HC puts rent, matrimonial cases on fast-track
Maneesh Chhibber
Our High Court Correspondent

Chandigarh, June 29
The Punjab and Haryana High Court is going to put on fast-track all pending service matters involving senior citizens, cases pertaining to matrimonial disputes, accident claim cases, rent matters and revision petitions, particularly those where proceedings before a lower court stand stayed on the orders of the High Court.

The decision could ensure swifter justice for thousands of litigants, whose cases have been pending in the Punjab and Haryana High Court for the past many years.

Also, over 250 cases which have been pending since pre-1980 will also be taken up for hearing by specially-constituted Benches on July 5. Sources say the decision to speed up disposal of all categories of old cases was taken recently by the High Court.

It is learnt that some of the cases that will come for hearing on July 5 have been pending since late 1960s and early 70s. The plan to speed up matrimonial disputes and accident claims would finally end the miseries of the parties concerned.

Counsel for litigants in rent matters, particularly cases where the property owner have pleaded personal necessity as the reason for seeking eviction of the tenants, are also being asked to furnish details of such rent revision matters so that they can be dealt with on priority.

“This is a very positive step. Not only will it provide speedier justice, the pendency of old cases will also be tackled. Litigants, particularly those whose cases have been pending for the past many years, will finally expect to get justice,” observed Punjab and Haryana High Court lawyer Raman Walia.

According to sources, all writs pertaining to service matters where the petitioner is beyond the age of 65 years will be heard by Mr Justice P.S. Patwalia on a regular basis, while all revision petitions, where proceedings before the lower courts stand stayed, have been ordered to be listed regularly before the Bench of Mr Justice Venod Sharma.

A leading lawyer, Mr Gurminder Singh, also commended the step, saying it would go a long way in mitigating the sufferings of the litigants. “In many cases, even the clients are no longer interested in pursuing the matter. These cases were only adding to the pendency. What the High Court is doing will also go a long way in providing justice to the old litigants and estranged couples, who will finally get a fresh opportunity to start life afresh,” said Mr Gurminder Singh.
