Sharjah murder case
Court to hear compensation plea of injured on Feb 15
Prabhjot Singh/TNS

Chandigarh, February 8
After the Sharjah Shariat Court's revised sentence today, the future of 17 Indian youths whose death sentence waiver has already been upheld by the Supreme Court of the United Arab Emirates, rests on the civil court verdict on February 15, which is expected to order quantum of compensation to be given to two of the companions of the slain Pakistan boy Mishri Khan in a bootlegging-cum-murder case.

Since the Supreme Court after approving the death sentence waiver last year had sent the case back to the Sharjah Appeal Court for reviewing sentence of these Indian youths for other offences, including bootlegging, drinking and arson, the Sharjah Appeal Court today increased the imprisonment period from two years to two-and- half years.

The case had come up before a Jury comprising Mohammad Al Karnawi, Mohammad Al Fateeh and Abdul Rahim Al Feel that after some debate ordered the Indian boys to serve additional six months in prison in addition to two years sentence awarded to them for these offences earlier.

"Because they have spent three years in prison, they are free, totally free, from all the criminal cases," says SP Singh Oberoi, a Dubai-based businessman, who has been following the case religiously.

In fact these Indian boys were set to be released in October last after all formalities of their deportation from the UAE on completion of their earlier sentence awarded by the Sharjah Appeal Court had been completed.

However, a petition was filed before the civil court of Sharjah by two of the survivors of the murderous assault on Mishri Khan who demanded compensation maintaining that families of the convicts had paid blood money - Diya - to the family of the murdered Mishri Khan and nothing was paid to them for grievous injuries suffered by them.

The case dates back to early 2009. And all these 17 boys had been in jail since then.

Defence team that appeared on behalf of the Indian boys refused to entertain any claim for compensation to Mushtaq Ahmed and his cousin Shoaib maintaining that they had no locus standi in the case as their own statements before the Appeal Court were contrary to their demand for compensation.

It was during the hearing of the Appeal that Mushtaq had maintained throughout that he did not recognise any of the 17 Indian boys involved in the violent clash that led to the murder of Mishri Khan besides injuries to two persons, including him.

"Since he did not recognise any of his attackers, on what basis he could ask for compensation from these boys," argued the defence team before the Civil Committee hearing the petition.

The defence team, however, maintained that Mushtaq and his cousin, who already stands deported from the UAE, could ask for a portion of the blood money paid to the family of Mishri Khan. In fact, Mishri Khan, Mushtaq and Shoaib are all related.

HC breather for TV producer
Saurabh Malik

Rajan Shahi
Rajan Shahi

Chandigarh, February 8
In a relief to television producer-director Rajan Shahi, the Punjab and Haryana High Court has directed the trial court to adjourn the case against him to a date after the HC hearing.

He was seeking the quashing of an FIR registered on October 6, 2009 in Jalandhar under Section 295-A of the IPC. The Section deals with "deliberate and malicious acts, intended to outrage religious feelings or any class by insulting its religion or religious beliefs".

The order by Justice Naresh Kumar Sanghi is significant, as the Trial Court will now have to wait and watch the developments that take place on the next date of hearing in the case before the High Court.

Shahi is known for producing television serials such as Bidai, aired on Star Plus. In fact, the FIR was registered after an episode of the serial was aired on October 6, 2009. After the programme was broadcast, Valmiki Samaj gathered at Ali Mohalla in Jalandhar and protested against the channel.

In his petition filed through counsel Jasjit Bedi, Shahi contended that a dialogue between characters Alekh and Mamaji in the serial was judged out of contest. The dialogue they were protesting against was, in fact, in praise of Lord Valmiki.

Claiming that the dialogue was full of appreciation for Lord Valmiki's strength and character, Bedi added the lord was also projected as "an inspirational source of motivation".

"The entire dialogue clearly depicts that the intention behind it was to praise Lord Valmiki and was no way insulting him", Bedi elaborated. He added Star India Private Limited suffered huge financial losses as the cable operators and local distributors in the region stopped broadcasting Star Plus following constant protests by the Valmiki Samaj against the dialogue.

Bedi further added initially Star Plus channel was arrayed as an accused in the FIR. Subsequently, the petitioner, the actor and the scriptwriter were sought to be arrayed as accused.

"Thereafter, the police officers from Jalandhar, accompanied by some police officers from Mumbai arrived at the Star Plus office in Mahalakshmi to arrest him and others on October 24, 2009".

Chandigarh, February 8
Taking cognisance of a report filed by the UT Administration, confirming the misbehaviour by the Sector-15 Old-Age Home manager, the Punjab and Haryana High Court today directed the authorities concerned to first address the issue of his continuance.

The directions from the Division Bench headed by Chief Justice Ranjan Gogoi came after a complaint was filed by advocate Tanu Bedi.

UT senior standing counsel Sanjay Kaushal said he visited the Old-Age Home, along with Bedi, on January 16. An interaction with the inmates revealed the manager’s behaviour was rude. Some of the inmates had tears in their eyes as they narrated the incidents.

Kaushal also heard that woollens distributed by public-spirited person were not handed over to them. Taking cognisance of Bedi’s complaint, the high court had put the UT Administration on notice.

In the complaint, Bedi stated the residents of the state-run old age home were facing harassment at the hands of its manager. Bedi stated that she visited the Old-Age Home, where the inmates informed her that woollens were distributed among them, but the manager snatched those from them.

She was also told that this was not the first time such an incident had happened. She was also told that the residents had to pay Rs 16 a day for going out. The residents also told her that the home was earlier better managed by the Lions Club.

The residents also complained about the non-availability of medicines. Bedi also found two old women lying on the floor, their rooms stinking. Bedi had stated that total neglect of problems faced by old women was apparent and the house demonstrated lack of concern towards hygiene and medical treatment.

Bedi further stated that senior citizen were already a hassled lot and such a state of affairs at state-run institution was unfortunate.

Taking cognisance of the complaint, Justice Surya Kant had referred it to the Chief Justice of the Punjab and Haryana High Court. He had further recommended the matter to be taken up on the judicial side.
