Statehood protests: Shoot orders in Assam
Guwahati, August 3 Some miscreants had damaged the railway tracks at different places in the district on the night of Thursday causing great inconvenience in the movement of trains yesterday. Subsequently, shoot at sight orders have been declared to keep the miscreants away from the railway line that connect eastern and Central Assam to the rest of the country. A railway spokesman Nripen Bhattacharjee informed that the railway communication has remained disrupted between Dibrugarh (in eastern Assam) and Guwahati (in western Assam) as the state authority has not given clearance to run the service because of the volatile situation in Karbi Anglong hill district. In view of the renewed statehood movements in Assam after Centre’s decision to create Telangana state, Chief Minister Tarun Gogoi said, “We can’t prevent anybody from demanding anything in a democratic set up, but it should be in a peaceful way.” Regarding the demand for bifurcation of Assam, Gogoi said, “We want to live together with various communities in Assam as a joint family. At the same time, we want to look into the genuine grievances of all the communities.” Gogoi today pointed out that though agitators had so far burnt down many government offices and property in Karbi Anglong, the authority in Karbi Anglong Autonomous Council (KAAC) had not condemned the incidents yet. The KAAC is ruled by the Congress. The agitators demanding a separate state comprising Karbi Anglong and Dima Hasao districts have asked the MP, MLAs and the members of both the autonomous council to resign and join the statehood movement.

Hyderabad, August 3 All the employees, born in Seemandhra but working in Hyderabad, would have to leave once the new state of Telangana was created, he said while addressing the Telangana Employees Association at his party office. "There is no other option for employees from the other regions. They will have to leave. Once all the Seemandhra employees leave, the Telangana staff will get promotions,'' KCR, as he is popularly known, said. The TRS chief’s comments came in the backdrop of widespread protests rocking Seemandhra, as Rayalaseema and coastal Andhra are jointly referred, against the UPA leadership’s decision to bifurcate the state with Hyderabad as the common capital for a period of 10 years. Hyderabad, the bustling IT hub, has been a bone of contention between the protagonists and opponents of the state’s division. The people from Seemandhra account for nearly 40 per cent of the city’s population and a big chunk of the government employees at the State Secretariat here hail from Seemandhra. “Once the state of formed, the Telangana employees will be happy here and Seemandhra staff will prosper in their regions,” KCR, who has been in the forefront of the statehood movement, said. His remarks triggered a storm in political circles with leaders, across the political spectrum and the regional divide, condemning thev statement and said the employees from all regions would enjoy equal rights even after the bifurcation. “Whenever any state is bifurcated, the employees from other regions will be given an option to move to their respective regions or stay back. It will be their own decision and no one will impose anything on them. It is the government’s responsibility to protect their rights,” Deputy Chief Minister Damodara Rajanarasimha, who hails from Telangana region and has been a strong votary of the statehood cause, said. According to estimates, over 60 per cent of the government jobs at the Secretariat are held by people from Seemandhra. This has been, for long, a sore point for Telangana employees who believe they have been ignored. The Seemandhra employees today boycotted their duties and held demonstration inside the Secretariat complex. Raising slogans against KCR for creating fear among a section of the staff, they said they would fight for the cause of United Andhra Pradesh.

Darjeeling, August 3 All shops, markets, schools, colleges, government and private offices, banks, post offices remained closed in the towns in Darjeeling hills and vehicles remained off the roads. There was no report of any fresh violence since the beginning of the strike at 6 am as one battalion of CRPF was posted in various parts of the town. Women CRPF personnel were also deployed. GJM workers were seen checking all vehicles that plied with emergency signs pasted on them. Sources said that normal work was, however, on at tea and cinchona gardens in the Darjeeling hills. Meanwhile, the six-member GJM team that is in Delhi contacted several MPs and apprised them of the Gorkhaland statehood demand, which has gained momentum since the UPA's nod to the creation of
Telangana.

Panel to probe Bhatti’s role in Nagpal’s suspension
Lucknow, August 3 The committee includes Bijendra Singh Bhatti who is Narendra Bhatti’s brother. The other three members — Fakeer Chandra Nagar, Rajkumar Bhati and Sunil Yadav — are also reportedly close to Bhatti, posing a question mark on the impartiality of such an investigation. The suspended officer yesterday met UP Chief Secretary Javed Usmani and Anita Singh, secretary to the Chief Minister, where she reportedly submitted her application pleading not guilty of the charges being made against her. A delegation of the Rashtriya Lok Dal today met Governor BL Joshi demanding a judicial inquiry into the whole affair. Meanwhile, social activist Nutan Thakur today complained to Chairperson of the National Women Commission Mamata Sharma regarding the “improper comments” made by Bhatti, Chairman of UP Agro, holding a Cabinet rank, against Nagpal. In his statement made at a public meeting in Gautam Buddha Nagar on July 28, Bhatti reportedly said “Is *** aurat ne itni behudgi yahaan ki, us dande ko 40 minute nahi jhel paayi” (This woman, who indulged in so much vulgarity, could not sustain the wrath of sticks for 40 minutes). Thakur has called upon Mamata Sharma to take cognisance of the matter and initiate legal proceeding against Bhatti for using such language against a woman officer.

Review plea in SC on tainted MPs, MLAs
New Delhi, August 3 Ramesh Dayal, president of the Haryana Swatantra Party, has contended in his review petition that the SC had struck down Section 8(4) of the Representation of People Act to disqualify convicted MPs and MLAs without going into the lawmakers’ rationale for enacting the provision which was to protect the very existence of Parliament and Assemblies. The other SC verdict debarring jailed candidates would be misused as a weapon by the ruling parties against their rivals. “The impugned order itself gives a weapon to the Executive and the members of ruling parties to bring a new concept of criminalisation of politics by misusing their power to frame members of Opposition in criminal cases so that they will not be able to contest elections on account of being in police custody,” he said. “There is no doubt that preventing criminalisation of politics is a basic feature of the Constitution but it cannot be extended to the level when democratically constituted Parliament may be weakened even to face its very existence and continuity,” he has pleaded in the petition.

Kolkata, August 3 “Let us embrace RTI ourselves and not just recommend it for others,” Trinamool Congress MP and Chief Whip of the party in the Rajya Sabha, Derek O’ Brien, said here. “We certainly want political parties to come under the RTI to the degree that is practicable,” he said. “The parties need to be transparent about their accounts and sources of funding and share these on multiple platforms," he said. Don’t speak against Modi: Rajnath to Shatrughan Sinha New Delhi, August 3 BJP sources said party president Rajnath Singh has asked Sinha not to speak against Modi or praise Kumar. Sinha is likely to pipe down and toe the party line in the coming days. Meanwhile, the BJP countered Sinha's statement that if popularity is the criteria then actor Amitabh Bachchan should be made the president of India. "Reel life and real life are different. The popularity in one is different from the popularity enjoyed in the other. In reel life, there is no doubt that Amitabh Bachchan is popular but in real life Modi enjoys huge popularity," BJP spokesperson Shahnawaz Hussain told reporters. Sinha had made the popularity remark to counter Singh's oft-repeated comments that Modi is the most popular leader in the country. Sinha has caused embarrassed to the BJP in the last few days with a series of comments. He had described Nitish Kumar as "PM material" which had irked his party as the JD(U) leader walked out of NDA when Modi was elevated as BJP's Election Campaign Committee chief. Kumar had strongly indicated to BJP that he is opposed to Modi being made the PM candidate. Many within the BJP feel Sinha has got away without any disciplinary action as he invokes senior leader LK Advani while hitting out at Modi. SC: States can have special laws to curb organised crimes New Delhi, August 3 “Control of crime by making appropriate legislation is the most important duty of the legislature in a democratic polity, for it is necessary to scuttle serious threats to the safety of the citizens. Therefore, the (UP) legislature has, in actuality, responded to the actual feelings and requirements of the people,” a Bench comprising Justices HL Gokhale and Dipak Misra pointed out. The Bench made the observations while dismissing a writ petition challenging a provision in the UP Gangsters and Anti-Social Activities (Prevention) Act 1986 for holding speedy trial of the accused persons in special courts by suspending the trial in other cases against the culprits. The petitioner had contended that this amounted to denial of the fundamental rights of such accused to life, liberty, equality before law and protection against detention guaranteed under Articles 14, 21 and 22(4) of the Constitution. Rejecting the contentions, the Bench pointed out that the “accused persons under the Act belong to altogether a different category. The legislature has felt that they are to be dealt with in a different manner” as it had a sacrosanct duty to enable people to enjoy their rights without fear and see that some persons did not become a menace to the society in a singular or collective manner. Acknowledging that it was judiciary’s duty to uphold the dignity of personal liberty, the SC said that at the same time it also had the responsibility to see as to whether the individual had crossed the “Lakshman Rekha.” “In essence, liberty of an individual should not be allowed to be eroded but every individual has an obligation to see that he does not violate the laws of the land or affect others’ lawful liberty to lose his own,” the Bench explained in the verdict, authored by Justice
