Notwithstanding guidelines of the Punjab Municipal Corporation Act, 1976, a majority of councillors, including mayor Ajit Pal Singh Kohli, do not know that the general house of the civic body is open to the public.

A majority of the councillors owing allegiance to the BJP, the SAD and the Congress have also expressed their ignorance on this issue.

The mayor said the general house was open only to councillors, civic officials and MLAs (ex-officio members).

“Special invitees of the mayor can attend the meeting”, Kohli said. Notably, the present house did not allow mediapersons to attend the meeting.

It was only at the last general house, where the media was given entry and that too, after repeated requests by mediapersons.

However, contrary to the mayor’s claims, clause 4 of section 62 of the Act reads, “Subject to sub-section 5, every meeting shall be open to the public, unless a majority of the members present at the meeting decide that any inquiry or deliberation pending before the corporation shall be held in private”.

Section 5 of the Act further mentions, “The corporation may make regulations for the purpose of admission of the members of the public to its meeting and for the removal by force, if necessary, of any member of the public admitted to a meeting for interrupting or disturbing the proceedings of the meeting”.

When contacted, senior deputy mayor Anil Bajaj also expressed his ignorance on this issue. “I do not have any clear idea as to whether commoners too have right to attend the meeting”, he said.

He added that he would study the Act in detail, besides discussing the issue with the authorities concerned.

When contacted, a majority of the councillors were completely unaware about rules and regulations in this regard.

If the Act permitted the masses to witness proceedings of the general house, they must be given the opportunity, asserted some Akali councillors.

They should also be allowed to submit their suggestions regarding the development of the city in writing to the house, asserted the councillors, suggesting that their names not be carried.

More than four years after the Right To Information (RTI) Act came into force in 2005, the local municipal corporation authorities have failed to comply with some obligations under section 4 (1) of the Act.

As per the Act, it is compulsory for every public authority to put details mentioned in section 4 (1) of the Act on its website.

It is essential for the corporation to put names, office details and contact numbers of the public information officer, the first appellate authority, the RTI cell superintendent and the zonal assistant public information officers on its website.

The Act further reads that every public authority is bound to disclose the items specified in rule 4 (1) of the Act.

It is mandatory to put information about powers and duties of civic officers and employees, the monthly remuneration received by each of them and a directory of their contact numbers on its website.

The civic body still does not have an official website. Some corporations in Punjab, including those of Amritsar and Ludhiana, have been complying with guidelines.

While Patiala municipal commissioner Manjt Singh Narang was not available for comment, mayor Ajit Pal Singh Kohli admitted that the civic body had been lagging behind in terms of having its website.

The process to launch a full-fledged website was under progress, he claimed. Once the website was launched, they would put all information mandatory under the Act on the website, he added.

Not only the civic body, but the Patiala improvement trust had also failed to comply with the guidelines under the Act.

There was no official website of the trust.

2 killed as bus hits scooter

Two youths were killed in a head-on collision between a scooter and a Haryana Roadways bus on the Dera Bassi-Ramgarh road here this afternoon. The deceased were identified as Chaman Kumar and Pawan Kumar, residents of Ramgarh. The incident took place around 12:20 pm.

They was moving towards Ramgarh from Kakraali village where their scooter collided with the bus. The bus driver fled from the scene.

They sustained serious injuries and were rushed to the PGI in Chandigarh, where they died during treatment. A case was registered against the bus driver.

The investigating officer stated that the bodies of the deceased would be handed over to members of their families after postmortem examination tomorrow.

Gurpurb celebrated with fervour

Celebrations marked Gurpurb in the city, with thousands of devotees paying obeisance at Gurdwara Dukhnivaran and other gurudwaras.

People from nearby villages started reaching the city in the wee hours and kept pouring in till the end of the day.

Gurpurb marked the culmination of prabhat pheris. The celebrations included a three-day Akhand Path.

The Panj Piaras led the procession carrying Nishan Sahib. Local bands playing religious music formed a part of the procession.

The city was decorated with lights to celebrate the occasion. Amidst singing of hymns and serving of langar, most places wore a festive look.

Men, women and children participated in kar seva. Kirtan was organised in different corners of the city, including colonies.

All local markets were abuzz with activity, with people making purchases for functions round the corner.

Cops were deployed near all gurdwaras to check any untoward incident.

Traffic was diverted to facilitate the visit of people from nearby areas.

8 booked for assault

The police today booked eight persons on the charge of assaulting Gurmeet Singh of Patiala. Four of the accused were identified as Janty, Kala, Pinda and Lali.

Gurmeet Singh reported in his complaint that he was going to meet the Ibrahimpur sarpanch for the demarcation of the Sand river where the accused assaulted him.

The accused also snatched Rs 5,600, a mobile phone and a watch, according to the investigating officer. Further investigations were on, the officer said.

Bike hits girl in dense smoke

A teenaged girl from Dholemajra village, near Rajpura, was injured today when a motorcycle hit her due to dense smoke arising from the burning of paddy stubble.

In his complaint to the Patiala deputy commissioner, Janak Singh said his daughter was walking towards her house in the village when the motorcycle hit her.

He said despite orders of the deputy commissioner, farmers had still been burning paddy stubble, which created pollution in the village and surrounding areas.

He demanded that immediate and strong action be initiated against the farmer who was burning paddy stubble near the village.

Residents of the area said commuters failed to see approaching vehicles or fell off roads due to the smoke. The girl was undergoing treatment at the local civil hospital.

1 held with liquor

The police has arrested a resident of Uttranchal for allegedly smuggling liquor here today.

The accused, identified as Ajay Sharma, was nabbed during a special naka near Alampur village. The police said the accused was smuggling around 840 bottles of liquor in a truck.

Further investigation revealed that the accused had been smuggling liquor into Punjab and its adjoining areas for the past many years. The police has impounded the truck and a case in this connection has been registered against the accused.

Begging unlimited!

What is common between railway stations, bus stops, religious places, footpaths and public toilets? All these places are full of beggars.

With beggars swarming various road crossings in posh areas and in front of almost all religious places in the city, they have become a public nuisance, with the authorities failing to take action.

Areas around the Gurdwara Dukhniwaran, the AC market, the Adalat Bazar, the Kali Mata Mandir and cinemas are the worst hit.

“Women and children in tattered clothes pester people for money. At traffc lights and road crossings, they step in front of vehicles and start begging. It you are in a car, they start cleaning windowpanes and keep knocking till one gets impatient and gives them money to avoid tension,” said Amarjit Kaur, a working woman.

Harsharan said, “There are a few who genuinely need help, but because of professional beggars, people become indifferent to the needy as well, which is bad. Many of them are even involved in petty crimes like theft. They also sell iron railings.”

He said the local administration should launch a campaign with zero tolerance against begging so that people were not pestered.

15 cattle seized

A total of 15 cattle were seized from a truck near Landran. The Gau Surakhsha Dal, an NGO, intercepted the vehicle, bound for Uttar Pradesh.

The NGO got information that a truck was carrying 15 animals from the Ropar area. Activists followed the truck late last night and sorrounded it.

The driver of the truck and the three other persons in it escaped from the spot taking advantage of the cover of darkness.

The police was informed about the incident. The animals were shifted to Shri Radha Krishan Gaushala.

Gaushala staff expressed its inability in keeping the cattle due to lack of funds and space. Owners of the cattle in Ropar were informed and they took the animals.

Tripri School defeated Punjabi University campus school 44-38 in the District Basketball Championship being held on the Polo Grounds here today.

DSP Gurinderjit Singh Baggar was the chief guest on the occasion and Prabjit Kaur, Sarbhjit Kaur Tiwana, Baljit Kaur Baggar and Chandan Mann were the guests of honour. Bobby and Kanwaldeep Singh were the coaches.

In the semifinal match (women), Punjabi University campus school beat Old Police Line School 52-33 and Tripri Senior Secondary School beat Government Girls School, Model Town.

In the final match (women): Tripri Senior Secondary School beat Punjabi University campus school 44-38.

In the semifinal match (men), Old is Gold Club beat EME Club 30 58-30 and Master Bikram Club beat Mohindra College Club 64-46.

In the final match (men), Master Bikram Club beat Old is Gold Club 52-36.

Winners were awarded trophies and sports kits.

Open theatre favoured

It should awaken them from the slumber of selfishness and impurity, said Punjab Rice Sheller Owners Association president Tarsem Saini.

He expressed these views while speaking at the 102nd monthly garden theatre festival, organised to mark the Punjab Day here today.

Departmental, criminal trials can go together

The Punjab and Haryana High Court has held that departmental proceedings can continue during the pendency of a criminal charge.

The ruling came on a petition filed by ex-constable Suba Singh against the state of Punjab. Departmental proceedings were initiated against him in 1981, when he was posted in Ferozepur, on the allegation of abusing and slapping an inspector. Ferozepur Senior Superintendent of Police dismissed him from service after the enquiry.

Justice MM Kumar asserted: “The sole question of law raised in the appeal is whether departmental proceedings could continue during the pendency of criminal charge.”

A trial court after examining the evidence had expressed the opinion that departmental proceedings could not continue if the criminal charge were pending. Aggrieved by the order of the trial court, the respondent-state preferred an appeal, which was allowed and the findings were reversed.

According to the lower appellate court, the departmental proceedings and criminal proceedings could progress side by side and there was no bar in the police rules to the adoption of such a course.

“The departmental proceedings were concluded on January 12, 1982, whereas the plaintiff-appellant was acquitted in the criminal case on July 24, 1984. It was further noticed the plaintiff-appellant was acquitted for want of proof beyond reasonable doubt,” the court ruled.

Justice Kumar asserted: “Feeling aggrieved, the plaintiff-appellant had filed the instant appeal. Having heard the state counsel and perusing the record with his able assistance, I am of the considered view that there is no merit in the instant appeal and the same deserves to be dismissed.”

He said: “The trial court has only taken into account the fact since the plaintiff-appellant was acquitted in criminal case, therefore he was also liable to be exonerated in the departmental proceedings because the charges in the departmental enquiry were the same. The view taken by the trial court cannot be subscribed because in the departmental enquiry witnesses have been examined and full opportunity to the plaintiff-appellant was given.

“Moreover, the plaintiff-appellant was a member of disciplined force and was working as a constable. Therefore, proceedings in departmental inquiry cannot suffer undue delay. The question of law raised in the instant appeal is answered against the plaintiff-appellant and in favour of the respondent state.”

Guest teacher’s appointment
HC imposes fine, directs action against erring aspirant

An aspirant for guest science teacher’s job opened a new chapter in forgery by not only tampering with his detailed mark certificate (DMC), but also having the audacity to move the Punjab and Haryana High Court for its stamp of approval on it by seeking job on the basis of that fake DMC. But the move apparently backfired.

Closing the chapter, Justice Ranjit Singh directed the initiation of criminal or other proceedings and imposed a fine of Rs 10,000 on the petitioner.

Challenging the appointment of a guest master in a petition against the state of Haryana and others, petitioner Sandeep Rathee had sought directions for his own appointment.

Taking up the matter, Justice Ranjit Singh asserted: “The actual fact would be apparent from the reply filed on behalf of a respondent. It is disclosed the petitioner manipulated the attested photocopy of the final DMC of his B.Sc results. It is pleaded the petitioner had produced a forged and fabricated mark-sheet. When the petitioner continued to dispute the actual marks obtained by him in B.Sc., directions were issued to the Registrar, Kurukshetra University, to intimate the marks obtained by the petitioner year/subject-wise.

“The inquiry conducted by the University has now been placed on record and would show the actual fact. The enquiry has found tampering in the DMC issued to the petitioner. Finding this, a committee has recommended that the DMC and degree issued in respect of the mentioned roll number be cancelled with immediate effect. The committee has further recommended that there is a clear case of tampering with the documents and forgery, for which the University may file an FIR against the petitioner.

“There is, thus, no merit in the plea raised by the petitioner to seek his appointment as guest science teacher. The petitioner has been found to have forged his DMC, which is a serious issue. This issue cannot be left at that. The act and conduct of the petitioner would disclose commission of serious criminal offences. The university and the state, therefore, would be under obligation to bring this case to its logical conclusion.”

“Directions are issued to the respondent-state and the university to proceed further against the petitioner by initiating criminal and/or other proceedings to cancel the degree etc.

Needless to observe the action against the petitioner would follow by observing due process of law, giving proper opportunity to the petitioner. The writ petition shall stand dismissed. The petitioner shall pay the costs of this litigation, which is assessed as Rs 10,000,” the court ruled.

Ex-judicial officer’s plea for benefits dismissed

The Punjab and Haryana High Court has ruled that the benefit of 10-year practice at the Bar would be admissible to judicial officers only on superannuation, but not if they are “retired in public interest”. The ruling came on a petition filed by retired Additional District and Sessions Judge Padam Kumar Jain against the State of Punjab and others.

The Division Bench of Justice Adarsh Kumar Goel and Justice Daya Chaudhary ruled: “The appellant was working as Additional District and Sessions Judge and was made to retire prematurely with effect from March 20, 1996, by the Punjab Government following the recommendation of the Punjab and Haryana High Court.”

Post-retirement, Jain’s claim for monthly pension was rejected. Then, he filed a plea contending that 10 years of practice at the Bar was not added at the time of granting monthly pension for qualifying period of service for the purpose of granting retirement benefits. He also contended that 18 per cent interest should have been awarded in place of the 6 per cent given to him.

Justice Daya Chaudhary said: The benefit of 10 years' practice at the Bar is admissible only on superannuation in terms of notification dated February 22, 1990. Since the appellant was retired in public interest and not on superannuation, he was not entitled to the benefit of 10-year practice at the Bar.” The Bench mentioned that in terms of Rule 6.16 of Punjab Civil Services Rules (Vol II), the appellant had already been granted service gratuity and death-cum-retirement gratuity, as admissible to him. “We do not find any ground to interfere with the view taken by the Single Judge. Therefore, the appeal is dismissed,” the Bench ruled.

35-yr-old woman attempts suicide

Veera, a 35-year-old mother of three, allegedly attempted suicide by consuming some poisonous substance at her residence in Maloya here yesterday.

The police said she had jotted down a suicide note on her hand accusing her husband Rajpal, a sweeper, of harassing her and her children.

She alleged that her husband was an alcoholic and used to beat them up after consuming liquor.

She was admitted to the PHI in a critical condition. Till the filing of the report, the police was recording her statement.

Electronic gadgets stolen from Rajput Bhawan

Thieves decamped with a camera and other electronic gadgets from Rajput Bhawan in Sector 25.

Surinder Kumar of Sector 15, Panchkula, reported that someone had stolen the digital camera, four mobile phones and a bag containing gifts items from Rajput Bhawan during the intervening night of October 30 and 31.

A case has been registered.

Caught stealing

Varinder Pal Singh of Manimajra reported that Parveen and Barij Pal were caught while stealing tyres from his shop on Sunday evening.

In another incident, Partap Singh of Attawa, Sector 42, in a complaint lodged with the police alleged that Anil Kumar and Vicky of Attawa had stolen a mobile and Rs 6,500 from his residence on October 31.

The police has arrested the accused and registered two cases in this connection.

Motorcycle stolen

Bhupinder Singh of Raipur Khurd reported that someone had stolen his Hero Honda motor cycle (PB 47 B 7105) on October 16 from a parking lot in the IT Park. A case of theft has been registered.

Liquor worth Rs 14 lakh seized

The Chandi Mandir police has seized a consignment of around 8,500 bottles of liquor while it was being smuggled from Chandigarh to Rajasthan in a canter.

Three persons were also nabbed in this connection. Two of them were escorting the canter in a Verna car.

The value of the contraband was around Rs 14 lakh. According to Chandi mandir SHO Jang Sher, the police laid a naka near Nada Sahib gurdwara.

On checking the canter, it was found that liquor was loaded in the vehicle. On being asked, the driver could not present documents.

The canter driver was identified as Virender from Rajasthan while the two smugglers, having the same first name Sunil, were from Jind and Hisar.

Govt Model-32, Sacred Heart to lock horns in final

The final match of the Chandigarh State Junior (under-19) Women Cricket Tournament would be played tomorrow at Government Model Senior Secondary School, Sector 32, Chandigarh.

The match will be played between Government Model Senior Secondary School, Chandigarh, and Sacred Heart School, Sector 26, Chandigarh. The tournament for Pt Kedarnath Trophy is being organised by the Chandigarh Women’s Cricket Association.

The trial to select the Chandigarh team, which will participate in the National Junior (under-19) Women Cricket Tournament to be held in Chandigarh from November 8, will be held at 12 noon after the final match.

Anjali adjudged best gymnast

Anjali of Punjab was adjudged the best gymnast in the All-India Mahatma Hansraj Aryan Inter- Zonal Tournament for Girls being organised here today.

Anjali won a gold, silver and a bronze medal in the uneven bar, vaulting table and the floor exercise, respectively. Ishika and Asrushi of New Delhi bagged the second and third prizes, respectively.

In the Yoga events Panchkula and Punjab zones bagged the first and second prizes, respectively. Garoma, Shabnam, Anjali, Alka Dhiman, Neha, Shiva Rana, Sonia and Saloni played for the Panchkula team whereas Kiran, Arjoo, Dilraj, Aryavani, Pritika, Ridha, Mahima, and Gurpreet played for the Punjab team.

Delhi bagged the first position in table tennis, volleyball and kho kho championship and secured second position in the basketball events. Similarly, Punjab secured first position in the basketball and second in the Yoga and volleyball competitions, respectively.

The Bihar zone secured the first and second position in the badminton and kho-kho events while Haryana zones bagged the first position in table tennis while Himachal Pradesh bagged second position in badminton.

In the gymnastics team championship Punjab secured the first place while New Delhi secured the second.

13 schools to compete

Thirteen schools have confirmed their participation in the U-15, U-11 and U-19 categories for the Annual St Xavier’s Six-a-Side Soccer Championship to be held at St Xavier’s School, Sector 44, here tomorrow.

In the U-19 category, St Xavier’s School-44, Chandigarh, SIS of Mohali, Delhi Public School of Pinjore, Shishu Niketan-22, Chandigarh, and St Solider’s International-28, Chandigarh, have been given a bye in the first round. In the opening match, St Joseph’s School-44 would face Baptist-45 at 8.30 am. Other teams in contention for the title are Delhi Public School-44, St John’s School-26, DPS, Pinjore, DAVPS-8, Ryan International-49 and St Soldier’s, Mohali.

Baptist School, Sector 45, have been drawn to meet Shishu Niketan of Sector 22 in the inaugural match in the U-15 category. Delhi Public School, Pinjore, Ryan International-49 and St Xavier’s, Chandigarh, got a bye in the first-round matches. St Xavier’s, Panchkula, St Jonn’s, St Kabir School, Sector 26, Ajit Karam Singh International Public School, Mohali, Delhi Public School-40 and St Soldier’s, Mohali, are also in the fray for top honours.
