High Court relief for freedom fighter’s wife
Court imposes Rs 2 lakh fine on Centre for denying pension benefits

Tribune News Service

Chandigarh, November 2
Allowing a petition filed by a freedom fighter’s wife against the rejection of her claim for a revised Swatantrata Sainik Samman pension, the Punjab and Haryana High Court has imposed an exemplary cost of Rs 2 lakh on the Union government.

The amount is to be recovered from the Secretary, Freedom Fighters Division, Ministry of Home Affairs.

The directions by Justice Mahesh Grover came on the petition filed by Shivtar Kaur, wife of late Sawaran Singh.

She had alleged that her claim for a revised pension, as modified by the government from time to time, was rejected on the ground that her case came under the category of grant of special pension for ex-army personnel, who revolted against the British. As such, she was not entitled to the benefits accruing out of revisions made by the Centre for freedom fighters.

Justice Grover held that the order rejecting her claim was passed in violation of the earlier orders by the High Court in a writ petition filed by her husband.

Acting on his petition, the court had issued directions to the department concerned to grant Swatantrata Sainik Samman pension with an interest of 9 per cent per annum from the date it became due to the petitioner.

But, in spite of the order by the court, the pension was not released. Then a contempt petition was filed, following which an affidavit was furnished to the effect that the Centre has taken a decision to grant Swatantrata Sainik Samman pension to the petitioner. But, in spite of the directions by the court and the affidavit filed in the contempt petition, the petitioner was not given the revised pension.

Before parting with the case, Justice Grover also directed the release of benefits accruing out of revisions made for the Swatantrata Sainik Samman pensioners within three months with 12 per cent interest.

Three witnesses depose in court
Tribune News Service

Chandigarh, November 2
A local court today recorded the statements of three witnesses, including a municipal corporation councillor, Vijay Singh Rana, in the case involving Pakistan spy Kashif Ali. The court had recently framed charges against Kashif Ali and others.

Ali, a 22-year-old resident of Faislabad in Pakistan, was arrested on July 10, 2010, from Sector 44.

The police had maintained that he had been living in the city on Delhi resident Pawan Kumar’s fake ID.

Investigations revealed that the accused was a resident of Zulfkar Colony in Faislabad and had kept an eye on vital defence installations, including Chandi Mandir Western Command, Air Force station, Chandigarh, and on the movement and deployment of the Indian Army.

The UT police had sent the documents recovered from him to the Indian Army to ascertain if these were restricted under the Official Secrets Act.

The police had also sent photographs recovered from Kashif’s camera to the Army. The Defence authorities had confirmed that the photographs were vital and could be used by neighbouring countries for insurgency.

Besides, the documents recovered from the accused, including a PAN card and a driver’s licence were examined by the CFSL, which confirmed that the signatures were that of Ali.

Before filing the charge sheet, the UT police had got the prosecution sanction from the ministry of home affairs (MHA).

Police submits supplementary charge sheet in court
Forensic samples ‘match’ with those of prime accused
Tribune News Service

Chandigarh, November 2
The Chandigarh police submitted a supplementary charge sheet in the case of murder and kidnap of five-year-old Khushpreet in a local court here today.

In the charge sheet, the police has attached the forensic reports of the kidnapper’s voice and writing samples, claiming that these matched with those of the main accused, Sukhdev Singh.

The police filed a supplementary charge sheet against Sukhdev Singh, a resident of Burail, his brother Gurvinder and their servant Nand Kishore in a case of murder under Section 302 of the IPC.

This is the third charge sheet to have been submitted by the police in the court.

The police informed the court that the writing samples on a bank receipt, which the kidnapper had used to deposit the ransom amount in a bank, had also matched with those of Sukhdev’s.

The brutal kidnapping and murder case that rocked the city was cracked with the arrest of two brothers on March 22.

The accused lived in the victim’s neighbourhood and had planned his kidnapping to tide over their financial liabilities.

Khushpreet, a kindergarten student and son of a dairy owner, was kidnapped on December 21 last year near his house in Burail.

The family, which informed the police within a couple of hours of the incident, had criticised the casual attitude of the police in handling the case, which ultimately helped the kidnappers get away from a police trap with the ransom of Rs 4 lakh on December 23 last year.

The boy’s body was recovered on January 5 near a pit in Mohali.

Mastermind gets bail

Chandigarh, November 2
Two days after the CBI filed its first charge-sheet in the PGI admission scam, a local court today granted bail to mastermind Gaurvan Shalin. Though the CBI had opposed Shalin’s bail application, the court granted him bail on a surety of Rs 50,000. Gaurav, the main accused in the scam, is accused of running the racket involving admissions to the PGI in MD/MS courses in 2009.

On September 28, 2010, the anti-corruption branch of the CBI had arrested two junior resident doctors of the PGI — Dr Amit Musale and Dr Sujay Sonawane — who had allegedly secured admission by clearing the entrance exam with the help of impersonators. Tns

High Court notice to CBI

Chandigarh, November 2
Taking up a petition alleging recruitment scam in the Food Corporation of India (FCI), Justice Nirmaljit Kaur of the Punjab and Haryana High Court issued a notice of motion to the CBI today.

The notice came on a petition filed by Panchkula FCI assistant general manager Surinder Singh Taxak.

The petitioner claimed that he was deliberately denied equal opportunity in the matter of appointment to the post of deputy general manager (DGM) in the FCI despite securing fourth rank in the written examination. Going into the background of the controversy, the petitioner said the FCI had advertised posts of the DGM (general administration) in 2009. Taxak said initially his application for the post was misplaced by the FCI. The roll number was issued to him only after he approached the court, he added. In the examination results, he was shown to have failed but in a reply to his RTI application, it was found that he had secured fourth rank in the test and was topper among the departmental candidates. The case will now come up for further hearing on January 16. tns

Rajiv Bhatia

Zirakpur, November 2
After a two-hour chase right out of any Bollywood action flick, the Zirakpur police nabbed a car thief, but not before getting its own vehicles damaged.

Sources said the rashly driven vehicle rammed into a highway patrol vehicle several times before it was intercepted by the police at Banur.

The vehicle taken by three carjackers eventually overturned, resulting in the arrest of one, while the other two fled the scene.

The pursuit started from the Zirakpur-Kalka traffic lights when a stolen white colour Maruti car (CH03 H 8502), being pursued by the Chandigarh police, entered the Punjab territory around 2.30 am on Wednesday, an hour after the car owner, Amrik Singh, reported the theft to the police.

The carjackers entered the Zirakpur territory where the chase was taken over by a local police unit. All attempts to intercept the speeding car failed even as the police vehicle nudged the car several times.

The suspects took the Zirakpur-Patiala highway towards Banur even as both vehicles came in contact with each other several times till Banur.

A police official said the highway patrol vehicle tried to take out the other vehicle by ramming into it time and again, which resulted in severe damaged to both vehicles.

Later, the car overturned near Banur and the Zirakpur police informed the area police about the incident.

The police said the car was stolen by three youths, including a minor, from Amrik Singh’s Ram Darbar Phase-II residence.

Talking to The Tribune, Amrik Singh said his neighbour Harcharan Singh Bawa informed him about the theft of his car.

Bawa had seen three youths push the car to a little distance before starting its engine after three attempts. Amrik Singh informed the police about the theft around 2.05 am.

Zirakpur SHO Yogi Raj said they got a tip-off that a gang of car thieves was moving towards Zirakpur after stealing a car from Ram Darbar in Chandigarh.

The police engaged the car in pursuit till Banur, where it arrested a minor youth. The two others escaped in the cover of darkness.

The suspects have been identified as Ravi and Sonu, besides the minor, all residents of Ram Darbar.

A case under Sections 379 and 457 of the IPC has been registered against them.

A police official said the arrested suspect had sustained minor injuries was admitted to the Dera Bassi Civil Hospital from where he shifted to the GMCH-32, Chandigarh. He was later discharged after treatment.
