It may be mentioned that the case pertains to booth No. 15 in Sector 25 and the applicant is the co-owner with one-fourth share. Mr Pannu had moved an application for the NOC as he wanted to gift his share to his sister, Amarjit Kaur. However, instead of issuing an NOC, the Estate Office issued a letter to the applicant, asking him to end the misuse of the site.It was claimed by the applicant that earlier no objection was made or proceedings initiated against in this regard. The applicant claimed that the site was not misused and he had sent a reply in this regard to the Estate Office. However, in reply, the Estate Office contended that the site was misused for the sale of tyres whereas it had been allotted for carrying on general/semi-industrial activity. It said the sale of tyres falls in the category of automobile spare-parts and this had been put in the new special trade category. There was no provision under the rules for refusing or deferring the NOC of the sites allegedly under misuse. |
