FCI directed not to allow overloading of trucks
Maneesh Chhibber
Our High Court Correspondent

Chandigarh, August 27
In what could effectively put an end to overloading of trucks used by government agencies, including the Food Corporation of India, the Punjab and Haryana High Court has directed the FCI to ensure that officers don’t allow overloading in trucks used by it to transport foodgrains.

Passing this order in a petition filed by a Sangrur-based transporter, Mr Jagtar Singh, the Division Bench of Mr Justice Viney Mittal and Mr Justice H.S. Bhalla also ordered that if any of the transport contractors working for the FCI indulged in overloading, then the FCI should initiate proceedings against such contractor for termination of contract.

Despite strict orders of the Supreme Court, including one which set aside the notification issued by the Union Government by which truckers indulging in overloading could go scot free by paying a heavy fine, overloading by truckers continues unabated.

There have been many cases of heavily overloaded trucks resulting in serious mishaps.

But, despite claiming to make efforts to check overloading, government agencies have not been able to completely check the menace.

It is a well-known fact that even government agencies such as the FCI facilitates overloading as it means lower freight charges, while the truckers do it as they are generally paid according to the load they transport.

The petitioner had earlier also moved court, challenging the action of the FCI in denying livelihood to him by employing lesser number of vehicles by resorting to overloading.

The petitioner had stated that apart from violating orders of the apex court in this regard, the FCI was also causing loss of revenue worth crores to the exchequer. He had pointed out that in some cases, FCI allowed trucks to carry as much as 13 tonnes foodgrains, whereas, as per rules, a truck can’t carry more than nine tonnes.

During hearing of the petition, counsel for the petitioner told the court that the loss of state exchequer due to overloading allowed by the FCI at its Khanauri (Sangrur) godown since January this year would be about Rs 2 crore.

He also stated that overloading was being allowed despite the letter dated March 2 sent by the FCI to all its zonal offices to put an end to this practice.

When the petitioner’s pleas to the FCI authorities did not yield any result, he filed a writ along with another person, which was disposed of with a direction to the FCI to take appropriate action.

However, the respondent held that the petitioner did not have any grievance against the FCI, following which the petitioner filed another writ.

During hearing of this writ, counsel for the FCI told the court that it was not possible for the FCI to enforce various provisions of the Motor Vehicles Act as the same was in the domain of the state government.

However, the Bench in its order said that without going into the enforcement of various provisions of the Motor Vehicles Act, it was satisfied with the argument of the petitioner’s counsel that the FCI has to at least take such steps as are within its control and ensure that transport vehicles used by it are not overloaded in its godowns or at loading centers.
