consumer court
Chandigarh, July 15 The state commission, comprising Justice (retd) Sham Sundar and member Neena Sandhu, have also directed the respondents to replace the defective parts under the supervision of their panel of experts without charging anything from the complainant. The commission also directed the respondents that the experts concerned would submit their affidavits, duly signed by them, immediately thereafter to the commission stating that the defects had been rectified/defective parts replaced to the satisfaction of the complainant and the
vehicle had been made roadworthy. The opposite party shall also give extended warranty of one year of the car, which will commence from the date of handing over the car to the complainant after carrying out necessary repairs or replacement of the defective parts. The complainant, Harpreet Singh Giani, had submitted that he had booked a Tata Aria Prestige 4x4 IV with the opposite party no.1 through Hind Motors Ltd (opposite party no. 2) on January 19, 2011, against the booking amount of Rs 50,000. The total sale price of the vehicle was Rs 14,62,413 and Rs 6,91,594 was paid by him while the vehicle was financed to the extent of Rs 7,50,000 by the State Bank of Patiala, Sector 8. Subsequently on January 24, he took delivery of the vehicle after making the balance payment. It was further stated that within a short time he discovered that the vehicle had certain deficiencies and defects. Most of these were minor, which were rectified by the opposite party no 2. He informed the opposite parties that when the vehicle was being driven, at a slightly higher speed, i.e. around 80 km ph, the steering wheel of the vehicle would start shaking and wobbling uncontrollably even on a smooth road. It was further stated that, at the same time, the vehicle was also recalled by the opposite party no. 2 at the behest of the opposite party no.1, for some repairs. It was further stated that the aforesaid inherent manufacturing defects in the vehicle were not rectified and the vehicle was lying at the premises. He was not using the vehicle as driving it could prove to be dangerous to his life. The counsel for the opposite party no. 1 pleaded that the complainant had levelled misconceived and baseless allegations and he didn't fall within the definition of a consumer. Nor the case in question was a consumer dispute. It was stated that the complainant purchased the vehicle from the opposite party no. 2 and the vehicle had done around 4,027 km till June 11, 2011, which proved that the vehicle was in absolutely roadworthy condition. It was further stated that the vehicle was tested, as per the specifications of the Automotive Research Association of India (ARAI) Laboratory, duly recognised by the Government of India. It was further stated that wobbling problem at a higher speed did not indicate that the vehicle had inherent manufacturing defects rather it might be due to normal wear and tear, unwanted/hard jerks and improper maintenance. It was further stated that as and when the vehicle was brought to the workshop of the opposite party, whatever defects were pointed out were duly rectified. It was further stated that the complainant's claim for a refund was completely misconceived and liable to be rejected. The opposite party no. 2 was duly served summons but no authorised representative appeared before the commission on its behalf. Accordingly, it was proceeded against
ex-parte. |
