Insurance co. told to pay
Rs 23,711
Chandigarh, September 25 The stray dog had ventured onto the road while the complainant’s son was going towards Sector 22 on February 26, 2007. Despite the extensive damage suffered by his insured vehicle, the insurance company had refused to pay compensation. Agreed at the denial, they moved to the consumer courts. The forum directed Oriental Insurance Company Limited in Sector 17 to pay Rs 18,711 to the complainant for the repair of the motorcycle that got damaged. The forum also directed the insurance firm to pay Rs 5,000 to the complainant as the compensation as well as cost of litigation. The complainant, Ranjan Sherpa, a resident of Sector 22, stated in the complaint that he got his Bajaj Pulsar motorcycle insured that was valid till March 17, 2008. On February 26, 2007 the motorcycle was being driven the complainant’s son in front of his house when a dog came in front of him and in an effort to save the dog, the motorcycle skidded and got damaged. The motorcycle was taken by the complainant to Partap Auto India Limited for repairs where a bill of Rs 23,946 was raised towards the repair of the motorcycle. The complainant then filed a claim with the insurance firm. The firm declined the claim on the ground that the complainant had already taken a claim under the previous policy. The firm said a “No Claim Bonus” (NCB) of 20 per cent while taking the renewed policy. In view of this, the insurance contract became void and no claim was payable. The file was closed as “No Claim”. In its reply, the firm said the complaint was not maintainable because the complainant had concealed that he had obtained NCB to the extent of 20 per cent in the premium towards the policy in question. However, during arguments it came to light that the complainant after realising that he had wrongly taken the NCB approached the insurance firm to pay the amount. The firm accepted Rs 216 as the payment deducted towards NCB on the insurance policy issued to the complainant. This amount was paid by the complainant to the firm on April 8, 2009. Once, the firm has accepted this amount of NCB from the complainant, it is clear and apparent that his part of the default if any is pardoned by them. |
