Delay in possession of flat
Realtor told to pay compensation

The District Consumer Disputes Redressal Forum has directed Ansal Lotus Melange Projects Private Limited to pay Rs 1 lakh as compensation for mental agony caused to complainants on account of delay in possession of flat.

The forum has also directed the realtor to waive off the interest on delayed payment amounting to Rs 1,81,817.

The complainants have alleged that they had booked an apartment in Kharar following an advertisement issued by the opposite party and paid Rs 4,00,000 as the booking amount.

The area of the said apartment was 1525 sq ft and the total sale consideration was Rs 29,75,000, in addition to Rs 60,000. Subsequently, an allotment letter was issued to the complainants. The complainants claimed that they opted for construction-linked installment plan and they regularly made the payment as per the plan. After a total payment of Rs 19,33,750 to the opposite party, the complainants requested to provide details of the total outstanding dues and were shocked to see outstanding amount payable as Rs 16,49,569.

The opposite party allegedly demanded Rs 2,57,508 and Rs 7,957 towards the total price of the increased area at the time of the possession and service tax and also Rs 1,81,817 on account of interest on delayed payment. The complainants sought clarification as to how they were being charged interest on late payment when the project was running behind the schedule but allegedly no response was attained.

The opposite party said the area calculation at the time of the booking and allotment was tentative/estimated. Further, the allotment letter made it clear that the plans were tentative and company in its discretion could make variations, additions and alterations.

“The complainants have failed to fulfil the conditions of the allotment letter. The complainants have defaulted many times in making the payment,” it said.

“The grievances of the complainants were not redressed. On the other hand, they were asked to make the payment of the interest on delayed payment. We are of the view that since there is definite evidence to this effect that the possession of the apartment has been delayed by the opposite party on account of which the complainants have suffered immense physical and mental agony, the opposite party is guilty of deficiency in service and they are not entitled to recover the interest on delayed payment amounting to Rs 1,81,817,” the forum ruled.

Deshraj case: Reader’s statements recorded

In the resumed hearing of the corruption case involving UT police SP Deshraj Singh as the accused, statements of the SP’s reader were recorded in the CBI court today.

Sub Inspector Neki Ram, who was the SP’s reader, recorded his statements in court. The voice recording of the conversation between SP Deshraj Singh and Inspector Anokh Singh was played in court today following which the SI identified the voices in the recording.

The case has now been adjourned to September 11 when the SI will be cross-examined by the defence counsel.

The case was registered in October 2012 when the CBI had laid a trap at the SP’s residence in Sector 23 and caught him red handed while taking bribe from Inspector Anokh Singh, SHO of the Sector 26 police station.

Gujarat resident dupes man with cellphone app

With an application on his cellphone that made him change his location while calling the other person, a Gujarat resident duped a person of money on fake promises of sending him abroad. The accused called the complainant stating that he was calling from abroad, but actually he was calling from Attawa village in Sector 42 here.

The police have booked a Gujarat resident for duping a Rajasthan resident on the pretext of sending him abroad. The complainant Mustaq Ghosi, a resident of Rajasthan, reported to police that Srikant Shekhawat cheated him on the pretext of sending him abroad.

Complainant Mushtaq told the police that the accused contacted him on his cellphone and assured that he could send him abroad.

Mushtaq claimed that the accused also took money from the complaint. However, after receiving the money, the accused started making excuses. Following which, Mustaq lodged a complaint with the local police.

When the police scrutinised the call details of the accused, the Cyber Crime Cell found that the accused was using a special mobile application (V-phone) while calling the victim. With the help of this application, the accused used to change his location and claimed that he was calling from abroad. The local police found that the accused was calling him from Attawa, Sector 42, in Chandigarh.

Meanwhile, a case has been registered under Sections 66-A, 66-C, 66-D of the IT Act and Sections 419, 420, 507 of the IPC and forwarded the case to the Cyber Crime Cell for further investigations.

In another match of the same category, Sacred Heart School, Sector 26, beat Government Model Senior Secondary School, Sector 23, 14-13. In the last match of the same category, SGGSC Public School, Sector 26, beat Government Model Senior Secondary School, Sector 40, 10-0.

In a closely contested match of boys’ (U-19 years) category, Government Model Senior Secondary School, Sector 44, defeated the Government Model Senior Secondary School, Sector 37, 3-1.

Ranjit-Rohit duo reach final

Local pair of Ranjit and Rohit defeated Himanshu and Ritwik while Manjot and Kabir Manrai beat Gautam and Parveen, to reach in the final of boys’ (doubles) category, during the ongoing UT Open Tennis Championship for boys and girls, being held at Lake Sports Complex, here today. In the first semifinal of the category, Ranjit and Rohit defeated Himanshu and Ritwik in straight sets 4-2 and 4-2 whereas in the second semifinal, pair of Manjot and Kabir Manrai defeated their counterparts Gautam and Parveen 4-1 and 5-3.

In the girls’ (singles) category, Arushi Kakkar marched ahead to face Nikita Bishnoi in the title clash. In the first semifinal, Arushi Kakkar easily won against her opponent Gayatri by winning in straight sets 4-2 and 4-3(0). And in the second semifinal, Nikita Bishnoi had a cake walk against Prabhneet defeating her 4-0 and 4-1. In the boys’ (singles) event, Ranjit Singh defeated Kabir Manrai 4-2 and 4-0 to face Nihit Rawal in the final. Nihit defeated Rohit Barwal 4-1 and 4-2. In the girls’ (doubles) category, pair of Tanya and Gayatri beat Shamita and Prabhneet 4-1 and 4-2 whereas Nikita and Arushi defeated Garima and Adity 4-1 and 4-1 to reach in the finals of the category.

The winning side registered a 2-0 win over their rivals. In another match, Tender Heart School, defeated Stepping Stones School, 2-0 and Chitkara School, Sector 25, defeated St Kabir School, Sector 26, 2-1. In the boys’ (U-19) matches, Delhi Public School, Sector 40, defeated St John’s School, Sector 26, 2-0 while Government Model Senior Secondary School, Sector 23, defeated Guru Nanak Public School, Sector 36, 2-0.

Vivek High start campaign with win

Cagers of Vivek High School, Sector 38, defeated St Kabir School, Sector 26, opening match of inter-school basketball championship for boys (U-14), being held at basketball courts of Sports Complex, Sector 46, here today. The winning side outclassed their rivals 28-04. Playing an attacking game, Vivek High School maintained lead throughout in the match and registered win. In the second match, Aurobindo School, Sector 27, posted a 10-9 victory over Gurukul Global School, Manimajra, while in another neck to neck fight Bhawan Vidyalya School, Sector 27, defeated St Stephen’s School, Sector 45, 13-11.

In another one-sided matche, SGHPS, Sector 38, defeated GNPS School, Sector 36, 20-12 whereas St Peter’s School, Sector 37, defeated Saupin’s School, Sector 32, 22-10 and St Joseph School, Sector 44, beat DPS, Sector 40, 21-06.

Kabaddi tournament

In the girls’ category, Government Model High School, Dhanas, again performed well defeating Government High School, Sector, 11, 25-03 whereas Government High School, Sector 42, beat Government High School, Sector 40, 20-05.

PCA selects junior teams

The selection committee of Punjab Cricket Association (PCA) for junior players selected Punjab boys (U-14 years, U-16 years and U-19 years) team to participate in the inter-state cricket tournaments for the current domestic season.According to Sushil Kapoor, spokesperson, PCA, the boys (U-16) Vijay Merchant Trophy matches will start from October 10 while Cooch Behar Trophy for boys (U-19) will held from November 1. The PCA will hold a preparatory camp for under-16 team from August 13 to 28 at Mohali while under-19 camp for Cooch Behar Trophy will be held at Patiala from August 10 to 22.
