Insurance firm penalised for rejecting claim
Chandigarh, October 22 The forum directed the company to pay the assessed amount of Rs 95,743 to the complainant towards his insurance claim and Rs 25,000 as compensation for mental agony and harassment, in addition to Rs 7,000 as the cost of litigation. The complainant got his truck insured with the opposite parties by paying a premium of Rs 29,295. The said truck suffered damage in an accident. The complainant immediately informed the opposite parties and lodged the claim. However, inadvertently the driver of the vehicle gave the copy of the licence, which was valid for LMV only. According to the complainant, after approval from the surveyor, he got his truck repaired by paying a sum of Rs 1,80,743. Despite supplying the copy of the valid licence, the company rejected the claim to the complainant. The opposite parties in their written statement did not dispute the facts with regard to the insurance as well as the accident of the vehicle in question. It has also been admitted that the surveyor was appointed by them for assessing the damage. However, it has been denied that the said surveyor/loss assessor ever gave any approval for carrying out the repairs. “The vehicle of the complainant was duly insured with the opposite parties and during the term of the policy, it met with an accident in which it suffered damage,” stated the forum. “The case of the complainant is that inadvertently his driver gave to the surveyor the copy of the licence that was valid for LMV only. However, when the surveyor pointed the same on telephone, the complainant immediately provided the copy of the licence (C-5) to him, which was valid for LMV, MMV and HMV. The present complaint deserves to succeed and the same is accordingly allowed”, the forum ruled. |
