Consumer forum finds Kotchi firm at fault, imposes penalty
Chandigarh, July 2 Satpal Singh Rana, the complaiant, alleged that he planned to start a coaching centre to earn his livelihood by means of self employment. He learnt about a latest system of English teaching lab equipments and softwares available in the market and contacted Orell Techno Systems at Kochi in Kerala. A representative of the company gave a short demo of the software to complainant “but did not show the complete working/operation along with the equipments,” the complainant stated. Later, the opposite party (Orell) agreed to supply the software and material at the price of Rs 65,000 and further agreed to get the software and lab equipments installed and provide all the relevant support in making the lab operational, the complainant stated. As per the agreed terms, Orell was to supply the entire material software and hardware equipment. The complainant handed over the payment amounting to Rs 58,500 and an amount of Rs. 6,500 was withheld, which was to be paid at the time of complete installation. “On inspection, it was found that the material — software, one CD, hardware, web camera, head phones, catalogues and typed matter— on letterheads was supplied by the representative. However, the invoice for a sum of Rs 65,000 was raised only for one CD and no billing was done on rest of the material supplied in the said invoice. He was told the unbilled material was complimentary so it could not be billed,” it was stated. Despite requests, the invoice was not corrected, the complainant stated. “The complainant purchased the software with the open eyes after taking demo and also purchased the same after negotiations,” stated Orell. “ We are of the opinion that the conduct of the opposite party points out towards unfair trade practice and deficiency in service on its part because as per request of the complainant, it should have issued a detailed invoice containing the rates charged for individual items,” the forum ruled. |
