Padam Motors penalised for not releasing sale letter
Tribune News Service

Chandigarh, December 2
Padam Motors has been penalised for failing to release the sale letter despite taking the entire payment for the car purchased by a complainant. The District Consumer Disputes Redressal Forum has directed Padam Motors to pay Rs 40,000 to the complainant for causing immense mental tension, physical harassment and financial loss. The forum also directed it to pay Rs10,000 in litigation expenses.

The complainant, Kitab Singh purchased a Sail U-VA CS (diesel) car by paying Rs 5.70 lakh to the opposite party. He alleged that after he was handed over the car, he was asked to collect the sale letter the next day.

Fearing an increase in registration charges from 3% to 6% on the sale price of the vehicle, the complainant visited the office of Padam Motors several times to collect the sale letter.

Meanwhile, the air-conditioner of the car started showing some problem and a demand of Rs 3,000 was raised when the complaint asked for its repair.

The opposite party contended that the sale letter was not issued to the complainant as he “had failed to supply his salary slip, which was a prerequisite for availing the corporate discount”.

“The plea of the opposite party is totally bereft of any merit. The opposite party, instead of making the complainant a pride owner of the vehicle in question, reduced him to a watchman to take care of the vehicle. The deficiency in service and indulgence in unfair trade practice on the part of the opposite party is writ large and for all these deficiencies and unfair trade practice, it is liable to compensate the complainant,” the forum ruled.
