Reply by person impleaded as party must, says High Court
Chandigarh, August 29 Miffed over the failure of the officers to do so, the high court has also sought the Chief Secretary’s intervention in the matter. Though the directions came on a case filed by a Kaithal resident, Yogesh Gaur, against the State of Haryana and other respondents, the instructions are equally applicable to the officers of the Punjab Government. Taking a note of the slip up, Justice Ranjit Singh minced no words to say: “An aspect, which requires notice is that the Secretary has filed an affidavit stating that the case has been brought to his notice for the first time in August 2011, whereas the reply on his behalf was filed long ago…“It has earlier been noticed also that though impleaded as a party, the Secretaries hardly bother to personally see the case. Time and again this court has expressed itself that wherever the Secretary is impleaded as a party, reply must be filed by him. “Still, no one has cared to comply with the requirement. The Chief Secretary is once again requested to ensure compliance of the requirement”. Making it clear that the high court would monitor the implementation of the directions, Justice Ranjit Singh has kept the issue pending. In his detailed hard-hitting order, Justice Ranjit Singh has added: “Let the Chief Secretary file an affidavit that all the heads of the departments and the secretaries of the departments have been apprised about this requirement and asked to ensure compliance”. Reiterating that “reply should be filed by a person, who is impleaded as a party”, Justice Ranjit Singh also fixed September 22 as the next date of hearing in the matter. |
