Encroachment removed

As per information, the company had appealed in the civil court to get the encroachment removed and on the basis of the appeal, the court had ordered removal of the encroachment. Though family members resented the action, due to the court’s orders, the encroachment was removed. SHO Gurdyal Singh said the action was taken following the court orders and this case was pending in the court for long time. The duty magistrate was also present on the occasion. |

Chandigarh, April 16 The Division Bench of Chief Justice Ranjan Gogoi and Justice Mahesh Grover also suggested setting up of cattle feed industry, as both paddy and wheat straw could be used for fodder. The suggestions came on petitions by Captain Sarabjit Singh and advocate Jagmohan Singh Bhatti. They were seeking the formulation of a policy by the states to ban the burning of wheat stubble, paddy straw and dry leaves. Taking up the matter, the Bench held: “We will firstly underline that this is an issue where promulgation of a law banning such activity possibly may not yield the desired result. “A fiat or a diktat by an authority necessarily involves penal consequences upon its violation and booking the farmers for violating the ban of burning of wheat straw/paddy straw would hardly be a situation which any government or a citizen would want. “It has also to be understood that a farmer feeds a nation and, therefore, holding him responsible alone would not be an idea to relish. “The issue, therefore, has to be seen from the perspective where the society and the government, who are beneficiaries of the industrious activity of a farmer, take proactive measures by providing solutions to a farmer which are affordable and readily available and thus save both the farming community as also the general public from the hazards ensuing polluting activity of burning straw”. Referring to technical steps such as easy availability of rotavator, zero-till drill and happy seeder, the Bench asserted: “These are measures which provide alternatives to burning but are expensive and, therefore, the governments are required to take steps to make such machines available to the farmers…. “The governments can formulate and grant subsidies, long-term loans and encourage manufacturers in making these machines more competitive, which will result in fall of prices and make the machines more affordable. “The government can consider giving incentive to manufacture the machines at affordable prices. These measures also require intensive training of the farmers by expert agricultural staff since the operation of this zero-till technology requires guidance, the lack of which may result in the loss of few crop which a farmer can ill-afford”. |

Jail superintendent deposes

Chandigarh, April 16 The court of the Additional District and Sessions Judge, Shalini Nagpal, had issued a contempt of court notice to the Patiala Jail Superintendent, LS Jakhar, on March 27 for returning the execution warrants twice. While appearing before the court today, the Jail Superintendent said he needed more time to file a reply in the case. The court then deferred the next hearing of the case to April 25. While issuing the contempt notice on March 27, the court had stated: “the Superintendent, Patiala Jail, has not once but on two occasions refused to execute the warrants of sentence of death by way of written communication dated March 19 and March 24. These publications intend to interfere with the due course of judicial proceedings, obstruct the administration of justice and also lower the authority of the court. As such, let show-cause notice be issued to the Superintendent, Central Jail, to appear in person in the court on April 16 and explain why proceedings of the Contempt of Court Act should not be initiated against him. The death warrants along with relevant documents are ordered to be returned to the Superintendent, Patiala Jail, for execution.” |

District Forum directs car firm to rectify defect
Chandigarh, April 16 Irked over this the complainant TN Singla filed a complaint with the District and Consumer Disputes redressal Forum-I for seeking redressal of his grievances. District Forum comprising president PD Goel, and members, Rajinder Singh Gill and Mandanjit Kaur Sahota, directed respondents to rectify the fault in the rear suspension of the car failing which they would be liable to pay Rs 1 lakh to the complainant. The forum also directed the opposite parties to pay Rs 15,000 as costs of litigation to the complainant. Singla submitted that he had purchased a Honda Civic car from Harmony Honda, Joshi Automobiles Pvt Ltd (Opposite party No 2) for Rs 12.02 lakh on June 18, 2008 besides extending warranty by paying an additional payment. He said that when he along with his wife were going to Vrindavan on February 7, 2009 he noticed that the car’s rear body was touching the tyres time and again and same was the position when he approached the speed breakers or pot holes. He said that when he reported the matter to opposite party No 2, they reported that there was no defect in the car. Later, he took the car to Prestige Honda, Lally Motors Ltd, (opposite party No 3) which also failed to detect the defect. Finally, Singla’s car was inspected by an engineer, Sukhjit Singh Gill, who in his report stated that rear shock absorbers and recoil springs as well as suspension of the car were faulty and required replacement. He alleged that since the opposite parties failed to rectify the defects within the warranty period that amounted to gross deficiency in service on their part and filed this complaint in the forum. The counsel for the opposite party No 1, while denying that the car was self driven by the complainant pleaded, that the complainant did not have any dealing with his party except that the car was manufactured by his client. He further denied that the car was sent to opposite party No 2 to cure the defect on February 20, 2009 and admitted that the suspension of the car was found to be ‘ok’ by opposite party No 3 on February 27, 2009. The opposite party No 2 submitted that their obligation was only to repair or to replace the defective components subject to the conditions of warranty. It also denied that the complainant had ever visited its premises and pleaded that documents produced by the complainant in this regard were false and procured one. The opposite party No 3 stated that the car was thoroughly checked and no defect was found it the said vehicle. It was pleaded that the no inherent manufacturing defect was found in the vehicle and prayed for the dismissal of the complaint. |

7 acquitted in murder case
Chandigarh, April 16 The prosecution had failed to produce any substantial evidence in the court. The victim’s son, Arjun, had failed to identify any of the accused in the court. The incident dates back to September 25, 2011, when Bhanuvati (45) was allegedly stabbed by seven persons at her house in Charan Singh Colony, Mauli Jagran. She was taken to the government hospital, Sector 6, Panchkula, but was declared brought dead. The case of eighth accused, who is a juvenile, is pending in a juvenile court. |

Tricity petty crime graph up, police clueless

The rising number of cases of snatching, motor vehicle thefts and house burglaries have given the city residents sleepless nights in the first three months of the year alone. More than 70 per cent of these cases are still unsolved. As Brig Iqbal Singh (retd) said: “The city environs no longer exude an air of confidence particularly for the women on streets and the elderly. Everyday newspapers are splashed with incidents signalling danger lurking round the corners”. The police has managed to solve only 12 of the 38 incidents of snatching and just 16 of a total of 65 burglary cases witnessed this year. This clearly means either snatching has become anyone’s cup of tea or the police has no clue to the active gangs of snatchers in the area. Besides, only 35 of a total of 183 cases of vehicle thefts have been solved. In the absence of any servant verification process, domestic helps, too, have been in news for fleeing with their employers’ cash and jewellery. Last week, the UT police arrested four members of a gang who ran a fake domestic help agency. Its members used to flee with their employers’ valuables only the next day after being hired. The residents are shaken by a spate of murders, incidents of road rage, cheating cases, snatching cases and the most recent kidnapping of an NRI. Moreover, assault on policemen and incidents of drunk policemen creating ruckus are becoming increasingly common. Statistics available with the police reveal that the city has witnessed 140 cases of thefts, 183 incidents of vehicle thefts, 65 burglaries and 38 incidents of chain snatching till March 31 this year. While a woman in Ram Darbar was stabbed and robbed when she was alone in her house last week, two women, who were riding a two-wheeler, were attacked with iron rods and sticks on March 31. The police has failed to make any headway in the Ram Darbar robbery case involving the woman. Harish Dadhwal, a retired police officer, said: “Cases of snatching in markets reveal the confidence of burglars. In the first place there is no adequate police deployment at rush spots. More importantly, there is no participation from onlookers. I was surprised to read about a recent incident of snatching in Sector 22 where the victim woman had confronted the snatchers while the onlookers remained mere spectators. These people don’t fear the police. The police and the public have to set examples, particularly in battling petty crime on the streets”. While daily reports are full of incidents of snatching, there are no reports about heroics shown by the police or the public. These incidents, too, need to be adequately highlighted. The police has also failed to make any headway in the incident in which Harjit Kaur, 62, had fought with a snatcher and forced him to flee on March 24. Moreover, incidents of late-night ruckus are also being reported in large numbers. The rising incidents suggest failure of the police beat system, lack of proper patrolling and vigil. Out of the total 1,037 cases which have been registered till March 31, the police has worked out only 682 cases. |

Robberies, burglaries up in Mohali

The comparative crime data from the Mohali district police has revealed a drastic fall of 60 per cent and 75 per cent in the rate of murder and rape cases, respectively, in the first three months of 2012 in comparison to the corresponding period last year. On the other hand, a five-times rise in the cases of robbery, around 10 per cent increase in burglaries and 25 per cent increase in the cheating cases is surely a cause of concern for the police. Where as many as five murder cases were registered during the period in 2011, this year the figure has reduced to three. The police success rate in cracking down the cases this year is also 100 per cent as the police claims to have solved all the five murder cases this year whereas last year it could solve only two out of a total of three cases. If four cases of rape that had been registered from January 1 to March 31 last year, this year the figure for the corresponding period is three. The police claims to have worked out all the cases. In 2012 (up to March 31), the police had registered a total of five robbery cases in comparison to one case registered during the corresponding period last year. While in 2011 the figure of burglary cases was 35, this time it has touched 38. “Actually some snatching cases also attract robbery sections, so we don’t hesitate to slap robbery case in such snatching cases. More or less we are working hard and the crime situation is not alarming here,” said Bhullar. The number of cases (six) registered under the NDPS Act is the same in 2011 and 2012. |

No respite from vehicle thefts in Panchkula

The number of vehicle thefts has increased from 307 to 369 in the comparative figures for 2010 and 2011, respectively, while the number of cases of thefts has risen from 132 to 150 and snatching from 33 to 49. The police is making tall claims of having busted at least 17 gangs of vehicle thieves. However, the number of vehicle theft cases have not gone down at all. As Vikram Guleria, a software engineer, puts it, “Our town has a very peculiar and a very friendly setting for thieves because its porous borders allow them to escape to the interiors of Haryana, Himachal Pradesh or even Uttarakhand. The residents have complained of rare visits by the beat constables. An army officer’s daughter said: “My husband is posted on the Jammu and Kashmir border. I am staying with two daughters and both study in a college at Chandigarh.” “I am scared right from the time they leave the house till the time they come back. I was born and brought up here and we were absolutely casual when we studied because the tricity was an absolutely safe place. Things have changed. Till date not even a single personnel from the beat box wing (if any) or the police station concerned has visited our home and enquire about our welfare. At least, a soldier’s family deserves this basic courtesy while he is defending the frontiers of the nation”. However, a senior police official said the increase in the crime figures did not mean there was an increase in the crime rate. It was because of fair and openness of the police in registering cases. The residents now should not complain about them not being heard when they come to us”. The city witnessed a higher number of road accidents at 109 in 2011 against 98 in 2010. The number of rape cases almost doubled from 8 to 14 during the corresponding period while the kidnappings, too, witnessed an increase. The police is still grappling to solve murder cases some of which are more than a year old. In April, 2010, an NRI and a resident of Sector 6 here was found dead in Morni. The police is yet to solve the murder case. In 2011, out of a total of 17 murder cases, the police is still working on at least half a dozen cases. |

1 held with stolen auto-rickshaw
Zirakpur, April 16 The accused has been identified as Lovely Sharma, a resident of Chandigarh. In his complaint, a local resident, Balu Kumar, alleged that his auto-rickshaw was stolen by the accused, while he was buying vegetables from a local market. “During a raid at the accused house, we recovered the auto-rickshaw along with two scooters. Chandigarh, April 16 The boys’ u-16 football team of the city that achieved the feat for the first time in the history of the city’s football is still facing the apathy of the officials as they continue to carry their attitude of not felicitating the players for putting the city’s name on the priority list of the All India Football Federation (AIFF). Earlier, the winning team was made to travel on the aisles of train coaches during their return to the city after winning the trophy. Not only this, the players are yet to receive any award or a single word of appreciation by the officials. “The day when we were made to sit outside the toilets in the train, we got to know our future with the association. Our friends in the Assam team told us that after winning the trophy, they were felicitated by the Chief Minister of the state. During the north zone tourney, the Haryana team finished the runners-up and the players were awarded Rs 5,000 each. But here, we have got nothing but twinge even after improving the city’s ranking at the national level,” said a group of the players. This is not a new thing as during 2010, the boys’ u-19 football team of the city won the Dr BC Trophy for the first time and faced the same embarrassing situation. Later, after facing pressure from critics, the local association felicitated the winners by inviting them to a formal ‘dinner’ on July 4, 2010, after a local hotelier interfered. “Not even a single member of the association has won such laurel ever. They don’t know the value of this win because they have never been to the winning stands. They behave with players as if they (players) are begging for something. They don’t understand what they deserve. “The members have been into this profession for the past many years and how come they cannot provide a mere track suit or any cash prize to the winners. The associations of smaller states have much better functioning than ours and they know how to respect the real sportsmanship,” said Harjinder Singh, coach of the Chandigarh Football Academy. |
Sachit clinches tennis title

In a well-settled finals, Rohit went down against Sachit by 7-6 (7-3), 6-4. In the first set Sachit took an early lead of 4-3 but Rohit, with his aces level the score at 4-4. Both competitors, played a neck and neck games till 6-6 but in the tiebreaker Sachit showed his class and hit serves with solid ground strokes to defeat Rohit 7-6(7-3). In the second set, both the players held their service till 4-4 but during his ninth game Sachit hit back to back to win the service. Later, on the other half of the court, Rohit took a lead of 30-0 in the 10th game but Sachit came back strongly and managed to win all the four points of the game in a row and named the set by 6-4. Earlier, in the semifinals of the tourney, Rohit defeated his opponent Raghav Talwar in straight sets by 8-2 while in another one-sided clash Sachit overpowered Chandan Agnihotri 8-3. In the junior category of boys (U-10), Pranav defeated Udayvir by 4-1,0-4,5-4 (7-4) to lift the title while Yuvraj Singh won the boys (U-12) category after defeating Chiraz Singh in a three set clash by 2-4,4-2,4-1. In the final match of boys’ (U-14) group, Parmeet defeated Chinoy Sethi 6-2 and 6-2 while Harleen defeated Hansika to claim the girls’ (U-12) title.
