Forum quashes power theft charge against senior citizen
Our Correspondent

Ludhiana, March 13
The Consumer Forum has quashed the theft charge levelled by the Punjab State Electricity Board (PSEB) against a consumer, with the observation that the meter checked in ME Lab was not the same that was removed from the house of the consumer.

The orders were passed by Mr A.S. Narula, President, and Mr Daljit Singh Bakshi, Member of the forum, while deciding on the complaint filed by a senior citizen, Mr Mehar Singh of Maharaj Nagar, Civil Lines, Ludhiana.

The PSEB had raised an demand of Rs 15,717 on theft charge. The forum directed it to refund the amount deposited, if any, against that demand along with 9 per cent per annum interest from the date of deposit till refund.

It was submitted by the consumer that his meter had stopped working. He lodged a complaint with the department and the meter was replaced in June, 2004. In the status report prepared by the JE at the time of replacing the meter, it was no where mentioned that the glass of the meter was tampered with.

Surprisingly, in March, 2005, he received a demand notice of Rs 15, 717 with the claim that the glass of the removed meter was tampered with. He contacted officials of the department, but no satisfactory reply was given to him causing undue harassment to him, added the consumer.

On the other hand, it was pleaded by the opposite party that the removed meter was sent to the M.E. Lab in January, 2005. It was tested in his presence by the Senior Executive Engineer, M.E. Lab, and the Senior Executive Engineer, Enforcement. On the basis of lab report, the demand was raised.

But, after appreciating the evidence of both parties, the Consumer Forum observed that the perusal of MCO showed that the meter number of the consumer which was removed, had been mentioned as 1101184 and its reading at that time was 39,909. However, as per the store challan and M.E. Lab report, the meter number was 1107784 and its reading was mentioned as 40,010.

In this way, the PSEB failed to prove that the meter that was removed from the premises of the consumer was ever sent to the M.E. Lab or the same meter was tested there, the forum said.
