Former MC chief to move SC
Panchkula, January 9 Justice K Kanan dismissed his writ petitions yesterday and directed the state to conduct and complete the election process of the Panchkula MC president within four weeks. Justice Kanan also dismissed the writ petition of district administration in this regard. Rawal was elected as president on May 13, 2008, defeating VK Sood of the BJP. Sood, however, filed an election petition against Rawal, alleging that the procedure followed by the officials for conducting the elections violated the secrecy. Following this, the election of Rawal as MC chief was declared void by Anshu Shukla, civil judge (senior division) and the judge of the municipal election tribunal, Panchkula. Subsequently, an appeal against the tribunal’s order filed by Rawal was also dismissed by the authority concerned. Thereafter, Rawal had approached the High Court for quashing both orders. Panchkula Deputy Commissioner said he was yet to see the judgement and any decision to challenge the judgement could be taken by the state government only, he added. |

FIR quashing after pact
may come at cost Chandigarh, January 9 In their petition against the CBI and another respondent, Kultaj Singh and others had sought quashing of the FIR dated December 23, 1997, registered under Sections 148, 149, 342, 506, 452, 427 of the IPC at Chandigarh on the ground of compromise. The case pertains to “assault” on the then Maharishi Dayanand University vice-chancellor VC Sharma and his son. The case was registered against an employees’ leader and student leaders. Appearing before the court, the counsel for the complainant confirmed the information on compromise. But counsel for the CBI Ajay Kaushik told the court that the matter had been handed over for investigation to the premier investigating agency on the directions of the high court. After protracted investigation, the CBI had filed the challan and charges
had also been framed, he added. After going through the documentary evidence, Justice Tewari ruled: Keeping in view the fact that the offences complained of are not very serious and the fact that both parties have reached a compromise on the matter, and in view of the decision of this court in Kulwinder Singh and others vs State of Punjab, I deem it in the interest of justice, if the present FIR be quashed”. Allowing the petition, Justice Tewari quashed the FIR and “the subsequent proceedings emanating there from”. But before parting with the order, Justice Tewari added that it would, however, be subject to payment of Rs 50,000 as costs to be deposited with the National Legal Services Authority by the complainant.
