Urban Area Act being violated
Kalka, April 15 Official sources say the Urban Area Act 8, 1975 has already been enforced within the 5-km area limit of the municipal limits of Kalka, Pinjore and Panchkula. Under the Act, cutting, carving or transfer of land and construction on less than 12.5 bigha without the permission of the department of town and country planning, Haryana, is a criminal offence. The sources confirm that the Punjab New Capital Periphery Act, 1952, has already been enforced in the rural areas of the tehsil, beyond the areas that have been included in Panchkula corporation, and any construction without the permission of the director of town and country planning is a violation of Act 41 of 1963. Under the Act, there is a provision of imprisonment of three years and fine of at least Rs 3,000 in case of carving of plots, construction of houses on plots, construction of roads and transfer of plots without getting the permission. The department of town and country planning had sent a letter to Kalka tehsil in this context in January, 2008, but to no avail. In the tehsil, registries of plots less than 12.5 bighas are being carried out without the permission of the department for the past two years. The sources say most registries have been made by showing fake construction plan of house of 10x10 sq ft area. Small plots in biswas have been transferred by making power of attorney. Such registries and transfer of plots on power of attorney have caused a revenue loss worth lakhs of rupees to the state government. |
