Company told to pay damages
Mohali, January 19 Balbir Singh had in a complaint under Section 12 of the Consumer Protection Act, 1986, stated that he had got his Skoda-Octavia (Rider model 2005) car insured with the company. The car came in contact with a heavy flow of water on September 2, 2010, while being driven on the road separating Sectors 70 and 71,
Mohali. As a result thereof, the engine of the car broke down. The matter was reported to the company and on its instructions the car was brought to the workshop of Krishna Auto Sales, Chandigarh. After that, the company sent a surveyor, Saravjeet Singh, to the workshop. On his instructions, engineers and mechanics of the workshop opened the engine and removed the damaged parts with a view to assessing the loss. The surveyor prepared his survey report and submitted it to the company. On the instructions of the surveyor, the workshop repaired the engine of the car and made the same in a running condition. The workshop prepared a bill of repair charges totalling Rs 96,520. On the directions of the surveyor, the complainant paid the repair charges from his pocket. The surveyor gave an assurance that Rs 96,520 would be reimbursed to him by the company. Instead of reimbursing the same, the company settled the claim for Rs 17,313 only and denied the claim to the remaining amount on the grounds that “internal parts inside the engine body could not be damaged merely by coming in contact with the water” and that as per policy terms and conditions, the loss was not covered by the policy. Condition No.2 (a) says “consequential loss, depreciation, wear and tear, mechanical or electrical breakdown, failures or breakages” is not covered. The complainant said he was entitled to the reimbursement of the remaining amount as well. The complainant alleged deficiency in service on the part of the company and sought directions to its representatives concerned to pay him the remaining charges to the tune of Rs 79,207 with interest thereon, compensation for harassment and agony and litigation expenses. However, the company branch office concerned and the claim department stood by their letters reiterating that the remaining amount of Rs 79,207 could not be reimbursed to the complainant on account of Condition 2 (a) of the terms and conditions. They also pleaded that their surveyor assessed the loss to the tune of Rs 17,313 only and they had paid this amount to the complainant. The company was told to pay Rs 3,000 as costs of litigation totalling Rs 3,000. |

Two acquitted of dowry death charges
Panchkula, January 19 The prosecution failed to prove the allegations following which Sessions Judge Anita Chowdhary acquitted both the accused. The police said Meena Devi, the mother of Anil Kumar, suffered burn injuries on May 30, 2009. When Meena was taken to a hospital, Sushma committed suicide. Later, Meena Devi also died in the hospital. Before succumbing to her injuries, she told the police that her daughter-in-law had set herself on fire. On the other hand, Sushma’s parents alleged that their daughter was killed by husband Anil and his father Shishpal, who were harassing her for bringing Rs 3 lakh. |

2 convicted of drug smuggling
Chandigarh, January 19 The court convicted Paramjit Singh of Amritsar and Festus Benson of Burundi, who were nabbed with eight-kg heroin on November 30, 2007. They were intercepted at the grain market in Sector 39. Paramjit came in his car to deliver the consignment to Festus. As the delivery was being made, NCB officials nabbed them. |

Six theft cases reported in city
Chandigarh, January 19 Ram Parsad, resident of Ram Darbar, reported that 41 kg steel screws and one sack of scrap iron were stolen from the Industrial Area last night. In another case, Veer Singh of Phase I, Ram Darbar, reported that Rs 5,000 in cash, four gold rings, five pairs of gold earring, two gold nosepins, one VCR, and two bottles of liquor were stolen from his residence last night. Parveen Kumar, a resident of Colony Number 4, alleged that Partap of Mani Majra was caught red-handed while stealing bicycle from near Sector-20. The accused in this case has been arrested. In a similar case Suresh Kumar resident of Kishangarh, alleged that Ajay Kumar, resident of Sector 56, was caught stealing mobile phone from the aforementioned address on January 18. Dalip Bagri of Industrial Area alleged that Laxman Bahadur Thapa of Nepal was caught stealing a 50-kg iron rod from his plot. The accused has been arrested in the case as well. |

Four cases of cheating registered
Chandigarh, January 19 The complainant added that the duo neither sent her abroad, nor returned the money. Ajit was
arrested and a case of cheating under Section 420 and 120-B of the IPC registered at the Sector-19 police station. In a similar case, Devinder Singh of Sangrur reported that Subarmaniam Pandian, Kapil and Vandana of Hilltop’s Immigration at Sector 15 took Rs 7 lakh from him for sending him abroad, but he was defrauded. In another case, Ram Singh reported that Javed Aslam of Mohali and
Ashwani Kumar of Sector 52 took Rs 4.5 lakh from him by assuring him of his appointment with the Railways as ticket-checker. The complainant, a mechanic with the Haryana Roadways depot residing at Sector 20, added that the duo neither secured his appointment, nor returned the money. In yet another case, PN Khanna of Panchkula reported that Abhimanyu Sharma and Seema Sharma of Sector 7 cheated him of Rs 1.85 crore. |
