3 vehicle-lifters arrested
Jammu, September 15
The police today arrested three vehicle-lifters and recovered a stolen truck from them. It said the accused used to steal trucks from different places, replace their engines and chassis numbers with fake registration numbers and sell them in different states. The Narwal police seized the truck bearing registration number JK02AM/440 and arrested its driver, Jatinder Singh,a resident of Qazigund, Kashmir.

There persons were injured in road mishaps here today. Shabir Khan, a resident of Kathua, was seriously injured when he was hit by a bus this morning. The driver of the bus reportedly fled after the accident.

Section 147 dealing with J&K’s integration with India
Bill seeking amendment to state Constitution disallowed

State Assembly Speaker Mohammad Akbar Lone has disallowed a private member’s Bill seeking an amendment to the Jammu and Kashmir Constitution to change the provisions that make the state an integral part of India.

“The Bill submitted by PDP legislator Nizam-ud-din Bhat seeking an amendment to Section 147 of the state’s Constitution has been disallowed by the Speaker,” Assembly Secretary Mohammad Ramzan told PTI. He said the earlier letter of admission sent to the PDP MLA was a “clerical error”.

Bhat had submitted the Bill seeking to amend Section 147 of the state’s Constitution to the effect that Sections 3 and 5 of the Constitution be brought under the purview of the legislature for any amendments in future.

“Section 147 of the Constitution of Jammu and Kashmir deals with the procedure to be adopted for its amendment. But the existing second proviso imposes restrictions on moving an amendment to Sections 3 (three) and 5 (five) of the Constitution,” said the aims and objectives of the Bill tabled by Bhat.

“The existing proviso is the violation of the basics of the constitutional guarantees and is against the spirit of democracy that too in the state of Jammu and Kashmir, which is facing the problem of alienation.

“Also, to debar a legislator from bringing a piece of legislation is an unreasonable restriction that goes against the constitutional schemes,” he added.

According to the state’s Constitution, there can be no amendment to Section 147, which deals with constitutional amendments and the abolition of the Legislative Council, and Sections 3 and 5.

Section 3 of the Constitution reads, “The state of Jammu and Kashmir is and shall be an integral part of the Union of India.” Section 5 reads, “The executive and legislative powers of the state extend to all the matters except those with respect to which Parliament has the power to make laws for the state under the provisions of the Constitution of India.”

Bhat told PTI that his Bill did not seek any amendment to either Section 3 or Section 5, but sought powers for the legislature of the state to do so in future for the resolution of the Kashmir issue.

“The Bill only seeks an amendment to Section 147 with respect to Sections 3 and 5. If the Jan Lokpal Bill draft can come from the civil society, which is not provided for in the Constitution, why can’t a legislator move a Bill that seeks to amend the Constitution,” he added.

The PDP has distanced itself from the Bill submitted by Bhat, saying “he has done it in his individual capacity and the party has nothing to do with it”. “Our self-rule formula is well defined and does not question the sovereignty of India (on Jammu and Kashmir),” PDP spokesman Naeem Akhtar said. — PTI

Illegal Mining

Realising that illegal mining from the Ravi in Kathua district is posing a threat to the road and rail bridges on the Jammu-Pathankot road, the Kathua Deputy Commissioner has imposed Section 144 of the CrPC near the river.

Zahida Khan, Deputy Commissioner, Kathua, told The Tribune over the phone that after getting a number of complaints in this regard, the administration imposed the ban order.

“Stones are helpful in controlling the velocity of water in the river and in checking soil erosion. It was observed that illegal mining had been continuing for the past few months.So, we visited the embankments of the river and imposed Section 144 of the CrPC,” Khan said.

“There are a number of stone crushers on both sides of the river in Punjab and Jammu and Kashmir. We have told their owners to either stop the illegal practice or face action,” she added.

The Pathankot Deputy Commissioner had also been approached to take the necessary steps in this direction,she said.

“So far, the ban has been imposed in the one-km area upstream and downstream from the barrage. We have also informed the higher authorities about it,” Zahida added.

Locals alleged that there was a nexus between the mining mafia and the authorities concerned.

“The illegal practice of mining is not only causing a loss to the bridges, but also to the Excise and Sales Tax Department, as a large number of trucks daily enter the area from Punjab without paying the toll or any other tax,” said an advocate.

He added that, “The authorities had been silent about it for a long time, but when they realised that the illegal activity might lead to a disaster, they took the decision”.

Leh to have golf course: CM
Ladakh Tourism Festival concludes

Chief Minister Omar Abdullah has stressed the need for preserving the state’s unique bio-environment and natural beauty while promoting tourism and opening new areas of tourist interest.

Addressing the concluding function of the 15-day Ladakh Tourism Festival, organised by the state Tourism Department in Leh, the Chief Minister today highlighted the need for sustaining the environment and eco-balance for the generations to come. He stressed a balanced growth of tourism for enhancing economic activities and creating jobs.

“While showcasing the rich and varied tourist potential and raising infrastructural facilities, the necessary attention has to be paid to protect our environment, mountains, rivers, atmosphere and natural beauty from all kinds of pollution and unnecessary human interference,” he said while emphasising on making the aspect an integral part of the Tourism Development Policy.

Announcing an 18-hole golf course on the banks of the Sind in Leh, the Chief Minister said Kashmir and Jammu were already on the map of world golf destinations. The development of a full-fledged golf course in Leh would open new avenues of sports tourism in the area.

Speaking on the occasion, Minister for Tourism Nawang Rigzin Jora highlighted the schemes the Tourism Department had initiated in the state, especially in the Ladakh region, for the promotion of tourism.

Chief Minister Omar Abdullah today formally announced that he had separated from his wife, Payal, 17 years after their marriage. “While it is true that my wife and I have separated, the speculation about the motives and my future course of action are unfounded, untrue and deeply hurtful to all the concerned,” he said in a statement here.

On the reports about his remarriage appearing in a section of the media, Omar said these were “completely false and concocted”. He lamented that no effort had been made “to ask me whether any of this is true”. In the process, a lot of people had been hurt, he added. He said no other statement would be issued in this regard and no further question would be answered.

Omar, 41, who married Payal on September 1, 1994, has two sons, Zahir and Zamin.

“I have noted with considerable dismay and anguish the growing tide of speculation in the media about my private life, particularly the status of my marriage,” Omar had tweeted earlier. He added, “The media in India has a well-established and undeclared code of conduct that keeps the private lives of public figures by and large private. I believe my family and I are entitled to that privacy. At this point, my concern is and will remain my sons, who do not deserve to see themselves splashed across the news channels and on the pages of the newspapers in this manner”.

The Chief Minister pointed out that while his private life had gone through a period of “unprecedented upheaval”, he had not allowed this to affect his work in any manner. “It is with this in mind that I make a humble appeal to the media to please allow my family and me the space and privacy to deal with what we are going through,” Omar stated.

Gurdaspur resident rescued from flash floods

The police rescued a resident of Gurdaspur from flash floods in the Basantar nullah in Samba district today.

The police said Inder Singh, a resident of Gurdaspur, was trapped in the flash floods around 2:45 pm and was rescued around 4:30 pm.

Inder’s parents had been informed.

Meanwhile, there was heavy rain in several parts of the region, which led to a fall in the temperature. However, there were no reports of any landslide or mishap.

156 Scouts and Guides get Rajya Puraskar

Governor NN Vohra has stressed the need for taking the activities of the Bharat Scouts and Guides to the remote and far-flung areas of the state to bring a large number of youth under
its orbit.

The Governor, who is the patron of the Jammu and Kashmir State Bharat Scouts and Guides, was addressing an award presentation ceremony at Raj Bhawan here this evening. He presented the seventh Rajya Puraskar to 156 successful Scouts and Guides of the Valley.

He also presented the President’s Award to five persons and four awards on behalf of the J&K State Bharat Scouts and Guides.

First Lady Usha Vohra, Minister for Youth Services and Sports RS Chib, Minister for Agriculture Ghulam Hassan Mir, Principal Secretary to the Governor RK Goyal; Ram Lubhaya, ADGP, Home Guards and Civil Defence; Jai Pal Singh, Director, Youth Services and Sports; Mohammad Rafi, District Development Commissioner, Budgam, other senior officers and a large number of Scouts and Guides were present at the function, an official spokesman said.

Referring to the conduct of various Scouts and Guides camps in various parts of the state this year, the Governor said such activities helped encourage and promote the movement in a significant manner.

He said efforts should be made to hold a camp in the Ladakh region next year in which 700 to 1,000 children should be invited to participate.

He added that such an initiative was bound to give the required momentum to the Scouts and Guides movement in the entire Ladakh region.

Referring to the piece of land made available for the construction of the Scouts and Guides organisation office in Srinagar, the Governor said the layout plan and the design of the building should provide adequate scope for expansion of the complex in the coming years.

He said the Scouts and Guides organisation should have its own offices in the remote areas like Nubra and Zanskar to extend the movement to the far-flung areas of all the three regions of the state.

The Governor announced a grant of Rs 6 lakh for the promotion of the activities of the Jammu and Kashmir State Bharat Scouts and Guides in the state.

The police today arrested three vehicle-lifters and recovered a stolen truck from them.

It said the accused used to steal trucks from different places, replace their engines and chassis numbers with fake registration numbers and sell them in different states. The Narwal police seized the truck bearing registration number JK02AM/440 and arrested its driver, Jatinder Singh,a resident of Qazigund, Kashmir.

“Inquiries from the Regional Transport Office showed that the registration number of the truck was allotted to a motorcycle,” the police said.

“Investigations revealed that Narveer Singh of Upper Beli Charana, Jammu, had purchased the stolen truck from Subash of Pathankot through Sarabjeet Singh, a resident of Jagial Colony, Pathankot, for Rs 5 lakh whereas the cost of the 2009 model truck should be Rs 12-13 lakh as per the market value,” the police said.

The police arrested driver Jatinder Singh, Narveer Singh and Sarbjeet Singh and was making further investigations. An FIR was registered at the Bahu Fort police post. — TNS

Three hurt in Jammu mishaps

There persons were injured in road mishaps here today.

In another incident, Hari Nath, a resident of Roop Nagar, was injured when he was hit by a school bus.

Similarly, Om Prakash, a resident of Colonel Colony, was injured in a road mishap at Talab Tillo.

Cases of rash and negligent driving have been registered in the three incidents.

The injured have been admitted to the Government Medical College and Hospital here. — TNS

Relief to Drought-Hit Farmers
Govt adopting pick-and-choose policy, says PDP

The general secretary of the PDP, Balbir Singh, today charged the NC-led coalition government with adopting a pick-and-choose policy in giving compensation to the drought-hit farmers of Billawar tehsil.

He was addressing a public meeting in the Billawar area of Kathua district.

According to a press note issued here by the party, Balbir alleged that the government was not giving relief to all the farmers affected by drought in 2009. “It is unfortunate that a pick-and-choose policy is being adopted to give compensation to the affected farmers,” Balbir said and warned the government that the PDP would not tolerate such a policy.

He also expressed concern over the failure of the authorities to restore traffic on the Dayala Chak-Billawar road. He said a portion of the road was washed away in the recent rain, but it had not been repaired.

Meanwhile, the Panthers Party has urged the government to release the wages of members of the Village Defence Committees (VDCs) and Special Police Officers (SPOs).

Interacting with a delegation of VDCs and SPOs here today, the party urged the government to enhance their salaries.

Minister gets Agriculture Leadership Award

Minister for Health, Horticulture and Floriculture Sham Lal Sharma was awarded the Agriculture Leadership Award 2011 in New Delhi yesterday for his outstanding performance in the horticulture sector in the state.

The award was given to him by Union Minister for Law and Minorities Affairs Salman Khurshid in the presence of Union Minister of State for Agriculture Harish Rawat and veteran Congress leader Balram Jakhar.

Jammu and Kashmir was selected for the prestigious award by a high-level committee headed by Parliamentarian Prof Swaminathan. Last year, the state was given an award for the best primary health services, an official spokesman said.

Speaking on the occasion, Sham Lal said though the state had been producing fruits at a commercial scale, in the recent past it had been able to add new dimensions to the horticulture sector.

“The effective implementation of some Centrally-sponsored schemes like the Horticulture Mission and the Rashtriya Krishi Vikas Yojana and corrective measures to improve the overall functioning of the department have been the major contributing factors for such changes. The political will of our government to boost the horticulture sector has also played a catalytic role in helping us to march towards better horticulture achievements,” said the minister.
