District Courts clash
HC dismisses petition filed by 14 lawyers
Tribune News Service

Chandigarh, July 4
A petition filed by 14 lawyers allegedly involved in the Sector 17 district court clash on May 14 today failed to find favour with the Punjab and Haryana High Court and has been dismissed as withdrawn.

Taking up the petition, Justice Rajesh Bindal verbally expressed his displeasure and asked them to raise the issue before the trial court.

The lawyers had sought the quashing of the FIR on the grounds that they had entered into a compromise with the complainant in the case, Ram Karan on June 30.

They had added that the misunderstanding between them had been removed and to maintain peace and cordial relations it was decided not to pursue the matter.

Taking cognizance of a report submitted by the Registrar (vigilance) in the district courts violence case, the High Court had earlier issued a notice to 14 advocates, asking them to show-cause why criminal contempt of court proceedings not initiated against them.

The incident took place on May 14 when Ram Karan, a police constable deployed as naib court in the district courts, sustained injuries in the incident.

The report says, “The advocates, who were in the forefront during the entire incident, misbehaving with the presiding official and addressing him in an arrogant manner have been identified by Parinder Singh, Judicial Magistrate (First Class), his staff and eyewitnesses, Ashok Chauhan, Ajay Sood, Harinder Singh Thakur, Malkit Singh Jandiala, Baljeet Singh, Munish Dewan, Gagan Aggarwal, Jagtar Singh, Satinder Singh, Munish Chaudhary, Satinder Basia, Gaurav Kathuria, Parminder Singh and Vipin Negi.”

The report goes on to say that the witnesses have also named Surinder Thakur, brother of Harinder Thakur, as being actively involved in creating a scene in the court.

Virtually indicting the police for moving about in “slow motion”, the report says: “The UT Administration and police did not respond promptly to the situation and in a professional, responsible manner.”

“The intimation of the incident was given to the police control room at about 11.15 am. The incident continued for 100 minutes. During the period no senior police official came to the spot.”

Dissatisfied with the way the bar association handled the situation, the report says: “Office-bearers also failed in the discharge of their duties to play a responsible role during the entire incident. The lawyers who actually participated in the incident were youngsters and there was no office-bearer of the bar to guide and advise them.”

Estate office serves 350 notices on violators

Tribune News Service

Chandigarh, July 4
The estate office seems to have toughened its stand against building violations in the city with serving at least 350 notices to violators, residing along Udyog Path (the main road leading from Inter-State Bus Stand, Sector 17 to Industrial Area), here.

This time, the department has also tightened the noose on the government houses, many of which have been served notices for constructing rooms/stores in the backyards of their houses or have made amendments like extension of the front gates and extra balconies, etc, on their premises. The houses, which have been served notices, are located in Sectors 18, 20, 21, 27, 28 and 30.

The violators are being served with the notices under Section 15 of the Punjab Capital (Development and Regulations) Act, 1952. Under the section, any building violation, not older than six months, has to be altered or demolished by a written notice either by the owner or occupant themselves or by the authorities at the expense of the owner.

Earlier in the past, the notices of violations were served under Section 8 of the Act, which implies cancellation of allotment or resumption, but the Section 15 implies demolition.

Talking to Tribune, UT Assistant Estate Officer Rahul Gupta said this time the authorities were serious about their drive against violations.

“The people, who got notices should remove the unauthorised construction on their own otherwise after coming Sunday, we would start the demolition drive,” said Gupta.
