New Delhi, February 16 Addressing an election rally in Farrukhabad in the presence of Congress general secretary Digvijaya Singh and Union Law Minister Salman Khurshid, Verma said, “Reservation for the Muslims will be increased and if the EC wants, it can now issue notice to me.” The EC responded cautiously saying, “We are in possession of the CD of the minister’s speech. The commission is examining the matter.” Khurshid had last week courted controversy by insisting that he would continue to speak on the 9 per cent sub-quota for the minorities even if the Election Commission “hangs me”. He, however, later apologised for his wilful defiance after the EC issued notice to him. It was generally assumed that the matter stood closed after that. The Congress has not taken too kindly to this attempt to wilfully defy a constitutional body by the second Cabinet minister from the party. Visibly annoyed with this successive attempt to challenge the authority of the Election Commission, Union Information and Broadcasting Minister Ambika Soni said, “Congress general secretary Janardhan Dwivedi has said very clearly three-four days back that we function under democracy and the language of our political discourse should be restrained and we should definitely respect Constitutional bodies. This statement given by our party general secretary is applicable to me, to Beni Prasad Verma, Salman Khurshid and all of us,” Soni told mediapersons adding though that she had not heard what Beni had said. UPA partner Trinamool Congress has also debunked Verma’s statement as a “political conspiracy” and an “attempt to befool Muslims” and demanded that he be debarred from campaigning in Uttar Pradesh. Baring the widening chasm between the two allies, Trinamool general secretary and Union Minister of State for Tourism Sultan Ahmed rejected the Congress contention that the Model Code of Conduct does not have a statutory status. “It becomes a Code of Conduct when the matter concerns other parties, but not when it is related to the ruling party. If the government is serious about giving any such thing to the Muslims, it should announce it at the level of government,” Ahmed said. Asked whether he is demanding debarring of Verma from election campaign in UP, he said, “Of course. The EC can debar such leaders. He (Beni) should be debarred from campaigning in the state. The EC should take serious cognisance. Salman and Beni have violated the model code of conduct.” |
Poor turnout mars Mumbai civic poll
Mumbai, February 16 By 3.30 pm, about 29 per cent of the voters had cast their votes in elections for the 227 wards in the country's financial capital. However, Election Commission officials, briefing reporters, expected the turnout to increase towards close of polling as political workers swung into action two hours before the 6 pm deadline to mobilise voters. In the last civic elections held in 2007, 46 per cent of the electorate had cast their votes. Polling began on a sluggish note, with less than 5 per cent of the voters showing up at polling stations till 9.30 am. At some places, polling officials turned away voters, citing various archaic rules. At Borivali in suburban Mumbai, people were seen arguing with polling officers over identification documents. Unlike in the past, EC officials were not accepting ration cards as valid documents unless all the persons from a family listed in the card were present together at polling stations. Order was restored after a while with senior officials interceding on behalf of voters who were allowed to cast their votes. In Central Mumbai, declared sensitive, voter turnout was very poor till the afternoon. However, later in the day, Samajwadi Party workers active in the area went door-to-door to persuade people to come out and vote. Political leaders expressed their unhappiness at people not coming out to vote. “People who don't come out to vote are not contributing anything to society,” said Congress MP Priya Dutt. On the other hand, a number of people who did turn up to vote didn't find their names in the voter list. Lyricist and filmmaker Gulzar who came to cast his vote at a polling station at Bandra had to return disappointed after he found his name missing from the voter list.

UP health scam claims 5th life
Lucknow, February 16 The decomposing body of Sharma, who according to his family had gone missing on February 7, was found last evening by the police in his official residence next to the Community Health Centre (CHC). DIG Khiri A Chandra said, “A CHC employee had come to lodge a report following which a police team broke open Sharma’s official residence which was locked from inside in the presence of Sharma’s son and found his body lying in a pool of blood.” Refusing to elaborate on the condition of the body or any injury marks, DIG Khiri said that it had been sent for a post-mortem examination which alone could ascertain the cause of death. However, Sharma’s immediate family accused the Khiri district CMO of putting pressure on the accountant to sign some files related to the NRHM. “My father’s body was decomposed, was covered in dust and had injury marks on his head. His ring was also missing,” his son told the local media who also alleged his father’s almirah had been burgled sometime ago to remove some important files. The family has also demanded that the post-mortem examination should be conducted by an external team rather than state health department doctors. This is the fifth unnatural death related to the Rs 5,000 crore NRHM scam in the state and the second since the election campaign begun. Two Chief Medical Officers (CMO) posted at Lucknow had been murdered, and a Deputy CMO was similarly found dead under mysterious circumstances inside the Lucknow jail. On January 23, project manager Sunil Verma reportedly committed suicide at his residence in Lucknow. He had been designated as project manager of the Construction and Design Division of UP Jal Nigam which was responsible for the up-gradation of 134 hospitals across the state under the NRHM, including purchase of furniture amounting to approximately Rs 13.4 crores. Verma’s name figured in the first FIR along with the then minister for family welfare Babu Singh Kushwaha. He had been interrogated by the central agency following which he claimed to suffer from depression. However, CBI sources claim that till now Sharma’s name has not figured anywhere in the NRHM probe. The Allahabad HC had directed the CBI to inquire into the misuse of NRHM funds following these murders. The CBI has carried out searches at the houses of various officials, including bureaucrats and businessmen associated with the family welfare department. The CBI has so far arrested eight people in this connection.

Panchkula, February 16 The CBI had charged Shahid, who was brought on production warrants from Meerut jail, with luring poor people to donate their kidneys. Defence counsel Manbir Singh Rathi said Shahid refused to become an approver in the case hearing today. The CBI court had already framed charges against Dr Amit Kumar, his brother Jeevan Kumar, Dr Krishan, laboratory technician Manoj, middlemen Giyasuddin and Jagdish, nurse Linda, Dr Saraj and Dr Upender Aggarwal. The racket was busted on January 24, 2008, after a joint team of Uttar Pradesh and Gurgaon police raided a house in Sector 22, Gurgaon. Dr Amit Kumar, who was later nabbed from Nepal, and his accomplices, were allegedly operating the racket.

Lucknow, February 16 The target of this propaganda is clearly the upwardly mobile middle class. A substantiation of this appears in a BJP advertisement strategically placed today in only an English national daily known for its strong business, classified and display job section. The advertisement is self-explanatory and is an indicator of what BJP president Nitin Gadkari said during a press conference in Lucknow on January 17. He had accused the Congress and Samajwadi Party of unleashing a new chapter of religion-based reservation in Uttar Pradesh which would lead to fresh turmoil across the country. "When Mulayam Singh Yadav who has survived on backwards' politics speaks of giving 18 per cent reservation to Muslims and Congress promises them 9 per cent, are they considering depriving OBCs or SCs of their existing quota?" Gadkari had asked. The agenda for the present turn of events was set by the Congress, when the UPA Cabinet promising a 4.5 per cent sub-quota to educationally and socially backward Muslims in the 27 per cent OBC quota just two days before election was announced in UP. Soon after, Samajwadi Party Chief Mulayam Singh Yadav's promised 18 per cent sub-quota for Muslims. This became a poll plank which Rahul Gandhi used repeatedly to hit out at the SP during his meetings. That this figure of 18 per cent did not find mention in the SP's election manifesto is a different matter altogether. Union law minister Salman Khurshid hyped the issue with his statements about doubling the Muslim OBC sub-quota to 9 per cent inviting the Election Commission’s wrath. |

Labour conference on uniform minimum wages
New Delhi, February 16 The two-day conference, inaugurated by Prime Minister Manmohan Singh and chaired by Labour Minister Malikarjun Kharge, focused on three specific issues - minimum wages; employability and employment; and social security, said the minister at the end of the conference. It was attended by representatives of 12 central trade unions and six major industries. While noting that 12 states/UTs were not paying variable dearness allowance (VDA), there was broad consensus that all states/UTs should adopt VDA and recommended that minimum wages be paid through banks or post offices. On the social security front, it recommended increasing the wage ceiling for getting Employees’ Provident Fund (EPF) benefit from the present level of Rs 6,500 to Rs 15,000. The conference also pressed for increasing minimum pension under Employees Pension Scheme to Rs 1,000 per month. The conference advocated six months maternity leave for women workers in the private sector as well. The government already grants six-month maternity leave to its women employees. The minister acknowledged that industry representatives had rejected almost all the major recommendations. Earlier inaugurating the conference, the Prime Minister emphasised on the significance of 9 per cent growth rate to create more job opportunities and “to get rid of the chronic curse of poverty.” He said, “Job opportunities can come only if the economy is expanding fast enough,” and added that “we can hope to get rid of the chronic curse of poverty” only with faster growth.

New Delhi, February 16 A Bench comprising Justices Aftab Alam and CK Prasad made the clarification yesterday while allowing an appeal filed by Rajvit Singh, who was posted as officiating Commandant, Central Ordnance Depot, Chheoki, during 2005-07. The General Officer Commanding (GOC), Madhya Bharat Area, had issued an order on August 23/26, 2010 for convening a GCM to try Rajvit Singh on charges relating to gross financial irregularities punishable under Section 52(f) of the Army Act, 1950. Singh, however, challenged this order before the Armed Forces Tribunal (AFT), contending that the GCM was barred by limitation under Section 122 of the Act. The AFT gave him the liberty to raise this point before the GCM, which subsequently accepted this contention on February 17, 2011. The officiating GOC, MB Area, however, refused to confirm the GCM order and directed the GCM to proceed with the trial. In its verdict, the SC pointed out that the GOC-in-C had come to know about the offence on May 7, 2007 but he took one year to pass the order for initiating disciplinary action against the accused on May 12, 2008. “Reckoning
from that date (May 7, 2007), the order passed by the GOC, MB Area, to
convene the GCM on August 23/26, 2010 is clearly beyond the period of
three years and hence, barred in terms of Section 122,” the Bench
ruled. “One feels sorry to see a trial on such serious charges being
aborted on grounds of limitation but that is the mandate of the law,”
the apex court held.

Will fight female foeticide in Haryana, says Ajit
New Delhi, February 16“I still remember that day. I was only five years old. I woke up in the morning and my world was dark,” 32-year-old Ajit Kumar recalls the day his struggles began.
Born in a humble family of village Kheri in Haryana’s Mahendragarh district, he always dreamt of being a surgeon until one day his vision failed him completely. But the physical disability could not deter him from dreaming big even though it meant a world of toiling. Today Ajit is Assistant Professor of Political Science in Shyamlal College affiliated to Delhi University. “I joined the job in 2007 and began preparing for the civil service exams. Preparations for a 100 per cent blind student were not easy. Today we have computers and softwares that convert written texts into audio files for the visually disabled to hear and memorise. But when I went to school and college, I would go mad taking notes of class lectures. My hands would ache like death. I can still feel the pain,” says Ajit, as he prepares to leave for the IAS Academy in Mussorie, where he has to report for induction and training on February 20. Ask him if he fears the prospect of his disability standing in the way of administration when he receives his posting orders as ADC and Ajit says, “I am very confident. I will be better than many. Most policy decisions are taken with the mind. As for file work, I have my computer and text converting softwares for help. Nothing is impossible. After all, I am only the second 100 pc blind candidate joining the IAS. Give me some time to prove myself,” he says. Before Ajit, Delhi boy Ravi Prakash, now posted in Chhattisgarh cadre, became the first 100 per cent visually impaired student to enter the IAS. His induction orders had the Supreme Court stamp. Naturally for Ajit, getting the DoPT orders to join the IAS after four years of struggle is the culmination of one big dream and the beginning of another. As District Magistrate someday, he hopes to return to Haryana and fight female feticide. “Bureaucracy gives you the power to change things. That’s how I see this opportunity. It’s my chance of fighting female foeticide in my home state,” he says, crediting his friend Manisha for helping him prepare for the UPSC. “She never got tired of reading aloud to me while I memorised and wrote in Braille for practice. For UPSC, I had a writer but the writers given to visually disabled are very slow. They need to be trained to cope with the paucity of time. I had trouble taking the test and clearing it. But it was nothing compared to the trouble I had getting my induction orders for a service I had qualified with a top rank of 208,” says the assistant professor, soon to be ADC.

New Delhi, February 16 “Got very good news from Dr Lawrence today! The tumour is almost out of the system. After reading my todays scan! Second cycle has started,” Yuvraj, being treated at the Boston Institute of Cancer Research, wrote on his twitter account. The 30-year-old, who went to the US last month, has gone bald during the treatment, which will go on till the last week of March before the process of rehabilitation starts in April. The dashing batsman had earlier got a message from US cycling legend Lance Armstrong, whose own inspirational triumph over cancer is well-documented, wishing him a speedy recovery. “Message from @lancearmstrong makes me feel better! Thank you, Lance...means a lot. Hope we can meet,” tweeted Yuvraj. A photo of Armstrong’s message, posted by Yuvraj, read: “Yuvi, I want you to know that the entire LIVESTRONG team is here for you. We say it all the time, and truly believe in it: Knowledge is power, Unity is strength, and Attitude is everything. Please know that we are here to help you and your family in any way possible. Go Yuvi!!

The committee, headed by retired Kerala High Court Judge MN Krishnan, has also suggested engagement of an international agency with experience in dealing with such huge assets to manage the treasure. In its third report submitted to the Bench, the committee said there was an urgent need to find a solution to the problems relating to the day-to-day opening and closing of the ‘kallaras’ (vaults) where the treasure was kept. Senior counsel KK Venugopal said the ‘parihar kriya’ festival held last week posed a lot of problems for the committee as one section wanted to take out 106 golden vessels from the vault, while others wanted 200 vessels. |

Licence Cancellation fallout
New Delhi, February 16 This is apparently a fallout of the Supreme Court order earlier this month cancelling 122 telecom licences doled out during tenure of former Telecom Minister A Raja. The Norwegian telecom operator, who claims to have invested over Rs 14,000 crore in the operations in India, late on Wednesday night issued a statement. It blamed its Indian partner Unitech for cancellation of 22 licences held by their telecom joint venture Uninor and sought “indemnity and compensation” from it. Unitech has responded by saying it would take the Norwegian telecom firm to court. "We reserve our right to take appropriate legal action against Telenor for damages caused to Unitech Group owing to breach of the confidentiality obligation by Telenor," a company spokesperson said. This is not the first time that the two joint venture firms have expressed their bitterness against each other. Differences between the two have been prevailing for some time now. Bitterness in the relationship was sparked off in 2011 when Unitech refused to participate in Uninor’s Rs 8,200 crore rights issue in 2011. Following the arrest of Unitech’s Sanjay Chandra, the relationship got worse. Later, Unitech filed a case against Telenor, citing gross mismanagement of their joint venture. Now, while saying it would contest the claims of Telenor, Unitech said, “The Supreme Court has cancelled all the UAS licences and spectrum granted on and after January 10, 2008, and has raised multiple questions on the government policy which in no manner can be considered as breach of warranties on the part of Unitech Limited.” It added that it will therefore be incorrect to claim or even suggest that the cancellation of the UAS licences by the Supreme Court demonstrates a breach of any warranties on the part of Unitech. “At best, Telenor group can invoke the provisions between the governments for protection of their investment in India, but they will have no valid claim on Unitech,” Unitech said. Yesterday, the Norwegian telecom firm said, “Telenor group holds Unitech liable for breach of warranties related to the cancellation of licences - seeking compensation for all investment, guarantees and damages caused by the Supreme Court order,” Telenor said in a statement while adding it would make an indemnity claim against Unitech for the failure to obtain spectrum in the strategically critical Delhi circle. “The legality and validity of the licences was a fundamental term of the share subscription agreement between Telenor Group and Unitech Limited. We believe that the Supreme Court’s cancellation of the Unified Access Service Licenses (UASL) conclusively demonstrates a clear breach of Unitech’s warranties,” said Pål Wien Espen, Group General Counsel, Telenor Group. In the share subscription agreement between the partners, Unitech Ltd has irrevocably and unconditionally agreed to indemnify and hold harmless the Telenor Group from all damages which may be suffered as a result of breach of any of the agreed warranties. “The fact is that Uninor, as a consequence of the judgment, will no longer hold any UASLs. Telenor will therefore exercise its entitled right under the share subscription agreement to hold Unitech Ltd liable to indemnify and compensate Telenor Group for its investment in India,” said Pål Wien

India, Nepal to speed up Pancheshwar hydel project
New Delhi, February 16 The Nepal-India Joint Ministerial-Level Commission on Water Resources, which met for the first time, also explored the possibility of duty-free movement of equipment to Nepal for the repair work at the Gandak project. It also recommended maintenance of 15-km stretch of the eastern Kosi embankment, presently maintained by Nepal, to be taken up by India. The meeting, held jointly by Water Resources Minister Pawan Kumar Bansal and Nepalese Minister for Energy Posta Bahadur Bogati, also discussed the issue of DPR of the Saptakosi High Dam in Nepal, required to bring permanent solution to Kosi floods and stabilise benefits from the Kosi barrage. A breach in the Kosi embankment had caused major floods in Bihar in 2008. Bansal said the Bihar Government had also raised the issue of maintenance of Kosi embankments in a wildlife sanctuary located in Nepal and the two sides decided to look into the matter. While Nepal has already prepared terms of reference for the proposed 6000-MW Pancheshwar project, India is yet to finalise its draft. Bansal said there were some issues behind the delay, but the government was now expediting it. The Pancheshwar dam project will bring irrigation to Uttarakhand and Bihar, and power to northern grid. The cost of implementing Pancheshwar project, estimated at about Rs 17,000 crore in 2002, has now escalated to over Rs 30,000
crore.

Suspect NRI in US bank fraud gets bail
New Delhi, February 16 Gurdev Singh Dhnoy was granted bail on a personal bond of Rs 10 lakh and two sureties of same amount by Justice V K Shali, who said the government had nothing on record that he was an accused in a criminal case. The court accepted Dhnoy's plea that he was arrested by the Indian government on the basis of a request from the US embassy here for his provisional arrest only with no further request on his arrest forthcoming from the US. Dhnoy, arrested from IGI Airport on March 28 last year, and some of his other associates have been facing charges of bank and access device fraud for illegally withdrawing USD 200,000 from various banks including the Bank of America during 2001-2003. The accused persons while working with a store in Arizona had allegedly gained access to the customers ATM information of their debit cards and used small electronic device to fraudulently withdraw the money from various banks. A criminal case was registered against them in 2003, while Dhnoy had visited India to see his mother last year but was arrested. — PTI

SC seeks govt reply on Tata’s plea
New Delhi, February 16 Tata has also questioned the logic of having an investigation done by a government agency when its own departments were allegedly involved in the tapping and the leakage. “The inquiry has been conducted in a manner that would hardly inspire public confidence….For any inquiry to be fair and transparent, it would have to be by an outside agency skilled in making investigations — this has not been done. There is an indelible impression that inquiry may exonerate the department and pass the blame for this lapse on to outsiders,” he said in the affidavit seeking a copy of the probe report. On the government’s contention that the tapped conversations were leaked out by private telecom service providers, Tata said even in that case it was the responsibility of the government to ensure their confidentiality. “The unauthorised disclosure of the intercepted material is in blatant violation of the provisions of the Official Secrets Act, 1923, whether intercepted by the government or by a service provider as its agent, the data collected and the information contained therein is the property of the government.” Even the media had no right to use or publish it or withhold the source from where it had “illegally obtained” it, Tata contended. The government had given the probe report in a sealed cover to a Bench comprising Justices GS Singhvi and SJ Mukhopadhaya on January 31. Tata, however, contended that the court could not rely on this report unless it was shared with him. The Bench slated the next hearing in the case for March 27. In his Public Interest Litigation, Tata has sought a directive to the government to immediately delete or destroy all private conversations recorded in the course of tapping of telephones of individuals for various official purposes such as income tax and national security. |

Mi-17 V5 copter induction today
New Delhi/Chandigarh, Feb 16 While Bathinda is located close to the Indo-Pak border, Srinagar sits close to Pakistan and also China. Bagdogra is crucial as it located within the ‘chicken’s neck’ - a reference to the 40 mile wide strip of land in north-Bengal that connects the North-East with the rest of India. The first lot of these medium-lift category of helicopters is to be inducted into the IAF tomorrow morning at the Palam IAF here. These will then be sent to the three airbases across the country. IAF spokesperson Wing Commander Gerald Galway today said, “This helicopter falls in the category of armed helicopter having substantial and effective firepower”. It also has the latest and a more powerful engine than its earlier version - the Mi-17 IV. The powerful engine will enhance its weight-carrying capability in the mountains. It can airdrop some 20 fully armed troops at any location. This is the first lot of 80 helicopters that was ordered from Russia in 2008. The chopper is equipped with state-of-the-art avionics and onboard navigation systems. It also has an onboard weather radar, state-of- the-art autopilot and is compatible with the latest generation of night-vision goggles. The new choppers can undertake all-weather and day-and-night operations in any terrain. The helicopter is also equipped with a ‘bambi-bucket’ that can be used for dousing fires while the copter hovers above the fire. The airframe has a high degree of tolerance to ballistics and is crash-resistant. It is also equipped with an emergency flotation system allowing it to float on water in case of an emergency, Wing Commander Galway said. The induction of Mi-17 V5 will enhance the capabilities of the Indian Air Force manifold in undertaking varied roles to face the challenges thrown in by unforgiving weather, hostile environment and difficult terrain in the country. The IAF first inducted helicopters in 1954. They have operated in Siachen Glacier, the highest battlefield in the world, and have also proven their mettle in UN missions. At present, the first batch of Mi-17 V5s is undergoing acceptance trails at No. 3 Base Repair Depot in Chandigarh after being assembled from semi-knocked down kits.

Govt assures quick action
New Delhi, February 16 ATF prices in India are 30 to 40 per cent more than the prices in international market due to high base price and higher taxes. The Group of Ministers had recently ruled in favour of direct import of ATF by, or on behalf of, cash-strapped Indian carriers directly as actual user and on actual use basis. The sales tax on ATF in different states in India is on a much higher side and varies from four to 30 per cent in different states. While the Civil Aviation Ministry had also written to Chief Ministers to bring down the rate of sales tax on ATF and make it cheaper for Indian carriers, a majority of the states did not responded favourably. While revenue from sales tax on ATF is only 0.5 to 2 per cent of the total sales tax collection of the states, for airlines, it contributes almost 40% of the operational costs. The Indian carriers would have to enter into their own tie-ups with the suppliers having infrastructure to import ATF directly for their use.
