Lok Adalat quashes water bill, tells MC officials to pay litigation cost
Our Correspondent

Mohali, August 21
The Permanent Lok Adalat (Public Utility Services), Ropar, headed by Jagroop Singh Mahal, has quashed a bill of Rs 6,635 issued to a resident of a village in Anandpur Sahib tehsil and directed the Executive Engineer and the SDO, Water Supply and Sanitation, concerned to pay her litigation cost of Rs 2,000.

Narinder Kaur of Jeowal village had obtained a water connection from the respondents and deposited the amount for the period from January 1, 2005, to December 31, 2008. She filed an application before the PLA (PUS) alleging that thereafter, water was not supplied to her but the respondents had issued a bill dated February 10, 2014, of Rs 6,635, which she was not liable to pay.

The contention of the respondents was that water was regularly supplied to her and the premises were inspected on March 22, 2014, by the SDE, who also found water flowing in the taps.

The PLA (PUS), however, found that the contention of the respondents was not correct. They did not produce any register to show the quantum of water supplied to her, no bills were issued nor was it explained as to why bills were not issued for about five years and the amount was not recovered. No evidence was produced by the respondents to prove if there was flow of water in the taps during the period prior to February 10, 2014, on which date the bill was issued. The subsequent inspection allegedly made on March 22, 2014, was, therefore, of no use.

The applicant contended that she made several complaints to the JE and the SDO on the phone. The contention was not denied by the respondents though they stated that “written complaints” were not made. It was noticed that the bill was issued after five years to cover their lapses when residents of the locality agitated for the supply of water. A newspaper item also appeared in this respect.

The PLA (PUS), therefore, quashed the relevant bill with costs and directed the respondents to pay her litigation cost of Rs 2,000.
