HC raps UT estate officer over demolition
Chandigarh, March 29 A division bench of the High Court has observed that the Assistant Estate Officer passed an order of demolition of a building at the instance of the landlord without giving sufficient opportunity to the petitioner to avail the remedy against the order passed by him which was communicated to the petitioner on the eve of the demolition so that he could not take any action. The court has directed the official to file a detailed affidavit giving details of demolition order passed in respect of residential properties in the last three years and if possible, of the last ten years, and in how many cases demolition was actually carried out and after how many days of the passing of the order of demolition. As per the petitioner, one Dalbir Singh, after the landlord failed to get possession of a house under litigation, he entered into connivance with the estate office and illegally demolished central part of the rented kanal house in Sector 33 on 03-02-2012. On challenge to the illegal demolition done by estate office, the High Court on 22-03-2012 ordered the reconstruction of demolished part of the house and directed the estate office to file detailed affidavit in the court as to how many orders of demolitions in residential property have been passed and how many demolitions actually done. The court has observed that the tenant in this case was not given even a day for filing appeal in court. As per High Court, the demolition was done without opportunity to the tenant and to help the owner, which the High Court has viewed seriously. The tenant further stated that original owner never stayed in the house and always kept let out and he is permanently settled outside Chandigarh. Owner sold the house in 2005 to a property dealer when the case was pending in the court. Estate Officer acted in conspiracy with the new buyer of the house to forcibly evict the tenant through demolition inside the house. During demolition, personal asserts of the tenant were also damaged for which the tenant has also claimed compensation of Rs 50 lakh. |

No light, no ipl match
Chandigarh, March 29 The cricket stadium in Sector 16, which said to have all the modern facilities, is still struggling to come up with the most-awaited project of floodlights, leaving the cricketing buffs to wait for yet another year to witness an IPL match in the city. Missing yet another deadline of the ongoing financial year, the officials failed to light up the stadium. The project was announced in 2007 by the then finance secretary, IS Sandhu, and planned by three director sports, including ML Sharma, SS Sandhu and Rahul Gupta. However, it started last year. Sources said the dream project of the UT administration will take another six to eight months. “The project is going through tendering and all governmental procedures, which will delay the work by at least eight months. Work, including connection and installation of generators, maintenance and all technical aspects, will take time,” Sources said. The present director sports Sunil Bhatia was unavailable for comments on the matter. On other hand, last year Kings XI Punjab owners showed interest in hosting T20 matches here, but due to unavailability of floodlights at the stadium they organised three matches at a stadium in Dharamsala. The non-availability of floodlights this time too discourages the owners to host any match at the local cricket stadium. “The no-functioning of lights is among the primary reasons why the owners decided to stay away from the venue. However we might get a chance to host practice sessions here,” said an official. |
