Pending cases HC Chief Justice’s concern
Tribune News Service

Chandigarh, January 28
As the new District Courts complex in Sector 43 completed one year of functioning today, Chief Justice of the Punjab and Haryana High Court Sanjay Kishan Kaul emphasised the issue of pendency of cases and urged the lower courts to bring down the number.

“Pendency is a major issue but in Punjab, Haryana and Chandigarh, the same is relatively low. Focus should be on disposing of cases that have been pending for more than five years. If we are able to dispose of 54,000 cases, which have been pending at different stages for more than five years, by the end of this year, then our job is done,” said Justice Kaul while interacting with the media after inaugurating a block housing lawyers’ chambers at the District Courts today.

Setting a deadline, the High Court also asked the subordinate judiciary to dispose of all cases, which had been pending for more than 10 years, by March 31 while the cases that had been pending for the last five years should be disposed of by July-end.

While inaugurating the lawyers’ chambers, Justice Rajive Bhalla of the Punjab and Haryana High Court asked the lawyers, who are occupying space in the service block of the new judicial complex despite being allotted chambers, to vacate them.

Justice Bhalla said: “The service block was constructed to provide various facilities to litigants as well as lawyers but the same is being used by a few lawyers. These should be vacated at the earliest. Even those lawyers who have been allotted chambers are sitting in the corridor of the service block, so they should move immediately to their chambers.”

Parking remains chaotic

Even thought the new District Courts complex in Sector 43 completed one year of functioning on Tuesday, the parking issue remains as it was last year at this point of time. Hundreds of litigants daily face inconvenience as there is no authorised parking lot. They have to park their vehicles on the ground adjoining the complex. The situation worsens in the rain season.

Panchkula, January 28
Months after the murder of the sister-in-law of Ludhiana Superintendent of Police Manohar Lal, the Forensic Science Laboratory, Madhuban, is yet to submit the viscera report of the victim. Taking note of the delay, the court today directed the public prosecutor to write to the Director of the FSL asking him to submit the report at the earliest.

Sushila Devi (68) was killed by domestic helps (Suraj Pal and his wife Chintesh) on August 31 last year, with loot being the motive behind the gory act.

She was found murdered in a washroom. As the domestic helps did not flee the spot, they were declared innocent.

They said the elderly woman had slipped in the washroom, but the post-mortem report stated that she was smothered to death.

The case had come up for hearing here today. Dr Sunil Gambhir deposed before the court stating that he had conducted the autopsy, but had not received the viscera report.

Devi’s viscera was sent to the FSL in Madhuban immediately after her murder. The police wanted to ascertain whether she was drugged before being smothered.

On the day of the murder, the police had arrested four persons (two servants and their relatives). Loot was cited the reason behind the murder. The police said after smothering her, the domestic helps stole cash and jewellery and gave those to their relatives who fled the scene.

Devi's husband was an Army officer. He died 20 years ago. Her younger son and his wife were away to Dubai at the time of the incident. Devi's elder son is settled in Canada.
