SC upholds extension of Punjab Rent Act to city

New Delhi, December 23
The Supreme Court has upheld the extension of the East Punjab Urban Rent Restriction (Amendment) Act, 2001, to Chandigarh through a notification dated October 9, 2009.

A three-member Bench headed by Justice RM Lodha made the ruling while disposing of a bunch of appeals pertaining to disputes under Section 13B of the Act which offered NRI landlords a one-time privilege to get their properties vacated by tenants.

In one of the appeals, the petitioner had contended that the extension of the Act to Chandigarh through an executive action was ultra vires as laws could be enacted only by Parliament in respect of union territories.

The Bench, which included Justices Madan B Lokur and Kurian Joseph, noted that Parliament hardly had sufficient time to go into the details of all the legislative requirements of Chandigarh or other union territories.

It was unreasonable to expect Parliament to enact laws for UTs, which had only a few seats in the Lok Sabha and Rajya Sabha. Further, most of the MPs from other parts of the country were unlikely to be interested in framing laws for UTs, the Bench explained, citing earlier rulings of the apex court.

In such a situation, adaptation of laws in force in other areas of the country, particularly in contiguous states, through extensions would be the most convenient course of action, the Bench explained.

One of the appeals had been filed by the Haryana Government which had taken on rent a property in Chandigarh. It contended that only NRIs could avail of the one-time privilege.

Since the landlord, Kalu Bahadur, was born in Iran, he should not be given the special protection meant for NRIs, it argued. Bahadur’s advocate Dr Surat Singh, however, contended that since Haryana had not challenged the validity of Section 13B in the Punjab and Haryana High Court, it could not raise the point in the apex court.

Pointing out that Bahadur had an Indian passport, the apex court upheld the orders of the HC and the rent controller and directed the Haryana Government to vacate the premises within a year and also clear all the rent arrears. — TNS

What led father to take U-turn?
Hina Rohtaki
Tribune News Service

Panchkula, December 23
It was an altogether a different Buti Ram before the court today. From receiving bribe offers to threat calls, pressure from local villagers to being a hostage for taking back the case, earlier, Buti Ram had not given up.

Finding that that the probe was not being done properly, he moved the Punjab and Haryana High Court and got a special investigation team (SIT) constituted. His efforts to get justice for his daughter Jyoti went futile once he refused to recognise Doon MLA Ram Kumar Chaudhary in the court today.

A tailor by profession, Buti Ram ran from pillar to post to get the probe conducted fairly as the MLA from the ruling party in Himachal Pradesh was the main accused in the case. A special investigation team (SIT) in the case was constituted after Buti Ram had moved the Punjab and Haryana High Court saying that the investigation by a single Investigating officer (IO) was not being done fairly. He had demanded that the probe be done by an independent agency.

Buti Ram had alleged several times that there was threat to his life and family from the aides of the MLA. The Panchkula Police had asked the

Hoshiarpur police to provide him security. In the transcripts provided by the police, it was stated that Chaudhary’s wife Nidhi had even spoken to Jyoti’s maternal uncle on the phone. The transcript mentioned that the maternal uncle had allegedly spoken about giving money to Jyoti’s family and settling the matter.

But Buti Ram gave up his entire battle today. In his statement before the court, Buti Ram said that he didn’t know who Chaudhary was. Buti Ram is the complainant in the Jyoti murder case.

Buti Ram was the key witness in the case. His another daughter Ishu too, was an important witness, but she failed to depose before the court. Buti Ram verbally informed the court that since his wife was unwell she could not make it to the court.

Supplementary statements of Buti Ram

My daughter Ishu told me that her sister Jyoti was in relationship with Doon MLA Ram Kumar Chaudhary. Jyoti was given a SIM card, which was provided on Ishu’s voter ID. Jyoti had told Ishu and me that Chaudhary was a very rich man and son of former MLA of Himachal Pradesh Lajja Ram Chaudhary. Jyoti said she had good relations with Chaudhary and the latter had also come to Ishu’s wedding in September. Ishu and I interacted with him when Jyoti introduced him to them. We also got photographs clicked. She also said that Chaudhary had promised to marry her after the elections. But later, he backtracked from marrying her. But when my daughter began putting pressure on him to marry her, to eliminate, he killed her with the help of his aides.

In tears

Buti Ram began crying after he came out of the court. When asked why he turned hostile, he folded his hands and left the premises.

Setback

* Three more witnesses were examined on Monday, but they did not support the prosecution’s case.

* Assistant sub-inspector Rakesh deposed before the court on Sunday saying that they had arrested MLA’s brother Madan Lal Chaudhary for reportedly giving him shelter, but as it could not be substantiated, they filed for the cancellation of the case

* The maternal uncle of the victim, Lakwhinder Singh, said he knew his niece and her husband, but the person sitting next to her was said to be some Raj. He said the photograph was not taken in his presence and he didn’t know any Ram Kumar.

* Kalu Ram, another witness said that he found a mobile near the Ghaggar Bridge, which the police claimed to be that of Jyoti, but he was not aware of any such case and to whom the phone belonged.

Jyoti murder case

Doon MLA Ram Kumar Chaudhary and four others are accused of killing Jyoti, who hailed from Bhunga village in Hoshiarpur. The victim was found murdered on a road in Sector 21, Panchkula. The chargesheet by the Panchkula police stated that since Jyoti was coming in the way of Chaudhary’s political career and wanted him to continue his relationship with her, he eliminated her with the help of aides. First, Jyoti was strangulated and then a truck was run over her to show that it was an accident.

Special children suffer apathy of administration
Deepankar Sharda
Tribune News Service

Chandigarh, December 23
The recently concluded Asia Pacific Regional Games (special children), held in Australia, has brought happiness for parents of the contestants. Special children made their parents proud when their children returned with medals in their hands.

However, parents are not happy because of the lack of support by administration.

“Performing sports has made my son independent. He is having IQ level of 48 but he can explain things like sports, what a medals stands for and its types. It brings joy and a ray of hope for us. He is not aware of what exactly he is into. For him, everything is same, every person is good but participation in games has given him an aim. Hopefully, he will continue to work for his passion.” said Baldev’s father Harsimran. He won a medal in table-tennis competition.

Another proud father, added, “I am happy that despite facing such problems in life, he is performing well in sports. These medals are really important for us. It gives our children an identity. They cannot behave like normal kids, they can’t express themselves, can’t eat or play like other kids but when they win medals they made us proud,” said Vedparkash Kallia, father of Akshit. He participated in athletics event of the competition.

But this happiness remains for a short while, when someone ask these parents about their future planning, many of them were left with blank faces. When asked about the problems, these parents accepted that funding and lack of help from administration led them down. “They are making themselves and all of us happy by winning medals. But in a day or so, things will be back to square one. We face a lot of trouble in collecting funds just to make sure that they can play, participate and win medals. But when it comes to appreciation, felicitation or some help nothing comes from administration,” said Paramjeet Kaur, guardian of Prabhjot Singh, who participated in table-tennis and won medals.

Another parent added, “We are not asking for any financial aid. But these kids, if deserve, should get help in their tour expenses. They are not felicitated by any sponsors or local authorities. We are spending lakhs on them from our own pocket. We are trying hard to make them happy but sometimes it becomes really impossible for us,” said Gulashan Kumar, father of Hardik.

“I had requested the UT Sports Department but they asked me to bring papers approved by the Government of India. I will again approach the authorities to get some reimbursement,” said Nellu Sareen, area director of Bharat Special Olympics Chandigarh chapter.
