Kala, for help. He also called the police. Dhull said he was rushed to the Government Civil Hospital, Sector 6, by his colleagues. After getting the medical examination of the victim conducted, the police have lodged a DDR at the Sector 16 police post. |
