Compensating crime victims not on states’ agenda
Chandigarh, December 3 Eight months have lapsed since the Punjab and Haryana High Court asked the three governments to mull over the issue of compensating the victims in monetary terms and empowering them. Yet, not even replies have been filed. Taking a serious view of the matter, the Bench of Justice Adarsh Kumar Goel and Justice L.N. Mittal made it clear that further delay in filing the replies would see the home secretaries summoned to the court. The Bench observed: Though a period of eight months has lapsed, no response is coming from the Union of India. We give last opportunity to file reply by December 15, failing which we have no option, but to direct the home secretary, Union of India, to remain present and explain why no response is being given, in spite of repeated opportunities in the matter of such a serious nature. “The states of Punjab and Haryana are also given last opportunity in same terms, clearing indicating that on failure to file reply, the home secretaries will be required to remain present in the court”. The case will now come up for further hearing on December 22. The Bench of Justice Adarsh Kumar Goel and Justice S.D. Anand had initially sought directions to treat the matter as a public interest litigation. The Judges had ruled: “We consider it appropriate to draw the attention of all concerned to the need to remedy a serious flaw in the administration of criminal justice; namely failure of justice to the victims, particularly when the crime goes unpunished. “It is a paradox that the victim of a road accident gets compensation under no-fault theory, but the victim of crime does not get any compensation, except in some cases where the accused is held guilty …. “There may be cases where the crime goes unpunished. How a victim is to be given justice in such a situation is the question for consideration.... “Only 30 to 35 per cent of all criminal cases end in conviction, while 90 to 95 per cent of the matters, involving heinous offences, end in acquittal. And, there are other serious handicaps, such as long delays, in the disposal of criminal trials, which contribute to frustration in the mind of the victims... Apart from monetary compensation , various other forms of assistance can be focused upon by the sate. These include counselling, victim empowerment, public education, sensitisation and crime prevention,” the Bench concluded. |
