death
due to cattle Tribune News Service
Chandigarh, August 30 Advocate Pankaj Chandgothia, who filed the petition on behalf of Avinash's kin under Section 156(3) of the CrPC, contended before the court that the police post in-charge at Colony No. 5 was refusing to register an FIR regarding Avinash’s death after hitting stray cattle on a road. The police had only registered a daily diary report and was not investigating the matter further, he said. Chandgothia argued that offences under Section 283 (dangerous obstruction on pathway), Section 289 (negligent conduct with regard to animal) and Section 304-A (causing death by negligence) of the IPC were clearly made out against the officials of the Municipal Corporation, including the Mayor, Commissioner, Additional Commissioner, Joint Commissioner and area councilor. He said the police was trying to protect them by not taking the required action. Chandgothia said cattle carry identification marks made by their owners, and the one that caused the accident should be traced to its owner, so that he could be brought to book. Chandgothia said the charge of negligence was clearly made out against the corporation officials as they had failed to remove the stray cattle even after a court order, dated September 21 last year. Following this the pleader from the government sought more time to file the report. The judge directed the police to file the investigation and status report on September 30, the next day of hearing. |
