Uma Khurana is free

New Delhi, November 1
Almost two months after being heaped with humiliation following a fake sting operation, suspended government schoolteacher Uma Khurana today walked free as a city court discharged her due to insufficient evidence against her.

Justice has, finally, been done, said a relieved Khurana, as she and her lawyer emerged out of the crowded court of additional chief metropolitan magistrate Alok Aggarwal.

Khurana’s lawyer, Amit Kumar, had filed an application in the court seeking discharge of his client, as the police had not produced clinching evidence against her.

Prakash, a reporter of the Live India channel (formerly known as Janmat), who carried out the fake sting operation that was aired on August 30, was arrested on September 8. He was arrested, after it was learnt that the girl who appeared in the video making allegations against Khurana was not a student, but an aspiring journalist.

The fake TV sting operation, which allegedly projected that Khurana was involved in a sex racket involving schoolgirls, had sparked violent protests in the walled city area. Khurana was also manhandled by a mob. Thereafter, the Delhi government suspended Khurana.

Earlier, at the time of filing the chargesheet, the Delhi police gave a virtual clean chit to Khurana due to the lack of evidence. It mentioned her name in column number two of the chargesheet, implying that the decision on whether to proceed against her had to be taken by the court.

Khurana was granted bail on September 10, after the court noted that she was more of a victim than an offender in the fake sting operation aired by the news channel. — PTI

Nithari case
SC notice to CBI chief

The Supreme Court today issued notice to the CBI director on a petition by the mother of a minor girl, who allegedly fell victim to macabre Nithari episode, after the agency was accused of suppressing facts and helping accused Moninder Singh Pandher.

A bench of justices H K Sema and Lokeshwar Singh Panta issued notices to the union home secretary, U.P government, CBI’s SP S J M Gilani, who is in-charge of the Nithari killings’ investigation.

It also issued notice to the West Bengal government on the issue of providing protection to the victims’ mother Bandana Sarkaar. Bandana Sarkaar has left Nithari and is living in Murshidabad, West Bengal.

The CBI chief and others have to submit their affidavit in four weeks.

Bandana Sarkar’s husband was allegedly murdered, after he accused the CBI of carrying out a ‘lopsided’ investigation in the rape and murder of his daughter Pinki. Pinki was amongst those children who fell victim to Pandher and his servant Surender Koli.

“After the case was transferred to the CBI, the victims of the Nithari killings were having faith in the agency. But, at the direction of Vijay Shankar, director, CBI, and S J M Gilani, SP, who have taken partisan stand and rap for providing illegal protection to the main accused — Pandher,” the petition alleged.

She said that though the complaint regarding her missing child was lodged, followed by a reminder, the CBI has not bothered to register the FIR till date.

The petitioner said that her voice was not being heard because of her poverty.

She alleged that the accused with the help of some CBI officials killed her husband on September 1.

She alleged that the officials had done this “to save him from the capital punishment”.

She alleged that her daughter was raped and murdered by Pandher and his servant Surinder Singh Koli, while her husband was found dead under mysterious circumstances in Murshidabad.

He was apparently murdered to prevent him from deposing before the court, before which he was to appear nine days after his body was recovered on September 1 at Murshidabad, her lawyer B P Singh said.

Her husband became the target of the accused’s henchmen, after he had filed an application before the trial court challenging the CBI’s soft approach in their chargesheets towards Pandher, who virtually was given a clean chit for his alleged role in the serial killings, the petition said.

Two shot dead in Thakur clan war

Two brothers returning from a court hearing on bike were shot dead in a hail of bullets by half a dozen killers. Later, the police teams gunned down two of the fleeing assailants in Hindon Pushta.

Three brothers from Man Singh clan were returning home from Phase-II court after deposing in a murder case when shooters from the opposite clan hit their bike with their Gypsy from behind near Kulesra culvert. As the three fell down, sprawling on the ground, shooters from the vehicle rained bullets on them, killing two on the spot, the third was lucky to have escaped into field with minor wounds.

Soon after, the police which reached the spot, in turn shot dead two of the killers in Hindon Pushta.

It may be mentioned that enmity between the two Thakur families has, to date, claimed the lives of 33 persons.

Three brothers, Kripal, Har Veer and Sanjay, accused in murder of Harpal on June 4, 2006, had gone to Phase-II District Courts on October 31. After the hearing while they were returning home at about 4 p.m. on a bike, a gypsy chasing them hit their bike from rear, near Kulesra culvert. As the brothers fell down sprawling, bullets were rained on two of them. Har Veer and Sanjay had been shot dead on the spot while Kirpal managed to flee into the nearby fields.

Admitted in district hospital, Kirpal said one of the assailants was a woman, Usha, who had also fired shots. Other assailants, he identified as Kalu, Sansar, Dev Charan, Dev Chand and Kiranpal.

The police were informed by the passers-by. The assailants, on seeing the police coming, got into their gypsy and slipped away. But in a hurry two of them could not climb into the vehicle and raced towards Hindon Pushta, with the police team in hot pursuit.

Special training programme for police officers

Guru Gobind Singh Indraprastha University (GGSIPU) began a special training programme for officers of Delhi Police on Thursday and this will continue till November 29. The training programme was jointly inaugurated today by Y. S. Dadwal, commissioner of police, Delhi and Prof. K. K. Aggarwal, vice-chancellor, GGSIPU.

P. N. Aggarwal, jt. commissioner (Training), Delhi Police, and V. K. Jain, registrar, GGSIPU, were also present on the occasion.

Almost 50 police officers of the rank of assistant sub-inspector, sub-inspector and inspector are participating in this training programme, which endeavours to update the knowledge of the serving officers about new enactments, various rulings of apex court and directions from various national and state statutory bodies relating to Human Rights, Women, Child and SC/ST communities, etc. It will also sensitize the officers and equip them with social, legal and human rights perspectives for balanced functioning and efficient law enforcement.

Speaking on the occasion, Dadwal remarked, “With the changing times, new challenges have arisen and just like medical sciences even law and legal studies need to be updated. We are thinking of a system where we can have a regular interaction with the finest legal minds.”

Throwing light on the nature of the training programme, Prof. K. K. Aggarwal informed, “The programme will offer a judicious mix of theoretical lectures and case law analysis. It will include components on Criminal Procedure Code, Indian Evidence Act, Witnesses and their examination, Dying declaration, stages of crime and so on, and will be taught by an eminent panel of legal experts.”

Some of the guest faculty invited for conducting this training programme include R. K. Anand, senior advocate, Mukta Gupta, state advocate, Justice (Retd.) A. S. Qureshi, Prof. S. C. Raina, Law Campus, Delhi University, U. S. Prasad, (Retd.) Additional Legal Advisor, CBI, and Ram Jethmalani, senior advocate, among others. The participants will be evaluated and issued certificates.

Election today
JNU students clash over Ram

The JNU students’ union elections took a violent turn as political groups clashed at the lawns of the university’s Jhelum Hostel on Wednesday night over some remarks made about Lord Ram.

Three of the guards were injured, when they tried to bring the situation under control. The JNU students’ union elections will be held tomorrow.

Amit Singh, Saurav Dubey and Ankita Bhatta of the ABVP are contesting for the posts of president, vice-president and general secretary respectively. Tauqir Alam, Shabir Alam and Kavita Sharma from the NSUI are contesting for the posts of president, vice-president and general secretary respectively. Dhananjay, Roshan Kishore and Fauzan Abara from the SFI/AISF are contesting for the posts of president, vice-president and general secretary respectively. While, the Youth for Equality’s presidential and vice-presidential candidates are Babita Sharma and Sujeet Kumar.

The main issues are better facilities in the campus and more scholarship programmes for students of the university. Others include national issues like — the Indo-US nuclear deal, the existence of Lord Ram and India’s foreign policy.

An NSUI candidate said, “We support the nuke deal, as it will help generate electricity in the country by 2020.” Others say that the deal will harm India’s security and independence. It will also affect the foreign policy positioning.

Meanwhile, the JNUTA has taken the ‘disturbing trends’ on campus into consideration and has appealed to the political groups to reiterate their commitment to the democratic and secular values of the varsity.

Kite fest tableau on R-Day

Kite flying would be one of the tableaus in the Republic Day function to be held in the Capital next year.

The Delhi government had sent four items – the Red Fort, Commonwealth Games, Delhi’s contribution to the 1857 movement and kite flying to the defence ministry for approval. The ministry has given its nod to kite flying. However, a committee of the defense ministry comprising 20 members will take the final decision on November 3.

Last year, the Delhi government’s tableau was ‘Stri Shakti’. The government had spent Rs 13 lakh in preparing the model of Stri Shakti.

Rs 15 lakh would be spent to prepare the model of kite flying.

To add beauty to the model, the government will show the Red Fort, temple, mosque, gurdwara and narrow streets of the walled city.

Kite flying has been practised for 550 years in the country. Mirza Chapati of the Mughal dynasty was fond of it. He used to fly kite at Nao Wali, an open area across the Yamuna with his friends. After independence, Nizam Badruddin and Lath Sahib were a few known for kite flying in the walled city.

A park adjacent to the Meena Bazar, in front of the historic Jama Masjid; Parade Ground in front of the Red Fort and Shanti Van are some of the places, where people can be seen flying kites on occasions like Republic Day, Independence day and Raksha Bandhan.

Earlier, each mohalla had at least one kite shop. Now, the market of kite manufacturing and sale are at Ballimaran and Lal Kuwan in Old Delhi. Kite manufacturers in Barreilly, U.P. also supply kites to the Capital.

Many residents of the walled city survive on kite making.

NCR board projects discussed

The NCR planning board discussed the progress of the implementation of infrastructure development projects financed by the board in the National Capital Region and in five counter magnet towns of Bareilly, Hissar, Patiala, Gwalior and Kota today.

The meeting was held under the chairmanship of M Ramachandran, secretary, ministry of urban development, in the Capital. The sanctioning of finance for the new infrastructure development projects in the region was discussed.

During the current financial year, the board has sanctioned loans amounting to Rs 123.90 crore so far, for seven projects related to robs, road improvements, power transmission and distribution network.

The project sanctioning and monitoring group approved loan assistance amounting to Rs 674 crore for 27 infrastructure development projects. These involve a total outlay of Rs 1,597 crore in water supply, sanitation and sewerage, roads, housing and power in Haryana, UP and Rajasthan.

This includes loans amounting to Rs 93.42 crore for nine water supply projects in Rohtak, Rewari, Jajhar and Sonepat districts of Haryana. It also comprise loans of Rs 48.78 crore for seven sanitation and sewerage projects in Rohtak, Rewari and Jajhar, Rs 43.26 crore for 3 robs in Rohtak and Rs 194.59 crore for the improvement of 6 state roads in Haryana.

Besides, it includes loans amounting to Rs 133.80 crore for Anand Vihar residential housing scheme in Hapur-Pilkhua in U.P and Rs 160 crore for Kota Thermal Power Station, unit-7 of 195 MW in Kota, Rajasthan.

The financial assistance from the NCRPB is in addition to the grants and other funds available under various central and state schemes and private investment in the sector. — UNI

Transport minister Haroon Yusuf said that the government would not allow Blueline buses to violate traffic norms and kill innocent people.

Permit once cancelled will not be renewed. This is a lesson given to the bus owners.

He said the government was determined to phase out these buses. To replace them, the transport department has decided to purchase 6,000 DTC buses instead of 3,000. Tender notice will be issued soon to invite companies to supply buses, he said.

Govt’s apathy to Blueline victims decried

Holding the Delhi government responsible for yet another death by a Blueline bus, People’s Action has today sought to expose the government’s apathy in not providing for hospital and trauma care to such victims.

The lone survivor of the accident by Blueline bus has succumbed to injuries but his family members say the victim was not attended to on time by the hospital staff merely due to their inability to give money.

People’s Action has argued that it is the duty of the Delhi government to step up relief in situations that have been caused by the arms of its administration. “This government is not only aiding and abetting Blueline deaths, it is also avoiding to offer relief once the deed is done,” said Kaul.

Residents have argued that private hospitals that have received land at preferential rates from the government cannot refuse treatment to citizens even if they are not in a position to pay. “It is the duty of the government to enforce the rule that if Blueline victims are brought to any hospital in Delhi, the hospital will settle the medical bills directly with the government,” said Varinder Arora of URJA East Delhi

“Numerous other cases have come to our notice ever since we have formed the Blueline Victims Association. Victims’ families are unable to meet mortuary and medical expenses and in many cases absence of timely and proper medical assistance is exacerbating the pain of the victims,” added Kaul.

HIV valid ground for divorce

A city court has granted divorce to a man from his HIV positive wife saying that her ailment had prevented him from leading a happy married life.

Ruling in favour of the divorce seeker, whose wife tested positive for HIV within months of their marriage seven years ago, additional district judge Rajnish Bhatnagar said the disease being sexually communicable, the petitioner (husband) cannot be reasonably expected to live with the respondent (wife) and lead a happy married life.

The court further said sex was an integral part of marriage and the husband was deprived of it as his wife was suffering from the communicable disease.

The HIV positive status of the wife no doubt resulted in non-enjoyment of sexual intercourse between the parties and marriage without sex is anathema, the court said.

The couple from Kerala got married in October 2000 and later moved to the national Capital.

Five months after their marriage, the wife was found HIV positive in a medical test conducted during her pregnancy. The husband, however, was found HIV negative when he underwent the test. — PTI

Mukhi wants stamp duty to be lowered

In a letter written to the Lt-Governor of Delhi, Leader of Opposition in Delhi Assembly, Jagdish Mukhi demanded lowering the stamp duty by two per cent on sale and purchase of property.

He said that a few months back, the Congress-ruled Delhi government announced for reducing the stamp duty to encourage residents of the Capital to invest in the property.

But nothing has been done so far.

Mukhi said that since the announcement of circle rate in Delhi, only 25 per cent properties were being registered in sub-registrar office of the Delhi government, the rest of transactions were being registered in the neighboring states. On account of this, the Delhi government is losing revenue worth crores of rupees.

No parking around Ferozshah Kotla

There would be no general parking in and around Ferozshah Kotla cricket ground tomorrow due to a cricket match to be played between the Pakistan cricket team and the Delhi Ranji team. The Delhi police announced this today.

Labeled vehicles coming from Bahadurshah Zafar Marg would be permitted to park near the stadium. Those coming by private vehicles have to park their vehicles at Ramlila Grounds, Velodrome Road, Rajghat Parking, MCD parking, Asaf Ali Road, Kotla Marg or Mata Sundri Lane at their risk. — TNS

Three get life term for killing cop

The Noida court in Phase II has found three persons guilty of killing constable Sohan Pal Malik in April last year and sentenced them to life imprisonment.

Cop Sohan Pal had gone missing in suspicious circumstances on April 21, 2006 from Noida’s Phase-II police station where he was posted. A police search team, investigating Sohan Pal’s disappearance, raided the house of timber merchant, Manphul in P Sector of Greater Noida under Kasna police station.

While interrogating Manphul, the police came to know that Sohan Pal had been murdered and his body was recovered from a gutter in Chi Phi sector. The police had arrested Manphul, his wife Sushila and brother Sushil.
