Tribune News Service

Chandigarh, March 3
Upholding the orders passed by the District Forum, the State Consumer Disputes Redressal Commission has directed the UT Director (Health Services) and Government Block Civil Hospital, Sector 22, to pay Rs-2 lakh compensation for the “intra-uterine death of the foetus of the complainant, which resulted on account of negligence of the doctors on duty.”

The opposite parties had filed an appeal against the order passed by the District Forum directing them to pay a compensation of Rs 2 lakh to the complainant on account of physical and mental agony and pay Rs 29,900 spent by the complainant at Jindal IVF and Sant Memorial Nursing Home.

Rejecting the appeal, the state commission ruled, “The foregoing findings clearly prove that there was negligence on the part of the treating doctors of the appellants. The treating doctors did not conduct any ultrasound on the complainant, did not prescribe any rest, nutritious diet for the pregnant lady (complainant) for the foetal growth, never ascertained the position of foetal growth through ultrasound and no foetal growth restriction was detected through any diagnostic test on June 8, 2012.”

The complainant, Vibha Aggarwal, a resident of Sector 21, who was one-month pregnant in December, 2011, contacted the Gynaecology Department at Government Block Civil Hospital, Sector 22, Chandigarh, for further check-up. She was examined from time to time by the gynaecologist on duty at the Sector 22 Civil Hospital. The names of the doctors could be found out from their signatures mentioned on the OPD cards of the hospital.

In the beginning, the gynaecologist, advised the complainant to get some blood tests and ultrasound conducted. She also advised some tablets of folic acid (iron).

As per the advice of the doctors, the complainant visited the Gynaecology Department on January 3, 2012, for consultation as she was running mild fever. The doctor advised her to get TLC-DLC and urine tests conducted and asked her to take Dolo 650 tablets BD for two days. The report of the ultrasound was produced, which was normal and the doctors mentioned the period of pregnancy as 10 weeks and asked the complainant to come after 15 days. It was further stated that the complainant visited the Gynaecology Department on January 19, 2012, and the doctor after examining here found everything normal.

The doctor also advised her to undergo ultrasound and to come after one month. The complainant approached the doctor on February 4, 2012, as she was having stomach ache. The doctor advised some medicines and a dual test was conducted on February 13, 2012, which was normal.

The complainant again visited the Gynaecology Department on April 19, 2012, as there was swelling on her body and she had completed 23 weeks of pregnancy. At the stage, the doctor allegedly took it lightly and said everything was fine and normal.

On May 14, 2012, the complainant developed some infection and visited the doctors who administered her some antibiotic and anti-allergic medicine for three days and asked her to come after one month. The complainant again visited the hospital on June 2, 2012, and the doctors observed that there was no growth of foetus in the uterus, they told the complainant to undergo blood sugar test.Thereafter, the complainant again contacted the gynaecologist as she had severe stomach ache, but the doctor did not get any ultrasound conducted which showed negligence on their part in attending to her.

On July 1, 2012, the condition of the complainant became more serious and, ultimately, she decided to consult Umesh Jindal Nursing Home in Sector 20, Chandigarh. The gynaecologist conducted her abdominal examination, and observed that the growth of the foetus was of 26 weeks at the completion of 33 weeks, but she could not find out as to why the foetus was not growing in the uterus and this fact was never brought to the knowledge of the complainant. The gynaecologist removed the dead foetus after conducting a normal delivery and the complainant had also developed severe infection as the dead foetus was lying in her uterus for a long time.
