Four persons of a family were charred to death and two others sustained burn injuries when the van they were travelling in abruptly caught fire after it reportedly collided with a tree on the Delhi-Jaipur highway, near Kathuwas village, 10 km from here, today.

A 32-year-old man was shot dead here this evening. The victim was identified as Babloo, a resident of Sidhana village in Sonepat district.

Attack on Lecturer
Teaching work in varsity suspended

Kurukshetra, October 8
Teaching work remained suspended on the university campus here today in protest against yesterday’s incident of attack on a University College lecturer on the premises of the university.

The incident was followed by a protest by at least 250 teachers of the university in front of the vice-chancellor’s office.

A memorandum mentioning similar four incidents of attacks on teachers in the recent past was handed over to the vice-chancellor by Dr O.P. Gahlawat, president of the Kurukshetra University Teachers Association (KUTA).

Responding to the teachers’ concerns, vice-chancellor R.P. Bajpai displayed solidarity with the teaching community and strongly condemned the incident.

He said concrete actions were being taken to improve security on the premises.

He also revealed that since yesterday this agenda had been discussed with senior police officials, including the superintendent of police, Kurukshetra, and the DGP, Haryana, who had assured Bajpai that assailants would be caught at the earliest.

On behalf of the teachers of University College, staff secretary Kusum Lata demanded that the administration should take appropriate measures to nab the culprits within 48 hours otherwise the teachers would be demoralised.

President of the Kurukshetra University Non-Teaching Employees Association (KUNTEA) Karan Singh along with other associates was also present and rooted for the cause raised by the teaching fraternity.

Medicine shops closed

Irked over the raids conducted by the drugs control authorities on Monday, chemist shops remained closed for the third consecutive day here today.

Chemists refused to open their shops, which disrupted healthcare services.

Meanwhile, all owners of chemist shops of the town had gone on strike alleging malicious attitude of the authorities.

Dr Ved Beniwal, patron of the local chapter of the Indian Medical Association, has urged the authorities to intervene in the resolution of the imbroglio.

Breach in minor canal

Over 100 acres of agriculture land was waterlogged due to a breach in the Sheranwali minor, which passes through Darba Kalan village here today.

The breach could not be plugged till the filing of this report. However, the authorities have stopped water supplies from behind.

According to the report, a breach occurred near RD number 24,800 of the minor and it increased up to 50 feet by the afternoon.

Farmers alleged that their paddy crop had been submerged due to the breach.

Farmers of the district seem to be annoyed with the role of the district authorities regarding the purchase of kharif crops, which have already started pouring into the local mandis.

They blocked traffic by squatting on NH-71 in Narwana town here for about two hours in protest against non-purchase of bajra crop.

The MSP of the bajra crop has been fixed at Rs 840 per quintal. About 98,000 quintals of bajra had been purchased from the Jind market.

Though local officials claimed that there was hardly any issue regarding the official purchase or procurement of the crops in the grain markets, the activists of the district unit of the Bharatiya Kisan Union and some of the farmers, who had been awaiting the purchase of their produce in the local mandi, said there was hardly any proper strategy adopted by the district authorities to ensure smooth purchase operations and the farmers had been at receiving end as far as the matter of procurement was concerned.

The farmers had been left with no alternative to come out on the road to highlight the problem, claimed a spokesperson for agitating farmers.

He said the farmers had blocked the roads for at least six times in the past few days and if the authorities had been serious, the problem could have been resolved easily.

He demanded that the government should set up a coordination committee to solve such issues immediately.

Bishnoi reorganises HJC

President of the Haryana Janhit Congress (BL) Kuldeep Bishnoi has reorganised his party. The reorganisation included the constitution of the parliamentary board, the working committee and the changing of certain district presidents.

While Bishnoi himself has been “elected” chairman of the parliamentary board and the working committee, Ramji Lal, Sudha Malik, Jai Bhagwan Sharma, Rakesh Kamboj, Subhash Batra, Rao Narender Singh, Devi Lal Bishnoi, Tapesh Bagati, Shiv Jit Singh and Prof Kishan Lal have been elected its members.

Dharam Pal Malik, Suinder Madan, Rao Narbir Singh, Krishan Murti Hooda, Devendra Sharma, Om Prakash Jain, Bijendra Kadian and Sarvdanand Arya have been elected members of the working committee.

Media convener of the party Sanjay Gautam said here today that Devi Lal Bishnoi, Tapesh Bagati, Gurmesh Bishnoi and Buta Singh had been nominated members of the working committee.

He said while Hooda and Arya had been appointed vice-presidents of the party, Ram Singh, Parminder Dhul, Ramesh Bajaj, Deep Chand, Tayab Hussein, Ramraj Sharma, D.N. Tyagi and Pradip Kaushik had been made general secretaries.

Larger Bench to decide excess payment recovery issue

Is the government entitled to recover excess payment made to an employee because of a mistake or erroneous interpretation of law?

The vital question of law will now be answered by a larger Bench of the Punjab and Haryana High Court.

As of now there are divergent views on the issue, and the larger Bench order will serve as a guideline for deciding all such cases.

The issue came up for hearing before a Division Bench during the hearing of civil
writ petition 2799 of 2008 filed by an employee, Budh Ram, against the State of
Haryana and others.

Appearing before Justice Mehtab Singh Gill and Justice Augustine George Masih, the petitioner’s counsel referred to the High Court and Supreme Court judgments in the case of Sahib Ram versus State of Haryana and others, and Parshotam Lal and others versus State of Bihar and others.

He contended, on the basis of the judgments, that financial benefits, if granted to an employee, not on the basis of any fraud or misrepresentation on his part, cannot be recovered from him.

Opposing the plea, counsel for state relied upon a Division Bench judgment in the case of Bishan Chand and others versus Registrar, Punjab Cooperative Societies.

He contended that excess salary paid can be recovered, as otherwise it would be against the basic principles of justice.

Elaborating, he added, depriving an employee of benefits he was legally entitled to, or grating benefits by mistake he was not entitled to, was against the principle.

The government was entitled to rectify its mistake and in doing so, it was entitled to recover excess amount paid to an employee by mistake.

He further added that non-recovery would lead to corruption in government departments. The employees, while giving and receiving the benefits, would be encouraged to use unfair means.

After hearing the arguments, the Bench observed: Another aspect is that the hard earned money of the tax payer goes to run the government, which needs to be protected and taken care of by the government as a trustee. It, therefore, casts a duty on the government to recover the excess amount paid to a person who is not entitled to in law.

Admitting the plea, the Bench added: Keeping in view the divergent opinion and views expressed by the Supreme Court, as well as this court, over a period of time, and in view of the fact that a large number of cases are frequently coming up for hearing before this court for consideration on this issue, an authoritative decision by a larger Bench of this court is required, which could be the guiding principle for decision of such like cases.

4 die as van catches fire

Four persons of a family were charred to death and two others sustained burn injuries when the van they were travelling in abruptly caught fire after it reportedly collided with a tree on the Delhi-Jaipur highway, near Kathuwas village, 10 km from here, today.

The deceased have been identified as Kamla Devi (37), wife of Naurang Lal, her sister Santoshi Devi (35), wife of Jhabar Singh, and her two sons, Manish (11) and Kalu (7), all residents of Jhunjhunoo district of Rajasthan.

Sanju, Naresh Kumar’s wife, and Shish Ram, Ram Avtar’s son, sustained burn injuries.

The mishap occurred when they were returning to their villages in Jhunjhunoo district after paying obeisance at the Sheetla Mata temple in Gurgaon.

Man shot dead

A 32-year-old man was shot dead here this evening. The victim was identified as Babloo, a resident of Sidhana village in Sonepat district.

Babloo was intercepted by some persons when he reached Anand Gardens, near Sector 13, on NH1.

He was on his way to Chandigarh from his native village. The assailants fired three bullets at him which proved fatal, the police said.
